Section 12. Fringe Benefits and Working Conditions
(a) Pursuant to the authority contained in Section 108C of Chapter 41 of the General Laws, certain fringe benefits as set forth in subsequent sections of this by-law are hereby granted to employees occupying positions in the classification plan. The fringe benefits are considered to be a part of the compensation plan and the monetary value thereof shall be extended to eligible employees in addition to rates set forth in the appropriate salary or wage schedule.
(b) Additional fringe benefits and/or working conditions may be added to the by-law or fringe benefits and/or work- ing conditions may be amended from time to time by vote of the Town at a Town Meeting.
Section 13. Initial Application of the Compensation Plan
(a) Upon the adoption of this by-law, salary and wage rates for affected employees shall be adjusted as follows:
(1) Retroactive to the first of the year of adoption if at an annual Town Meeting.
(2) Effective the beginning of the month following adoption if at a special Town Meeting prior to the establishment of the tax rate for that year.
(3) Effective the January first following adoption if at a special Town Meeting later than the estab- lishment of said tax rate.
(b) The rate of each employee occupying a position, the compensation of which is provided for in Schedule B or Schedule C of Section 8 shall be adjusted, based on his prior service in said position, according to the formula set forth in Section 5 (e) or 5 (f).
(c) The rate of each employee occupying a position, the compensation of which is provided for in Schedule D of Sec- tion 8 shall be adjusted to the rate for his position class as set forth in this schedule.
(d) If an employee's rate at the time of the adoption of this by-law is in excess of the maximum rate set forth in his appropriate compensation grade in Schedule B or Schedule C of Section 8 or is in excess of the rate set forth for his position class in Schedule D of Section 8, this rate shall not be reduced but shall become a personal rate applicable only to said em- ployee as defined in Section 2.

(e) The adjustments provided for in this section shall be subject to the availability of appropriated funds.

Section 15. Overtime Compensation
(a) Clerical Group
An employee shall be compensated at the hourly rate set forth in Section 9 which corresponds to his step rate desig- nation in the corresponding compensation grade on Schedule B, Section 8, for hours worked in excess of those constituting his work week as set forth in Section 14 except for attendance at evening meetings which shall be considered as part of the basic work week of 37.5 hours.
(b) Library Group
An employee shall be compensated at the hourly rate set forth in Section 10 which corresponds to his step rate desig- nation in the corresponding compensation grade in Schedule B, Section 8, for hours worked in excess of those constituting his work week as set forth in Section 14.

(c) Custodial Group
Positions classified in this group may receive compensa- tion at the hourly rates set forth in Section 11 for hours worked in excess of forty-four weekly.
(d) Labor Group
An employee shall be compensated at one and one-half times his regular hourly rate for hours worked in excess of those set forth for the department to which he is assigned, incorporated in Section 14 by reference.
(e) Public Safety Group
(1) An employee in full-time employment called back for duty on his scheduled day off shall receive one fifth of his weekly rate for such duty provided the duty consists of an assigned shift of not less than eight hours.
(2) An employee of the Fire Department in full-time employment who responds to a box alarm pursuant to the administrative rules of the department may be compensated at an hourly rate determined by the Public Safety Commission which rate shall not ex- ceed one-fortieth of the employee's weekly rate.
(3) An employee of the Police or Fire Departments in full-time employment who is required to work more than one hour beyond his scheduled tour of duty may be compensated at an hourly rate deter- mined by the Public Safety Commission which rate shall not exceed one-fortieth of the employee's weekly rate.
(4) Nothing in the preceding sub-section shall be construed to permit the payment of such overtime rate for court appearances on the part of an employee during other than his assigned shift.
(5) An employee in other than the Police or Fire de- partments shall not receive overtime compensation. However, nothing in this sub-section shall be con- strued to deny compensation to an employee on an hourly rate in the group at his hourly rate multiplied by the number of hours worked and approved by his department head for any designated pay period.
(f) Administrative and Supervisory Groups
(1) Employees occupying positions classified in these groups are not entitled to overtime compensation as

