Article 42. Under this article the Moderator appointed Melville F. Cate and John P. Lovell as tellers, and they were sworn by the Moderator.


Voted: That the sum of Fifty Thousand Dollars ($50,000) be raised by loan and appropriated for the laying and relaying of the Town's water mains of six (6) inches or more in diameter, and that the Treasurer of the Town be and hereby is authorized, with the approval of the Selectmen, to borrow said sum of Fifty Thousand ($50,000) Dollars for said purpose, and to issue bonds or notes of the Town therefor in accordance with the provisions

of Section 19, Chapter 44 of the General Laws, to be paid in equal installments in fifteen (15) years from the date of issue, as authorized by Chapter 303 of the Acts of 1923, and to bear such rate of interest as may be fixed by the Town Treasurer, with the approval of the Board of Selectmen.


The result of the vote was 114 in favor, 2 against.


Article 43. Voted: That the subject matter of this article be referred to the Water Commissioners.


Article 44. Voted: To raise and appropriate the sum of $68,065 for repairs of highways, townways, bridges, street oiling and for removal of snow. $3,000 of this amount is for the do- ing of private work which the street department may do, and for which the town is to be reimbursed.

Hunt one half the cost of sidewalk at 718 Broad Street; to reimburse Minot P. Garey one half the cost of sidewalk at 717-719 Broad Street; to reimburse F. Wayland Preston one half the cost of sidewalk in front of his new building on Broad Street; all these sidewalks having been built during the past year and paid for in full by the above mentioned parties.


Article 57. Voted: That the Town accept the report of the Selectmen upon the laying out as a townway of the private way, leading from the easterly side of Union Street and known as May Terrace.

Article 68. Voted: That the Town accept the report of the Selectmen upon the laying out of a town way the private way (formerly known as Taylor Street) which runs from the northerly side of Columbian Street in a northerly direction for some four hundred feet and it shall be known as Shaw Street.


Article 69. Voted: To raise and appropriate the sum of $300 for the purpose of working Shaw Street.


Article 70. Voted: That the subject matter be referred to the Superintendent of Streets, and if done the money to be taken from his regular appropriation.

Article 71. Voted: That the Selectmen be and hereby are authorized to execute a contract of indemnity with the Common- wealth of Massachusetts, subject to the approval of the Town Counsel, against any and all claims for land, grade or drainage damages which may be caused by, or result from the laying out, construction or reconstruction of any state highway in the Town during the present year.


Article 72. Voted: To raise and appropriate the sum of $500 for Memorial Day.


Article 73. Voted: To raise and appropriate the sum of $400 for the alewive fishery and that the Selectmen be a com- mittee of the Town to conduct the alewive fishery.


Article 74. Voted: That the Town authorize its Selectmen to commence suit for the recovery of any money or property due to it, or to prosecute a bill in equity, or any other proceeding in court when in their judgment it is expedient or in the inter- ests of the town to do so.


Article 75. Voted: That the Selectmen be and hereby are authorized to sell any real estate of which the Town is possessed, and for which it has no further use, the sale to be at public auc- tion, said property to include the lockup property located in Ward 3, including land building.


Article 76. Voted: To raise and appropriate the sum of $6,200 for miscellaneous expenses, $750 of this amount to be for the purchase of a safe for the record cards in the Assessor's Department.


Article 77. Voted: That no action be taken under this article.


Article 78. Voted: That a committee of five (5) be ap- pointed to consider this question (collection of garbage) and re- port at some future meeting.

Article 79. Voted: That the Town accept as a gift from Bradford Hawes a piece of land containing about four (4) acres Adjoining Lovell's Corner Playground, the same to become a part of the playground, and that the thanks of the Town be ex- tended to Mr. Hawes for his gift.

Article 80. Voted: No action was taken under this article.


Article 81. Voted: That a committee of five (5) be ap- pointed by the Moderator to investigate gas and electricity rates in the Town, and that this committee be empowered to call upon the Town Counsel for legal advise in their investigation.

Voted: Upon motion of George E. Cuniff, that any citizen begranted the privilege to address the meeting.


Article 83. Voted: To raise and appropriate the sum of $8,000, the same to be expended in purchasing insurange against loss by fire on all the buildings of the Town, and their contents, and liability insurance covering the trucks of the Street Depart- ment, for a period of 3 years. Any insurance now carried upon buildings is to be cancelled at the time the insurance provided for in this article becomes effective. The fire insurance and lia- bility insurance shall be placed by the Selectmen who shall make arrangements so that the insurance agents conducting business in Weymouth shall receive a substantially equal proportion of the insurance.


Article 84. No action was taken under this article.


Arrticle 85. Mr. John F. Robinson for the committee ap- pointed under Article 95 of the town meeting of March, 1923 (Building laws for different zones in Weymouth) read a report of that committee. Mr. J. Leonard Bicknell moved no action be taken under this article. Mr. F. E. Loud moved and it was voted : That the subject matter of this article be recommitted to the com- mittee appointed under Article 95 of the town meeting of 1923 for further consideration.


