Letter received and read by the Moderator from Mr. Joh n A O'Keefe, asking permission to address the meeting in relating to Fire Department, and all other matters relating to fire hazards. He was given an unanimous consent.


ART. 52. To see if the Town will appropriate and raise by borrowing $15,000 for water supply purposes under authority of Chapter 133, of the Acts of 1914, of the Massachusetts Legis- lature, or take any action in relation thereto, agreeable to the petition of Robert T. Allen and others.


Voted, That the Town appropriate $5,000 for water supply purposes and that the Town Treasurer, with the approval of the Water Commissioners, be and hereby is authorized to raise said amount by issuing bonds or notes of the Town under Massa- chusetts Acts of 1914, Chapter 133, said bonds or notes to be in coupon form, to be dated May 1, 1915, to bear interest at a rate not exceeding 5 per cent, to be denominated on their face " Town of Saugus Water Loan, Act of 1914" to be payable, $500 on the first day of each of the years 1916 to 1925 inclusive, all other particulars as to the form, issuance, and sale of said bonds or notes to be determined by the Town Treasurer, with the approval of the Water Commissioners. ART. 53. To see if the Town will appropriate the sum of $14,542.52, the same to be used in lieu of the income of the Water Department to pay interest and principal of maturing bonds issued under authority of Chapter 91, Section 2, of the

ART. 44. To hear and act on the report of the By-Law Committee appointed by the Moderator under Article 34 in the Town Warrant of March 9, 1914.


Report of the Committee was read by Judge William E. Ludden, Chairman of the Committee.

ARTICLE I.


TOWN MEETING.


SECTION I. The Annual Town Meeting for the election of Town officers, and for voting on the question of granting licenses for the sale of intoxicating liquors, shall be held on the first Monday of March of each year ; and all matters to be con- sidered at the Annual Town Meeting, other than the election of Town officers and voting on the question of granting licenses for the sale of intoxicating liquors in the Town, shall be brought before the Town at a meeting to be held on the evening of the second Monday of March. The time and place of hold- ing such subsequent meeting shall be stated in the Warrant for the annual election, and said election, subsequent meeting and its adjournments, shall all be regarded as part of the Annual Town Meeting, and the election of a Moderator by ballot to serve until the next Annual Meeting shall be the first business in order at said subsequent meeting. 3 In the absence of the Moderator at any subsequent meeting a Moderator pro tem shall be elected.

SECT. 2. Notice of every Town Meeting shall be given by posting attested copies of the Warrant calling the same, in at least two public places in each precinct not less than seven days before the day appointed for such meeting, and by leaving printed copies of the Warrant at the several dwellings of the inhabitants, at least four days before the day of meeting, pro- vided, however, that no meeting shall be invalidated by reason of any mistake, or omission on the part of the officer serving the Warrant as to leaving copies at every dwelling

SECT, 3. The Selectmen shall not insert in any Warrant for a Town Meeting any article under which an appropriation of money may be made either at that or any subsequent meeting, except for the annual appropriations, unless a request in writing therefor, signed by ten or more legal voters is filed with them at least thirty days prior to the time fixed for said meeting. And the Selectmen shall not insert in any Warrant for a Special Town Meeting any article under which an appropriation of money may be made either at that or any subsequent meeting, unless a request in writing therefor signed by ten or more legal voters is filed with them at least fifteen days prior to the time fixed for said meeting. And the Selectmen shall append to each such article mentioned in this section the name of the first per- son signing said request and the words "and others." Said request shall be filed and kept by the Selectmen until after the final adjournmenf of any Town Meeting at which action can be taken under said article.

ARTICLE II.


GOVERNMENT OF TOWN MEETINGS.


SECTION 1. All articles in the Town Warrant shall be taken up in the order of their arrangement unless otherwise decided by a two-thirds vote of those present and voting.

SECT. 2. There shall be chosen at each Annual Meeting a committee of three persons who shall make an annual appraise- ment of all property owned by the Town and make a report of their appraisement in the Annual Town Report.

SECT. 3. All questions and motions submitted for the con- sideration of the Town involving the expenditures of money, and such other motions as may be required by the Moderator shall be in writing.

SECT. 4. On demand of fifty legal voters the check list shall be used in taking the vote, and the meeting to determine whether by ballot or yea and nay vote, on any motion or resolution properly before a meeting of the Town.

No vote shall be reconsidered at the meeting in which it was passed, except upon a motion made within one hour after such vote has passed, and upon notice that such motion is to be made, given within half an hour after such vote has passed, nor then unless such motion to reconsider is made by a person who gave such notice and who voted with the prevail- ing side of the question.

