ARTICLE 33


Will the Town appropriate the sum of twelve hundred dollars ($1,200.00) to May Futrelle, to compensate for her land at Edward Foster Road and Bridge Avenue, covering an area of approxi- mately 6400 square feet, taken by eminent domain in Article 31 in the Town Warrant of 1937. No compensation has ever been paid to her for this land.

ARTICLE 34


Will the Town vote to authorize the Board of Water Com- missioners to take by eminent domain, under Chapter seventy- nine, or Chapter eighty A, or acquire by lease, purchase, gift, devise or otherwise, and hold, all lands, rights of way, and other easements necessary for collecting, storing, holding, purifying and treating water developed by means of driven, artesian or other wells, and protecting and preserving the purity thereof, and for conveying the same to a connection with the mains in the Town of Scituate; provided, that no source of water supply and no lands necessary for preserving and protecting the purity of the water shall be taken or used under authority of this Article without first obtaining the advice and approval of the Department of Public Health, and that the arrangement and location of all wells, reservoirs, filtration and pumping plants or other works necessary in carrying out the provisions of this Article shall be subject to the approval of said Department, for procurement of additional water supply for the Town of Scituate. Said water supply to be developed as required by the Board of Water Commissioners. All lands, rights of way or other easements, now owned by the Brockton Edison Co., as shown on Plan, titled "Brockton Edison Well Field," on file with the Town Clerk, and raise and appropriate the sum of Eight Hundred Dollars ($800.00) therefor, or take any action relative thereto.


VOTED: That the Board of Water Commissioners be auth- orized to take by eminent domain, under Chapter 79, or Chapter 80A, or acquire by lease, purchase, gift, devise or otherwise, and hold, all lands, rights of way and other easements necessary for collecting, storing, holding, purifying and treating water developed

by means of driven, artesian or other wells, and protecting and pre- serving the purity thereof, and for conveying the same to a con- nection with the mains in the Town of Scituate; provided, that no source of water supply and no lands necessary for preserving and protecting the purity of the water shall be taken or used under authority of this Article without first obtaining the advice and approval of the Department of Public Health, and that the arrange- ment and location of all wells, reservoirs, filtration and pumping plants or other works necessary in carrying out the provisions of this Article shall be subject to the approval of said Department, for procurement of additional water supply in the Town of Scitu- ate. ARTICLE 35


To see if the Town will raise and appropriate by taxation or otherwise, a sum of $24,200.00 for the construction of a gravel- packed well, a pumping station with necessary machinery on the land acquired under Article 34, and lay a water main to and con- necting with, the present water system by the Water Department, or take any action thereon.

To see if the Town will raise and appropriate the sum of $3,000.00 for drainage and improvement of the Town owned parking area in the vicinity of the North Scituate railroad station.

L. and authorize the Selectmen to execute and deliver a bond of indemnity there- for to the Commonwealth.

ARTICLE 44


To see if the Town will raise and appropriate or transfer from available funds a sum of money for the procurement of plans specifications, and working drawings for elementary school hous- ing, and to receive bids to be opened and submitted for approval at the next annual or a future Town Meeting.

ARTICLE 45


To see if the Town will appoint a School Building Committee composed of the present Primary School Building Committee as follows: Jackson E. Bailey, appointed by the Selectmen; Edward S. Rand, appointed by the Planning Board; Nels H. Sandberg, appointed by the School Committee; Lester J. Gates, appointed by the Advisory Board; Arthur J. Gartland, appointed by the Parent- Teacher Association; Harvey A. Taylor, appointed by the Select- men; and Rose M. Trefry, appointed by the Scituate Teachers' Association, to function as the building committee for future school house construction, to authorize it to carry out the intent of Article 44, and, in the event of the inability of any of the mem- bers named above to serve, replacements shall be named by the organization which named the original member.


VOTED: To so appoint a School Building Committee. Unan- imous vote.

