of the warrant for the Annual Town Meeting of 1959 to contract for the construction of said building and the purchase of said equipment and fur- nishings, and to engage such professional services as the committee deems necessary, and to raise and appropriate therefor, by taxation or transfer, a sufficient sum of money, and/or to authorize the treasurer, with the approval of the Board of Selectmen, to borrow and issue notes or bonds of the town therefor, under Chapter 645 of the Acts of 1948, as amended; and to take any other action relative thereto. - West Side Elementary School Building Committee.


On motion by Finance Committee:


Voted: To construct a new elementary school building, including original equipment and furnishings, said school building to be located on the property acquired by the town for school purposes under the vote on Article 15 of the warrant for the Annual Town Meeting of 1958, and to authorize and instruct the committee appointed under Article 23 of the warrant for the Annual Town Meeting of 1959 to contract for the con- struction of said building and the purchase of said equipment and fur- nishings, and to engage such professional services as the committee deems necessary, by transfer from the Excess and Deficiency Account the sum of $120,000 and further appropriate by transfer from the Stabilization Fund created under the provisions of Chapter 40, Section 5B, the sum of $138,500 and to authorize the Treasurer, with the approval of the Board of Selectmen, to borrow the sum of $100,000 and issue notes or bonds of the town therefor, payable in annual installments within 10 years from their dates or at such earlier time as the Treasurer and Selectmen may determine, under the provisions of Chap. 645 of the Acts of 1948 as amended.


The vote in the affirmative was: YES, 389 - NO, 86, and, having re- ceived the necessary two-thirds vote, the Moderator declared the motion passed.


At this time, William K. Lawrence, Chairman of the Finance Com- mittee, notified the meeting of his intention to move for reconsideration of the vote under Article 4.

To see if the Town will vote (1) to terminate coverage of Town em- ployees under the Workmen's Compensation Act, so-called, as voted under

Article 56 of the Annual Town Meeting of 1947, and (2) to raise and appropriate a sufficient sum of money for the purpose of self-insurance by the Town, of the employees now covered under the provisions of said Workmen's Compensation Act. - Board of Selectmen.


Julius Horovitz, speaking, stated that, in his opinion, the subject matter of the article was illegal.


Frederick A. Beyer, Jr., read the report of the Finance Committee.


Walter J. Hunt, of 59 Salem Street, moved that the Moderator direct the Town Counsel to render an opinion on the authority of the Town Meeting to conduct a secret ballot on this appropriation, and such other financial or important matters that may come before the Town Meeting from time to time.


The Moderator stated he would accept the motion as it applied to Article 16 only.


Mr. Hunt, later, withdrew the motion.

That the Town raise and appropriate the sum of $9,000 to provide for the self insurance of employees presently covered under the provisions of the Workmen's Compensation Insurance Account.
