Our cover this year graphically depicts a new adventure in the life of Scituate, caused when the great storm of March 16-17, 1956, cast upon Cedar Point this hapless Italian freighter. After successive attempts at refloating, the tremendous engineering achievement was accomplished on Thanksgiving afternoon, Novem- ber 22, 1956. This ship, named the Etrusco, was towed to drydock for repairs and on December 19, 1956, was rechristened the "SS. Scituate" in honor of the Town who played host to many thousands of sightseers during this reluctant visit.

REPORT OF THE BOARD OF SELECTMEN


To the Citizens of Scituate:


The past year was a progressive one for the Town of Scituate. Only through the combined efforts of your Board of Selectmen and other Town Officials were solutions found to the many problems which arose.


Early in the year Sections 56 through 59 of Chapter 32 of the General Laws were accepted for the Town by your Board of Selectmen. This authorized certain retirement benefits to veterans of the Armed Forces, which previously had been denied to them.


In March, of course, the Etrusco came ashore on Cedar Point. The presence of the vessel posed many problems to the Town. Immediately regulations and conditions were set up by the Select- men to protect the interests of all concerned. Several meetings and conferences were held with the owners of the ship, resulting in the acceptance of the Town's regulations, including the posting of an adequate bond to insure that the Town was fully protected.


Several hearings on applications for liquor licenses were con- ducted by the Board, thereby giving all concerned an opportunity to present their views. Hearings of this sort are not compulsory, but it is felt by your Board of Selectmen that they are desirable.


In connection with this, a complete survey was made of the fees charged for Liquor Licenses with the result that the fee for all types was increased, bringing additional revenue to the Town.


The mosquito and midge nuisance became a serious problem during the year, particularly in the Musquashiat Pond area. With the co-operation of the State Reclamation Board and the South Shore Mosquito Control Project, the Pond was sprayed at least three times, but with varying degrees of success. However, through the continued efforts of your Board of Selectmen, entailing several meetings with State Officials, the dredging and drainage of the Pond is now fast becoming a reality.


For the further protection of the citizens, two Police Officers and three Firefighters were appointed, all with the full co-operation of the Police and Fire Chiefs.


The Selectmen have inserted an Article in the Warrant of the March 4, 1957 Town Meeting requesting funds to improve the Town owned parking area off Jericho Road, overlooking beautiful Scituate Harbor. This is one of the few locations that are available to park and enjoy the beauty of the Harbor. Included in the im-

provements are grading, resurfacing and the planting of trees along the roadside. Also, it is planned, if voted, to construct a suitable launchway for the use of boat owners. It is the sincere hope of the Board that this Article is acted upon favorably.


Various meetings with the Selectmen of Norwell and Marsh- field were held for the purpose of promulgating Rules and Regu- lations for the usage of boats on the North and South Rivers, as well as for Scituate Harbor. It might be pointed out at this time that Scituate took the initiative in this respect, and was the first Town to approach the problem in an objective manner. The result was the filing of a Bill in the State Legislature, seeking authority to enforce Rules and Regulations governing the speed and handling of boats in the waters of Norwell, Marshfield and Scituate. The coming boating season should see a marked improvement in this respect as a direct result of the efforts of your Board of Selectmen.


The property off Hatherly Road at Egypt Beach has been taken by eminent domain to provide additional bathing and park- ing facilities for the residents of Scituate. It is hoped that this action will result in more people being given access to the use of the ocean for bathing.


Several inspections of the seawalls have been made, and many additions and repairs have been requested of the Massachusetts Division of Waterways. To implement this vital work, an Article has been inserted in the Annual Warrant requesting the appropria- tion of $50,000.00 to be used in conjunction with matching funds from the State and County.


The Board has inserted Articles for the acceptance of several streets by the Town as Town Ways. These Articles are the direct result of petitions received, and are being submitted for the voters consideration.


A committee was appointed to oppose the proposed abandon- ment of the Old Colony Branch of the New York, New Haven and Hartford Railroad. This committee attended all hearings and voiced their opposition to the discontinuance of service.


In closing, your Board of Selectmen has made every effort to handle satisfactorily all requests, and we wish to thank all citizens and Town Departments for the co-operation received during the year.

At a legal meeting of the inhabitants of the Town of Scituate, qualified to vote in Elections and Town Affairs, held at the High School Gymnasium in said Scituate on Monday, the fifth day of March, 1956 at 7 o'clock P.M .; order was called by Moderator Philip S. Bailey.

