ANNUAL TOWN MEETING WARRANT


THE COMMONWEALTH OF MASSACHUSETTS


Barnstable, ss.


To Harvey T. Moore, Constable of the Town of Eastham, in the County of Barnstable :


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town qualified to vote in elections and Town affairs to meet at the Town Hall on Monday, the Eighteenth (18) day of February next at 7:00 o'clock in the evening, then and there to act on the following articles in this Warrant and to meet in the Town Hall at 10:00 o'clock in the morning on Tuesday, the Nineteenth (19) day of February next, then and there to elect all necessary officers.


POLLS TO OPEN AT 10:00 A.M. AND MAY CLOSE AT 6:00 P.M.


Article 1. To see in what manner the Town will vote to dispose of its refunded dog tax.


Recommended that the Town place the refunded dog tax at the disposal of the Public Library.


Article 2. To see if the Town will vote to authorize 'he Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1963, and issue a note or notes therefore, payable in one year and renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


Recommended.


Article 3. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow

money from time to time in anticipation of reimbursement for the financial year beginning January 1, 1963, and to issue a note or notes therefore, payable in one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44, General Laws.


Recommended.


Article 4. To see if the Town will vote to raise and appropriate a sum of money not to exceed $1,000.00 for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certified by the Selectmen to be residents of the Town and unable to pay for such care and treatment, in accordance with Chapter III, Section 74, General Laws, or take any action relative thereto.


Recommended $500.00.


Article 5. To see if the Town will vote to authorize the Selectmen to sell property taken under Tax Title pro- cedure by the Town, and raise and appropriate the sum of $500.00 for this purpose, or take any action relative thereto.


Recommended.


Article 6. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, a sum of money for Chapter 81 Highways, or take any action relative thereto.


Recommended $4,000.00.


Article 7. To see if the Town will vote to raise and appropriate the sum of $950.00 for the purchase of a Police Cruiser, and the present Cruiser to be traded in as a credit towards the new.


Recommended.


Article 8. To see if the Town will vote to raise and appropriate the sum of $3,000.00 to be paid to the Town of Orleans for Ambulance, Fire and Police Dispatcher Service for the year 1963.

Article 10. To see if the Town will vote to raise and appropriate a sum of money for the purpose of holding five Band Concerts in the ensuing year, or take any action relative thereto.

Article 14. To see if the Town will vote to raise and appropriate the sum of $1,000.00 for the purpose of pur- chasing and equipping a Patrol Fire Truck, the old one to be sold.

Article 15. To see if the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended by Chapter 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massa- chusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores and shores along a public beach outside of Boston Harbor, including the Merrimack and Connecticut Rivers, in accordance with Section II of Chapter 91 of the General Laws, and authorize the Select- men to execute and deliver a bond of indemnity therefor to the Commonwealth.


Recommended.


Article 16. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, the sum of $3,300.00 for the purchase of "Tone Control" alerting receivers, for the use of the Fire- men.


Recommended.


Article 17. To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the Treasury, the sum of $1,500.00 for the purpose of painting traffic lines on the Town roads and for the pur- chase and erection of signs, under direction of the Police Department, or take any action relative thereto.


Recommended.


Article 18. To see if the Town will deed, without con- sideration, to the Cape Cod National Seashore, National Park Service, Department of the Interior, that parcel of land and beach known as "Coast Guard Beach" and more particu- larly described as parcels No. 25, No. 26, No. 27 and No. 31. Block 17, Sheet 4A, as shown on the Eastham Assessors Map; reserving to the taxpayers of the Town of Eastham, and their families and/or tenants, the right to use the above- described beach, the adjacent parking area and facilities

without charge in perpetuity. And reserving to those per- sons legally entitled thereto the right. to pass and repass over the same by appropriate ways between the Town road and property lying southerly of the above-described premises, and to use said ways as ways are commonly used in the Town of Eastham both now and hereafter; and authorize the Selectmen to take any and all action necessary thereto.


Article 19. To see if the Town will transfer to the Cape Cod National Seashore, National Park Service, De- partment of the Interior, its rights of way and easements in the below-described Town ways, reserving full rights of way to those persons legally entitled thereto and to the taxpayers of the Town of Eastham, and their families and/or tenants, the right to use the same as ways are commonly used in the Town of Eastham both now and hereafter over the same, viz : Nauset Road from its intersection with Route 6 running thence Easterly and Northerly a distance of about eight-tenth (.8) mile to the intersection of Doane Road; and Doane Road from the intersection of Nauset Road run- ning thence Easterly and Southerly a distance of about one and one-tenth (1.1) miles to Coast Guard Beach, so-called, said roads to be maintained, policed, and kept in good re- pair by the National Park Service ; and authorize the Select- men to take any and all action necessary thereto.

Article 20. To see if the Town will vote to accept an invitation to participate in Wellfleet's two hundredth Anni- versary Celebration, and raise and appropriate a sum of money for same, or take any action relative thereto.


Recommend $200.00.


Article 21. To see if the Town will vote to amend the Zoning By-Laws of the Town of Eastham, as adopted February 18, 1952, and as amended from time to time, as follows :


That section of the Zoning or Protective By-Law, ro-

lating to the establishment of districts, is amended to read as follows :


SEC. II. ESTABLISHMENT OF DISTRICTS


1. Classes of Districts. The town of Eastham is hereby divided as shown on the Zoning Map dated Feb. 18, 1952 and amended to date, and filed with the Town Clerk, into 5 classes of districts, the effect of which will be to add a Seashore District and to place all the area of such towns lying within the Cape Cod National Seashore in a Seashore District. The classes of districts shall hereafter consist of the following :


a. Residential and Agricultural, District A.


b. Residential and General Farming, District B.


c. Commercial, Districts C & D.


d. Permissive Use.


e. Seashore District.


