ARTICLE 17. (At Request of Board of Public Works). To see if the Town will vote to raise and appropriate a sum of money for the con- struction of common sewers and determine whether the money shall be provided for by taxation, by appropriation from available funds including sewer assessment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.

That the sum of $328,500.00 be raised and appropriated for the purpose of constructing common sewers, to be expended under the direction of the Board of Public Works. Of this sum, $28,500.00 shall be raised by Tax Levy and the Treasurer with the approval of the Board of Selectmen, is hereby authorized to borrow a sum not to exceed $300,000.00 for new con- struction and to issue bonds or notes to be payable in accordance with the General Laws (Ter. taxation or otherwise, and appropriate for 50% of the land damage costs in the Pond Meadow area of Braintree for flood control purposes of the Weymouth Landing area, including Smelt Brook area, in conjunction with the Town of Braintree and the Soil Conservation Service of the Federal Government, under Public Law 566; monies to be made available pro- vided proper legislation is enacted as voted under Article 11 of the Special Town Meeting, September 15, 1958; and, provided further, that the Town of Braintree make available a like amount therefor, or take any other action in relation thereto.

To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the De- partment of Public Works of Massachusetts for the improvement develop- ment, maintenance and protection of tidal and non tidal rivers and streams, harbors, tidewaters, for shores and shores along a public beach cutside of Boston Harbor, including the Merrimack and Connecticut Riv- ers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonweatlh, or take any other action in relation thereto.

ADJOURNED ANNUAL TOWN MEETING WEDNESDAY, MARCH 4, 1959


The Adjourned Annual Town Meeting was called to order at 7:45 o'clock in the evening of Wednesday, March 4, 1959, by the Annual Moderator, Mr. Daniel L. O'Donnell.


There were 191 Town Meeting Members present.


Prayer for Divine Guidance was offered by Rev. David Eaton, Pastor of the First Church in Weymouth, Congregational.


There were no Town Meeting Members to be sworn in.


The Moderator declared a quorum present.


We now continue with consideration of the Articles in the Warrant.


MOVED by the Appropriation Committee:


Reconsideration of Article 1.


Vote was taken and the Moderator declared the motion by the Appro- priation Committee LOST.


ARTICLE 20. (At Request of Drainage Committee and Board of Public Works). To see what sum of money the Town will vote to raise and appropriate, by taxation or otherwise, for drainage purposes (for stream improvement) from Weymouth Back River to Whitman's Pond, consisting of flood-flow conduit and channel and work at dams, as recommended by Metcalf and Eddy, Engineers in report to Weymouth Drainage Committee dated March 11, 1957.


That the sum of money named shall be made available only if the

State, under General Laws Chapter 91, will pay a sum of money propor- tionate to the cost of construction under the provisions of said chapter.


Provided further that such work shall be done by private contract under the direction of the Board of Public Works and/or the State De- partment of Public Works.


Also, to see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Board of Public Works to execute and deliver a bond of indemnity therefor to the Com- monwealth; monies to be provided in accordance with Chapter 481, Acts of 1958, Section 1 through 4, or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the Town raise and appropriate the sum of $110,000.00 for drainage purposes and for stream improvements, from Weymouth Back River to Whitman's Pond; consisting of flood-flow conduit and channel and works at dams, bridges, and walls as recom- mended by Metcalf and Eddy, Engineers, in a report to the Weymouth Drainage Committee, dated March 11, 1957. Of the sum appropriated $55,000.00 shall be appropriated from the Excess and Deficiency Account. and 55,000.00 shall be raised and appropriated by Tax Levy.

UNANIMOUSLY VOTED: That the Town vote to raise and appro- priate to the Board of Public Works, the sum of $77,862.64 for drainage improvement purposes in the Mill Street to West Street area, as recom- mended by Metcalf and Eddy, Engineers, in a report to the Weymouth Drainage Committee, dated March 11, 1957, and to meet said appropria- tion $30,000.00 shall be appropriated from the Excess and Deficiency Ac- count, and $25,000.00 shall be raised and appropriated from Tax Levy, and $22,862.64 shall be re-appropriated from the unexpended balance in the following accounts:

That the Town raise and appropriate the sum of $20,000.00 for the continuation of shore protection from the Wessagussett Beach Improve- ment to River and Neck Streets; provided further that an equal sum of money is provided by the State Department of Public Works to be used on the same project. It is further provided that said work be done under the direction of the Board of Public Works and/or the State Department of Public Works. $20,000.00


MOVED the following amendment by Mr. Blaisdell:


That the Town raise and appropriate the sum of $20,000.00 for the continuation of shore protection from the Wessagussett Beach Improve- ment to within 75 yards of the junction of River and Neck Streets.