ARTICLE 3


To see if the Town pursuant to the authority contained in Section 108A of Chapter 41 of the General Laws, will vote to amend the By-Laws by adding a Classification and Salary Plan as follows:


Town of Scituate Classification and Salary Plan


PART I- GENERAL


Section 1. TITLE.


The Classification of Positions and Pay Schedules appended hereto and the provisions of this By-Law shall be the Classification and Salary Plan (hereinafter referred to as the Plan) for the payment of salaries and wages to the employees of the Town of Scituate covered by the Plan.


Section 2. COVERAGE.


The provisions of this By-Law shall apply to all positions in the employ of the Town, except (1) those filled by general election, (2) those under the control of the School Committee, (3) part time professional services which are more appropriately contracted for on either a fee or a contractual basis, (4) part time or intermittent official, executive, or other services for which the compensation paid, if any, represents an honorarium rather than actual pay for services rendered, or work performed. Nothing herein, however, shall bar reference to the Plan for assistance in determining the compensation of employees not covered by the Plan.


Section 3. TITLES OF POSITIONS.


The title of each classification shall be the official title for all purposes having to do with the position as such, and shall be used to designate the position in all payrolls, budget estimates, and official records and reports, and in every connection involving per- sonnel and fiscal processes, but any abbreviation or code symbol approved by the Personnel Board may be used in lieu of the title to designate the classification in any such connection.


(a) Position titles shall be interpreted as descriptive only and not restrictive. They shall be construed solely as a means of distinguishing one position from another and not as pre-

scribing what the duties or responsibilities of any position shall be, or, as modifying, or in any way affecting, the power of any administrative authority, as otherwise existing, to ap- point, to assign duties to, or to direct and control the work of, any employee under the jurisdiction of such authority.


Section 4. RECORDS.


The Town Accountant shall keep such records of all employees of the Town, including the name, age, date of employment, classi- fication, department in which employed, and other information as the Personnel Board shall deem necessary. Department Heads shall furnish such information as shall be requested for this pur- pose.


Section 5. CONFLICTING BY-LAWS


All By-Laws or parts of By-Laws in conflict with this By-Law are hereby repealed.


Section 6. INVALIDITY.


If any section, subsection, sentence, clause, phrase, or figure of this By-Law is for any reason held to be unconstitutional or invalid, such decision and invalidity or voidance shall not affect the validity of the remaining portions of this By-Law. The Town Meeting hereby declares, that it would have passed this By-Law and each section, subsection, sentence, clause, phrase, or figure thereof even if it had known that any one or more sections, sub- sections, sentences, clauses, phrases, or figures shall be declared unconstitutional or void.


Section 7. BUDGETS.


Each Department Head shall include in the departmental budget a Pay Adjustment Section, to provide funds for anticipated pay adjustments during the year, expenditures to be made there- from only in accordance with the Salary Plan with the approval of the Personnel Board.


Section 8. CIVIL SERVICE.


Nothing in this By-Law shall be construed to conflict with Chapter 31 of the General Laws.


Section 9. EFFECTIVE DATE.


Except as otherwise specified herein, this By-Law shall take effect January 1, 1956.


Section 10. AMENDMENT.


This By-Law may be amended by vote of the Town at any regu- lar or special Town Meeting.

PART II - PERSONNEL BOARD


Section 11. THE PERSONNEL BOARD.


There shall be a Personnel Board serving without compensa- tion consisting of five (5) persons responsible for the administration and maintenance of the Classification and Pay Plan. The member- ship of the Personnel Board shall be as follows: five (5) members to be appointed by the Moderator, two (2) to serve for one year, two (2) to serve for two (2) years, and one (1) to serve for three (3) years; at the expiration of each term of office, appointments thereafter shall be for a three (3) year term. In the event of a vacancy occurring in the membership of the Personnel Board, the position shall be filled in the same manner as in the original method of selection and for the remainder of such unexpired term of office. The members of the Personnel Board shall not be employees or elected officials of the Town. The Board shall elect a chairman from its membership who shall have the power to call meetings and who shall preside over such meetings. Any three (3) members shall constitute a quorum for transaction of business. A majority vote of such a board shall prevail unless there be a bare quorum, in which event there must be a unanimous vote. The initial Board shall be appointed within fifteen. (15) days of the adoption of this By-Law. Each term of office shall expire on April 1st, except that an incumbent shall continue to serve until his successor is appointed.


Section 12. DUTIES OF PERSONNEL BOARD.


(a) Administration. The Personnel Board shall administer the Plan, establishing only such policies, procedures and regulations as may be consistent with the administration of the Plan.


