b. All walls and partitions going through floors shall be fire-stopped with masonry or with wood not less than 2" thick nominal dimension.


Section 22. Garages:


a. Private garages within a cellar, basement or body of a dwelling may be of wood frame; ceilings and walls must be covered with expanded metal lath and cement plaster or perforated gypsum lath and cement plaster. Any door leading from garage to cellar, basement or any part of dwelling, must be an approved fire door or covered on garage side with an approved non-combustible material and have a self-closing device. These rules shall apply to garages that are connected with breezeways which are less than 6' to dwelling.


b. The State Law for garages.


Section 23. Heating, Cooking, Etc .:


a. All apparatus for heating and cooking shall be so installed as not to create a fire hazard. Smoke pipes shall enter the side of chimneys through a suitable metal thimble.


b. Combustible materials adjacent to heaters and smoke pipes shall be covered with wire lath and plaster or other approved fire-resisting materials to such an extent as the Inspector may require.


c. No range, stove, oven, broiler, deep fat fryer, or boiler shall be used for cooking in a hotel or restaurant or for manu- facturing purposes until the same has been examined and approved by the Inspector.


d. Depositories for ashes in the interior of any building shall be built of non-combustible material.


Section 24. Electric Wiring:


a. All electric installations shall be in accordance with the National Electric Code and amendments thereto, and no

installation of electrical equipment shall be made except in conformity thereto.


Section 25. Glass Dead Eyes:


a. The first floor of every mercantile establishment and store shall be equipped with glass dead eyes in the locations and of the type determined by the Inspector and shall be installed in a manner satisfactory to him.


Section 26. Snow Guards:


a. Every building upon the line or within five feet of the line of any street, having a pitched roof sloping to the street, shall be provided with suitable snow barriers or guards upon said roof to prevent the snow sliding therefrom, the same to be constructed and applied to the satisfaction of the Inspector.


Section 27. Roofing Protection:


a. All roofs of new, reconstructed or repaired buildings within the fire limits shall be covered with a non-combustible or fire-resisting material satisfactory to the Inspector. All sky-lights within this limit to be glazed with wired glass.


b. FIRE LIMITS: The building or fire limits within the Town shall be: "Starting from a point on the shore 300 feet northerly from the northerly line of Lothrop Street continued to the shore; thence running in a westerly direction parallel to Lothrop and Allerton Streets to a point 300 feet west of the northerly line of Allerton Street; thence running in a southerly direction parallel to Allerton, Russell and High Streets and Willard Place to the Brook; thence following the Brook in an easterly direction to the shore; thence following the shore in a northerly direction to the point of beginning.


Starting from a point on the shore 300 feet south of the southerly line of Holmes Terrace, continued to the shore; thence running westerly parallel to Holmes Terrace to Court Street; thence crossing Court diagonally to a point 300 feet south of the southerly line of Centennial Street; thence run- ning westerly parallel to Centennial Street to the railroad, thence by the railroad westerly to a point 1000 feet west of the westerly line of Standish Ave .; thence parallel to said Stand- ish Avenue and Spooner Street, northerly to the Kingston line; thence easterly along the Kingston line to the shore and southerly along the shore to the point of beginning.

Section 28. Plumbing Code:


a. In all public establishments the floor of every water closet compartment or toilet hereafter installed, and the side walls to a height of nine inches, shall be constructed of material impervious to moisture, and which has a smooth surface. Where urinals are installed, the floors in front for a distance of at least twenty-four inches shall slope to the drain.


Section 29. Penalty:


a. Anyone violating any provisions of these by-laws shall be subject to a penalty not exceeding $100.00 for each separate offense.


Section 30. Validity:


a. The invalidity of any section or provision of these By-Laws shall not invalidate any other section or provision thereof.

SPECIAL TOWN MEETING September 17, 1953


Including Recommendations by the Advisory and Finance Committee.


The meeting was called to order by the Moderator at 8 p.m. 171 Town Meeting Members were present.


Article 1. To see if the Town will vote to accept the provisions of Chapter 434 of the Acts of 1953 which is 'an Act relative to rent control,' and whether the Town will declare that a substantial shortage of rental housing ac- commodations exists in the Town of Plymouth and that the control of rents in the Town is necessary in the public interest.


Recommend no action. No indication of a substantial shortage of rental housing accommodations in the Town of Plymouth.


Voted: That the Town take no action under Article 1.