ARTICLE 46


Will the Town vote to convey to Kenneth H. Gauley and Ruth F. Gauley any rights, title and interest it may have in and to a twenty foot right of way referred to in a deed from Margaret J. Cole et. al. to the Scituate Water Company dated October 27, 1926 and recorded with Plymouth Registry of Deeds in Book 1571 Page 143 in return for a deed from said Gauleys to the Town of Scituate granting it a right of way over Eisenhower Lane from County Way westerly approximately 600 feet, thence over a forty foot unnamed way leading northerly from Eisenhower Lane ap- proximately 270 feet, thence over a twenty foot right of way northerly and northwesterly to land of the Town of Scituate, all as being shown on a plan entitled "Plan of Houselots in Scituate, Massachu- setts owned by Kenneth H. Gauley." dated November 15, 1954, and drawn on a scale of 50 feet to an inch by Stenbeck and Taylor Surveyors, said plan was approved by the Scituate Planning Board November 28, 1954, or take any action thereon.


VOTED: That the Town convey to Kenneth H. Gauley and Ruth F. Gauley any rights, title and interest it may have in and to a twenty foot right of way referred to in a deed from Margaret J. ARTICLE 47


To see if the Town will vote to increase the number of mem- bers of the Board of Selectmen from three to five, so that in the year 1956, one Selectman will be elected for one year, one for two years, and one for three years, or take any action in relation thereto.


VOTED: That the Moderator shall name a five-man committee to make a study of the proposal contained in Article 47 of the 1955 Town Meeting to increase the Board of Selectmen from three to five members and report not later than the next annual

ARTICLE 48


Will the Town vote to accept Section 59 of Chapter 33, of the G. L., which provides that any person in the service of the Commonwealth, or of a county, city or town which, by vote of its county commissioners or city council or of its inhabitants at a town meeting, accepts this section, or has accepted similar pro- visions of carlier laws, shall be entitled, during the time of his service in the armed forces of the Commonwealth, under section thirty-eight, forty, forty-one, forty-two, or sixty, or during his annual tour of duty of not exceeding fifteen days as a member of a reserve component of the armed forces of the United States, to receive pay therefor, without loss of his ordinary remuneration as an employee or official of the Commonwealth, or of such county, city or town, and shall also be entitled to the same leaves of absence or vacation with pay given to other like employees or officials.

ARTICLE 49


Will the Town vote to authorize the Selectmen to file a petition with the House of Representatives of the Commonwealth of Massa- chusetts to obtain authorization for the Town to pay Antonio C. Lopes of said Town, the husband of Mamie B. Lopes, in reimburse- ment for the expenses for medical and hospital care and funeral expenses incurred by him on account of the injuries which later resulted in death, sustained by his wife Mamie B. Lopes, as a result of falling into a fire on the town dump in said Town, the sum of $1,656.52.


VOTED: To so instruct the Selectmen. Unanimous vote.


ARTICLE 50


Will the Town vote to amend its By-Laws by adding the fol- lowing, to become effective upon approval by the Attorney General: No person shall be reimbursed by the Town for telephone service, except for necessary telephone service made in connection with town business made from points within the town to points out- side the Town (hereinafter called outside service), and evidenced by voucher properly presented to the Town, showing the cost of such outside service.

Will the Town vote to raise and appropriate the sum of $208.40 to purchase a parcel of land at the westerly end of Beal Place, containing 2084 square feet (by calculation); said parcel to be used as a highway turn-around, or take any action thereon.


VOTED: That the Town raise and appropriate the sum of $208.40 to purchase from Fred T. Waterman a parcel of land at the westerly end of Beal Place, containing 2084 square feet (by calculation); said land to be used as a highway turnaround. Unani- mous vote.


ARTICLE 52


Will the Town vote to amend the Zoning By-Laws by striking out the provisions of Sections 1, 3, 4 and 5 and substituting Sections 1, 3, 4 and 5 and amending Section 6-1 all as follows:


SECTION 1


ESTABLISHMENT OF ZONES


1-1. Types of Zones


For the purpose of this by-law, the Town of Scituate is hereby divided into six types of zones, designated as:


"A-1" (Residence 40,000 sq. ft.)


"A-2" (Residence 20,000 sq. ft.)


"A-3" (Residence 10,000 sq. ft.)


"B-1" (Limited Business)


"B" (General Business)


"C" (Commercial)


1-2. Location of Zones


Zones "A-1," "A-2," "A-3" and existing "B" areas are located and bounded as shown on a map entitled "Supplementary Zoning Map,' dated May 18, 1953, signed by the Planning Board, and filed in the Office of the Town Clerk, which map, together with all explanatory matter thereon, is hereby incorporated in and made a part of this by-law; zones "B-1," "C" and additional or revised as "B," "A-1," "A-2" or "A-3" zones will be shown on said map, as any such area or areas may be made subject to vote of the Town at any annual or special Town Meeting.

