WARRANT FOR THE ANNUAL TOWN MEETING MARCH 14, 1961


COMMONWEALTH OF MASSACHUSETTS


Norfolk, ss.


To either of the Constables of the Town of Franklin in the County of Norfolk.


Greetings:


You are hereby required in the name of the Commonwealth of Massachusetts to notify and warn the qualified voters of the said Town of Franklin to assemble in the High School on Tuesday, the Fourteenth day of March, A.D., 1961, it being the second Tuesday of March at six o'clock in the forenoon and remain in session until eight o'clock in the evening then and there to act on the following articles, viz:


Article 1. To choose by ballot the following Town Officers, viz: A Moderator, a Town Treasurer, a Town Auditor, a Collector of Taxes, three Selectmen, three Members of the Board of Public Welfare and three Constables, all for the term of one year; one Member of the Board of Assessors, one Member of the Board of Public Works, one Member of the Board of Public Health, one Member of the School Committee, and one Member of the Town Planning Board (to fill vacancy), all for the term of three years; and one Member of the Town Planning Board and one Member of the Franklin Housing Authority, both for the term of five years.


Article 2. To choose all other necessary Town Officers.


Article 3. To hear a report of the Town Officers and Committees and act thereon.


Article 4. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money, from time to time in anticipation of the revenue of the financial year, begin- ning January 1, 1961, and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17, Chapter 44 of the General Laws.


Article 5. To see what sum of money the town will raise and appropriate for the following purposes, to wit:

1. For general government, including the Compensation and expenses of the Selectmen, Auditor, Moderator, Collector of Taxes, Treasurer, Assessors of Taxes, Town Clerk, Elections and Registration, Dog Officer, Planning Board, Advisory Board, Field Driver, Town Hall, Town Counsel, Building Inspector, Wire Inspector and other finance accounts.


2. For Protection of Persons and Property, including the payment of Police, Bicycle Registration, Support of Fire Department, Sealing of Weights and Measures and for Prevention and Suppression of Forest Fires and Civil Defense.


3. For Health and Sanitation, including expenses of the Board of Health, Inspection of Animals, Inspection of Meats and Provisions and Inspection of School Children.


4. For the Department of Public Works, including Administration and Clerical; Labor, Supervision and Maintenance; Pest Control; Snow Removal; Swimming Pool Maintenance.


5. For Street Lighting, Union Street Cemetery, Recreation and Recreational Facilities of the Town including the Lifeguards for the Swimming Pool.


6. For Public Welfare, Welfare Administration and Welfare Assistance.


7. For Veterans' Center and Benefits, including Soldiers' Burials.


8. For education, including all expenses of the School Committee.


9. For the Franklin Public Library.


10. For the various Insurance Accounts, including Fire Insurance, Fleet Fire and Theft, Fleet Liability and Property Damage, Workmen's Compensation, and Group Life and Hospitalization.


11. For unclassified accounts, including Ambulance Maintenance, the Decoration of Soldiers' Graves, Printing and Distribution of the Town Reports, for the Town's share of cost of Maintenance of Norfolk County Retirement System, Foreclosure of Tax Liens, and also for Rent of Quarters for the Veterans of Foreign Wars, Disabled American Veterans and American Legion.


12. For the Payment of Interest on Town Debts.


13. For the Payment of Municipal Indebtedness.


Article 6. To see if the Town will vote to use the interest of the Helen A. Ward Fund, amounting to Three Dollars and Thirty-eight Cents ($3.38) for the care of the Ward Cemetery Lot at the City Mills Cemetery, to be expended under the direction of the Board of Public Works, or do anything relating thereto. (By Selectmen)

Article 7. To see if the Town will vote to use the interest of the Lucretia Pond Fund, amounting to Eighty-five Dollars ($85.00) for the care of Town Cemeteries to be expended under the direction of the Board of Public Works, or do anything relating thereto. (By Selectmen)


Article 8. To see if the Town will vote to raise and appropriate a sum of money for a Special Reserve Fund to be used for extraordinary or unforeseen expenses, or do anything relating thereto. (By Selectmen)


Article 9. To see if the Town will vote to raise and appropriate the sum of One Hundred Dollars ($100.00) to purchase eyeglasses and spectacles for children under eighteen years of age and whose parents or guardians are financially unable to provide them, the same to be expended under the direction of the Selectmen, as provided for in amendment to Section V. Chapter 40 of the General Laws, or do any- thing relating thereto. (By Selectmen)


Article 10. To see if the Town will vote to transfer the amount of One Thousand Nine Hundred Eighty-eight Dollars and Eighty-one Cents ($1,988.81) from the Road Machinery Fund to the Road Ma- chinery Account, or do anything relating thereto. (By B.P.W.)


