To see if the Town will vote to transfer to the Cape Cod National Seashore, National Park Service, Department of the Interior, its' rights of way and easements in the below-described Town ways: Viz: That part of Lttile Creek Road (so-called) from its' intersection with the southerly side line of Doane Road (so-called) and run- ning southerly to the marsh, thence Easterly along the marsh to the southern end of Doane Road (so-called), as shown on Land Court Plans 14663A and 8939E; also two spur roads that are shown as Town Roads near the southern terminus of Doane Road, on Land Court Plan 8939E, and authorize the Selectmen to take any and all action necessary thereto.

Article 15. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapter 516 and 524, Acts of

1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massa- chusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach outside of Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section II of Chapter 91 of the General Laws, and authorize the Select- men to execute and deliver a bond of indemnity therefor to the Commonwealth.

Article 16. To see if the Town will deed, without consideration, to the Cape Cod National Seashore, National Park Service, Department of the Interior, that parcel of land and beach known as "Nauset Light Beach" and more particularly described as: Parcel 1, being Lots 4 and 6 in Block 16, Nauset Beach Plan 2: Parcel 2, being Lots 1 to 8 inclusive in Block 14, Nauset Beach Plan 2: Parcel 3, being shown as Lot B on Land Court Plan 17649B, filed with Land Court Plan 6751 and being Land Court Plan 30192: Parcel 4, being Lots 4 and 5 in Block 13, Nauset Beach Plan 2, as shown on the Eastham Assessors Maps; reserving to the taxpayers of the Town of Eastham, and their families and/or tenants, the right to use the above described beach, the adjacent parking area and without charge in perpetuity, and authorize the Selectmen to take any and all action necessary thereto. (For the Town's right and title to these parcels see Book 1201 Page 453, Book 540 Page 306, Book 290 Page 217 and Book 637 Page 93).

Article 17. To see if the Town will transfer to the Cape Cod National Seashore, National Park Service, De- partment of the Interior, its' rights of way and easements in the below-described Town ways, reserving full rights of

way to those persons legally entitled thereto and to the tax- payers of the Town of Eastham, and their families and/or tenants, the right to use the same as ways are commonly used in the Town of Eastham both now and hereafter over the same, viz : Cable Road from its' intersection with Nauset Road and running East to its termination at the Atlantic Ocean, said road to be maintained, policed, and kept in good repair by the National Park Service; and authorize the Selectmen to take any and all action necessary thereto.

Article 18. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, the sum of $1,500.00 for the purpose of painting traffic lines on the Town roads and for the pur- chase and erection of signs, under the direction of the Police Department, or take any action relative thereto.

Article 19. To see if the Town will vote to raise and appropriate, or transfer from available funds in the Treasury, a sum of money for the permanent construction of Samoset Road, or take any action relative thereto.

Article 23. To see if the Town will vote to raise and appropriate the sum of $1,100.00 for the purchase of a Rescue Boat, Motor, Trailer and Gear, or take any action relative thereto.

Article 24. To see if the Town will vote to establish a permanent committee on Public Buildings and Parks. Duties of this committee will be to determine the present and future needs of the Town in regard to all Public Build- ings, except schools, and all public Parks and Landings. The committee shall be composed of five members, three of whom shall not be officers or employees of the Town. The Board of Selectmen shall appoint members of the com- mittee annually. The findings and recommendations of the committee shall be made to the Board of Selectmen from time to time and an annual report shall be submitted by the committee to the Town.

Article 25. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, a sum of money for the purpose of building an addition to the present Fire station and heating system, or take any action relative thereto.

Article 26. To see if the Town will vote to raise and appropriate a sum of money to hire a professional planner in an advisory capacity for the purpose of preparing a master plan for the Town of Eastham and suggest any necessary amendments to the zoning by-laws. Said planner to be responsible to the Planning Board.

Article 27. To see if the Town will vote to raise and appropriate the sum of $1,000.00 for supervision, safety and control of recreation at Great Pond, or take any action relative thereto.

Article 28. To see if the Town will vote to raise and appropriate the sum of $1,600.00 for the purchase of a Volkswagon (Sedan) for the Town Nurse department, or take any action relative thereto.

Article 29. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, the sum of $15,500.00 to be spent under the direction of the Board of Assessors for professional equali- zation of land and buildings in the Town of Eastham, or take any action relative thereto.

Article 30. To see if the Town will vote to accept the following by-law, as authorized under Chapter 40, Section 21, sub-section 1, of the General Laws :
"No person, except an officer of the law in performance of his duties, shall enter upon or remain upon the premises of another with the intention of peeking, spying or looking into the window, door or other aperture of a house or struc-

ture in any manner or upon any person or persons therein. Any person found violating this law shall be subject to arrest and any person convicted of this offense shall be fined in an amount not exceeding twenty dollars ($20.00) for each offense."

