SUPERIOR COURT.


James J. Naughton vs. Town of Weymouth. This was an action to recover money paid by the plaintiff at tax sales of real estate made by the Tax Collector in the year 1904. There were seventy-four (74) tax deeds or parcels of such real estate. The plaintiff claimed that such sales and deeds were invalid on ac- count of errors, omissions and informalities in the assessments and sales. The amount sought to be recovered back with in- terest and charges was about $1200. During the year the hear- ings before Winfield S. Slocum, Esq., auditor have been con- cluded. The auditor found in favor of the plaintiff as to twenty of these deeds and in favor of the town as to fifty-four other deeds. The plaintiff asked for further trial in the Superior Court and this was had in April, 1914. The result of this trial was to reduce the number of deeds to sixteen as to which the plaintiff was found entitled to recover back his money, and judg- ment was thereupon entered in the sum of $143.81. This has been paid and the case is now settled. )


Louis A. Cook vs. Town of Weymouth. Petition in Superior Court for assessment of damages for the taking of land to widen Pleasant Street at South Weymouth. (Pending.)


Johanna Burke vs. Town of Weymouth. This is an action of tort to recover damages in the sum of $10,000 for personal injuries sustained by her in consequence of an alleged defect in the sidewalk on the westerly side of Neck Street. (Pending. )


By writ dated December 14, 1914, returnable February 1, 1915, Hannah R. Abbott brings an action of tort against the town in the sum of $15,000 to recover damages for personál injuries alleged to have been sustained by reason of an alleged defect on Putnam Street.


By writ of same date, returnable to the same Court, Charles H. Abbott, her husband, brings an action of tort in the sum of $10,000 to recover for medical attendance and nursing.


DISTRICT COURT OF EAST NORFOLK.


Herbert A. Billings vs. Town of Weymouth, being an action of tort seeking to recover damages to his property alleged to have been occasioned by blasting in the vicinity of his residence on Front Street.

Petitions for the registration of land titles in which the town is a party by reason of land abutting on public ways : Leon J. Auger, Edna Pope, D. Arthur Brown, Teresa Shea and Ellen E. Condrick.


PROBATE COURT.


The late Josepn E. Trask died on the thirty-first day of Octo- ber, 1913, leaving an instrument in writing purporting to be his last will and testament, executed by him on the first day of March, 1899, wherein it was provided that, after the payment of certain legacies, the residne of his estate was to be held in trust during the life of certain beneficiaries, who were to receive the annual income therefrom, and upon the death of the last sur- vivor to the Town of Weymouth, to be further held by the town in trust and the income expended for the purchase of new books for Tufts Library and for free public lectures.


On November 1, 1913, the executor filed a petition in the Pro- bate Court for the County of Suffolk for the allowance of this will. Certain of the heirs entered their objection to its allowance and negotiations followed among all parties interested looking toward a compromise. As a result of these negotiations, the Probate Court, on petition by the executor and in order to adjust the con- troversy that had arisen concerning the probate of the will, au- thorized an agreement of compromize and entered a decree al- lowing the will modified as to some of its provisions. As a result of this decree the town of Weymouth is to receive out right two-fifths of the rest and residue of the estate to be held by it upon the following trust, to wit :


" To safely hold the same as the "Joseph E. Trask Fund " and to safely invest and re-invest said fund in such manner or in such securities as the Board of Trustees of the public library, known as the Tufts Library, in said town may direct, more re- gard being had in such investment to its security than to the rate of percent. of income, and to pay over the income of said fund as it accrues, or at least as ofen as once in each year to the said Board of Trustees to be expended by said trustees in the pur- chase for the use of said library, of useful books of a standard character, giving special prominence to those of a scientific nature."