set forth in Section 14, except as provided in the paragraph below. However, compensatory time may be granted an employee at the convenience of his department head for hours worked and approved in excess of forty in any one week.
(2) Highway foremen shall during snow plowing, sanding or snow removal operations, be paid for hours worked in excess of forty in one week at the hourly rates appearing in Compensation Grade W-10. If the employee's regular rate is Step III or below in Compensation Grade S-12, he shall be paid the mini- mum rate of Compensation Grade W-10; if above Step III, he shall be paid the appropriate rate above the minimum.
Section 16. Paid Holidays
(a) The following days or dates shall be recognized as legal holidays within the meaning of this by-law:

on which days employees shall be excused from all duty not required to maintain essential Town services.
(b) Every employee in full-time or continuous part-time employment shall be entitled to these designated holidays on the following terms:
(1) If paid on an hourly basis he shall receive one day's pay at his regular rate based on the number of hours regularly worked on the day on which the designated holiday occurs;
(2) If paid on a weekly, semi-monthly or annual basis, he shall be granted each designated holiday without loss in pay.

(c) Payment under the provisions of this section shall be made provided the eligible employee shall have worked on his last regularly scheduled working day prior to and his next regularly scheduled working day following such holiday, or was in full pay status on such preceding and following days in accordance with other provisions of this by-law.
(d) An employee in continuous employment, occupying a position in other than the Public Safety or Supervisory Groups who performs work on one of the days designated in sub-section (a) shall be paid at his regular rate for such day or fraction thereof (except as provided under sub-section [g], following) in addition to the amount to which he is entitled under sub-section (b)
(e) At the request of the employee, he may be granted compensatory time off at the convenience of the department in lieu of payment provided under sub-section (d).
(f) An employee in continuous employment, in other than the Police or Fire Departments, who, because of a rota- tion of shifts, works different days in successive weeks shall be granted, in each year in which the number of holidays falling on his regular days off is in excess of the number of holidays in that year falling on Saturday, additional days off equal to the excess.
(g) An employee in continuous employment, who per- forms scheduled inspection or maintenance work for part of one or more of the days or dates designated in sub-section (a) shall be entitled to one additional day off each year if he is required to perform duties on three such days or dates in a period of twelve months.
(h) Whenever one of the holidays set forth in sub-section (a) falls on a Sunday, the following day shall be the legal holiday.
Section 17. Vacation Leave
(a) An employee in continuous service shall be granted two weeks vacation with pay provided he has completed thirty weeks of service prior to June first.
(b) The employee eligible for the vacation allowance provided under sub-section (a) must complete this allowance within fourteen consecutive calendar days beginning on a scheduled work day or within two periods of seven consecu- tive days each beginning on a scheduled work day.

(c) Exceptions to the requirements of sub-section (b) permitting an employee to schedule his vacation allowance in a different manner may be made with the approval of the employee's department head if his scheduled work week is Monday through Friday or part thereof.
(d) In addition to the vacation allowance provided in sub-section (a), each employee who has (or will have) com- pleted ten years of service shall, in the year during which this length of service has been or will have been completed, be granted additional vacation with pay at the rate of one day for each year in excess of nine years of completed service up to a maximum allowance of fifteen days to which the em- ployee shall be entitled in the year during which fourteen years of service has been or will have been completed.
(e) Vacation allowance granted under sub-section (d) shall be taken separately from that granted under sub-section (a) unless approved by the employee's department head and the Personnel Board.
(f) Upon the death of an employee who is eligible for vacation under these rules, payment shall be made to the estate of the deceased in an amount equal to the vacation al- lowance as accrued in the vacation year prior to the em- ployee's death but which had not been granted. In addition, payment shall be made for that portion of the vacation allow- ance earned in the vacation year during which the employee died up to the time of his separation from the payroll.
(g) Employees who are eligible for vacation under these rules and whose services are terminated by dismissal through no fault or delinquency of their own, or by retirement, or by entrance into the armed forces, shall be paid an amount equal to the vacation allowance as earned, and not granted, in the vacation year prior to such dismissal, retirement, or entrance into the armed forces. In addition, payment shall be made for that portion of the vacation allowance earned in the vaca- tion year during which such dismissal, retirement, or entrance into the armed forces occurred up to the time of the em- ployee's separation from the payroll.
(h) Absences on account of sickness in excess of that authorized under the rules therefor or for personal reasons as provided for under other leave may, at the discretion of the department head, be charged to vacation leave.

