and the Board of Selectmen are hereby authorized to acquire by gift or purchase, or take by right of eminent domain in fee or otherwise for all purposes of a public street and highway in and over each of said streets as laid out and accepted, and that the sum of $9,520.00 be raised and ap- propriated for materials for the working of the above-named streets, in- cluding the acquisition of the fee above referred to and for the building of any bridges, drains or conduits or securing easements which may be necessary in connection therewith, and that the Board of Selectmen are authorized to accept deeds of any reservation strips existing in connec- tion with any of said streets; and provided further, that no work shall be done on any of these streets until 90% of abutters, or 100% if, in the opinion of the Town Counsel, that becomes necessary, have signed, executed and delivered to the Town Counsel proper releases. Provided further, that the final naming of those streets accepted must meet with the approval of the Planning Board, and the work on these streets shall be performed un- der the direction of the Superintendent of Streets. that the sum of $13,852.00 be raised and appropriated for the necessary water mains in said streets and that the water mains be installed by the Water Department before any work is done by the Street Department. $9,520.00 $13,852.00

To see what action the Town will take to resurface the following streets: (a) Green Street from North Street to Neck Street; (b) Front Street from Washington Street to Glines Avenue; (c) Commercial Street from Washington Street to Thayer's Crossing (so-called), or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was unanimously

That the sum of $38,000.00 be appropriated to the Highway Department from available funds (Excess and Deficiency Account) to reconstruct, re- surface, widen, straighten, relocate and work Pond Street and/or Com- mercial Street from Washington Street to No. 344 Commercial Street or any portion of said ways and for the building of any bridges, drains or conduits or securing any easements which may be necessary, and that the Board of Selectmen is authorized to accept any deeds of any reservation strips in connection with said streets; and provided further, that all dam- ages resulting or occasioned by the construction shall be a charge against the sum appropriated; the Board of Selectmen are hereby authorized to acquire by gift, or purchase, or take by right of eminent domain in fee or otherwise for all purposes of public streets or highways in and over said street; that the above-named sum shall be made available only if the State or County, or both, under General Laws (Ter. Ed.), Chapter 90, will pay a sum of money proportionate to the cost of construction under the provisions of said Chapter; all payments from State and County to revert to the Ex- cess and Deficiency Account; provided further, that such work shall be done by private contract under the direction of the Board of Selectmen and/or the State Department of Public Works. $38,000.00


ARTICLE 9. (By Direction of the Board of Selectmen.) To see what sum of money the Town will appropriate to rebuild Green Street to its entire length, and said money to be expended under direction of the Board cf Selectmen, or take any other action in relation thereto.

ARTICLE 10. (By Direction of the Board of Selectmen.) To see what sum of money the Town will appropriate to finish construction of Carroll Street to its accepted length, or take any other action in relation thereto.

ARTICLE 14. (At Request of Planning Board.) To see what sum of money the Town will raise and appropriate for the 1953 sidewalk program, or take any other action in relation thereto.

That the sum of $15,000.00 be raised and appropriated for construction of sidewalks and curbings on streets in the sidewalk building program; provided further that the Board of Selectmen are instructed to enter into contract to have this work performed. $15,000.00

That the sum of $15,000.00 be raised and appropriated for the con- struction of sidewalks and curbings on streets selected by the Planning Board in the sidewalk buiding program; provided further, that the Board of Selectmen be instructed to enter into private contract, selected by com- petitive bids, to have this work performed.

VOTED: That the subject matter be referred to the sidewalk building program.


ARTICLE 17. (On Petition of the Briarwood Section of Weymouth.) To see what sum of money the Town will vote to raise and appropriate to construct a sidewalk on Federal Street, from Summer to Front Streets, and on the west side of Front Street from Federal Street to the Homestead School, or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was unanimously


VOTED: That the subject matter be referred to the sidewalk building program.


ARTICLE 18 (At Request of Planning Board.) To see what action the Town will take to install adequate drainage from the culvert at Green Street to the sea valve at Norton Street, and to raise and appropriate the sum of $30,000.00 for said work to be done under the direction of the Selectmen's Department, or take any other action in relation thereto.

The following substitute motion by Mr. Newton of the Planning Board:


That a committee of three be appointed by the Town Moderator to look into the subject matter of this Article; that the sum of $500.00 be raised and appropriated for use by this committee for estimates and preparation of plans for the adequate drainage from the culvert at or near Green Street, and that this committee report to the next Annual Town Meeting.


Discussion ensued between Mr. Newton of the Planning Board Mr. Roulston of the Appropriation Committee, and Mr. Crehan of the Board of Selectmen.

Mr. Newton requested unanimous consent to delete the phrase "sum of $500.00 be raised and appropriated for use by this," so that the substitute motion now reads as follows:


That a committee of three be appointed by the Town Moderator to look into the subject matter of this Article; that the committee obtain estimates and preparation of plans for the adequate drainage from the culvert at or near Green Street, and that this committee report to the next Annual Town Meeting.

ARTICLE 20. (By Request of the Planning Board.) To see what action the Town will take to increase the size of the drain from Pierce Road to Webb Street from 12 inches to 24 inches and to increase the pres- ent 18-inch line under the bridge at the N. Y., N. H. & H. R. R. Old Colony Branch downstream from the above Pierce Road-Webb Street drain line to 30 inches, or to take any other action in relation thereto.

