ARTICLE V.

LEGAL AFFAIRS.


SECTION I. The Board of Selectmen shall annually appoint an Attorney at Law to act as Town Counsel.

SECT. 2. The Board of Selectmen shall have authority to prosecute, defend and compromise all litigation to which the Town is a party, and to employ special counsel to assist the Town Counsel whenever in their judgment necessity therefor arises.

SECT. 3. The Town Counsel shall draft all bonds, deeds, leases, obligations, conveyances, and other legal instruments, and perform every professional act which may be required of him by vote of the Town or any board of Town officers. Also when required by said boards or any committee of the Town, he shall furnish a written opinion on any legal question that may be sub- mitted to him, and he shall at all times furnish legal advice to any officer of the Town who may require his opinion upon any subject concerning the duties incumbent upon such officer by virtue of his office. He shall prosecute all suits ordered to be brought by the Town or Board of Selectmen, and shall appear at any court in the Commonwealth in defence of all actions or suits brought against the Town or its officers in their official capacity. He also shall try and argue any and all causes in which the Town shall be a party, before any tribunal, whether in law or equity, in the Commonwealth, or before any board of referees or commission, and shall appear at any and all hear- ings on behalf of the Town whenever his services may be required.

ARTICLE VI.


POLICE REGULATIONS.


SECTION I. It shall be the duty of the Chief of Police to report in writing, annually to the Board of Selectmen.

SECT. 2. No person shall leave any wagon, cart or other vehicle, or coal, wood, or other obstruction, in any street, way, sidewalk or public square, and suffer the same to remain there over night, without maintaining a sufficient light over or near the same throughout the night.

SECT. 3. No person shall place or cause to be placed, in any public street or upon any public sidewalk or common land of the Town, any dirt or ashes, nor any stones, bottles, glass, hoops, boards, or other wood with nails projecting therefrom, shavings, sawdust, manure, rubbish, or filth, of any kind, nor any noxious or refuse liquor or solid matter or substance.

SECT. 4. No person shall tie a horse, or other animals, to any tree nor to any structure protecting such tree, in the public streets or other pubic grounds of the Town.

SECT. 5. No person shall pasture any cattle or other animals in any street of this Town.

SECT. 6. No person shall permit or suffer any horse or other animal, carriage or vehicle of any description, belonging to him, or under his charge, to stand or stop upon any crosswalk in this Town, for any purpose except the taking up or setting down of passengers, nor for a longer time than shall be necessary for such purpose.

SECT. 7. No owner or person for the time being having the care or use of any horse or other beast of burden, carriage or draught, shall ride, drive or permit the same to travel at a faster rate than nine miles an hour in any street, way, or public place in this Town, and the speed of bicycles, automobile and all other motor vehicles shall not exceed that prescribed by the laws of the Commonwealth but the foregoing provisions of this section

shall not apply to any fire apparatus while responding to an alarm of fire, which in such case shall have the right of way.

SECT. 8. No person shall drive, wheel or draw upon a side- walk a coach, cart, handcart, hand barrow, or other vehicle of burden or pleasure, except children's carriages, or carriages containing children or invalids and drawn by hand.

SECT. 9. Every driver of a vehicle shall remain near it while it is unemployed or standing in the street, unless he is necessarily absent in the course of his duty and business; and he shall so keep his horse or horses and vehicle as not to obstruct the streets.

SECT. 10. No owner or driver of a vehicle shall bait or feed in a street, a horse or beast connected with such vehicle, except in a place designated by the Chief of Police, not unless the horse or beast, while being baited or fed, is under the care of some suitable person, and is properly secured to prevent it from getting beyond such person's control.

SECT. II. No person shall deal in, keep a shop for the purchase, sale or barter of, or collect by purchase or otherwise, from place to place within this Town, junk, old metal, or second- hand articles, without first obtaining a license therefor from the Selectmen on such terms as they may direct or prescribe.