ARTICLE 27. (At Request of Wessagussett Beach Committee and Board of Public Works.) To see what sum of money the Town will vote to raise by taxation or otherwise and appropriate for the purpose of ac- quiring by gift, purchase, or take by right of eminent domain in fee, Lot 14, Block 22; Lot 3, Block 23; Lot 1, Block 24, and part of Lot 18, Block 26, containing about 525,335 square feet (12 acres) as shown on Sheets 4, 5 and 7 of the Atlas of the Town of Weymouth, dated January 1, 1958, as a site for a municipal parking area for Wessagussett Beach, or take any other action in relation thereto.


MOVED by the Appropriation Committee:


That the Town vote to take by purchase, gift, or by Right of Eminent Domain in fee, together with all rights therein, Lot 14, Block 22; Lot 3, Block 23; Lot 1, Block 24; and part of Lot 18, Block 26, containing about 525,335 sq. ft., (12 acres) as shown on Sheets 4, 5 and 7 of the Atlas of the Town of Weymouth, dated January 1, 1958, and being more fully shown on a plan drawn by Frank S. UNANIMOUSLY VOTED: That the Town vote to raise and appro- priate the sum of $20,000.00 for Dutch Elm Disease Control under the requirements of Chapter 132 of the General Laws as most recently amended by Chapter 657, of the Acts of 1956, said sum to be expended under the direction of the Board of Public Works. $20,000.00

To see what sum of money the Town will raise and appropriate for the development and construction of additional well fields, including wells, pumping sta- tion, pipes and original pumping station equipment for the purpose of an emergency water supply; and further, that said sum shall include the in- stallation of a pipe line from the well to Pleasant and/or Middle Streets, all to be located on lands and roadways acquired under Article 10 of this Town Meeting, as located on Plan by Town Engineer entitled "Plan of Land for Well Location for Water Supply", or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the sum of $90,000.00 be raised and appropriated for the development and construction of additional well fields, including wells, pumping stations, pipes and original pumping sta- tion equipment for the purpose of an emergency water supply and, further, that said sum shall include the installation of a pipe line of not less than 6" in diameter from the well to Pleasant and/or Middle Streets, all to be located on lands and roadways acquired under Article 30 of this Town Meeting, as located on a plan entitled "Plan of Land for Well Location for Water Supply" by Frank S. Lagrotteria, Town Engineer, filed with the Town Clerk. And to meet said appropriation, the Treasurer, with the approval of the Board of Selectmen, be and hereby is authorized to bor-

ARTICLE 32. (By Request of Board of Public Works and Civil De- fense). To see what sum of money the Town will raise and appropriate for the purchase of radio equipment to be installed in Public Works equip- ment, said sum of money to be matched by Federal Civil Defense funds, or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the Town raise and appropriate to the Board of Public Works the sum of $7,000.00 from Tax Levy for the pur- chase of radio equipment to be installed in Public Works Equipment, said sum of money to be matched by Federal Civil Defense funds. $7,000.00


ARTICLE 33. (By Direction of Selectmen). To see if the Town will vote to take a portion of Lot 38, Block 276, Sheet 20, known as Weston Park, Broad Street, Weymouth Landing, for parking facilities for Lincoln Square, or take any other action in relation thereto.

That the town vote to transfer to the authority and supervision of the Trustees of Tufts Library of the Town of Weymouth to be used for library and parking facilities a portion of Lot 38, Block 276, Sheet 20 of the Town of Weymouth Atlas, corrected to January 1, 1958, known as Weston Park, Broad Street, Weymouth, containing approximately 86,000 square feet, and further identified as follows: The land shown on a certain plan entitled "Plan of Subdivision of land in Weymouth, Mass.