SECTION 3. USE REGULATIONS


3-1. Application of Use Regulations.


No building or structure, and no alteration, enlargement or extension of any existing building or structure shall be designed, arranged or constructed, and no land, building, structure or part thereof shall be used for any purpose or in any manner other than for one or more of the uses specifically permitted herein.


3-2. Residence Zone Uses.


A. Permitted uses.


In a "A-1," "A-2" and "A-3" zone the following uses are per- mitted as of right.


(1) Single family detached dwelling with not more than one single dwelling located on any lot.


(2) Church, parish home, rectory or convent.


(3) Religious, sectarian or denominational educational use.


(4) Public school, or private school offering general educational courses.


(5) Public or non-profit library, museum, art gallery or civic center.


(6) Public administration building, fire or police station.


(7) Public recreation or water supply usc.


(8) Country club, yacht club, lodge building, or other non-profit social, civic or recreational use but not including any use the chief activity of which is one customarily conducted as a business.


(9) Orchard, truck garden, nursery or similar open use of land for the raising of agriculture or horticultural crops.


(10) Commercial dairy, poultry or livestock farm on a lot contain- ing three acres or more (but not including a piggery, com- mercial kennel, or fur farm), provided that any building in which poultry or livestock are housed is not less than fifty feet from side and rear lot lines.


(11) The alteration of a single family dwelling existing at the time this by-law is adopted to accommodate two families if located on a lot having an area not less than twice that required for the erection of a single family dwelling in the same zone, pro- vided that no exterior change is made which alters the single family character of the dwelling.


(12) Accessory use as hercinafter limited and defined.

B. Uses Permissable on Appeal.


In an "A-1," "A-2," and "A-3" zone, the following additional uses are permitted if authorized by the Board of Appeals:


(1) Nursing School or other agency for day care of children or private organized camp.


(2) Rest home, convalescent or nursing home.


(3) Cemetery, hospital, sanitorium, philanthropic or charitable in- situation (but not including a correctional institution.)


(4) Commercial livery or mooring for marine pleasure craft with no fueling or repair services.


(5) Commercial golf course but not including a golf driving range or miniature golf course.)


(6) Tourist home, boarding or lodging house.


(7) Private Garage for more than three automobiles.


(8) Commercial greenhouse, provided that such building and any heating plant accessory thereto, is not less than fifty feet from side and rear lot lines.


(9) Salesroom or stand for the display and sale of agricultural or horticultural products the major portion of which are grown on the premises provided that no such products are displayed within 30 feet of any street or lot line.


(10) Removal of sod, loam, sand, gravel or other earth products from the premises (except where permitted as an accessory use), pro- vided that within two years after authorization for such use by the Board of Appeals, all removal operations are terminated and the premises graded and planted to suitable cover, in a manner specified by said Board.


(11) Airport, airpark or landing field (whether public, private, or accessory to a dwelling), provided that any building, structure or ground area so used is not less than two hundred feet from side and rear lot lines and one hundred feet from any street line.


(12) Riding academy on a lot containing three acres or more, pro- vided that any building in which horses are housed and any riding ring is not less than fifty feet from side and rear lot lines.


(13) Any public use (including a public utility or communications use) not hereinbefore specifically listed which is necessary for the service of the vicinity, or which requires a location within the zones for reasons of space or function.

3-3. Limited Business Zone Uses.


A. Permitted Uses.


In a "B-1" zone, the following uses are permitted as of right.


(1) Any of the uses permitted as of right in "A-1," "A-2," and "A-3" (Residence) zones, subject to the same conditions as therein specified.


(2) Any of the following retail businesses: book, stationery or news store, cigar store, drug store, delicatessen, dry goods or variety store, florist, or gift shop, fruit or grocery store, hadware store, jewelry store, meat market, or wearing apparel store.


(3) Any of the following personal or consumer service establish- ments: Barber or beauty shop, collection station for laundry or dry cleaning, frozen food locker, hand or self-service laundry, photographic studio, shoe or hat repair shop, shop for custom work by a dressmaker, milliner or tailor.