(i) An employee, unless receiving pay for such a day or date under the provisions of Section 17A of Chapter 147 or Section 57A of Chapter 48 of the General Laws, shall be granted an additional day of vacation if, while on vacation leave, a designated holiday occurs which falls on or is legally observed on Monday, Tuesday, Wednesday, Thursday or Fri- day.
(j) Vacation allowances provided under the terms of this section must be taken before December 31st in the calendar year earned. Such vacation shall be granted by the head of the respective department of the Town at such time as, in his opinion, will cause the least interference with the perform- ance of the regular work of the Town.
Section 18. Sick Leave
(a) An employee in continuous employment who has completed thirty weeks of service following original employ- ment shall be allowed fifteen days leave with pay each calen- dar year or one and one quarter days for each month thereof if in any year his employment is less than thirty weeks, pro- vided such leave is caused by sickness or injury or by ex- posure to contagious disease.
(b) An employee in continuous employment shall be credited with the unused portion of leave granted under sub- section (a) up to a maximum of sixty days.
(c) An employee in continuous employment shall, sub- ject to the limitation of sub-section (b), be credited with three days unused leave for each year of employment or fraction thereof ending on December 31st prior to the adop- tion of this by-law. An employee occupying a temporary or seasonal position shall not be credited with unused sick leave beyond his current period of employment.
(d) If the amount of leave credit provided under sub- section (b) has been or is about to be exhausted, an employee may make application for additional allowance to that pro- vided under sub-section (a). Such application shall be made to the Board which is authorized to grant such additional allowance as it may determine to be equitable after review- ing all circumstances including the employee's attendance and performance record prior to conditions supporting his request for the additional allowance.

(e) Sick leave must be authorized by the department head and must be reported, on blanks provided for same, to the Board.
(f) A physician's certificate of illness shall be submitted by the employee after three days absence to his department head before leave is granted under the provisions of this Section. This certificate shall be forwarded by the depart- ment head to the Board.
(g) The Board may of its own motion, require a medical examination of any employee who reports his inability to report for duty because of illness. This examination shall be at the expense of the Town by a physician appointed by the Board.
(h) Injury, illness or disability self-imposed, or resulting from the use of alcohol or drugs shall not be considered a proper claim for leave under this Section.
(i) Payments made under the provisions of this section shall be limited to an employee who is receiving Workmen's Compensation payments to the difference between the amount paid in Workmen's Compensation and the employee's regular rate.
(j) In the event of payments made to an employee under the preceding sub-section, the Board may debit the employee's sick leave accrual by such amounts as it determines to be equitable in relation to such payments.
(k) Nothing in this section shall be construed to conflict with Section 100 of Chapter 41 of the General Laws.
Section 19. Bereavement Leave
Emergency leave up to three days may be allowed for death in an employee's immediate family (wife, husband, mother, father, child, brother or sister).
Section 20. Other Leave
Absences for personal reasons may be charged to vacation leave upon application by the employee and approved by his department head. Such absences, however, may not be charged to vacation leave beyond that which the employee has earned by the time of such application.
Section 21. Physical Examination
Before appointment to a position in the classification plan requiring continuous service or to a seasonal position desig- nated by the Board, a candidate shall have passed a physical

