Article 3. To see if the Town will authorize the salc, conveyance or other disposition of all or any of the buildings on the land on Lake Street known as the True site, acquired by the Town for school purposes, under vote of the Town passed June 4, 1924; or take any action re- lating thereto.

Arlington, January 16, 1925.


Middlesex County :


By virtue of this warrant I have notified and warned the legal voters of the Town of Arlington to meet at the time and place and for the purposes herein named by causing a printed attested copy of the same to be left at every dwelling house in the Town, and by posting an attested copy at the doors of the Town Hall seven days at least before said day of meeting and by posting attested copies in two or more conspicuous places in each voting precinct in the Town. A notice of the time, place and objects of the meeting was published in the local papers.

Arlington, January 20, 1925.


Pursuant to the warrant of the Selectmen served ac- cording to law upon the inhabitants of the Town of Arl- ington, by a Constable of the said Town, and sent by mail by the Town Clerk at least seven days before the day of meeting to the Town Meeting Members elected and qual- ified to act in Town Meetings in Arlington, the Town Meeting Members met at the Town Hall in said Town on Tuesday, January 20, 1925, at eight o'clock in the evening. Notices of the special meeting were published in the local papers.


The Moderator called the meeting to order at 8:10 o'clock. The Clerk read the Call and the Constable's Re- turn of the Warrant, the reading of the remainder of the Warrant being waived by unanimous consent of the meet- ing.


It appearing to the Moderator that there was not a quorum present the roll was called by the Town Clerk.

The result of this Roll Call showed that fifty-nine mem- bers were present.

One hundred and thirty-five members constitute a quorum.


On motion of Nelson B Crosby, it was Voted: That this meeting adjourn to meet Friday, February 13, 1925 at eight o'clock in the evening.


The Check lists used at the entrances of the hall, in charge of Philip T. Robinson and James F. Higgins, showed that sixty-one members were present.


The meeting adjourned at 8:24 o'clock.

Arlington, February 13, 1925.


Pursuant to the vote of adjournment January 20, 1925, the Town Meeting Members met in the Town Hall on Wednesday evening, February 13, 1925, notices having been sent by mail by the Town Clerk to the Town Meeting Members seven days at least before the meeting. Notices were published in the local papers and posted at three places in each precinct.


Lists of the duly qualified Town Meeting Members were used at the entrances of the meeting place and were in charge of James F. Higgins and Philip T. Robinson.


The Check Lists filed with the Town Clerk at the close of the meeting showed that one hundred and thirty- six members attended the meeting.

Voted: that Article 1 be taken up.

Article 1 taken up. (Reports of Committee on Addi- tional School Accommodations, etc.)


Elliott R. Barker, Chairman of the Committee on Additional School Accommodations, obtained the consent of the meeting to show slides of the plans of schoolhouses submitted to the committee. The plans submitted were by the following named architects and were numbered as follows :


1. Haven and Hopkins


2. Gay and Proctor


3. Brainerd and Leeds


4. Charles G. Loring


5. Howard B. S. Prescott.


Mr. Barker submitted the report of the committee which had been most carefully prepared in every detail.


Voted : (Unanimously) that the report of the com- mittee on Additional School Accommodations be received.


Voted: On motion of Hollis M. Gott that the Finance Committee Report be received.


On motion of Hollis M. Gott:


Voted : that the remaining articles in the Warrant now be taken up and the recommendations of the Finance Committee be considered as now before the meeting, the articles to be taken up in the order in which they appear in the Warrant.

Article 2 taken up. (Cutter School-Borrowing.)


Vot d: (Unanimously) that the authorization of the Treasurer to borrow any sum in excess of ninety thousand ($90,000) dollars for the purpose of constructing an addi- tion to the school house called "Cutter School," contained in the vote of the Town passed March 25, 1924, under Article 28 of the Warrant for the annual meeting be and hereby is rescinded.

Article 3 taken up. (Disposition of Lake Street Buildings.)


On request of Roger W. Homer, Mr. Crosby, Chair- man of the Board of Selectmen, explained the delay in the settlement of the Town for the True property.


Voted : (Unanimously) that the Board of Selectmen be and hereby is authorized and empowered in the name and on behalf of the Town to sell at public auction or private sale all or any of the buildings on the land of the Town on Lake Street acquired for the purpose of con- structing thereon a school building, under vote passed June 4, 1924 and to execute, acknowledge and deliver any proper documents, all for the minimum amount of fifty ($50) dollars and upon other terms as the Selectmen shall consider proper.


