There has been considerable constructive work done at Menotomy Rocks Park under the supervision of the tree warden. A considerable portion of the growth of bushes has been eliminated and trees have been trimmed as far as our appropriations would allow, and this work should be continued until all of the trees in the park are taken care of, which will require an increase in ap-

propriation over what we have had in the past to work with.
The so-called Hills Pond could be made more at- tractive with walks around it and a system of drainage installed so that the proper level of the pond can be obtained at all times.
Rough grading work has been done on the Meadow Brook Park playground off Chestnut street, and it is the idea of the Park Board to finish this work this year if sufficient appropriation is allowed. This we feel is very much needed in this section. We strongly feel that the section of Meadow Brook Park abutting on the Summer street extension should be filled in, and while the Board of Public Works have been dumping some ashes into same, we believe that a considerably larger amount of this work could be done to advantage.
This winter we endeavored to keep Hills Pond ice in condition for skating, and our efforts among the people to avail themselves of this privilege were evident- ly very much appreciated, and we found a very strong desire for additional facilities for winter sports, and we strongly recommend that the land in back of the High School be drained and a culvert installed which not only will allow hockey rinks and skating, but foot- ball field, tennis courts, etc. This, we believe should be on a progressive scale, and therefore have inserted in the Warrant an article requesting that money be ap- propriated to start this work without further delay.

The committee met for organization and prelim- inary plans on January 28th, 1925 and Mrs. Grace E. Morton, was appointed secretary.
All of the Military, Civic and Fraternal bodies were invited to take part in the exercises of the day.
The secretary of this committee has compiled a record of all data, pertaining to our celebration which we append to this report.
Committee felt that more emphasis should be given to the part that Arlington, then known as Menot- omy, took in the stirring events of April 19th, 1775,

and to that end we arranged for publicity in the form of newspaper notices; three large banners suspended over Mass. Ave. marking the Jason Russell House; the spot where 18 British Soldiers with supplies, were cap- tured; and another bearing the information that 22 Americans were killed in our Town on April 19th 1775. Smaller signs were erected at the sites of the Cooper Tavern and the Black Horse Tavern.
In discussing a proper title for Arlington's part, or activities on April 19th 1775, we believe that this should · be hereafter referred to as the Battle of Menotomy, and would suggest that future celebrations by the Town, and appropriations therefor, be designated, "For the . celebration of the Battle of Menotomy."

All bills were supported by proper vouchers, ap- proved and paid.
The committee was very much pleased with the hearty co-operation of the organizations, in making the parade such a success; by furnishing marchers, bands and floats.
In spite of the unfavorable weather conditions, the Townspeople, as well as the paraders, manifested a true patriotism, by turning out in such large numbers, and in every way showing sincere appreciation of the efforts of your committee.
The merchants of our Town and residents along the main thoroughfares contributed much to the spirit of the day, by a liberal use of bunting, and splendid dis- play of flags.
The Town is indebted to the Arlington Board of Trade for originating the idea of uniform flag decora- tion; and supervising the placing of the hundreds of flags that added so much to the success of the day. We wish to publicly thank them.
The committee wishes to thank the Town Meeting Members for the generous appropriation made for this occasion.
Also take this opportunity to thank the Board of Selectmen, and other Town officials and heads of de- nærtments who so generously did their part in making this day a success.

REPORT OF TREE WARDEN (For Year Ending Dec. 31, 1925)
The past year was a trying one and in some cases a disastrous one to some of our large elms. The excava- tion for the large water main that went the entire length of Pleasant St., the erection of the new Engine House on Broadway, the reconstruction of streets and the re- setting of curb stone; all these, while necessary im- provements, work a hardship on the life of our trees. More consideration should be given our trees by com- mittees and engineers when laying out these improve- ments, and when ever possible our old and stately elms should be preserved. During the excavation on Pleas- ant St., I compelled the contractor to board all trunks of smooth bark trees to a height of six feet and to in- stall spark arresters on all steam engines. Every pre- caution was taken and for the enormous size of the trench, but slight damage was done to the trees. One elm at the corner of Swan St. and one elm on Swan St. were removed at the expense of the contractor. With the erection of the Engine House on Broadway two fine large elms and one horse-chestnut were doomed, and as I have stated, more consideration should be given to existing trees when plans are drawn for public build- ings and new curb lines.
During the year all dead and dangerous limbs were removed and a partial trimming given to all trees where the branches were low and interfered with traffic. A thorough trimming with cavity and bolting work can- not be accomplished with the appropriation available, ex- cept in extreme cases.
There have been thirtv-four trees removed, namely : 15 Elms, 9 Maples, 5 Ash, 2 Horse-Chestnut, 3 Poplars.

