REPORT OF TOWN COUNSEL
Weymouth, Mass.
January 14, 1924.
To the Honorable Board of Selectmen of the Town of Weymouth: I herewith submit my report as Town Counsel for the year ending December 31, 1923.
Un January 1, 1923, there were pending against the Town the following suits:
Harold A. Billings for damages alleged to have been caused by blasting on Front Street;
Simon Delorey for alleged damages to mowing land, in con- sequence of condition of street drain ;
Gustavus B. Bates for alleged damages to land on Pleasant Street, in consequence of street drainage;
Annie W. Bates for alleged damages to property on Washing- ton Street, alleged to have been caused by the shutting off of the water supply;
County Commissioners, petition for apportionment of the cost of Monatiquot River Bridge.
The following actions have been brought within the year:
Thomas P. Vaille et als against the Town in an action to re- strain the Town, from carrying out a vote of the Town Meeting . authorizing the issue of bonds and notes in connection with the building of the addition to the High School.
Nellie Wall against the Town, for injuries alleged to be due to an alleged defect in the sidewalk on Broad Street, East Wey- moutn.
Charles V. Douse vs Weymouth for land damages for the widening of Wessagusset Road, North Weymouth.
Mary E. Bessette vs Weymouth, for injuries alleged to have been received through an alleged defect on Broad Street, East Weymouth.
Linda F. Whittemore vs Weymouth, for personal injuries and property damage alleged to have been received through an alleged defect on Broad Street, Weymouth.
The cases of Billings, Delorey, Gustavus B. Bates and Annie W. Bates are still pending.
'I'ne action of County Commissioners for the apportionment of cost of Monatiquot River Bridge, has been heard by Commis- sioners appointed by the Superior Court, to wit,-Hon. Frederick H. Chase, Hon. George L. Mayberry and Hon. Fred S. Hall. The total cost of the Bridge together with charges for interest, com- pensation of Commissioners, reporting testimony, advertising of hearings was $337,282.73, of which cost, the sum of $44,316.29 was assessed upon the Town of Weymouth, which amount is a trifle short of thirteen and one-half (131/2 ) per cent of the whole. In the apportionment of the cost of the Weymouth Fore River Bridge by Commissioners, Weymouth was assessed ten (10) per cent of the cost.