Article 4 taken up. (Schoolhouse on Lake Street)


Elliott R. Barker offered the following amendment to the Recommendation as made under Article 4 by the Finance Committee and now before the meeting.


That there be and hereby is appropriated the sum of one hundred and eighty-five thousand dollars ($185,- 000) for the purpose of constructing a school building upon land of the Town situated on Lake Street, Brooks Avenue, so called, and Chandler Street, so called, ac- quired under vote passed June 4, 1924, being the land described in Article 4 of the warrant; that for this pur- pose sixty-five thousand ($65,000) dollars be raised by general tax, and for the balance one hundred and twenty thousand ($120,000) dollars the Treasurer, with the ap- proval of the Selectmen, be and hereby is authorized to borrow said sum of one hundred and twenty thousand ($120,000) dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the General Laws and all Acts in addition thereto or amendment thereof, so that the whole loan shall be

paid in not more than twenty years from the date of issue of the first bond or note or at such earlier date as the Treasurer and Selectmen may determine; and further, that a committee of five be appointed by the Moderator, to consist of one member of the School Committee, one member of the Board of Selectmen, and three citizens of the Town with full authority to construct said school building within the sum herein appropriated, sub- stantially in accordance with plans of Messrs. Brainerd and Leeds presented at this meeting, and with power to fill any vacancy in said committee.


A lengthy discussion followed. It was the decided opinion of some Town Meeting Members that the award- ing of this contract should go to a local architect. Many instances were recalled when both Mr. Prescott and Mr. Proctor had not only given the Town plans which had proven entirely satisfactory but had continued their in- terest in these buildings so that the Town had received much benefit by their advice as to maintenance and re- pairs. Roger W. Homer urged that the Town Meeting Members should not lose sight of the fact that it was the duty of the Committee on Additional School Accommoda- tions to choose the plan which best suited the needs of the Town.


On motion of Charles L. Fitch :


Voted: that the amendment as offered to the recom- mendation of the Finance Committee be not passed.


On the motion as made in the recommendation of the Finance Committee it was

Article 5 taken up. (Grading and Construction of Walks Schoolhouse Property on Lake Street.)


Voted: (Unanimously) that the sum of five thou- sand ($5,000) dollars be and hereby is appropriated for the grading of, and construction of walks upon, the land of the Town situated on Lake Street, Brooks Avenue, so called, and Chandler Street, so called, mentioned in Article 4 of the Warrant; and that said sum be raised by general tax and expended under the direction of the committee appointed pursuant to the vote passed under Article 4 of the Warrant.


Article 6 taken up. (Purchase of Fuel for Schools)


Voted: (Unanimously) that the sum of seven thousand ($7,000) dollars be and hereby is appropriated for the public schools, and that said sum be raised by

general tax and expended under the direction of the School Committee for the purchase of fuel.


Article 7 taken up. (By-Law-Billboards, Signs and Other Advertising Devices.)


Voted : (Unanimously) that the following by-law be adopted :


No person, firm, association or corporation shall erect, display or maintain, within the limits of the town, a billboard, sign or other outdoor advertising device, ex- cept those exempted by Section 30 and 32 of Chapter 93 of the General Laws, or by any additions to, or amend- ments of said sections,-


(a) Within fifty (50) feet of any public way ;


(b) Within three hundred (300) feet of any public park, playground or other public grounds, if within view of any portion of the same ;


(c) Nearer than fifty (50) feet to any other such billboard, sign or other advertising device, unless said billboards, signs or other advertising devices are placed back to back;


(d) On any location at the corner of any public ways and with a radius of one hundred and fifty (150) feet from the point where the center lines of such ways in- tersect ;


(e) Nearer than one hundred (100) feet to any public way, if within view of any portion of the same, if such billboard, sign or other advertising device shall ex- ceed a length of eight (8) feet or a height of four (4) feet ;


(f) Nearer than three hundred (300) feet to any public way, if within view of any portion of the same, if such billboard, sign or other advertising device shall ex- ceed a length of twenty-five (25) feet or a height of twelve (12) feet;

(g) In any event if such billboard, sign or other ad- vertising device shall exceed a length of fifty (50) feet or a height of tweive (12) feet; except that the Selectmen may permit the erection of billboards, signs or other ad- vertising devices which do not exceed forty (40) feet in length and fifteen (15) feet in height if not nearer than three hundred (300) feet to the boundary line of any public way.


(h) No billboard, sign or other advertising device shall be erected, displayed or maintained in any block in which one-half of the buildings on both sides of the street are used exclusively for residential purposes; except that this provision shall not apply if the written consent of the owners of a majority of the frontage on both sides of the street in such block is first obtained and is filed with the Division of Highways of the Department of Pub- lic Works, together with the application for a Permit for such billboard, sign or other advertising device.