Two hundred and twelve trees were planted, name- ly: 100 Rock Maple, 100 Norway Maple, 6 Plane and 6 Linden trees.
Seventeen tree hearings were held on the removal of trees and permits were granted with the exception of two, namely :
Elm tree at corner Franklin St. and Broadway and Elm tree at junction of Medford St. and Jean Road.
The past year our soft maples were badly infested with the cottony scale, and it will be necessary to spray for this insect this year. This is a sucking insect and requires a different spray than for the gypsy moth. To carry on the work of this department for the coming year I would recommend the appropriation of $3100.00.

REPORT OF THE TOWN COUNSEL

Board of Public Works.
Gentlemen :
The following summary of matters with which the Town Counsel has been connected during the year 1925 is presented as my report.
In connection with the claims of Mabel S. True for damages by reason of the taking of land on Lake Street for school purposes, of William T. Foster et al for dam- ages by reason of the taking of land on Irving Street for school purposes, of Philip F. Coleman for damages by reason of the taking of land on Central Street for police purposes and of Howard Kent Burgess et al for damages by reason of the taking of land on Park Avenue for a fire station, settlements have been arranged and substantially completed.
The petitions of the Arlington Realty Company for damages by reason of the establishing of building lines and the alteration of ways at the corner of Broadway and Medford Street were tried to a jury in June. The jury returned a verdict in the sum of seventy-five hun- dred (7500) dollars, which was less than the amount previously offered to the petitioner by way of settlement and much less than the sum demanded by it for settle- ment. These cases were tried by Damon E. Hall, Esq., on behalf of the Town and the judgments therein have been satisfied.
The claim of Louis V. Pellegrini and Carrie Zap- pini for damages from the taking of land on Park Ave- nue Extension for school purposes has been settled by the payment of a sum approved by the Selectmen.

REPORT OF THE TOWN COUNSEL
The action of Frances Cronin for damages due to an injury from a defect in the sidewalk of Medford Street was tried to a jury in December. The jury returned a verdict of one hundred (100) dollars for the plaintiff, which was less than the amount previously offered and much less than the sum demanded by the plaintiff for settlement. John M. Morrison, Esq., tried this case for the Town.
The claim of Elizabeth M. Campbell for damages from an alleged defect in the sidewalk of Mt. Vernon Street was settled by a payment approved by the Select- men.
The claim of Stephen D. Merrill for injuries re- ceived on the sidewalk of Wellington Street was settled by the payment of fifty (50) dollars.
The claim of John F. Rooney for damages due to a defect in Hamlet Street was settled by the payment of forty (40) dollars.
The petition of William C. Drouet for a writ of mandamus directing the school committee to observe certain statutory provisions relating to the physical ex- amination of children in the public schools was dismissed by agreement.
The following matters are pending in the Middlesex Superior Court:
1. The petitions of William A. Muller et al, Trus- tees of the Lockeland Real Estate Trust, of Alma L. Al- len, of Catherine Goldsmith, of Charles N. Hayden et al, of Bertha W. Munch, of Jane L. Osborne, of Helen O. Rideout, of Heber W. Youngken et al, for abatement of the assessments laid by the Board of Park Commission- ers for the improvement consisting of the addition to the Menotomy. Rocks Park. Under authority of the Select- men, Leland Powers, Esq., has been retained for the preparation and trial of these cases.
2. Fifty petitions for the assessment of damages alleged to have been sustained in connection with the establishing of building lines on both sides of Massa-

chusetts Avenue. Under authority of the Selectmen, Damon E. Hall, Esq., has been retained for the prepara- tion and trial of these cases.
3. The petition of the Boston Elevated Railway Company for the assessment of damages alleged to have been sustained in connection with the establishing of building lines on 'I'ufts Street.
4. The petition of Manuel M. Costa for damages in connection with the establishing of the exterior lines of "Mystic Lake Drive" from Hayes Street to land now or formerly of Russell Heirs.
5. The petition of Edward J. McGivern for damages in connection with the establishing of the exterior lines of Higgins Street from Robbins Road to land now or formerly of Russell.
6. The bills in equity of C. Alfred Myshrall and of Thomas Ryan to have certain parcels of land on the northerly side of Massachusetts Avenue decreed to be free from certain zoning law restrictions.
The petition of Solomon Rubin for the registration of the title of land on Massachusetts Avenue and in- cluding a portion of Swan Place, is pending in the Land Court. The Town Counsel has appeared in several other proceedings in this court wherein the interests of the Town might be involved and has taken action therein as directed by the Selectmen.
The work of the Town Counsel has also included the disposal of several small claims and of actions in which the Town was summoned as trustee, the settlement of claims under one assignment of wages and under the workmen's compensation act, the drafting of various deeds and other instruments, the attending of meetings of your Board, of the Board of Selectmen, and of other Boards and Committees, and the furnishing of legal opinions.
