Mr. Howard P. Barnes moved to amend Item 42 by striking out the words "and wire inspector" and to sub- stitute $2,940.00 in place of $3,527.00 and the motion was carried.

Article 7. To take such action as the Town shall see fit in aid of the Plymouth Public Library. -


The Committee recommends an appropriation of $19,830.00, including the Dog Tax of $1,743.15, of which appropriation $14,536.00 shall be for Salaries and $5,294.00 for Other Expenses.


Voted: That the Town raise and appropriate the sum of $19,830 including the dog tax of $1,743.15, in aid of the Plymouth Public Library, of which $14,536 shall be for Salaries, retroactive to January 1, 1953, and $5,294 for other expenses.


Article 8. To see if the Town will appropriate the sum of Fifty-one Hundred Dollars ($5,100) to be expended by the Plymouth Public Library for the Loring Library.


The Committee recommends an appropriation of $5,100.00.


Voted: That the Town raise and appropriate the sum of $5,100 to be expended by the Plymouth Public Library for the Loring Library.


Article 9. To see if the Town will appropriate a sum not exceeding Fourteen Hundred and Seventy-five Dollars ($1,475) in aid of the Manomet Public Library.


The Committee recommends an appropriation of $1,475.00

Article 10. To see what amount the Town will vote to raise and appropriate for the Reserve Account in the hands of the Advisory and Finance Committee.

Article 11. To see what amount the Town will vote to raise and appropriate for the use of the Plymouth County Trustees for County Aid to Agriculture and to choose a Town Director, as provided in Sections 41 and 45, Revised Chapter 128 of the General Laws, and act thereon.


The Committee recommends an appropriation of $150.00.

Article 12. To see if the Town will raise and appro. priate the sum of Forty-two Hundred Dollars ($4,200) towards the employment of one or more district nurses; said appropriation to be expended under the direction of the Board of Selectmen.


The Committee recommends an appropriation of $4,200.00


Voted: That the Town raise and appropriate the sum of $4,200. towards the employment of one or more District Nurses, said appropriation to be expended under the direction of the Board of Selectmen.


Article 13. To see if the Town will vote to raise and appropriate a sum not exceeding Seven Thousand Dollars ($7,000) for advertising the advantages of the Town and for providing amusements or entertainments of a public char- acter; said appropriation to be expended under the direction of the Board of Selectmen.


The Committee recommends an appropriation of $6,000.00, of which $1,000 shall be for Christmas lighting.


Voted: That the Town raise and appropriate the sum of $6,000 for advertising the advantages of the Town, including necessary expenses incurred outside the Commonwealth, $1,000 of which shall be for Christmas lighting, said appro- priation to be expended under the direction of the Board of Selectmen.


Article 14. To see if the Town will vote to set the rate per mile to be paid for the use of privately owned cars when being used for Town business.


The Committee recommends a rate of 8ยข per mile.


Voted: That the rate to be paid for the use of privately owned cars, when being used for Town business, shall be set at eight cents per mile.

Article 15. To see if the Town will appropriate a sum not exceeding Fifteen Hundred Dollars ($1,500) as provided in Chapter 40, Section 5, Clause 37 of the General Laws; said appropriation to be spent under the direction of the Board of Selectmen. (Conventions and entertainment of distinguished guests.)


The Committee recommends an appropriation of $170 for the entertainment of distinguished guests only.


Voted: That the Town raise and appropriate the sum of $170 for the entertainment of distinguished guests, said appropriation to be expended under the direction of the Board of Selectmen.


Article 16. To see if the Town will vote to appropriate a sum of money for the improvement of Rocky Hill Road ($16,000) and Standish Avenue ($28,000), Chapter 90 Con- struction; said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose.


The Committee recommends an appropriation of $11,000.00, of which $8,000.00 shall be for Rocky Hill Road and $3,000.00 for Standish Avenue.


Voted: That the Town raise and appropriate the sum of $11,000 under the provisions of Chapter 90 of the General Laws, of which $8,000 shall be for the improvement of Rocky Hill Road and $3,000 for the improvement of Standish Avenue, contributions from the State and County to be returned to the Excess and Deficiency Account.


Article 17. To see if the Town will appropriate the sum of Two Thousand Dollars ($2,000) from the proceeds from the sale of cemetery lots and graves; to be expended by the Cemetery Commissioners for the improvement and embel- lishment of the Oak Grove and Vine Hills Cemeteries.


The Committee recommends an appropriation of $2,000.00 from the Proceeds from the Sale of Cemetery Lots and Graves.


Voted: That the Town transfer from the Proceeds from the Sale of Cemetery Lots and Graves, the sum of $2,000 to be expended by the Cemetery Commissioners for the improvement and embellishment of the Oak Grove and Vine Hills Cemeteries.

Article 18. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachu- setts, for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach out- side of Boston Harbor, including the Merrimack and Con- necticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and to authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.


