Article 72. To see if the Town will vote to authorize the Board of Selectmen to take by eminent domain, an easement for purposes of constructing and maintaining a storm sewer over the following described parcel of land :


Beginning on the southeasterly side of River Road at the northeasterly corner of property of one Doolittle as recorded in Book 1679, page 261, Hampden County Registry of Deeds and running thence northeasterly on said River Road 40 feet; thence southeasterly in a line parallel with the northeasterly line of said Doolittle about 270 feet to the westerly bank of the Connecticut River; thence southwesterly along the westerly bank of said Connecticut River to the northeasterly line of said Doolittle; thence northwesterly about 90 feet to a stone bound and con- tinuing in the same course 180 feet along the northeasterly line of said Doolittle to the point of beginning. Said parcel of land being a portion of property owned by Edward A. and Winnifred S. Pettis and recorded in Book 1800, page 323, Hampden County Registry of Deeds. Pass any vote or take any action relative thereto.


Article 73. To see if the Town will vote to raise and ap- propriate the sum of $400.00 or any other sum as damages for the easement authorized in Article 72. Pass any vote or take any action relative thereto.


Article 74. To see if the Town will vote to raise and ap- propriate $25,000.00 or any other sum for the construction of a storm sewer on Cooper Street between Main Street and Fed- eral Street, pass any vote or take any action relative thereto.

Article 79. To see if the Town will vote to raise and ap- propriate the sum of $3,300.00 to recap the existing sidewalk on the southerly side of Springfield Street between Rowley Street and Royal Lane, pass any vote or take any action relative thereto.


Article 80. To see if the Town will vote to raise and ap- propriate the sum of $1,734.95 for the micro-filming of the rec- ords of the Assessors, Town Clerk and the Engineering Depart- ment, pass any vote or take any action relative thereto.


Article 81. To see if the Town will vote to raise and ap- propriate the sum of $1,800.00 or any other sum for the pur- chase of a car to be under the direction of the Board of Health, to be used by the Assistant Nurse in the conduct of Town Busi- ness only, pass any vote or take any action relative thereto.


Article 82. To see if the Town will vote to raise and ap- propriate a sum of money to compensate the Heirs of Dennis M. Crowley for land damages suffered by them as a result of a land-taking made by the Hampden County Commissioners in connection with the re-location of Springfield Street. Article 83. To see if the Town will vote to raise and ap- propriate a sum of money to compensate Romuald Chouinard for land damages suffered by him as a result of a land-taking made by the Hampden County Commissioners in connection with the re-location of Springfield Street. Article 84. To see if the Town will vote to raise and ap- propriate a sum of money to compensate John S. Article 85. To see if the Town will vote to authorize the Board of Selectmen to execute and deliver in its name and behalf a deed to Edwin C. Knapp, both individually and as the sole stockholder of Knapp Home Building Co., which company was dissolved March 3, 1927, said deed to cover lots 35 to 40 inclusive as shown on a plan of lots recorded in the Hampden County Registry of Deeds, Book of Plans H Page 64. Pass any vote or take any action relative thereto.


Article 86. To see if the Town will vote to authorize the Board of Selectmen to make an exchange of property with the First Baptist Church of Agawam, said exchange to be at the expense of the First Baptist Church of Agawam. Pass any vote or take any action relative thereto.


Article 87. To see if the Town will vote to adopt the fol- lowing new By-Law entitled "Snow and Ice":


SECTION 1. The tenant or occupant, and in case there be no tenant or occupant. the owner or persons having the care of any estate abutting upon any street, lane, court or square. within the Town where there is a sidewalk which now is estnh- lished or may hereafter be established, or set apart as such, shall within twenty-four hours after the ceasing to fall of any snow thereon, cause the same to be removed therefrom.


SECTION 2. When any snow shall be collected or denos- ited upon any sidewalk mentioned in the preceding section. either by falling from some adjacent building or by drifting upon said sidewalk, the tenant or occupant, and in case there be no tenant or occupant, the owner or persons having the charge of the estate abutting upon said sidewalk. shall within twenty-four

hours after its being so collected or deposited, cause the same to be removed.