(b) Job Descriptions. The Board shall maintain written de- scriptions of the jobs or positions in the Plan describing the essential characteristics, requirements and general duties. The descriptions shall not be interpreted as complete or limiting definitions and employees shall continue to perform any duties assigned by their superiors.


(c) Salary and Wage Review. The Board shall, from time to time, not to exceed three years, review the wage and salary schedules and the duties of all positions subject to the Plan. It shall keep informed as to pay rates and policies outside the service of the Town, and be in a position to recommend to the Town any action deemed desirable to maintain a fair and equitable pay level.


(d) Job Review. The Personnel Board shall review the work of all employees subject to the Plan at intervals of not more than

three years. The Board upon presentation of substantiating data, may add a new position, tentatively, to the classification schedule, or reclassify an existing position group, subject to the subsequent ratification of its action by formal amendment of this by-law by vote of the Town at Town Meeting.


(e) Reports. The Personnel Board shall, when deemed nec- essary, in advance of each annual Town Meeting at which recom- mendations of the Board will be considered, prepare a printed report for the information of Town Meeting and town employees. The Personnel Board shall make an annual report in writing to the Board of Selectmen on or before January 15, of each year.


PART III - SALARY PLAN


Section 13. GENERAL.


(a) All present employees in the Classification Plan who are rendering satisfactory service in the opinion of their Department Head shall be compensated according to the official Pay Plan.


(b) No pay shall be reduced as a result of the installation of this Plan. Any existing rates above the maximum shall become Personal Rates and apply only to the present incumbent. Such rates are not subject to automatic changes until such time as these rates conform to the Pay Plan or until such time as the position is vacated. When the incumbent leaves the employ of the Town, or is transferred to another job, the rate shall disappear. No other employee assigned to, or hired, for the job shall advance beyond the maximum of the job.


(c) Employees in the continuous full-time service of the Town, who have a satisfactory performance record, shall be eligible for an advance of one step-rate per year (the year to be counted from the date of the latest increase) , but not more, until the maximum for their job is reached, subject to the approval of their Depart- ment Head and the Personnel Board. Any employee denied such an increase has the right of appeal to the Personnel Board, which will confer with both the employee and the Department Head. All adjustments shall be approved in advance by the Personnel Board.


(d) Progressions through the rate ranges are not mandatory and shall be on the basis of merit and ability on recommendation of the Department Head.


(e) When an employee is promoted to a higher rated job, he shall enter at the minimum of the job rate range or at his own rate,

whichever is the higher. He may also receive a one step-rate increase at the time, if the Department Head feels that qualifications and performance warrant it, and the Personnel Board approves.


(f) The Personnel Board shall be notified of all requisitions for persons to fill positions or perform duties subject to the Classi- fication Plan and shall advise upon the appropriate classification to which such persons shall be assigned.


(g) The hiring rate shall be the minimum of the rate range of the job for which the new employee is hired, unless otherwise authorized by the Personnel Board. The first six months of em- ployment shall be a probationary period, at the end of which the Department Head may decide whether his performance warrants continued employment.


(h) The Personnel Board shall have the right to establish the salary schedule which shall be paid in a new position title neces- sary to the conduct of the business of the Town.


(i) The official Pay Plan, when established by the vote of the Town, shall consist of:


1. Minimum and maximum salaries to be paid for each position included in the Classification Plan, and


2. Designated step-rate increases for such salary ranges as shall, from time to time, be established by vote of the Town.


Section 14. VACATIONS.


To establish a uniform vacation policy throughout the Town, the following annual vacations with pay will be granted after the following periods of full-time continuous employment: 1 week after 6 months; 2 weeks after 1 year; 3 weeks after 10 years; and 4 weeks after 20 years.


In the case of nurses and the Library staff, the Personnel Board may establish a vacation program in accordance with the general custom of such professional groups. Details of vacation practices for the several departments shall be worked out under the direction of the Personnel Board.


Vacations with pay shall not be granted to temporary em- ployees. Vacations shall not be cumulative from year to year. No additional vacation shall be allowed because of a holiday in the vacation period.

TOWN CLERK'S REPORT


Section 15. PAID HOLIDAYS.


Regular employees shall be paid for each of the following holidays which fall on or are observed on a regularly scheduled work day:


New Year's Day


Washington's Birthday


Patriot's Day Decoration Day Independence Day


Labor Day


Columbus Day


Thanksgiving Day Veteran's Day Christmas Day


Regular employees of the Police and Fire Departments other than the Chiefs thereof required to work on any of the above specified holidays shall be paid on the basis of straight time in addition to the regular pay for that day, or, in the discretion of the Chief, may be given equivalent time off.