Article 86. Voted: That the sum of Fifty Thousand Dol- lars ($50,000) be raised and appropriated for the payment of the Town's proportion of the cost of Monatiquot River Bridge in Braintree, as determined by the Commissioners appointed by the Superior Court for the County of Norfolk, together with accrued interest thereon under the provisions of Chapter 315 of the Acts of 1917, Chapter 269 of the Acts of 1918, Chapter 44 of the Acts of 1919 and Chapter 90 of the Acts of 1920, and that the Treas- urer, with the approval of the Selectmen, be and hereby is author- ized to borrow of said amount the sum of Forty-Five Thousand ($45,000) Dollars for the purposes aforesaid, and to issue bonds or notes of the Town therefor under the provisions of Chapter 44, Section 7, Clause 5 of the General Laws, same to be payable within twenty (20) years from the date of issue therefor, or at such earlier dates as the Treasurer and Selectmen may determine.


This vote was unanimous, 112 voted in favor and none against.


Article 87. Voted: That the Selectmen, be and hereby are authorized to waive the provisions in favor of the Town con- tained in the will of Helen M. Rhines, allowed by the Probate Court for the County of Norfolk, November 24, 1899, and to ac- cept in behalf of the Town, subject to the approval of the Town Counsel, proposal made by Mrs. Laura F. Knapp and Mrs. Mary L. Nelson, heirs of Helen M. Rhines, to wit :-


To sell the premises No. 60 Commercial Street, in said Wey- mouth, and to add enough to the proceeds of such sale when made to make the sum of Ten Thousand Dollars ($10,000), which sum to be given to the Town of Weymouth, same to be kept and known as the John C. Rhines Fund, the income thereof to be used for such public purpose as the Town may, from time to time, decide.


Article 88. Voted: That the recommendation (No. 1) of

the committee chosen at the special Town Meeting of May 31, 1923 (to be found on page 128 of the Annual Report for 1923) be adopted. (This recommendation was that the Square formerly known as Fountain Square and by vote later named William B. Monteith Square, be renamed Parker B. Jones Square, and that the Junction of Central and Union Streets, be changed from Parker B. Jones to William B. Monteith Square).


Article 89. Voted: That a committee of 3 be appointed by the Moderator to consider the subject matter of this article and report at some future meeting.


The Moderator appointed a committee as follows: Richard Halloran, Arthur Cicchese, Irving E. Johnson.


Article 90. Voted: To adopt the following additions of Article 5 of our present By-Laws. (Unanimous vote).


Section 7. No Street or way shall be laid out or accepted by the Town of Weymouth of a width less than 40 feet, unless the same shall have been actually opened and used for public travel prior to January 1, 1924 or is requested and recommended by the Selectmen and Superintendent of Streets.


Section 8. No street or way constructed through lands by the owners thereon shall be laid out or accepted or recommended by the Selectmen or any committee of the Town for acceptance as a public street or way of the Town of Weymouth, unless pre- viously constructed and completed to the sub-grade in accordance with specifications set forth in Section 12.


Sec. 9. Any street or way constructed through private lands by the owner thereon in accordance with the specifications set forth in Section 12, may be laid out and accepted as a public street of the Town of Weymouth provided such action is taken in accordance with provisions of Chapter 50 of the Revised Laws of Massachusetts and amendments thereof; and provided also, that the owners of at least 75 per cent. of the lands through which such street or way passes, have signed releases of all property which the Town deem it necessary to acquire for such layout and accepted and have granted sloping privileges and have agreed to pay betterment assessments.


Sec. 10. When it is necessary in the opinion of the Super- intendent of Streets to construct catch-basins on any street or way, and lay drains to connect with a permanent outlet, such catch-basins and drains may be constructed and laid out and the cost of such work shall be considered as part of the total cost of constructing said street or way.


Sec. 11. Side gutters on any such street or way having a grade of five per cent., or over, may, if in the opinion of the Su- perintendent it be necessary, be paved four feet wide, with stone or concrete, the cost of such work shall be considered as a part of the total cost of constructing said street or way.


Sec. 12. A plan and profile on paper or tracing-cloth 19 inches wide by 28 inches long at a scale of not less than one inch to 40 feet of every street shall be filed in the office of the Super- intendent of Streets who shall fix the grade thereon.


(a) Every such street or way shall be at least forty feet wide and have a road-bed, equal to at least two-thirds of said street or way.


(b) All loam shall be removed from the limits of the street or way to a depth of at least twelve inches below the finished

grade for the roadway, (and six inches below the finished grade for the sidewalk), or such greater depth as may be required by the Selectmen; all rock or boulders removed from the street or way shall be used in embankment.


(c) The entire area of such street or way shall be first cleared of all stumps, brush, roots and like material and of all trees not intended for preservation.


(d) All work in excavation or embankment shall be brought to a sub-grade of not less than eight inches for the roadway and four inches for the sidewalk, below finished grade, or such greater as the nature of the sub-soil, in the opinion of the Selectmen may require.


(e) All corners of intersecting streets or ways shall be rounded as approved by the Selectmen.

A meeting of the Board of Registrars of Voters was held at the Town Office on Tuesday morning March 11, 1924 at 1:30 A.