The Committee recommends favorable action.


Voted: That the Town assume liability in the manner pro- vided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts, for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach outside of Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and to authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.


Article 19. To see if the Town will vote to transfer One Hundred and Seventy-five Thousand Dollars ($175,000) from available funds to reduce the tax levy of the current .year.

Voted: That the Town transfer the sum of $175,000 from available funds to reduce the tax levy of the current year, as recommended by the Advisory and Finance Committee.


Article 20. To see if the Town will vote to transfer from available funds the sum of Twenty-five Thousand Dol- lars ($25,000) for the Stabilization Fund as authorized by the provisions of Chapter 124 of the Acts of 1945.


The Committee recommends the transfer of $25,000.00 to the Stabilization Fund.

Article 21. To see if the Town will vote to raise and appropriate the sum of Six Thousand Dollars ($6,000) for the purchase of a front end loader (3/4 yard bucket) for the Highway Department.


The Committee recommends an appropriation of $6,000.00.

Article 22. To see if the Town will vote to raise and appropriate the sum of Thirty-five Hundred Dollars ($3,500) for the purchase of a dump truck with a 2 yard body for the Highway Department, and to dispose of 1940 Ford now in use.


The Committee recommends an appropriation of $3,500.00.

Article 23. To see if the Town will vote to raise and appropriate the sum of Fifteen Hundred Dollars ($1.500) for the purchase of a pick-up truck (3/4 ton) for the Highway Department and to dispose of 1946 Studebaker now in use.


The Committee recommends an appropriation of $1,500.00.

Article 24. To see what action the Town will take with reference to accepting the bequest of $800 and the devise of a certain parcel of land off Newfield Street in Plymouth, Massachusetts, as provided under Paragraph Four of the will of Philip Jackson, late of said Plymouth.


The Committee wishes to express, for the Town, appreciation of the spirit which prompted this offer, but recommends that the Town do not accept.

Mr. Lawrence Bongiovanni moved that the Town take no action under Article 24.


Mr. Henry Barnes moved to amend that the Town accept the bequest of $800 and the devise of a certain parcel of land off Newfield Street in Plymouth, Mass. as provided under Paragraph Four of the Will of Philip Jackson, late of Plymouth.


The original motion as amended by Mr. Barnes was then put before the meeting and carried.


Article 25. To see if the Town will raise and appro- priate the sum of Thirty-five Hundred Dollars ($3,500) for the purchase of a back drop for the stage in the Large Hall in the Memorial Building; said appropriation to be expended under the direction of the Selectmen.


The Committee recommends no action.


Voted: That the Town take no action under Article 25.


Article 26. To see if the Town will vote to accept Chap- ter 624, Acts of 1952, an Act relative to increasing amounts of pensions and retirement allowances payable to certain former public employees, and make an appropriation there- for.


The Committee recommends acceptance of Chapter 624 of the Acts of 1952 and an appropriation of $356.40 for increased pensions, to be allocated as follows: Pensions for Town Laborers $206.40

Voted: That the Town accept Chapter 624, of the Acts of 1952, an act relative to increasing amounts of pensions and retirement allowances payable to certain former em- ployees, and that the Town further raise and appropriate the sum of $356.40 to carry out the provisions of this act, to be allocated as follows:

Article 27. To see if the Town will vote to amend the Town of Plymouth, Massachusetts, Zoning Map, dated Febru- ary 1, 1951, changing from a Residence District to a Commer- cial District, an area extending from the Plymouth By-Pass

westerly along Samoset Street, for a distance of approxi- mately 2500 feet from the center line of the Plymouth By- Pass, to a depth of 1,000 feet, more or less, on each side of Samoset Street.


The Committee recommends favorable action, as recom- mended by the Planning Board.


Voted (Unanimously) That the Town amend the Town of Plymouth, Massachusetts Zoning Map, Dated February 1, 1951, changing from a Residence District to a Commercial District, an area extending from the Plymouth By-Pass westerly along Samoset Street, for a distance of 2500 feet from the center line of the Plymouth By-Pass, to a depth of 1000 feet on each side of Samoset Street.


Article 28. To see if the Town will authorize the Board of Selectmen to sell to William LaRocque for the sum of $1.00, a parcel of land consisting of approximately Three Thousand, Nine Hundred and Sixty (3,960) square feet, more or less, extending from the Plymouth By-Pass westerly along Samoset Street shown on the Assessors' Plan as Lot 54D (service road) .


The Committee recommends no action at this time.


Voted: That the Town take no action under Article 28.


Article 29. To see if the Town will vote to accept thir- teen (13) cemetery perpetual care funds amounting to $3,600 received and deposited in the Plymouth Federal Savings and Loan Association in the year 1952, in accordance with the usual votes of the Cemetery Commissioners and Selectmen and listed as New Funds in the Town report.


