Article 7. To see if the Town will vote to raise and appropriate the sum of $1,100.00 for the purchase of a Police Cruiser, and the present Cruiser to be traded in as a credit towards the new.

Article 14. To see if the Town will vote to amend and change the By-Law regulating the construction, reconstruc- tion and location of buildings by adding further regula- tions to Section I as follows :


Article 1


A. Building Lines


In the first sentence add the words "raised terraces, sundecks" between the words "piazzas" and "and" and add the words "whether roofed or uncovered" following the word "projections" so that the sentence will read: The exterior walls of a building at or above the ground, in- cluding bay windows, porches, piazzas, raised terraces, sun- decks and similar projections whether roofed or uncovered.


D. Altered or Alteration


(2) Substitute the words "in which the value of such rebuilding or change is in excess of five hundred dollars" for the words "which exceeds 20 percent of the assessed value" so that the sentence will read: The rebuilding or change of any nature in structures of every kind, in which the value of such rebuilding or change is in excess of five hundred dollars and which is not in the nature of ordinary repair or maintenance.

E. Additions


Add after the word "increased" the following words "or the relationship of the building and lot lines are changed" so that the sentence will read: The addition to a structure by which its floor area is increased or the re- lationship of the building and lot lines are changed.


Article 4. Delete the first sentence.


Article 5. Paragraph 1


Delete existing wording and substitute the following :


Application for permit to erect, construct, reconstruct, alter or add to a structure shall be on forms provided. Applicants shall be required to give such information re- garding the proposed work as the Board of Selectmen shall ascribe in addition to the following requirements : Applicant shall provide a suitably scaled plot plan showing the following: Streets or ways on which the lot fronts. Location of sufficient permanent concrete bounds to clear- ly define the lot limits on the streets or ways. Location of the building lines of the proposed structure or struc- tures relative to all lot boundary lines. Proposed location of all wells and all sewage disposal facilities.


Article 11 Building Lines


Add the word "detached" between the words "of" and "structures" in the second sentence so that the sentence shall read: The building lines of detached structures which are necessary to wood framed structures for human habi- tation shall not be nearer to side and rear lot lines than 12 feet, nor nearer to the nearest boundary of any way than 30 feet.


Article 13 Fire Prevention


Add: "Motels - Fire partitions shall be installed as described herein :


(a) In one story motels, fire partitions shall be in- stalled between each five (5) units.


(b) In two story motels, fire partitions shall be in- stalled between each two (2) units per floor.


(c) Fire partitions shall consist of 8 inch masonry block

or brick, covered on both sides with plaster or gypsum board, or fire partitions may be constructed of gypsum block (such as "Pyrobar" as manufactured by U. S. Gypsum Company) and nogging full height in wood stud partitions with plaster or gypsum board applied on both sides of the partition.


(d) Attic spaces shall be cut off to prevent the spread of fire by extending the fire partitions from the ceiling line of the top story to the underside of the roof decking. Those attic fire partitions may be a single wall of either five-eighths inch gypsum board or five-eighths inch plywood.


(e) In basement or crawl spaces fire partitions shall be installed in locations as specified in paragraphs (a) and (b) above. Fire partitions shall be of the same con- struction as specified in paragraph (c) above.


Article 15 Minimum requirements for Dwellings


A Foundations :


Delete the existing wording and substitute the fol- lowing :


Excavations : 1. All excavations shall extend to stabi- lized ground. 2. All excavations shall extend to at least eighteen (18) inches below the finished grade.


Footings: 1. All footings must be constructed of con- crete. 2. Footings must be installed under all concrete block walls and under all poured concrete walls less than ten (10) inches thick. Minimum size of footings shall be six (6) inches thick under one story buildings and eight (8) inches thick under all buildings over one story, with a minimum projection of four (4) inches on either side of wall in all cases. 3. Footings under all solid masonry or concrete filled steel columns shall be a minimum of eight (8) inches thick by a minimum dimension of twenty (20) inches whether square or circular. 4. Footings under all chimneys shall be at least twelve (12) inches thick and shall extend at least eight (8) inches in all directions from the outside of the chimney base.

D Framing :


Add: 1. First floor girders must rest on solid masonry or concrete filled steel columns. 2. Floor joists shall be doubled under all partitions running parallel to the floor joists. 3. All floor joist headers over four (4) feet long shall be doubled. 4. All floor joists on which headers bear shall be doubled. 5. Floor joists shall be cross bridged when span exceeds eight (8) feet. Bridging shall be lo- cated in the center of the span. At least one by three or stronger stock shall be used. Metal bridging or solid blocking may be substituted for stock specified. 6. Ex- terior wall studs and bearing partition studs shall be at least two by four stock spaced not over sixteen (16) inches on center. Two by four shoes and double two by four, or equivalent, plates shall be used for all exterior walls and bearing partitions. 7. All openings in exterior walls and bearing partitions shall have headers sized in accordance with the following table : Up to 4 feet long - 4 inch nominal depth by full thickness of wall -- 4'-0" to 5'-6" long - 6 inch nominal depth by full thickness of wall -- 5'6" to 7'-0" long 8 inch nominal depth by full thickness of wall -- over 7'-0" long - 10 inch nominal depth by full thickness of wall. 8. All ceilings shall be strapped with stock at least one by three inches spaced at a maximum distance of sixteen (16) inches on centers.