Article 2. To see if the Town will vote to raise and appropriate, or transfer from available funds, a sum of money to defray the expenses of the Rent Board.


Recommend no action.


Voted: That the Town take no action under Article 2.


Article 3. To see if the Town will vote to abandon a portion of Samoset Street, being a service road on the southeasterly side of Samoset Street, as laid out in behalf of the Town of Plymouth by the Massachusetts Depart-

ment of Public Works on April 13, 1948, and as laid out by the Selectmen and reported to the Town.


Recommend favorable action. Planning Board has ap- proved.


Voted: That the Town abandon a portion of Samoset Street, being a service road on the southeasterly side of Samoset Street, as laid out by the Selectmen and reported to the Town.


Article 4. To see if the Town will authorize the Board of Selectmen to sell to William R. LaRocque, a parcel of land consisting of approximately Three Thousand Nine Hundred and Sixty (3,960) square feet, more or less, ex- tending from the Plymouth by-pass westerly along Samoset Street, shown on the Assessors' Plan as Lot 54D (Service Road) .


Recommend the sale to William LaRocque for a price of $400. Planning Board approves of the sale.


Voted: That the Town authorize the Board of Select- men to convey to William R. LaRocque for an amount not less than $400 a parcel of land on the southeasterly side of Samoset Street, containing 3,960 square feet and bounded and described as follows: Beginning at a Mass. Highway Bound in the southeasterly line of Samoset Street; thence S 64° 18' 45" E 77.20 feet to a stone bound; thence S 2º 38' 58" E 45.45 feet to a stone bound; thence N 64° 18' 45" W 120.76 feet to a stone bound; thence N 54° 29' 10" E by the southeasterly line of Samoset Street 45.65 feet to the point of beginning.


Article 5. To see if the Town will vote to raise and appropriate or transfer from available funds, the sum of Two Thousand Dollars ($2,000) for Veterans' benefits for the balance of 1953, and One Hundred and Fifty Dollars ($150) for Veterans' Services, Other Expenses.

Recommend $150 from E. & D. for Veterans' Services, Other Expenses.


Voted: That the Town transfer from available funds the sum of $150 for Veterans' Services, Other Expenses.


Article 6. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Twenty-six Thousand Dollars ($26,000) to be used for grants in aid for Old Age Assistance for the balance of the 1953 year.


Recommend $26,000 from E. & D.


Voted: That the Town transfer from available funds the sum of $26,000 for Old Age Assistance, Aid.


Article 7. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Five Thousand Dollars ($5,000) for improvements and re- pairs at the Town Infirmary.


Recommend no action at this time, since there is a possibility that the special committee appointed to study the Infirmary may recommend discontinuance of the insti- tution at the next annual town meeting.


Voted: That the Town take no action under Article 7.


Article 8. To see what action the Town will take with reference to rescinding the vote passed at the Annual Town Meeting in March of 1953 on Articles 59 to 64, in- clusive, of the annual warrant, which said articles related to waterfront protection at Harlow's Landing near Black Pond; at High Cliff; at Long Beach, so-called; at East White Horse Beach, south of Bartlett Brook; at Manomet Bluffs and for the construction of stone jetties in Warren Cove, it having been voted by the Town at said meeting to refer said articles to the Planning Board for study.


Recommend no action.

To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Four Thousand Dollars ($4,000) to be spent in conjunction with sums to be provided by the State or County or both and any or all abutters for the construction of water- front protection at Harlow's Landing near Black Pond in Ellisville the Town to assume liability as provided by Section 29, Chapter 91 of the General Laws as amended for all damages incurred hereunder.

Article 10. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Fifteen Hundred Dollars ($1500) to be spent in conjunc- tion with sums to be provided by the State or County, or both, and any or all abutters for the construction of water- front protection at High Cliff; the Town to assume liabil- ity as provided by Section 29, Chapter 91 of the General Laws as amended for all damages incurred hereunder.

Article 11. To see if the Town will vote to raise and appropriate or transfer from available funds, the sum of Twenty-five Hundred Dollars ($2500) to be spent in con- junction with sums to be provided by the State or County, or both, for the construction of waterfront protection at East White Horse Beach, south of Bartlett Brook, so- called; the Town to assume liability as provided by Section 29, Chapter 91 of the General Laws as amended for all damages incurred hereunder.

Article 13. To see what amount the Town will vote to raise and appropriate or transfer from available funds to be spent in conjunction with sums to be provided by the State or County or both to build waterfront protection at Manomet Bluffs from a point just north of Strand Ave- nue, Manomet, southward for approximately one-quarter of a mile; the Town to assume liability as provided by Section 29, Chapter 91 of the General Laws as amended, for all damages incurred hereunder.