A new section is inserted to read as follows :


SEC. 5-B. SEASHORE DISTRICT


The Seashore District is intended to further preservation and development of the Cape Cod National Seashore in accor- dance with the purposes of the Act of Congress of August 7, 1961 (75 Stat. 284, 291) ; to prohibit commercial and in- dustrial uses therein; to preserve and increase the ameni- ties of the town ; and to conserve natural conditions, wildlife and open spaces for the education, recreation and general welfare of the public.


Permitted Uses.


1. Conservation of land, water, wildlife, vegetation, and other natural features and values.


2. Facilities deemed by the Secretary of the interior to be necessary for the administration and public use and enjoy- ment of the Cape Cod National Seashore or deemed to be necessary by the Town of Eastham.


3. Recreation, including but not limited to, hunting, fishing, swimming and boating.


4. Gardening and traditional agricultural uses of cleared land, but excluding such objectionable uses as a piggery or the commercial raising of livestock, fur-bearing animals and

poultry, or other uses injurious, noxious or offensive to the neighborhood.


5. Traditional commercial fishing activities, the opening of shellfish, and storage and use of fishing equipment.


6. Uses of existing dwellings as residences and acces- sory uses customarily incidental to the principal residential use on the same premises, provided such uses are not detri- mental to a residential neighborhood and do not alter the essential character of the dwelling as a residence. Residential uses of dwellings may include the renting of rooms and furnishing of board by residents of the premises to over- night guests, if such uses do not alter the essential character of the dwellings as residences.


7. Customary or self home occupations as defined in Section III, paragraph 7, of the Town of Eastham By-Laws, Rules and Regulations, but this shall not include the use of acces- sory structures as stores or for the display of goods to the passing public.


8. Moving, alteration, enlargement, maintenance, repairs of existing one-family residential dwellings or the erection of customary structures which will be accessory to the exist- ing principal residential use provided that such improve- ments to existing dwellings and the erection of accessory structures will afford not less than the setback required by the By-Laws of 1962 from all streets and from the abutters' property lines and further do not alter the essential char- acter of the dwelling as a residence. In appropriate cases, the Board of Appeals may approve lesser set back or side vard requirements for improvements to existing dwellings or for the erection of accessory structures, provided they do not alter the residential character of the premises.


9. Religious and educational use.

11. Detached one-family dwellings and accessory structures, provided that no lot may be used for their construction which has a frontage of less than 150 feet, and an area of less than 40.000 square feet, and no dwelling or building may be lo-

cated in such manner as to provide less than a 50-foot setback from all streets measured at a right angle with the street line and a 25-foot distance from abutters' property lines.


12. The display of not more than one single-faced or one double-faced sign on property of a residential occupant which shall pertain to the occupancy, sale or rental of such property as herein authorized and such sign shall not exceed two square feet in area and shall not be of a type or style em- ploying or using neon, fluorescent, or other direct illumin- ation ; provided that the above limitation shall not apply to facilities deemed by the Secretary of the Interior to be necessary on federally owned property for administration and public use and enjoyment of the Cape Cod National Seashore or to facilities of the Town of Eastham on town owned land.


Except as provided above there shall be in the Seashore District :


1. No burning of cover unless determined by the Fire Chief to be necessary for the welfare and safety of the town and such burning shall be in accordance with the requirements of Section 13, Chapter 48 of the General Laws.


2. No filling of land, dumping, or removal of soil, loam, sand, or gravel in excess of 5 cubic yards.


3. No cutting of timber except : (a) by an owner for the purpose of reasonably controlling brush or trees ; (b) main- tenance cutting in pastures ; and (c) cutting for clearance or maintenance on rights-of-ways including those pertain- ing to public utilities or public highways.


4. No building or structures.


5. No commercial or industrial venture or activities.


6. No drainage, damming or relocation of any water course except by a publicly authorized agency for the pur- pose of pest control.


7. No continuous storage of materials or equipment. Applicants for variances or exceptions shall be promptly notified by the Board of Appeals that the Secretary of the

Interior is authorized to withdraw the suspension of his au- thority to acquire, by condemnation, property which is made the subject of a variance or exception that, in his opinion, fails to conform or is in any manner opposed to or in- consistent with the purposes of the Cape Cod National Sea- shore. The Secretary of the Interior shall be given notice by the Board of Appeals, of all applications or petitions made for variances or exceptions to the bylaws for the Seashore District and he shall be provided notice by the Building In- spector of all applications for building permits involving the Seashore District within seven (7) days of receipt of the applications or petitions. The Secretary may be consulted at any time by zoning authorities or by the owner of "improved property" regarding the effect of a proposed variance or exception upon the status of the affected property with re- gard to the suspension of the Secretary's authority to con- demn. The Secretary, within 60 days of the receipt of a request for such determination, or as soon thereafter as is reasonably possible, shall advise the owner or zoning au- thorities whether or not the intended use will subject the property to acquisition by condemnation. Subsequently, to meet the requirements of the Act of Congress of August 7, 1961, the Secretary shall be given notice by the appropriate board of any variance, or exception, or building permit, granted or denied for the area within the Seashore District.