SECT. 6. No action shall be had at any Town Meeting on the report of any Committee chosen at a previous Town Meet- ing unless the same shall be specifically stated in the Warrant calling such meeting.

When a question is under debate no motion shall be received, but to adjourn the meeting, to reconsider a previous vote, to lay on the table, to commit or amend, to refer or post- pone to a certain day, or to postpone indefinitely, which several motions shall have precedence in the order in which they are herein arranged, and no person shall speak more than twice on the same subject nor more than twenty minutes without the con- sent of the meeting.

SECT. 8. All Committees shall be appointed by the Mod- erator, unless otherwise directed by the meeting, and it shall be the duty of the member first named to promptly call the Com- mittee together for organization.

SECT. 10. The powers and duties of the presiding officer, not especially provided for by law or in the foregoing rules, shall be determined by the rules of practice contained in Cush- ing's Manual, so far as they are adapted to the condition and powers of the town.

SECT. II. It shall be the duty of the Moderator to request all persons not legal voters of the Town of Saugus, to retire from the Hall during the transaction of all Town business, and this rule shall be strictly enforced.

ARTICLE III.


CERTAIN POWERS AND DUTIES OF TOWN OFFICERS.


SECT. I. All official boards and commissions, Town Clerk, Town Accountant, Town Treasurer, Chief of Police, Superintendent of Streets and Building Inspector, Superintend- ent of Schools, Tree Warden, Forest Warden, shall hold a public meeting on the third Tuesday of each month in the Town Hall, and it shall be the duty of every Town official to be present or represented at such meeting and to submit to the meeting a report for the preceding month of the department that he represents. The Chairman of the Board of Selectmen shall preside at said meeting and the Town Clerk shall act as Clerk. It shall be the duty of every town official and any per- son employed by the Town to appear at such meetings upon the request of any member of the Board of Selectmen. If any department of the Town is to purchase goods in excess of $100 during any calendar month or is to let any contracts in excess of $100 it shall be the duty of the Town officer having charge of the same to notify the Board of Selectmen at the monthly meet- ing provided for in this section, and the Board of Selectmen

shall cause to be published a notice in such newspaper or news- papers as they may determine of all the proposed purchases and contracts to be made by the officers of Town departments, such publication to be at least seven days before said purchase or contracts are made and then to be unless all bids are rejected, given to the lowest responsible bidder. All bids received shall be kept on file in the office of the department, and any citizen shall have the right to examine the same.

SECT. 2. It shall be the duty of the Town Clerk to immedi- ately notify in writing, all members of committees that may be elected or appointed at any Town meeting, stating the business on which they are to act and the names of the committees.

SECT. 3. The Town Accountant shall cause to be printed and ready for distribution at least ten days before the Annual Town Meeting, a report, giving detailed statement of the receipts and expenditures of the Selectmen, Town Treasurer, Collector of Taxes, School Committee, Overseers of the Poor, and all other Town officers, boards, commissioners or commit- tees, who have had the charge or expenditure of the Town funds for the financial year, together with the estimates by all depart- ments for the current financial year. Said report shall also contain the Town Clerk's report of the number of births, deaths and marriages during the calendar year, and the report of the Selectmen and all official boards or Town officers, Library Trustees, Librarian, Commissioners of Sinking Funds and Water Commissioners, and the Selectmen shall cause said report to be distributed to the dwellings of the inhabitants at least seven days before the Annual Town meeting.

SECT. 4. The Selectmen shall cause an audit to be made annually in January, of the Town Accountant's accounts for the financial year, ending December 31, and the report of such audit shall be printed in the Annual Town Report.

ARTICLE IV.


FINANCE.


SECTION I. All poll taxes assessed in each year, shall be payable on or before the first day of July the same year.

SECT. 2. The Collector shall pay to the Treasurer of the Town, on the first secular day of each week, all taxes by him collected, if the amount in his hands reaches $500 or more.

SECT. 3. The Assessors shall keep a record in a book to be kept for that purpose, of all abatements of taxes, the names of the parties taxed, and the reason for and amount of abatements. And the Assessors shall furnish the Town Accountant and Tax Collector once each month with a list of such abatements.

SECT. 4. The Treasurer and Collector of Taxes shall, within Io days of the date of their election, give bond to the Town for the faithful performance of their duties, in a sum, and with sureties, approved by the Selectmen.

SECT. 5. It shall be the duty of the Town Clerk immediately after every Town Meeting, to furnish the Town Accountant and Board of Assessors with a statement of all moneys appropriated by the Town at such meeting, and of the purposes for which moneys were respectively appropriated.

SECT. 6. Any portion of an appropriation for Town charges remaining unexpended at the close of the financial year shall revert to the Town Treasurer, unless otherwise provided by law.