Article 14. To see if the Town will vote to raise and appropriate or transfer from available funds, the sum of Seven Thousand Dollars ($7,000) to be spent in conjunc- tion with sums to be provided by the State or County or both for the construction of stone jetties in Warren Cove for the protection of shore property; the Town to assume liability as provided by Section 29, Chapter 91 of the General Laws, as amended, for all damages incurred hereunder.

Article 15. To see if the Town will authorize the Water Commissioners to lay a water main of not less than six inches in diameter for a distance of about One Thou- sand (1,000) feet in a sub-division of land between Warren Avenue and Sandwich Road, owned by Lena F. Giovan- netti as shown on a plan approved by the Planning Board as of date, July 23, 1953, including gates, valves, fire hy- drants, services and other appurtenances as necessary and to make an appropriation therefor; such authorization and appropriation to be contingent upon the payment to the Town by the owner of said development of the sum of three dollars ($3.00) per linear foot of main in accordance with the Rules and Regulations of the Water Department as adopted December 12, 1950.


Recommend an appropriation of $6,000, of which $3,000 shall be a transfer from E. & D., provided $3,000 has been received, prior to town meeting by the town treasurer from the owner of the development, representing $3 per linear foot of main to be laid in said development, to meet a portion of this appropriation.


Voted: That the Town authorize the Water Com- missioners to lay a water main of not less than six inches in diameter for a distance of about 1,000 feet in a sub- division of land between Warren Avenue and Sandwich Road, owned by Lena F. Giovannetti as shown on a plan approved by the Planning Board as of date, July 23, 1953, including gates, valves, fire hydrants, services and other appurtenances as necessary and to raise and appropriate the sum of $6,000 therefor, and that to meet said appro- priation the sum of $3,000 be transferred from available funds and $3,000 from money in the Town Treasury re- ceived from the owner of the development, representing $3 per linear foot of main to be laid in said development.


Article 16. To see if the Town will raise and appro-

priate or transfer from available funds a sum of money for the purpose of acquiring by purchase the Standish Mills property on Billington Street consisting of land and build- ings and any water rights or other rights appurtenant thereto.


Recommend no action at this time. The Planning Board approves the purchase of this property at a reason- able figure, but the Committee was unwilling to accept the owner's proposal without further investigation.


Mr. Harvey Moore moved that the Town take no action under Article 16.


Mr. James Frazier moved to amend by substituting the following: That the Town raise and appropriate $3500 for the purpose of acquiring by purchase the Standish Mills property on Billington Street, consisting of land and buildings and any water rights or other rights appurte- nant thereto.


Mr. Howard P. Barnes moved to amend the motion of Mr. Frazier by substituting the following motion, that this matter be referred to the Planning Board for report and recommendations at the 1954 Annual Town Meeting.


The original motion as amended by Mr. Barnes was then put before the meeting and carried.


Article 17. To see if the Town will raise and appro- priate or transfer from available funds the sum of Four- teen Thousand, Six Hundred and Thirty-four Dollars and fifty-five cents ($14,634.55) for the purchase of an Ad- dressograph Tax Computing Machine for the Assessors' office.


Recommend no action.


Voted: That the Town take no action under Article 17.

Article 18. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of One Thousand Dollars ($1,000) for the installation of sidewalk and curbing on the north side of Memorial Drive from Court Street to rear door of Memorial Building.


Recommend no action.


Voted: That the Town take no action under Article 18.


Article 19. To see if the Town will vote to raise and appropriate or transfer from Parking Meter Receipts, the sum of Seventy-three Hundred Dollars ($7300) for the purpose of hard-surfacing the parking lot in the rear of the Memorial Building.


Recommend no action, pending a report of the Off- Street Parking Committee at the next annual town meet- ing on the use of the parking meter funds.


Voted: That the Town take no action under Article 19.


Article 20. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of One Thousand, Nine Hundred and Seventy-five Dollars ($1,975) for emergency repairs to the fire alarm system.

Voted: That the Town transfer from available funds the sum of $1,975 for emergency repairs to the fire alarm system.


Article 21. To see if the Town will vote to raise and appropriate or transfer from available funds, the sum of Nine Hundred Dollars ($900) for the purchase of one auto- mobile for the Police Department, and to dispose of one now in service.