ARTICLE 21. (At Request of Alfred C. Sheehy, 401 Broad Street, and Others.) To see if the Town will raise and appropriate a sum of money sufficient to survey, widen, deepen, or otherwise repair the culvert which conducts the brook under Broad Street and Academy Avenue, near the intersection of Broad Street, Essex Street and Academy Avenue, or take any other suitable action in relation thereto.

ARTICLE 26. (At Request of Committee on Columbian Square Traffic Control.) To see if the Town will acquire a certain parcel of land, now identified as a private way, running between Union Street and Chauncey Street, and showing on Assessors' Map No. 45 as part of Lot No. 12-Block 526, for the purpose of an accepted public street; and to further acquire the rest of this parcel, that is now vacant, from a line established 130 feet from Union Street and running in a parallel direction to Union Street for the full width of the lot, and extending to Chauncey Street, for the pur- pose of making a public parking space. The above parcels to be acquired by purchase, gift, or otherwise, in accordance with specific legal description to be included in the motion, or take any other action in relation thereto.

By the Appropriation Committee: That the matter be referred back to the committee for further study and costs of land taking and grading.


After discussion at length the parking situation in South Weymouth, Mr. Gunn offered the following substitute motion :

That the Town acquire by gift or purchase, for a public parking area, the following described land, namely: The land now or formerly of Angus Montgomery, and being shown as Lot A on Plan of Land in (South) Wey- mouth, Mass., dated February 27, 1953, Russell H. Whiting, Town Engineer, and containing about 30,800 square feet of land according to said plan; also a Private Way shown as Lot B on said plan and containing about 17,500 square feet of land according to said plan. Subject to any existing Rights of Way. Also land now or formerly of Weymouth Cameo Theater Co. on Chauncey Street, and shown as two lots containing 10,928 square feet of land about 7,600 square feet of land respectively, as shown on said plan. Reference may be had to said plan for a more particular description.

And that the Board of Selectmen are hereby authorized to acquire by gift or purchase said land, and the sum of $20,000.00 be raised and ap- propriated for this purpose; and that a further sum of $4,700.00 be raised and appropriated for conditioning expenses, and the said money to be expended under the direction of the Board of Selectmen.

ARTICLE 27. (By Request of the Herring Run Merchants Associa- tion of East Weymouth.) To see if the Town will raise and appropriate a sum of money sufficient to cover over, by cement slab or otherwise, the so-called "Canal" which runs along the northwesterly side of Commercial Street between the present Alewife Fishery and Commercial Square in East Weymouth, or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was unanimously

ARTICLE 28. (By Direction of the Planning Board and on Request of the South Shore Builders' Association.) To see what action the Town will take to revise the Zoning By-Laws as follows, or to take any action in relation thereto:


Art. X, Sect. III-Business District Uses-Add a new paragraph, No. II, to read: "II. Multiple family dwellings of not more than six families per dwelling."

ARTICLE 29. (By Direction of the Planning Board and on Request of the South Shore Builders Association.) To see what action the Town will take to revise the Zoning By-Laws, as follows, or to take any other action in relation thereto:


Art. X, Sect. I-Establishment of Districts. In the first paragraph to change the word "four" to "five," to delete the term "Residential District" and to substitute therefor "Residenial District A" and "Resi- dential District B" so as to read:


1. Classes of Districts: The Town of Weymouth is hereby divided as shown on the Zoning Map, dated February 1, 1939, as revised and filed with the Town Clerk, in five classes of districts: Residential District A, Residential District B, Business District, Limited Busi- ness Districts, Industrial Districts.


Section II-Resident District Uses. Delete the first paragraph and substitute therefor the following:


Sect. II, 1 (a). Residential District A, detached one-family dwell- ings; 1 (b). Residential District B, multiple family dwellings not to exceed more than six families per dwelling.

Changes of Districts. The following parcels shall hereinafter be classified as Residential District B and all other districts designated as Residential Districts heretofore shall henceforth be classified as Residential District A: (a) Block 120, Lot 15; (b) Block 121, Lots 1, 2, 3, 11 and 13; (c) Block 427, Lots 1, 2, 3, 12, 13, 14 and 15; (d) Block 377, Lots 2 and 16; (e) Block 462, Lots 1 and 17; (f) Block 464, Lots 13 and 19; (g) Block 466, Lots 1 and 2; (h) Block 490, Lot 14; (i) Block 492, Lot 2. To see if the Town will vote to amend the Zoning By-Laws of the Town, having to do with zoning so that the area described substan- tially as set forth below shall be changed from Residential District or Zone to Business District or Zone:


Beginning at a point at the corner of Neck and Shaw Streets, on the Easterly side of Neck Street and running easterly for 474.36 feet to a point at the intersection of Green and Shaw Streets and then running north along Green Street for a distance of 609.52 feet, to a Private Way and then Westerly along the Private Way 82.81 feet to the intersection of Neck Street and then southwesterly along Neck Sreet 471.01 feet to the point of beginning, entire lot comprising 4.33 acres, more or less.

From Business to Industrial, commencing at Commercial Square run- ning northerly on both sides of Commercial Street to the present indus- trial district at the junction of Wharf Street.

To see if the Town will vote to raise and appropriate the sum of $500.00 for the pur- pose of maintaining during the ensuing year, the mosquito control works as estimated and certified to by the State Reclamation Board in accord- ance with the provisions of Chapter 112, Acts of 1931.

To see if the Town will take action to raise and appropriate a sum of money for the purpose of Fluoridation of the Town's Water Supplies; said Fluoridation to be under the control and supervi- sion of the Board of Water Commissioners; or take any other action deemed necessary by the vote of the Town Meeting.