SECTION 3. Whenever any sidewalk mentioned in Sec- ion 1 hereof, shall be encumbered with ice, it shall be the duty of the tenant or occupant, and in case there be no tenant or occupant, the owner or persons having the charge of the estate abutting upon said sidewalk, to cause such sidewalk to be made safe and convenient for transit by removing the ice therefrom or by covering the same with sand or some other suitable sub- stance within twenty-four hours after such sidewalk shall become so encumbered.


SECTION 4. Any person violating any provision of this By-Law shall be punished by a fine not exceeding $20.00 for each day during which the said violation shall continue. Pass any vote or take any action relative thereto.


Article 88. To see if the Town will vote to authorize the Moderator to appoint a High School Building Committee of nine members composed as follows: Two members of the School Committee; One Selectman; one member of the Planning Board; one member of the Finance Committee; one member of the Agawam Council for Public Schools, and one member from each of the areas comprising North Agawam, Feeding Hills and Agawam Center; and to appropriate the sum of $6,000.00 for expenses which may be incurred by the High School Building Committee for the purpose of reviewing, revising and reporting upon preliminary plans drawn by Alderman and MacNeish; having engineering data compiled such as borings to determine subsoil conditions. To make a report of these recommendations together with any recommendation it might have relative to appropriations for the building of said High School at the first special Town Meeting to be held in the year 1953. Pass any vote or take any action relative thereto.


Article 89. To see if the Town will vote to appropriate the sum of $9,000.00 for the purpose of installing a hardened surface on the area in the rear of the present High School Building. Pass any vote or take any action relative thereto.


Article 90. To see if the Town will vote to appropriate the sum of $2.400.00 to be used for the installation of new electric service entrances in the present High School Building including some minor masonry and steam fitting work as may be necessary. Said work is required to promote the safety factor

now lacking in the present installation. Pass any vote or take any action relative thereto.


Article 91. To see if the Town will vote to amend a By- Law relating to the creation of the Board of Appeals, adopted July 24, 1945, by striking out the words "an associate member" and substituting in place thereof "two associate members" so that the same will read as follows:


SECTION 1. There shall be in the Town of Agawam a Board of Appeals, hereinafter called the Board, consisting of three members and two associate members appointed by the Board of Selectmen. The first appointment of members shall be for terms of one, two, and three years. Thereafter, the Board of Selectmen shall appoint each year one member to serve for three years. Appointments of the associate members shall be made for a term of three years. Vacancies shall be filled in the same manner for unexpired terms. Pass any vote or take any action relative thereto.


Article 92. To see if the Town will vote to authorize the Board of Selectmen to appoint a committee of five to work with the Planning Board in studying parking problems in congested areas in the Town, and to make a report not later than the next annual Town Meeting. Pass any vote or take any action relative thereto.


Article 93. To see if the Town will vote to change the zoning of the following described property from Residence A-2 to Residence B .:


Beginning at an iron pin in the northerly line of said North Street at the Southeasterly corner of land now or formerly of the Trustees of the Springfield Swiss Club and running thence Northerly one hundred sixty-seven (167) feet along last named land to a point; thence Easterly in a line parallel with said North Street along land now or formerly of William and Mary Sul- borski one hundred fifty (150) feet to a point; thence Southerly in a straight line along other land of said William and Mary Sulborski a distance of about sixty-seven (67) feet to a point distant Easterly five (5) feet from the Northeasterly corner of the second parcel described in a mortgage given by Precision Engineering Corporation to the M.A.C. Plan, Inc., of Spring- field dated June 21, 1943 and recorded in Hampden County Registry of Deeds in Book 1762, Page 184; said five (5) feet being measured along the projection easterly of the Northerly

line of said 2nd parcel described in said mortgage; thence again Southerly in a line parallel with the first described course (which is also parallel with the Easterly line of said second parcel described in said mortgage) a distance of one hundred (100) feet to a point in the Northerly line of said North Street distant five (5) feet Easterly from the Southeasterly corner of said second parcel described in said mortgage; thence Westerly along said North Street one hundred fifty-five (155) feet to the point of beginning. Pass any vote or take any action relative thereto.