(i) No billboard, sign or other advertising device shall be erected, displayed or maintained until a Permit therefor has been issued by the Division of Highways of the Department of Public Works pursuant to the follow- ing provisions : Upon receipt from said Division of a no- tice that application for a permit to erect, display or maintain a billboard, sign or other advertising device within the limits of the Town has been received by it, the Selectmen shall hold a public hearing on said application in the Town, notice of which shall be given by posting the same in three or more public places in said Town at least one week before the date of such hearing. A written state- ment as to the results thereof shall be forwarded to the Division containing, in the event of a disapproval of such application, the reasons therefor, within thirty days from the date of notice of the Town that an application for such a permit had been made.


This By-Law shall not apply to signs or other de- vices erected and maintained in conformity with law,

which advertise or indicate either the person occupy- ing the premises in question or the business transacted thereon, or advertising the property itself or any part thereof as for sale or to let and which contain no other advertising matter and provided further that this By- Law shall not apply to billboards, signs or other adver- tising devices legally maintained, at the time of its ap- proval by the Attorney-General, until one year from the first day of July following such approval.


Whoever violates any of the provisions of this By- law shall be punished by a fine of not more than one hundred ($100) dollars, and whoever, after conviction for such violation, unlawfully maintains such billboard, sign or other outdoor advertising device for twenty (20) days thereafter shall be punished by a fine of not more than five hundred ($500) dollars.


If any provision of this By-law is declared unconsti- tutional or illegal by final judgment, order or decree of the Supreme Judicial Court of the Commonwealth, the valid- ity of the remaining provisions of this By-Law shall not be affected thereby.

The Commonwealth of Massachusetts, Middlesex, ss. To any of the Constables of the Town of Arlington, in said County :


Greeting:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabit- ants of the Town of Arlington, qualified as the Constitu- tion requires, to vote in elections, to meet at the polling places designated for the several precincts in said Town on Monday, the second day of March, 1925, at six o'clock in the forenoon, to act on the following Articles, namely :


Article 1. To elect by ballot the following Town officers: a Moderator for one year; a Selectman for three years; a Town Clerk for one year; a Town Treas- urer for one year ; a Collector of Taxes for one year; a member of the Board of Public Works for Three years ; one Assessor for three years; three members of the School Committee for three years; two Trustees of the Robbins Library for three years ; one Trustee of the Rob- bins Library for one year ; one member of the Board of Health for three years; one Park Commissioner for three years; two members of the Planning Board for three years; one Commissioner of the Sinking Fund for three years; one Trustee of the Pratt Fund for five years ; one Trustee of the Edwin S. Farmer Poor Widows' Fund and the Edwin S. For these purposes, the polls will be opened at six o'clock A. M., and remain open until five o'clock P. M., at each of the polling places designated, viz: Precincts One and Two in the Crosby School Building, Winter Street; Precincts Three, Four, Five and Six in the Town Hall; Precinct Seven n the Locke School Building, Park Av- enue, Heights.


You are also required to notify and warn the said inhabitants to meet at the Town Hall in said Town on Thursday, the twenty-sixth day of March, 1925, at eight o'clock in the evening to act on the following articles:


Article 2. To choose or appoint all other usual town officers not hereinbefore mentioned in such manner as the Town may determine.


Article 3. To hear and act on the reports of the Board of Selectmen, of the committee under vote passed April 16, 1923, to investigate the matter of additional fire protection in the western section of the Town, of the com- mittee under vote passed April 16, 1923, to draw up reg- ulations relating to land acquired by the Town in connec- tion with unpaid taxes and assessments of the com- mittee under vote passed October 26, 1922 and April 16, 1923, to investigate the matter of additional school ac- commodations, of the Committee under vote passed March 28, 1923, for the construction of a fire department build- ing, and of other town boards and officers and of the Fi- nance and other committees heretofore appointed.


Article 4. To make an appropriation for the Robbins Library for the ensuing year.

Article 19. To see if the Town will make an appro- priation for the planting of trees, removal of dead and dangerous trees, and for the trimming and general care of existing trees, the same to be expended under the di- rection of the Tree Warden; or take any action thereon.


Article 20. To see if the Town will make an appro- priation for the maintenance and improvement of the pub- lic parks of the Town; determine in what manner the money shall be raised ; or take any action. thereon.

Article 21. To see if the Town will make an appro- priation for the payment of pensions to persons entitled to such pensions under the provisions of law accepted by the Town; or take any action thereon.