examination satisfactory to the Board. The examining physi- cian shall be appointed by the Board and the examination shall be at the expense of the Town. The examining physician shall advise the Board as to whether or not, in his opinion, the applicant is physically qualified to perform the duties of the position for which application has been made and the appli- cant shall complete a questionnaire which the Board will design. The examining physician's report shall be confidential and shall be deposited with the Board of Retirement.
Section 22. Operation of By-Law
This By-Law shall be operative only as to employees whose positions are classified hereunder and for which posi- tions minimum and maximum salaries, or single-rated sal- aries, have been established by vote of the Town at a Town Meeting.
Section 23. Civil Service Law
Nothing in this by-law shall be construed to conflict with Chapter 31 of the General Laws.
Section 24. Effect of Partial Invalidity
The invalidity of any section of this by-law shall not invalidate any other section or provision thereof.
Special Town Meeting, September 6, 1962
7:30 p.m. Meeting
The Special Town Meeting was called to order by the Moderator, George A. White at 7:45 o'clock p.m.
The number of Town Meeting Members present, as re- ported by records of the tellers, was 174. The Moderator declared a quorum present.
Mr. Ralph Drew moved that Articles 1 and 2 be taken up together for purposes of discussion only; that Articles 1 and 2 be voted on separately, and it was so voted.
Article 1. To see if the Town will authorize the Select- men to execute, on behalf of the town, a "Cooperation Agree- ment" between the town and the Plymouth Redevelopment Authority, providing for the cooperation required by the

Urban Renewal Administration of the Housing and Home Finance Agency of the United States with respect to the Urban Renewal Project for the Summer Street-High Street Urban Renewal Area, Project No. Mass. R-26 in the Town of Plymouth; said agreement containing provisions with respect to making local grants in aid, constructing public improve- ments, conveying town-owned land to the extent required, vacating certain streets, altering and widening certain streets, improving certain streets, crediting the town for the cost of certain of the foregoing, and other forms of cooperation; copies of a draft of which proposed agreement are on file in the Office of the Selectmen, the Plymouth Redevelopment Authority and the Town Clerk, or will take any other action with respect thereto.
Mr. Ralph Drew moved that the Town authorize the Selectmen to execute on behalf of the Town, a Cooperation Agreement between the Town and the Plymouth Redevel- opment Authority providing for the cooperation required by the Urban Renewal Administration of the Housing and Home Finance Agency of the United States with respect to the Urban Renewal Project for the Summer Street-High Street Urban Renewal Area, Project No. Mass. R-26 in the Town; said agreement containing provisions with respect to making local grants-in-aid, constructing public improvements, con- veying Town owned land to the extent required, vacating or altering and widening or improving certain streets, crediting the Town with the cost of certain of the foregoing, and other forms of cooperation. Such agreement is to be substantially in the form of the draft of proposed agreement on file at the office of the Selectmen, Plymouth Redevelopment Authority and Town Clerk prior to the meeting, but the Selectmen are authorized to bind the Town to pay the local cash grant-in- aid to the Plymouth Redevelopment Authority on a specific date not earlier than November 1, 1962 and to make such cor- rective and clarifying changes, or other changes required by said Urban Renewal Administration, as they consider nec- essary or desirable.
Voting by voice vote, the Moderator declared the motion carried.

Article 2. To see if the town, pursuant to the provisions of Section 26CC of the Housing Authority Law contained in Chapter 121 of the General Laws (Ter. Ed.) as most recently amended, will appropriate a sum of money for the purpose of defraying such part of the development, acquisition and op- erating costs of the Summer Street-High Street Urban Rede- velopment Project No. Mass. R-26 in the Town of Plymouth, Massachusetts, as will not be met by definitive loans, contri- butions or grants from the Federal Government, and will authorize the treasurer, with the approval of the Selectmen and the Emergency Finance Board, to borrow the whole or any part of the same.