Recommended.


Article 15. To see if the Town will vote to authorize the Assessors to negotiate a contract with the United Ap- praisal Company for the purpose of assessing new build- ings and land, for the year 1966, and raise and appro- priate the sum of $700.00 to meet the cost of the contract, or take any action relative thereto.


Recommended.


Article 16. To see if the Town will vote to amend Section 1 of the Town By-Laws, pertaining to the date of the Annual Town Meeting, to read "the first Monday in

March" instead of the "third Monday in February." as it now reads.


Recommended.


Article 17. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, a sum of money for the purpose of constructing and equipping a Highway Garage Building, on Town owned property, and authorize the Selectmen to execute contracts and do all things necessary thereto, or take any action relative thereto.


Recommended.


Article 18. To sec if the Town will vote to appropriate a sum of money for constructing and equipping an addi- tion to the Town Hall and to determine whether the funds shall be provided by transfer from available funds in the Treasury or by borrowing under the provisions of General Laws, Chapter 44, Section 7 (Clause 3), or a combination thereof, and to authorize the Committee to execute con- tracts and do all things necessary to construct and equip said addition.

Article 19. To see if the Town will vote to authorize the Selectmen to have the existing Highway Garage Build- ing, located on the Town Hall grounds, demolished, or take any action relative thereto.

Article 20. To see if the Town will vote to authorize the Selectmen to have the existing Band Stand, located on the Town Hall grounds, demolished, or take any action relative thereto.

Article 21. To see if the Town will vote to raise and appropriate, or transfer from available funds in the Treas- ury, the sum of $4,000.00 to be spent under the provisions of Chapter 90, or take any action relative thereto.

Article 22. To see if the Town will vote to raise and appropriate the sum of $4,500.00 to grade and surface part of Camp Ground Landing parking lot, or take any action relative thereto.

Article 23. To see if the Town will vote to authorize the Selectmen to enter into an agreement with the Public Access Board of the Department of Natural Resources to permit the Board to construct a boat ramp, and related parking facilities, at Rock Harbor, to provide public ac- cess to the waters within the Town of Eastham and that such agreement shall include an acceptance and police responsibilities on the part of the Town and the facilities shall be open to the general public on equal terms.

Article 24. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, the sum of $9,500.00 for the pur- pose of driving, or drilling, test wells in order to locate a supply of water for a future public water system, or take any action relative thereto.

Article 25. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as most recently amended by Chapter 5, Acts of 1955, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, main- tenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Common- wealth.

Article 26. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, a sum of money, to be used in conjunction with State and County funds, under Chapter 91, to construct two (2) stone jetties at South Sunken Meadow Town Landing, or take any action relative thereto.

Article 27. To see if the Town will vote to amend the zoning map, and the zoning By-Laws, by adding the following sentence to Description of "Permissive Use" area : "To a depth of 500 feet on the Westerly side of Route 6 from the Southerly bound of Commercial Area C southerly to the ditch in land of Obed Fulcher, and to a depth of 500 feet on the easterly side of Route 6 from the Southerly bound of Commercial Area C southerly to the ditch dividing the land of Clayton O. Horton and Mary A. Chase", or take any action relative thereto.

Article 28. To see if the Town will vote to raise and appropriate the sum of $2,000.00 for the purpose of pur- chasing road equipment, or take any action relative thereto.

Article 36. To see if the Town will vote to raise and appropriate the sum of $2,000.00 to be used as compensa- tion for a Plumbing Inspector, or take any action relative thereto.

Article 39. To see if the Town will vote to accept and enforce the following by-law :


A. It shall be unlawful for any person or persons occupying or having charge of any building or premises or any part thereof in the Town, other than that section of any establishment licensed under Chapter 138 of the General Laws, between the hours of 12 midnight and 8 A. M. to cause or suffer or allow any unnecessary, loud, excessive or unusual noises in the operation of any radio, phonograph or other mechanical sound making device or instrument, or reproducing device or instrument, or in the playing of any band, orchestra, musician or group of mu- sicians, or in the use of any device to amplify the afore- said. or the making of loud outcries, exclamations or other loud or boisterous noises or loud and boisterous singing by any person or group of persons or in the use of any de- vice to amplify the aforesaid noise, where the noise is plan- ly audible at a distance of one hundred and fifty feet from the building, structure, vehicle or premises in which or from which it is produced. The fact that the noise is plainly audible at a distance of one hundred and fifty feet from the vehicle or premises from which it originates shall constitute Prima Facie evidence of a violation of this by-law. Any person violating this by-law shall be pun- ished by a fine of not more than twenty dollars for each offense.