Article 94. To see if the Town will vote to change the zoning of the following described property from Industrial to Residence A-2;


Beginning at the intersection of the westerly line of property of one Scannell, and Kirkland Street and running westerly along Kirkland Street to the easterly line of property of one Christopher about 550 feet; thence Northerly along the easterly line of said Christopher about 250 feet to the center of Middle Meadow Pond; thence Easterly along the center of Middle Meadow Pond, being also the southerly line of said Christopher about 550 feet to the westerly line of the aforementioned Scan- nell; thence Southerly along the westerly line of said Scannell about 320 feet to the point of beginning. Said property being owned by Eugenio Albano and Christina Grimaldi. Pass any vote or take any action relative thereto.


Article 95. To see if the Town will vote to change the zoning of the following described parcels from Residence B to Business B. :


Parcel 1. Situated on the Westerly side of John Street and being Lots No. 71 and 72.


Parcel 2. Situated on the Easterly side of John Street and bounded as follows: Beginning at a point about 385 feet from the intersection of Meadow Street and John Street and running southerly about 235 feet; thence Easterly by the Springfield Wa- ter Works about 147.66 feet; thence Northerly by property now or formerly of Andrew Bobyak about 167 feet; thence Westerly by property now or formerly of Frances Longo and Salvatore Rossi about 120 feet to the point of beginning. Pass any vote or take any action relative thereto.


Article 96. To see if the Town will vote to change the zoning of the following described property from the present Business A and Agricultural Zone to Industrial :

Report of the School Committee


To the Citizens of Agawam:


The provision of adequate housing facilities for our pupils continues to be an outstanding problem in the operation of the Agawam Public Schools. The completion of the addition to the Benjamin J. Phelps School has helped the situation temporar- ily. However, the continually increasing enrollment is tending to cancel out gains made in obtaining new classrooms. The construction of a new high school in the immediate future is of extreme importance. The town has acted favorably on the acquisition of a suitable site for the new building. It is also felt that more new construction in the elementary field will be necessary soon. The new cafeteria at the Katherine Danahy School provides new space for auditorium and cafeteria use.


Any person or persons having matters which they feel should be discussed with the school committee can make ar- rangements to appear at a meeting. The school department office should be called to determine the time and date of the next meeting.


The committee appreciates the assistance of the newly formed Agawam Council for Public Schools. It is felt that the activities of this group have been of value in improving our schools.


It has been voted to transport all high school students living more than two miles from the school. This is an added service to our pupils.


The installation of a new boiler and automatic oil burner at the Katherine Danahy School eliminated two boilers which were more than thirty-five years old. The heating of the new cafeteria-auditorium would have taxed the old boilers to the limit of their capacity and thus created a hazard. The new boiler and burner will eliminate this condition. At the Spring- field Street School, a new automatic oil burner has been in- stalled. Revision of the sysetm of heat distribution by the

installation of traps in mains and the replacement of defective traps has increased the efficiency considerably. The installation of fuel oil tanks with a capacity of 10,000 gallons at each of these schools enables the purchase of oil in larger quantities with a consequent saving in cost.


An amount has been placed in the 1953 budget for the beginning of a program of Adult Education. The committee feels that this step will help the schools better serve the needs of the community.


The committee recognizes the long and successful service of Mr. Edward Connor as custodian at the Katherine Danahy School. Mr. Connor retired on December 1, 1952.


The Department of Streets and Engineering of the Town has rendered valuable service to the schools in plowing all our driveways and play areas and providing estimates in engineer- ing and supervision over playground improvements. For this service we are deeply grateful.


1952 has been a year of growth in the Agawam schools. It is felt that the Towns people have supported the school well. The committee is thankful for this support. Appreciation is also extended to all members of the staff who have been of assistance in making 1952 a happy and successfull year.