Article 31. To see if the Town will vote to accept the following by-law as authorized under Chapter 40, Section 21, Sub-section 1, of the General Laws:
"It shall be unlawful for any person to consume alcoholic beverages on Public Highways or in public parking places including vehicles thereon, within the Town of Eastham. Whoever violates the provisions of this by-law shall be fined in an amount not exceeding twenty dollars ($20.00) for each offense.
No recommendation.
Article 32. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, the sum of $20,000.00 for the purchase of the following lots from Florence Dorrie and Ernest and Helen Kirst, being shown as Lots 47, 48, 49 and 50 on Land Court Plan 10513-A, for a parking lot and bathing beach ; Said lots adjoin Town owned land at Cook's Brook Beach (so-called), or take any action relative thereto.
Recommended.
Article 33. To see if the Town will raise and appro- priate, or transfer from unappropriated available funds in the Treasury, the sum of $800.00 for the purpose of installing flood lighting in the Town Hall parking lot, and that the Moderator appoint a committee of three to make said in- stallation, or take any action relative thereto.

Article 34. To see if the Town will add to Article 5 of the Building by-laws and hereafter provide that all appli- cants for building permits will be required to submit to the building inspector the following :
A. A suitable scaled plot plan of a permanent type showing actual dimensions of the lot to be built upon, the size of buildings to be erected there and their location within the lot.
B. To show the proposed location of wells and sewerage disposal facilities.
C. To require sufficient permanent concrete bounds in order to clearly define the lot limits on the street or way.
No recommendation.
Article 35. To see if the Town will require that any building or premises to be occupied, either partially or in its entirety, for whatever purposes shall require a certificate of occupancy to be issued by the building inspector, stating that such building or buildings, or premises, is in com- pliance with the Town by-laws. Such certificate of occu- pancy shall be filed with the town clerk and kept a per- manent part of the record. This requirement shall apply to any change, alteration or extension of an existing use of land or buildings for which a building permit is henceforth is- sued. The certificate of occupancy shall be applied for at the same time as the building permit is requested. Such certifi- cates shall be issued only upon the completion and compli- ance of the by-laws.

Article 36. Under Article 6 the Building Code, to see if the Town will require that the value of the building shall be computed at the rate of $12.00 per square foot in area of the first floor and at the rate of $6.00 per square foot for each additional floor designed for living purposes.

Article 37. To see if the Town will require that work must be commenced within a 60 day period of the date of issuance of the building permit and the exterior of any building shall be completed within the year of that date. Failure to do so will void the permit and work shall not be resumed until a new permit has been issued.

Article 38. Delete Article 7 of the zoning by-laws and substitute : To see if the Town will require of non-conform- ing uses as follows :
Any non-conforming building, structure or use exist- ing upon the effective date of this by-law may be continued, rebuilt if damaged or destroyed. Whenever a non-conform- ing building, structure or use shall have been ceased for a period of one year, such building, structure or use shall thereafter be required to become conforming.

Article 39. To see if the Town will require that any fence, hedge or enclosure wall on a corner lot or curb ob- structing the view of motorists and situated within a fifteen foot area of such street or curb shall not exceed the height of three feet. Any and all trees that are situated in the same manner shall be limbed to the height of six feet.

Article 40. To see if the Town will require a fee in the amount of ten dollars ($10.00) shall accompany each appli- cation that is petitioned of the Board of Appeals.

Article 41. To see if the Town will amend the zoning by-law as adopted February 18, 1952, and as amended Feb-

ruary 18, 1963, by striking out from Paragraph 8, Section V-B the following words :
"The setback required by the by-laws of 1962 from all streets and from the abutters' property lines" and sub- stituting therefor the words:
"A fifty foot setback from all streets measured at a right angle with the line of the streets and a twenty-five foot distance from abutters' property lines".

Article 42. To see if the Town will delete Paragraph 4, Section 5 of the zoning by-laws and substitute the fol- lowing : "In Districts C and D business buildings shall have a minimum set-back of 100 feet from all streets and high- ways. The side and rear lot lines of all commercial build- ings, regardless of class of structure, shall not be less than 12 feet from such lines.

Article 43. To see if the Town will vote to accept Chapter 478 of the Acts of 1963 relative to increasing the amounts of pensions and retirement allowances payable to certain former public employees.

COVER STORY
The Outermost House, which is featured on the cover of this Town Report for 1964, was for a year the home of Mr. Henry Beston, author of the famous book of the same name. The Outermost House has long been an historical landmark and was officially recognized as such this year by the Cape Cod National Seashore and the Commonwealth of Massachu- setts, and a plaque has been placed on the house declaring it to be a National Literary Monument.
When we wrote Mr. Beston, suggesting that we would like to picture his house on our cover he replied that he was very pleased, and we quote, "I shall always remain deeply grateful to Eastham for the wonderful year on the beach and the added gifts of friendship and peace."
The cover was designed by Mr. James Kingsland, a resident artist. It is so designed that it may be used in future years, featuring other landmarks in Eastham, and we wish to express our appreciation to Mr. Kingsland for his contribution of this original design.
