1. Voted : That the Town appropriate from the income of the Electric Light Department $277.50 for salaries of the Electric Light Commissioners.

Voted: That there be included in the tax levy for elec- tricity used for street lighting the sum of $12,000.00 as appropri- ated under Article 13 of the Warrant for the 1936 Annual Town Meeting, and that the said sum together with the income from sales of electricity to private consumers or for current supplied to muni- cipal buildings or for municipal power, and from sales of appliances and jobbing during the current fiscal year, be appropriated for the

use of the municipal light plant, the whole to be expended under the direction and control of the municipal light board for repairs, re- newals, new construction and operating expenses of the plant for the present fiscal year, as defined in Section 57 of Chapter 164 of the General Laws, and that, if said income shall exceed the expenses for the fiscal year, such excess shall be transferred to the construc- tion fund of said plant and appropriated and used for such additions to the plant as may thereafter be authorized by the municipal light board. Mr. Southworth moved: That the Report of the Committee on the Limited or Representative form of Town Meeting be and hereby is accepted and that the thanks of the Town be extended to this Committee for its able and effective work; ad that this Committee be continued for another year as advisors to the town officials in putting into effect the great change required by the adoption of this form of government in the referendum at the annual town election on March 2, 1936. Carried 10:37.

Voted: That the Board of Selectmen be authorized to sign an agreement with the State Department of Public Works, said agree- ment to cover the payment by the Town of any and all land, grade and drainage damages which may be caused by or result from the laying out and construction by the State Department of Public Works of a bridge and approaches to abolish the grade crossing of Union Street with the New York, New Haven and Hartford Railroad. Carried - 10:56.


Mr. Storm moved: That we take up Articles 58 and 59. Unani- mous vote.


ARTICLE 58.


Voted : That there be raised and appropriated the sum of $10,000.00 for land, grade and drainage damages which may be caused by or result from the laying out and construction of a bridge and approaches to abolish the grade crossing of Union Street with the New York, New Haven and Hartford Railroad. Caried - 10:58.


ARTICLE 59.


Voted: That the Town through the Board of Selectmen request the Department of Public Works of the Commonwealth of Massa- chusetts to submit to the Secretary of Agriculture a project for the abolition of the grade crossing of Union Street with the New York, New Haven and Hartford Railroad for construction with funds ap- portioned to the Commonwealth under the Emergency Relief Appro- priation Act of 1935; and that the Town agree with the Department of Public Works that if such a project is approved and constructed by the Department and the Secretary of Agriculture, the Town, at its own cost and expense, will maintain the project in a manner satis-

factory to them and their authorized representative, and will make ample provision each year for such maintenance, and hereby autho- rize the Board of Selectmen to sign such an agreement in behalf of the Town, this agreement to cover no part of the expense of main- taining the way or structures of the New York, New Haven and Hartford Railway as may be constructed by this project. Carried 11 P. M.

Mr. Storm moved: That the Board of Water Commissioners is hereby instructed and authorized to prohibit swimming and bathing from the property of the Water Department at Sunset Lake.

Mr. Storm moved: That police protection at the Water Depart- ment property at Sunset Lake be under the authority and discretion of the Board of Water Commissioners and that any sum necessary to provide said protection shall be raised from the income of the Water Department. Carried.

Voted: That the Town Treasurer, with the approval of the Se- lectmen, be authorized to receive for the Town, gifts in the form of contributions or agreed contributions. Carried 11:42.

A Special Town Meeting was called to order at 8 P. M. by Mod- erator William F. Rogers. There was a quorum of voters present. ARTICLE 1.


Voted : That the Town accept as a Town Way, that portion of WESTON AVENUE, so-called, as laid out by the Selectmen, which may be constructed under a WPA or other Federal or State Aid projet. Carried 8:11.


Mr. John J. Foley offered the following resolution: RESOLVED: That the 296th Annual Town Meeting notes the absence of James W. Colbert who for almost a half century has been an active and interested citizen in all things that go for the betterment of the Town and its welfare. Illness makes it impossible for him to be present and the Town Meetnig assembled wish to extend to him its. good wishes for a speedy recovery. Unanimous vote.

Mr. John J. Foley offered the following resolution: RESOLVED: At this the last old-fashioned Town Meeting for the Town of Brain- tree we extend to the Moderator, William F. Rogers, our thanks for the fairness and dispatch he has conducted the duties of presiding officer. He has allowed liberal debate on all questions to both sides of all matters and it is the sense of this meeting that he has been fair and this Meeting records this .- The Moderator surrendered the gavel to the Town Clerk, Ernest C.