The Committee recommends favorable action.


Voted: That the Town accept thirteen Cemetery Perpetual Care Funds amounting to $3,600 received and deposited in the Plymouth Federal Savings and Loan Asso- ciation in the year 1952, in accordance with the usual votes of the Cemetery Commissioners and Selectmen, and listed as new Funds in the Town Report.


Article 30. To see if the Town will vote to rescind Section 20 of the Town by-laws, reading as follows: "The number of voters necessary to constitute a quorum at Town meetings shall be four hundred; provided that a number less than a quorum may from time to time adjourn the same.

This by-law shall not apply to such parts of meetings as are devoted exclusively to the election of officers."


The Committee recommends favorable action.


Voted: That the Town take no action under Article 30.


Article 31. To see if the Town will authorize the Board of Selectmen to construct a fish way at Hayden's and Rus- sell's Mill Pond for the passage of alewives from Eel River to Russell's Mill Pond and to acquire by purchase or eminent domain any land necessary for said project and make an appropriation therefor.


The Committee recommends an appropriation of $2,500.00 for the construction and understands that no purchase of land is required.


Voted: That the Town authorize the Selectmen to construct a fishway at Hayden's and Russell's Mill Pond for the passage of alewives from Eel River to Russell's Mill Pond and to raise and appropriate the sum of $2,500 therefor.


Article 32. To see if the Town will vote to raise and appropriate the sum of Eight Thousand Dollars ($8,000) to grade, eliminate curves and resurface Point Road, Manomet.


The Committee recommends an appropriation of $8,000.00.

To see if the Town will accept and allow as a Town way, Holmes Terrace, northeasterly and northwest- erly from Court Street about 1,500 feet to Atlantic Street as laid out by the Selectmen and reported to the Town, and make an appropriation for land and property damages and expenses of acquiring titles.


The Committee recommends the acceptance of this street with an appropriation of $100.00 for expenses of acquiring titles. Planning Board has approved this layout.

Article 34. To see if the Town will accept and allow as a Town way, Bourne Street, southwesterly from Court Street about 1,100 feet as laid out by the Selectmen and re- ported to the Town, and make an appropriation for land and property damages and expenses of acquiring titles.


The Committee recommends the acceptance of this street with an appropriation of $100.00 for expenses of acquiring titles. Planning Board has approved this layout.


Voted: (Unanimously) That the Town accept and allow as a Town Way, Bourne Street, southwesterly from Court Street about 1,100 feet, as laid out by the Selectmen and reported to the Town, and to raise and appropriate the sum of $100 for land and property damages, and expenses of acquiring titles.


Article 35. To see if the Town will accept and allow as a Town way, Maple Place, southeasterly and southwesterly from Bay View Avenue about 300 feet as laid out by the Selectmen and reported to the Town, and make an appropria- tion for land and property damages and expenses for acquir- ing titles.


The Committee recommends the acceptance of this street with an appropriation of $100.00 for expenses of acquiring titles. Planning Board has approved this layout.

Article 36. To see if the Town will accept and allow as Town ways a portion of Lot 53C of the Everson Tract (east) as shown on Plat 48 of the Assessors' Map and Cape Cod Avenue, Melix Avenue, Reed Avenue, White Street, First Street and Second Street as laid out by the Selectmen and reported to the Town and appropriate a sum of money for land and property damages and expenses for acquiring titles.


The Committee recommends the acceptance of these streets with an appropriation of $500.00 for expenses of acquiring titles. Planning Board has approved this layout.

Article 37. To see if the Town will authorize the Water Commissioners to purchase a new dump truck and to dispose of the Ford dump truck now in service and make an appro- priation therefor.

Article 38. To see if the Town will authorize the Water Commissioners to construct a stabilized, gravel packed well on land belonging to the Town near Lout Pond, including observation wells, screens, pumping tests of the capacity of the well, other necessary appurtenances and engineering services and to appropriate therefor the sum of $17,500.00.


The Committee recommends an appropriation of $17,500.00.


Voted: That the Town authorize the Water Commiss- ioners to construct a stabilized, gravel packed well on land belonging to the Town near Lout Pond, including observa- tion wells, screens, pumping tests of the capacity of the well, other necessary appurtenances, and engineering services and to raise and appropriate therefor the sum of $17,500.


Article 39. To see if the Town will authorize the Water Commissioners to purchase or acquire by eminent domain for water purposes a certain parcel of land on the south- easterly side of so-called Braunecker Road, westerly of the Westerly Route now owned by Reginald Marois and Mary E. Marois and described as follows: Beginning at a point on Braunecker Road at a corner of land now or formerly of Amedio Malaguti, said point is approximate 520 feet south- westerly from the Westerly Route, thence running easterly by Braunecker Road 200 feet, more or less, to remaining land of Marois; thence southeasterly by Marois land 150 feet, more or less, to a point in line of land of Marois; thence