SECT. 12. Every hawker or peddler, except such as are bona fide residents of Saugus, or who may be duly authorized by Statute Law or by State or County License to act as a hawker or pedler, shall pay to the Town Treasurer an annual license fee of twenty five dollars ($25).

SECT. 13. No person shall coast on any street or public walk of this Town, excepting upon such streets as may be desig- nated by the Selectmen.

SECT. 14. No person shall throw stones, snowballs or other dangerous missiles, nor play ball or football within any of the public streets of this town.

SECT. 15. Three or more persons shall not stand in a group, or near each other on any public way or sidewalk, after a request to move on made by any constable or police officer.

SECT. 16. No person shall behave in a rude or disordely manner or use any indecent, profane or insulting language, in any public place in this Town, or near any dwelling-house therein.

ARTICLE VII.


STREETS AND WAYS.


SECTION, I. No street shall be accepted by the Town if laid out less than 40 feet wide.


SECT. 2. Whenever the Selectmen make a report to the Town recommending the laying out or altering of a Town way, said report shall be laid upon the table without action, and the Selectmen shall put an article in the warrant calling the next Town Meeting to act upon said report.


SECT. 3. No person, except the Selectmen and Superintend- ent of Streets shall obstruct any sidewalk or street, or any part thereof, or break or dig the ground of the same, without first obtaining a written permit from the Selectmen therefor; and the person holding such permit shall put, and at all times keep, a suitable railing around the part of any sidewalk or street so obstructed or«dug up, as long as the same shall be unsafe or

inconvenient for travellers ; and shall also keep as many lighted lanterns fixed to such railing or fence, every night from twilight in the evening through the whole night, as the Selectmen or Superintendent of Streets shall direct.


SECT. 4. No building shall be moved over a public street without a written permit from the Selectmen, and no permit shall be given by the Selectmen when such removal will cause the destruction or injury of any tree standing in the street, or projecting over the street, unless the written consent of the official having control over public shade trees shall first be obtained. If any building shall be removed over or through any public street or square, the owner of such building and the person or persons moving the same shall be jointly and severally liable to the Town for all damages, cost and expenses for which the Town may be liable or which it may be compelled to pay in consequence of such removal.


SECT. 5. Whenever any sidewalk becomes obstructed or made impassable by reason of the erecting or repairing of any building, or of doing any work, the person doing or causing the same to be done shall place a good and convenient walk around such obstruction.


SECT. 6. No person shall erect any canopy, window or bay window awning, shade, shade-frame, nor place or maintain a sign, show bill, lantern, show board, goods, wares, or other articles, so as to project into or overhang any street except in accordance with a permit from the Selectmen ; and no person shall post, affix, nor in any way attach any poster, handbill, notice, advertisement or placard, to or upon any post, wall, tree, fence, building or structure not his own; nor mar, deface or disfigure the same without the permission of the owner or tenant.


SECT. 7. No owner, tenant, or other person having control of any building or premises, shall permit a gate or door thereon to swing open across any part of a sidewalk or street.


ARTICLE VIII.


FINANCE COMMITTEE.


SECTION I. There shall be a Finance Committee consisting of seven citizens of the Town, other than Town officers elected

by ballot. There shall be appointed at least one member from each precinct. The Moderator of the Annual Town Meeting of 1915 shall appoint two members of said committee for a term of three years, three members for a term of two years, and two members for a term of one year, the terms of said members to expire on the first day of December in the years 1918, 1917, and 1916, respectively. Annually thereafter the Moderator of the Annual Town Meeting shall on the first day of December appoint enough members of said committee to fill the same to serve for the term of three years from said date Any member of said committee who shall be elected by ballot to any Town office shall forthwith upon his qualification in such office, and any other member who shall remove from the Town shall upon such removal, cease to be a member of said committee. Said committee shall choose its own officers, and any vacancies in its membership shall be filled by appointment by the Moderator.