B. It shall be unlawful for any person or persons being present in or about any building, dwelling, premises, shelter, boat or conveyance or any part thereof, other than that section of any establishment licensed under Chapter 138 of the General Laws, who shall cause or suffer or coun- tenance any unnecessary, loud, excessive or unusual noises including any unnecessary, loud, excessive or unusual noises in the operation of any radio, phonograph or other mechan-

ical sound making device or instrument, or reproducing device or instrument, or in the playing of any band, orchestra, musician or group of musicians, or the making of loud outeries, exclamations or other loud or boisterous noises or loud and boisterous singing by any person or group of persons, or in the use of any device to amplify the aforesaid noise, where the aforesaid noise is plainly audible at a distance of one hundred and fifty feet from the building, dwelling, premises, shelter, boat or convey- ance in which or from which it is produced. The fact that the noise is plainly audible at a distance of one hundred and fifty feet from the premises from which it originates shall constitute Prima Facie evidence of a violation of this by-law. Any person shall be deemed in violation of this by-law, who shall make, or aid and abet, or cause or suffer or countenance, or assist in the making of the aforesaid and described improper noises, disturbance, breach of the peace or a diversion tending to a breach of the peace, and the presence of any person or persons in or about the building, dwelling, premises, shelter, boat or convey- ance or any part thereof during a violation of this by-law shall constitute Prima Facie evidence that they are a countenancer to such violation. Any person violating this by-law shall be punished by a fine of not more than twenty dollars for each offense.

Article 40. To see if the Town will vote to raise and appropriate the sum of $3,500.00 to surface the original Parking Lot at First Encounter Beach, or take any action relative thereto.

Article 41. To see if the Town will vote to raise and and appropriate the sum of $3,000.00 to surface a portion of the new parking lot at Cook's Brook Town Landing, or take any action relative thereto.

Article 42. To see if the Town will vote to adopt the following By-Law :


"It shall be unlawful to fill, dredge, grade, place any structure or sewerage disposal unit below a point four (4) feet above mean high water in the case of salt water areas or four (4) feet above average heights of fresh water areas within the Town of Eastham. High water marks and average fresh water heights shall be decided by a major- ity vote of the Selectmen, acting as the Board of Health, and the Conservation Commission".

Article 43. To see if the Town will vote to execute a deed running to Virginia C. Wholly in order to clear up title deficiency and remove any cloud from the title there- on caused by the Town of Eastham, or take any action relative thereto.

To see if the Town will vote to accept a triangular piece of property, consisting of about 21,000 square feet, more or less, located on the northerly boundary of the Eastham Fire Station and Route 6 from the Cape Cod National Seashore in exchange for Town owned land located on Nauset Beach Plan 1 Block B 2 Lots 1 & 2, Block C 3 Lots 3, 4, 5 & 6, Block D 4 Lots 3, 4 & 5, Block W 21 Lots 1, 2 & 4 and Ocean View Plan Block F Lots 8 & 10, or take any action relative thereto.

Article 45. To see if the Town will vote to grant a piece of land to the State for highway access in order to widen the State Highway, or take any action relative thereto.


Not recommended.


Article 46. To see if the Town will vote to raise and appropriate a sum of money, to be used together with funds provided by the Towns of Orleans and Wellfleet, to purchase a school bus to be jointly owned and con- trolled by the school committees of School Union 53, and

authorize the school committees to take any action rela- tive thereto.

Article 47. To see if the Town will vote to accept a private road, known as Western Avenue on the Carlton Shurtleff Plan, under the provisions of Section II Clause D of the Town of Eastham By-Laws, and the General Laws of Massachusetts, and raise and appropriate the sum of $100.00 for said purpose, or take any action relative thereto.

Article 48. To see if the Town will vote to raise and appropriate the sum of $6,500.00 to pave Western Avenue, so called, or take any action relative thereto.


Recommended, Yes 6 No 1.


Article 49. To see if the Town will vote to transfer from available funds in Highways, Chapter 679, the sum of $6,091.64 for the following project on Depot Road and Route 6, work to consist of reconstruction, widen and re- surface with 3" Type C-1 mix, also to pay for any work by Town for land damages, layout costs, fire house traffic control box and ducts to proposed state highway traffic light system, or take any action relative thereto.


Not recommended.


Article 50. To see if the Town will vote to transfer from unappropriated available funds in the Treasury the sum of $20,000.00 to reduce the tax rate, or take any action relative thereto.


Recommended.


Article 51. To see if the Town will vote to acquire by gift land to be used as an entrance to Hay Road at Route 6, or take any action relative thereto.


Recommended.
