REPORT OF TOWN COUNSEL
January 7, 1925.
To the Honorable Board of Selectmen of the Town of Weymouth: I herewith submit my report as Town Counsel for the year ending December 31, 1924.
On January 1, 1924, there were pending against the Town the following suits:
Harold A. Billings for damages alleged to have been caused by blasting on Front Street;
Simon Delorey for alleged damages to mowing land, in con- sequence of condition of street drain;
Gustavus B. Bates for alleged damages to land on Pleasant Street, in consequence of street drainage;
Annie W. Bates for alleged damages to property on Wash- ington Street, alleged to have been caused by the shutting off of the water supply;
County Commissioners of Norfolk, petition for apportion- ment of the cost of Monatiquot River Bridge.
Charles V. Douse for land damages for the widening of Wes- sagussett Road ;
Mary E. Bessette for injuries alleged to have been received through an alleged defect on Broad Street, East Weymouth; Linda F. Whittemore for personal injuries and property damage alleged to have been received through an alleged defect on Broad Street, Weymouth.
The cases of Billings, Delorey, Gustavus B. Bates, Annie W. Bates and Mary E. Bessette are still pending. The Monatiquot River Bridge case is pending before the Supreme Judicial Court. The suits of Wall, Douse and Whittemore have been disposed of without a trial.
During 1924, a controversy over the provisions of the will of Helen M. Rhines for the benefit of the Town, has been settled, and the Town has received the payment of Ten Thousand <10,000) Dollars, to be known as the "John C. Rhines fund," the income to be used for public purposes as the Town may from time to time decide.
During the latter part of the year 1924, the New England Telephone & Telegraph Company presented a petition to the Public Utilities Department, for authority to increase their tel- ephone rates generally. The Department has assigned February 9, 1925 as the date for the commencement of hearings on this petition. The appearance of the Town, in opposition to this pe- tition, has been entered, and the association of City Solicitors and Town Counsel have made arrangements for the obtaining and presentation of evidence.
