Article 3. To see if the town will vote to authorize the committee appointed by the moderator under Article 31 of the Annual Town Meeting to engage an architect to make studies and plans to remodel, rebuild or renovate the Clarke School and raise and appropriate the necessary money therefor from available funds, or take any action relative thereto. Article 6 To see if the town will vote to accept that portion of Hawthorne Road and a portion of Estabrook Road not now accepted as a public way, as laid out by the Selectmen in accordance with the plans drawn by Howard L. Hamill, Town Engineer, on condition that all abutters sign the necessary waivers. Petitioned for by Frederick S. Brennan et al.

Article 9. To see if the town will raise and appropriate a sum of money for out-of-state travel for the Chief of Police or take any action relative thereto. Sponsored by the Board of Selectmen.


Article 10. To see if the town will raise and appropriate a sum of money for out-of-state travel for the Chief of the Fire Department or take any action relative thereto. Sponsored by the Board of Fire Engineers.


Article 11. To see if the town will vote to accept Section 85E of Chapter 32 of the General Laws as inserted by Chapter 576 of the Acts of 1946, which provides for the retirement of permanent mem- bers of the Police and Fire Departments on attaining the age of sixty-five years. Sponsored by the Board of Selectmen.


Article 12. To see if the town will raise and appropriate a sum of money from available funds for pensions and compensation. Spon- sored by the Board of Selectmen.


Article 13. To see if the Town will vote to extend the sewer in Sherwood Road for a distance of approximately three hundred (300) feet, taking the necessary easements and raise and appropriate money for the same. Sponsored by the Board of Health and Water & Sewerage Board.


Article 14. To see if the town will vote to extend the sewer in Charlotte Road for a distance of approximately two hundred (200) feet, taking the necessary easements and appropriate money for the same. Sponsored by the Board of Health and Water & Sewerage Board.


Article 15. To see if the town will vote to construct a sewer in Muriel Road for a distance of approximately four hundred fifty (450) linear feet, taking the necessary easements and raise and appropriate money for the same. Sponsored by the Board of Health and Water & Sewerage Board.


Article 16. To see if the town will vote to extend the sewer in Eureka Avenue for a distance of approximately forty-five (45) feet, and raise and appropriate the necessary money for same. Sponsored by the Board of Health and Water & Sewerage Board.


Article 17. To see if the town will vote to amend Chapter XI, Article II, section 1 of the By-Laws of the Town of Swampscott by adding at the end of said section 1 the following paragraph:


Upon completion of the foundation the person or persons holding a building permit shall submit a certificate to the Building Inspector, prepared by a Registered Land Surveyor, certifying the location of the foundation complies with the existing Zoning By-Laws and Build- ing By-Laws of the Town of Swampscott. Sponsored by the Board of Selectmen and the Building Inspector.


Article 18. To see if the town will vote to amend Chapter IX of the By-Laws of the town of Swampscott by inserting therein the following section:


17. No person shall, except in the performance of duty re- quired by law, discharge any air gun, gun, pistol, or other firearm in or upon any public or private way, lane, alley, public place, beach or wharf, or within 50 rods thereof, or within 50 rods of any building or structure in the town of Swampscott. visions of section 17 shall be punished by a fine of not more than twenty dollars ($20) for each offense. Sponsored by the Board of Selectmen.


Article 19. To see if the town will authorize the Board of Park Commissioners to complete the athletic field at Phillips Park by the installation of a water system, backstop, clay, sod and other neces- sary materials and raise and appropriate the necessary money there- for or take any action relative thereto. Sponsored by the Park De- partment.


Article 20. To see if the town will authorize the Board of Park Commissioners to construct an outdoor basketball court on Jackson Park, Phillips Park and Abbott Park and raise and appropriate the necessary money therefor or take any action relative thereto. Spon- sored by the Park Department.


Article 21. To see if the town will vote to accept the provisions of General Laws, Chapter 48, Sections 42, 43 and 44 which are here- inafter set forth establishing a fire department to be under the con- trol of an officer to be known as the Chief of the Fire Department.


General Laws, Chapter 48, Sections 42, 43 and 44 provide as follows:


Section 42. Towns accepting the provisions of this and the two following sections or which have accepted corresponding provisions of earlier laws may establish a fire department to be under the con- trol of an officer to be known as the chief of the fire department. The chief shall be appointed by the selectmen, and shall receive such sal- ary as the selectmen may from time to time determine, not exceeding in the aggregate the amount annually appropriated therefor. He may be removed for cause by the selectmen at any time after a hearing. He shall have charge of extinguishing fires in the town and the pro- tection of life and property in case of fire. He shall purchase subject to the approval of the selectmen and keep in repair all property and apparatus used for and by the fire department. He shall have and exercise all the powers and discharge all the duties conferred or im- posed by statute upon engineers in towns except as herein provided, and shall appoint a deputy chief and such officers and firemen as he may think necessary, and may remove the same at any time for cause and after a hearing. He shall have full and absolute authority in the administration of the department, shall make all rules and regulations for its operation, shall report to the selectmen from time to time as they may require, and shall annually report to the town the condition of the department with his recommendations thereon; he shall fix the compensation of the permanent and call members of the fire department subject to the approval of the selectmen. In the expenditure of money the chief shall be subject to such further limi- tations as the town may from time to time prescribe.


Section 43. Chief to Act as Forest Warden. The chief of the fire department shall act as forest warden in all towns, and shall have authority to appoint deputy wardens and fix their compensation sub- ject to the approval of the selectmen.


Section 44. Effect of Two Preceding Sections on Firemen under Civil Service. The two preceding sections shall not affect the tenure of office nor apply to the removal of permanent and call members of fire departments in towns which have accepted chapter thirty-one or corresponding provisions of earlier laws. Said sections shall not apply to cities. Sponsored by the Board of Selectmen.
