Shall the Board of Selectmen be authorized to purchase or take by eminent domain for public school purposes 20 acres of land more or less located to the north of and immediately adjacent to the Marblehead Branch of the Boston and Maine Railroad and owned by the Tedesco Country Club; said land being shown in red on plan entitled "Plan of proposed taking of Tedesco Country Club land, dated April-, 1950, Howard L. Hamill, Town Engineer", on file with the office of the Planning Board of the Town of Swampscott; and appropriate the sum of $15,000 from the Excess YES and Deficiency Fund therefor?

To either of the constables of the Town of Swampscott in said County and Commonwealth :


GREETING :


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify the inhabitants of the Town of Swampscott qualified to vote in elections and Town affairs to assemble in the Hadley School in said Swampscott, on Tuesday, the 12th day of September, 1950, at 7:45 p.m. then and there to act on the following articles: viz.,


Article 1. To see if the Town will vote to authorize the Water and Sewerage Board to extend water mains within the Town of Swampscott and appropriate the necessary money therefor by borrowing or otherwise or take any action relative thereto.


Sponsored by the Water and Sewerage Board.


Article 2. To see if the Town will vote to modify, amend, affirm or rescind any part of the action taken by the Town Meeting under Article 6 of the warrant of the Special Town Meeting of May 16, 1950, or take any action relative thereto.


Sponsored by the Board of Selectmen.


Article 3. To see if the Town will vote to authorize the School Committee and Superintendent of Schools, to put the present Clarke School in suitable condition for use as an elementary school; and to that end to make such changes and improvements as will meet the requirements of the Massachusetts Department of Public Safety ; will provide suitable sanitation, and generally will put the building in shape for immediate occupancy; and appropriate the necessary money therefor from available funds or by borrowing or otherwise or take any action relative thereto.

Article 4. To see if the Town will vote to appoint a committee consisting of one member of the School Committee selected by the School Committee, one member of the Board of Selectmen selected by the Board of Selectmen, one member of the Finance Committee selected by the Finance Committee, the Superintendent of Schools, and one Town Meeting member appointed by the Moderator to en- gage an architect to make plans, drawings and specifications of sufficient detail to be used for advertising for bids and for construc-

tion for adding to, remodeling, enlarging, or constructing an addition to the present Clarke School building and equipping the same, for use as an elementary school with classrooms, auditorium, offices and other school features, and appropriate the necessary money therefor by borrowing or otherwise or take any action relative thereto.

Article 5. To see if the Town will vote to appropriate a sum of money for the payment of balance due for land damages for property taken for school purposes by eminent domain located at 96 Middlesex Avenue and owned by Harold R. Fall, or take any other action relative thereto.

Article 6. To see if the Town will vote to appropriate a sum of money to pay the architects engaged by the Clarke School Building Committee appointed under Article 6 of the Special Town Meeting of May 16, 1950, or take any action relative thereto.

Article 7. To see if the Town will vote to construct sidewalks on Cherry Street in front of the Veterans Housing Project; and ap- propriate the necessary money therefor or take any action relative thereto.

Article 8. To see if the Town will vote to appropriate a sum of money for civil defense under the provisions of Chapter 639 of the Acts of 1950, or take any action relative thereto.

Article 9. To see if the Town will adopt the following by-laws for Civil Defense under the provisions of Chapter 639 of the Acts of 1950:


CIVIL DEFENSE


Section 1. Department of Civil Defense. There is hereby estab- lished a department of civil defense (hereinafter called the "depart- ment"). It shall be the function of the department to have charge of civil defense as defined in Section 1, Chapter 639, Acts of 1950 and to perform civil defense functions as authorized or directed by said chapter or by any and all executive orders or general regu- lations promulgated thereunder, and to exercise any authority dele- gated to it by the governor under said Chapter 639.


Section 2. Director of Civil Defense. The department shall be under the direction of a director of civil defense (hereinafter called the "director") who shall be appointed as prescribed by law. The director shall have direct responsibility for the organization, adminis- tration and operation of the department, subject to the direction and control of the appointing authority, and shall receive such salary as may be fixed from time to time by the appointing authority. The director may, within the limits of the amount appropriated therefor, appoint such experts, clerks and other assistants as the work of the department may require and may remove them, and may make such expenditures as may be necessary to execute effectively the purposes of Chapter 639, Acts of 1950.


The director shall also have authority to appoint district co- ordinators and may accept and may receive, on behalf of the town, services, equipment, supplies, materials or funds by way of gift, grant or loan, for purposes of civil defense, offered by the federal government or any agency or officer thereof or any person, firm or

corporation, subject to the terms of the offer and the rules and regulations, if any, of the agency making the offer. The director shall cause appropriate records to be kept of all matters relating to such gifts, grants or loans.


Section 3. Civil Defense Advisory Council. There is hereby estab- lished a civil defense advisory council (hereinafter called the "coun- cil"). Said council shall serve without pay and shall consist of the director of civil defense, such other department heads and such other persons as the authority appointing said director may deem necessary. Such member of said council as said appointing authority shall designate shall serve as chairman of said council. Said council shall serve subject to the direction and control of the appointing authority and shall advise said appointing authority and the director on matters pertaining to civil defense.


Section 4. Police Aid to Other Cities and Towns in Event of Riots or Other Violence Therein. The police department is hereby authorized to go to aid another city or town at the request of said city or town in the suppression of riots or other forms of violence therein.


Section 5. Termination of By-Law. This by-law shall remain in force during the effective period of Chapter 639, Acts of 1950 and any act in amendment or continuation thereof or substitution therefor.


Section 6. Definition. All references to Chapter 639, Acts of 1950, as now in force, shall be applicable to any act or acts in amendment or continuation of or substitution for said Chapter 639.


And you are directed to serve this Warrant by posting an at- tested copy thereof at the Town Administration Building, at the Post Office, and in at least two public and conspicuous places in each precinct in the town and at or in the immediate vicinity of each railroad station in the town, not less than seven days before the day appointed for said meeting.


Hereof fail not and make due return of this Warrant, with your doings thereon, to the Town Clerk at the time and place of meeting aforesaid.

Special Town Meeting Tuesday, September 12, 1950


In accordance with the warrant the Town Meeting Members assembled at the Hadley School, and were called to order by the Moderator, Vincent P. O'Brien at 7:54 P.M., the necessary quorum being present (118).


John W. Lynch, Priest of St. John's Evangelist Church, offered an Invocation.


The warrant with the return thereon was read by Malcolm F. MacLean, Jr., Town Clerk.


Voted: That the reading of the records of the last meeting be omitted.


Voted: Article 1. To accept the report of the Finance Committee and adopt their recommendations as follows:


That the Town authorize the Water and Sewerage Board to extend water mains within the Town of Swampscott and that the sum of $50,000 be appropriated therefor to be raised as follows: That $10,000 be appropriated from the Water Available Surplus and that the Treasurer, with the approval of the Board of Selectmen, be authorized to borrow a sum not to exceed the remainder; namely, $40,000; and to issue bonds or notes of the Town therefor payable in accordance with the provisions of Chapter 44 of the General Laws (Tercentenary Edition) so that the whole loan shall be paid in not more than five years from the date of the issuance of the first bond or note, or such earlier dates as the Treasurer, with the ap- proval of the Board of Selectmen may determine. Unanimous.


Voted: Article 2. To accept the report of the Finance Com- mittee as amended, and adopt their recommendations as follows:


That this Town Meeting affirms the action taken on Article 6 at the Special Town Meeting held May 16, 1950.
