2. The Outboard Club has permanent float privileges for two (2) tenders which are to be tied to the back of the Town Pier Float.


3. All craft entering Plymouth Harbor are subject to the direction of the Harbor Master who should be consulted before anchoring or tying up to any of the facilities or moorings.


4. All draggers while moored at docks shall have their trawl boards swung inside rails at all times.

5. Boat moorings cannot be rented by owners and are assignable when not in use only by the Harbor Master.


6. Boats shall not be tied to docks in dead storage for over four (4) weeks time, after which, upon notice from the Harbor Master, they shall be removed.


E. Float and Pier Rules


1. No fishing gear, equipment, or any other matter shall be allowed to remain on the docks or floats for over twenty-four (24) hours without permission of the Harbor Master.


2. No swimming will be allowed from the State Pier, Town Pier, or Floats attached to Public Docks in Plymouth Harbor.


3. There will be no soliciting from Town-owned Floats.


F. Conducts


1. Noise


a. Unmuffled noise from engines, outboards, ampli- fying systems, radios and the like shall be kept at a minimum when in the proximity of piers, floats or yacht anchorages.


2. Negligent Operation


a. No person shall operate any motorboat or any vessel in a reckless or negligent manner so as to endanger the life, safety, or property of any person.


II. MOORING REGULATIONS


A. Applications


1. Applications for permanent mooring space in all areas shall be dated, signed and filed with the Harbor Master. Permits will be granted by the Harbor Master in the order of application dated as locations become available. If the Harbor Mas- ter denies a mooring application, and the applicant can show just cause, he may request and receive

a hearing from the Board of Selectmen on his rights to have a mooring in Plymouth Harbor. All future moorings will be assigned a suitable space in accordance with the requirements of the boats: that is, length, draft, type or rig: and shall be placed at a locus designated by the Harbor Mas- ter. A mooring space relinquished for any reason by any boat owner immediately voids all rights to that mooring space.


Mooring space is not transferable to a new owner when a boat is sold.

e. Boats moored on flats at 2.0' below Mean Low Water shall have their moorings completely buried with the eye of the block or mushroom at least 6" below level surface of the surround- ing flat.


B. 3. Special Areas: Moorings in channels, Hobs Hole, Saquish Head, Goose Point, Cordage Channel or equivalent tidal condition area.


a. Present moorings may stay at existing overall scope. If the Harbor conditions in these areas become congested in the future, moorings shall be shortened in these tidal areas with chain 2' above Mean High Water and the length of Pen- nant equal to length of. boat.


b. Special area moorings for small boats inside the Plymouth Town Wharf Basin and directly op- posite the westerly jetty are to have the follow- ing regulations:


Moorings-To be spaced 20' apart and to have an overall length of scope of 14' from exposed flat to the bow chock of the boat.

4. All Areas


a. Spars of present owners shall be upright at all times, at any period of tide, not less than 45° , and shall have a minimum exposed length of 24" above any tide level at all times.

b. All spars, cans, balls or styrene or equivalent chain flotation buoys shall be plainly and clearly visible above any tide level at all times.


c. The above described moorings shall be painted white, with a Blue Band, owner's or boat name, and length of boat on spar, can or buoy; also owner's name on mooring block or mushroom anchor.


d. All new complete moorings placed or replaced in any location in Plymouth Harbor after April 1, 1963 shall conform to the regulations; and will be placed at a locus designated by the Harbor Mas- ter.


e. Where winter spars or buoys are used, they shall be clearly visible or marked at all times except during ice conditions.


f. Winter spars or buoys shall not be installed prior to September 15th and must be removed by June 1st.


g. The Harbor' Master will inspect all moorings monthly, commencing June 1st through Septem- ber 1st of each year for flotation of cans, spars, balls or buoys, and notify owners in writing by Certified Mail if their cans, spars, balls or buoys do not conform with the Plymouth Harbor Mooring Regulations.


h. All pennants shall be nylon or equivalent with adequate mooring devices, approved by the Har- bor Master, to eliminate the hazard of chaffing. These will be checked annually by the Harbor Master. Certificates of inspection for defective moorings will be made by the Harbor Master and a copy held in his files showing conditions at the time of inspection.


i. Owners with defective moorings shall be allowed seven (7) days after receiving notice from the Harbor Master to correct the defective condi- tions. If the defect is not corrected after this time, the owner will be subject to penalty in

conformance with the Code. The Harbor Master, upon finding a defective mooring, shall properly mark said mooring to show danger or obstruction.


j. The Harbor Master shall order owners of moorings to have said moorings lifted, at owners expense, once each five (5) years for visual inspection by the Harbor Master to determine its condition. In lieu of lifting moorings, replacements may be made. Upon certification of moorings' fitness or replacement, owner may replace mooring at orig- inal locus.


k. The Harbor Master shall keep a detailed descrip- tion of all moorings, their locus and owner's name, telephone number, home and business address, date of mooring and the length and rig of the boat.


III CODE


A. Penalties


1. A fine not to exceed $20.00 may be imposed for first offense infractions or disobedience to this Code of Regulations when State or Federal penal- ties do not apply. All other fines that are ap- plicable are defined in Chapter 40 Section 21, Gen- eral Laws.


2. Offenders will be prosecuted by the Harbor Mas- ter and all other enforcement agents.


3. Any individual violating any of the preceding rules, regulations, by-laws, or orders, may be cause for the Harbor Master's refusal to allow said individual with his vessel or craft from the harbor for such period of time as may be deter- mined by the Harbor Master or the Board of Selectmen together with the necessary court ac- tion in cases of violation of the Motor Boat Law.

IV. PROPOSED RECOMMENDATIONS


A. Harbor regulations will be effective as specified in Chapter 40 Section 32, General Laws, and publicized by the Town Clerk.


B. A floating speed regulation sign reading "Speed Limit - 6 M.P.H." will be moored on the west side of the channel, 1000 feet southwest of Red Nun #14. A sign reading "Welcome to Plymouth. Watch Your Wake at All Times" will be placed at the entrance of the Harbor, locus about 1000 feet north of Nun #8. These signs will be moored at these locations from June 1st to October 1st of each year.


C. All boats moored in dredged areas of Plymouth Har- bor will pay an annual mooring fee for the privilege of maintaining a boat mooring in these areas. The fee will be 50¢ per foot measured from the stem in a straight line aft to the stern. Booms, boomkins or pulpits are exempt from this measurement.


D. Commercial interests, party boats, fishing boats, As- sociations or Companies using the Town Pier for per- manent moorings, float access, or gangways will pay an annual fee fairly determined by the Board of Selectmen.


E. The Harbor Master's duties should be confined to Plymouth Harbor as it is defined by the U. S. Gov- ernment.