SECT. 2. It shall be the duty of this committee to consider all the articles of any Warrant for a Town Meeting hereafter issued under which an appropriation of money may be made, and it shall be the duty of the Selectmen after drawing a Town Warrant to transmit immediately a copy of the same to each member of the Finance Committee. A hearing shall be given upon all such articles to the person or persons whose names appear attached to the same, and they shall be notified of the time and place of hearing thereon. No appropriation of money under any article, shall be made, until after an actual hearing shall be held, and the report of said Finance Committee thereon made to the Town. Provided, however, that if the committee is not prepared to report at the time the article is reached in the Warrant, the same be taken up and acted upon, if so decided by a two-thirds vote of those present and voting. The committee shall, after due consideration of the subject matter in said articles, report thereon, in print or otherwise, such information and recommendations as it shall deem best. All recommenda- tions of the committee made to the Town shall be recom- mendations of a majority of the entire committee, but this shall not be construed to prevent recommendations by a minority as such. The Finance Committee shall have authority at any time to investigate the books, accounts and management of any department of the Town, and to employ such expert and other asistance as it may deem advisable for that purpose, and the books and accounts of all departments and officers of the Town

shall be open to the inspection of the committee and of any person employed by it. It may appoint sub-committees and delegate to them such of its powers as it may deem expedient.


SECT. 3. The various town officers, boards, and committees charged with the expenditure of the Town's money are each directed annually to prepare detailed estimates of the amounts necessary to carry on the Town's business intrusted to them for the ensuing year, with explanatory statements as to any changes from the amount appropriated for the same purpose in the pre- ceding year. They shall also prepare estimates of any income which may be received by the Town during the ensuing year in connection with the Town's business or property in their care. The Selectmen shall include in their estimates the salaries of all officers elected directly by the Town and all other items not otherwise provided for, and the salaries of all other persons shall be included in the estimate of the officers, boards, or committees appointing them. The Treasurer shall include in his estimates the amount required for the payment of interest on the Town debt, and for the payment of such portions of the town debt as may become due during the succeeding year. Said estimates and explanations shall be filed with the Town Accountant on or before the fifteenth day of January, and he shall forthwith com- pile the same in tabulated form and add thereto two columns, one giving the amounts appropriated and the other amount expended in the preceding year and shall furnish a copy to each member of the Finance Committee. Said Committee shall at once consider the estimates and add another column giving the amounts which in their opinion should be appropriated for the ensuing year, and shall add thereto such explanation and sug- gestions in relation to the proposed appropriations as they may deem expedient. The document shall be compleled and returned to the Selectmen in time to enable them to have it printed and distributed not later than the first Monday in March which they are hereby directed to do.


SECT. 4. Any Board, Standing Committee or officer of the Town, or any person or persons intending to ask an appropria- tion at any meeting of the Town, other than the regular annual appropriation, shall file a written notice in the office of the Selectmen of such intention, at least fourteen days before such meeting, stating the object and sum of the appropriation intended to be asked. The Selectmen shall thereupon record such notice

and inform the Finance Committee thereof. It shall thereupon be the duty of the Finance Committee to examine into the sub- ject, to be prepared to inform the Town thereon, and to cause to be printed and distributed to the voters a statement of the proposition, with such comments as they may deem expedient, at least three days before such meeting, or, for the annual meet- ing, not later than the first Monday in March. Provided that an appropriation may be asked, without such notice, at any meeting of the Town, but in the absence of such previous notice, the subject shall not be acted upon except at an adjourn- ment of said meeting, not less than one week later in either case, and during said interim the Finance Committee shall cause a printed notice of the sum and object of said proposed appro- priation, with its recommendations in relation thereto, to be distributed among the voters at least three days before such adjourned or other meeting.


ARTICLE IX.


ADVISORY COMMITTEE.


SECTION I. There shall be an advisory committee consisting of three citizens of the Town, other than Town officers elected by ballot. The Moderator of the Annual Town Meeting of 1915 shall appoint one member of said committee for a term of three years, one member for a term of two years and one member for a term of one year, the terms of said members to expire on the first day of December of the years 1918, 1917, 1916 respectively. Annually, thereafter, the Moderator of the Annual Town Meeting shall, on the first day of December appoint one member of said committee to serve for the term of three years from said date. Said Committee shall make its report before any article considered by it is acted upon, unless such articles are taken up and acted upon by a two-thirds vote or persons present and voting.


ARTICLE X.


SEALER OF WEIGHTS AND MEASURES.


SECTION I. The Sealer of Weights and Measures shall account such compensation as the Town shall annualy direct, and he shall account for and pay into the Treasury of the Town all fees received by him by virtue of his office, said com- pensation to be in full payment for all services rendered as Sealer of Weights and Measures.


ARTICLE XI.


PUBLIC CARRIAGES.


SECTION I. The Selectmen shall from time to time license, upon such terms as they shall deem expedient, proper persons, to maintain public carriages or other vehicles for carrying passengers for hire, and shall assign to such persons, stands where they may remain and solicit passengers. Such licenses shall not be transferable, may be revoked at any time, and shall expire upon the first day of May next succeeding the date thereof. No person shall solicit passengers in any street or other public place in the Town without such license.


ARTICLE XII.


SPECIAL BUILDING INSPECTOR.


SECTION I. The Selectmen, if in their judgment it seems necessary may appoint for any case, a Special Inspector of Buildings, who shall be some competent builder, architect, or

civil engineer, who shall have all authority for the time and case for which he is appointed, which is usually given Inspector of Buildings. His compensation shall be fixed by the Selectmen, unless otherwise provided by the Town.


ARTICLE XIII.


PENALTIES UNDER THE BY-LAWS.


SECTION I. Every violation, not otherwise provided for, of any of the foregoing By-Laws, shall be punished by a fine of not less than one dollar ($1), nor more than twenty dollars ($20), to be recovered by complaint before any court having jurisdiction.


ARICLE XIV.


PROSECUTION UNDER THE BY-LAWS.


SECTION I. Any citizen may, and the Selectmen, Police Officers and Constable, shall prosecute every violation of the foregoing By-Laws, by complaint before any Court having jurisdiction.


ARTICLE XV.


Upon the acceptance of the foregoing By-Laws by the Town, and approval of the same by the Attorney-General, all By- Laws heretofore existing, excepting the rules and regulations of the Board of Health, and ordinances relating to plumbers and plumbing, and building regulations for inspection and con- struction of buildings, shall be annulled and repealed ; provided that this repeal shall not apply to or affect any By-Law, or article heretofore adopted, accepting or adopting the provisions of any Statute of the Commonwealth.

In the name of the Commonwealth you are hereby required to notify and warn the inhabitants of said Town who are qualified to vote in Primaries to meet in Town Hall, Tuesday, the twenty- first day of September, 1915, at three o'clock P. M., for the following purpose: To bring in their votes to the Primary Officers for the Nomination of Candidates of Political Parties for the following offices : Governor, Lieutenant-Governor, Treas- urer and Receiver General, Secretary, Auditor, Attorney- General, for this Commonwealth ; Councillor, Sixth Councillor District, Senator, Seventh Middlesex District, Two Representa- tives in General Court, Fifteenth Representative District, County Commissioner, Essex County, Associate Commissioner (to fill vacancy), Essex County ; County Treasurer, Essex County, Dis- trict Attorney (to fill vacancy), Essex County ; Sheriff, Essex County. And for the election of the following officers : Dis- trict Member of State Committee for each political party for the Seventh Senatorial District, Members of the Democratic Town Committee, Members of the Republican Town Committee, Members of the Progressive Town Committee, delegates to State Conventions of Political Parties. All the above candidates and officers are to be voted for upon one ballot.


The polls will be open from 3 to 9 P. M.


And you are directed to serve this Warrant by posting attested copies thereof seven days at least before the time of said meeting as directed by vote of the Town.


HEREOF FAIL NOT, and make return of this Warrant with your doings thereon to the Town Clerk at the time and place of said meeting.