Article 11. To see if the Town will vote to appropriate the Dog License money ($1,021.40) received for the present year for the support of the Schools or Public Library, or do anything relating thereto. (By Selectmen)


Article 12. To see if the Town will vote to raise and appropriate the sum of Three Thousand Nine Hundred Dollars ($3,900.00) to pay Seventy-five Dollars ($75.00) weekly for the use of the Town Dump; that the Town owned bulldozer be furnished for leveling off said dump, free of charge, with driver, at least once a year and not more than four times a year; that exterminator in sufficient quantity be supplied by the proper authorities to the owner to be applied by him for the exter- mination of rats; and authorize the Selectmen to execute a lease for one year with the option of renewal yearly for the following four years, or to do anything relating thereto. Article 13. To see if the Town will vote to use the interest of the City Mills Cemetery Fund, for the care of the City Mills Cemetery, to be expended under the direction of the Board of Public Works, or do anything relating thereto. (By Selectmen) (Amount of Interest: $68.84)


Article 14. To see if the Town will vote to transfer from Sewer Available Surplus to Municipal Indebtedness the sum of Eight Hundred Twenty-nine Dollars and Ninety-three cents ($829.93) to cover pay-

ment on Sewer Loan debt maturing in 1961, or do anything relating thereto. (By Treasurer)


Article 15. To see if the Town will vote to raise and appropriate or appropriate from available funds the sum of One Thousand Dollars ($1,000.00) for the proper observance and celebration of the Christmas season by the decoration and illumination of public buildings and public streets, and for the purchase, installation and decoration of Christmas trees upon municipal lands, to be expended under the direc- tion of the Selectmen, or do anything relating thereto. Article 16. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Five Thousand Dollars ($5,000.00) for the repair and maintenance of Chapter 90 Roads, said sum to be used in conjunction with any money which may be allotted by State or County, or both, for this purpose, the same to be expended under the direction of the Board of Public Works or take any action relative thereto. Article 17. To see if the Town will vote to raise and appropriate or transfer from available funds, the sum of Seven Thousand Dollars ($7,000.00) for Chapter 90 New Construction Grove Street, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose, to be used under the direction of the Board of Public Works, or take any action relative thereto. Article 18. To see if the Town will vote to amend its present by-law, known and cited as the Building By-Law as follows:


By inserting immediately following lettered paragraph "A" of Section 2 of Article 3 the following new paragraph to be lettered "B":


"B. Top of foundation wall of any building (that is the regulation distance from street) shall be at least six (6) inches higher than the sidewalk or crown of the road. In all the above cases grade must pitch toward the street. A building that is set back from the street more than one hundred twenty-five (125) feet may be set lower than the road if other conditions permit, provided provision was made at street line to prevent water from running on the lot."


By inserting in Section 12 of Article 8, immediately preceding present sub-section "(a)," the following new paragraph:


"Grades of framing and boarding lumber to be used. All framing and boarding lumber (if western) shall be construction and standard grades or better. No utility or economy grades are to be used. If eastern lumber, number one and two common for framing and number

three common or better for boarding. No soft pine lumber is to be used for framing. No green lumber is to be used for framing."


By inserting in Section 14 of Article 8, immediately following the present sub-section "(c)," the following paragraph to be designated "(d)":


"(d) Roof shingle exposure in relation to roof pitches. No roof with a pitch of less than four (4) inches shall be shingled with standard 12" x 36" strip, asphalt slate surface shingles. On any pitch of four (4) inches up to five (5) inches, these standard twelve (12) inch must be laid with not more than four (4) inches exposure to the weather. On a roof of three (3) inches up to four (4) inches, 15" x 36" strip asphalt slate surfaced shingles may be used. On all roofs less than three (3) inch pitch, double coverage cemented slate surfaced roofing or four or five ply built up asphalt roofing must be used. Use fifteen (15) 1b. asphalt felt under all roofing. No roofing shingles shall be laid with staples, only large head galvanized roofing nails are to be used. Plywood used for roof boarding must be at least one-half (1/2) inch thick."


By inserting in Section 18 of Article 8, immediately following the present sub-section "(b)", the following paragraph to be designated "(c)":


"(c) Required-A wire-lathed and plastered ceiling ten (10) by ten (10) feet over all coal, oil, and gas fired house and small building heaters."

Article 19. To see if the Town will vote to transfer the sum of Thirty-one Thousand Dollars ($31,000.00) from the Excess and Defi- ciency Account, or authorize the Town Treasurer to borrow from time to time as necessary to meet the State and County Allotments for Chapter 90 Maintenance and Chapter 90 Construction, provided that all reimbursements from the State and County shall be credited back immediately upon their receipt to the Surplus Revenue Account, or do anything relating thereto. Article 20. To see if the Town will vote to raise and appropriate the sum of Nine Hundred Fifty Dollars ($950.00) for a new car for the Police Department, plus trade-in-value of the present car, or do anything relating thereto. (By Selectmen)


Article 21. To see if the Town will vote to raise and appropriate a sum of money to purchase and equip a new car for the Police Depart- ment, or do anything relating thereto. (By Selectmen)

Article 22. To see if the Town will vote to accept a gift of Two Thousand Dollars ($2,000.00) from the Fletcher Hospital Corporation to be used in conjunction with other money to be appropriated by the Town for the purchase of a town ambulance, or do anything relating thereto. (By Fire Chief and Selectmen).


Article 23. To see if the Town will vote to raise and appropriate the sum of Four Thousand Dollars ($4,000.00) to be used in conjunc- tion with a gift of Two Thousand Dollars ($2,000.00) from the Fletcher Hospital Corporation for the purchase of a new town ambulance, to- gether with the trade-in value of the present town ambulance, to be expended by the Board of Selectmen and the Fire Chief, or do anything relating thereto. (By Fire Chief and Selectmen).


Article 24. To see if the Town will vote to authorize the Treasurer to pay the former Acting Board of Health Agent, Peter O'Brien, the sum of Thirteen Hundred Fifty ($1,350.00) Dollars for services ren- dered from January 1, 1960 to September 30, 1960, to be paid from the Board of Health appropriation in accordance with the provisions of G.L. Chap. 44, Sec. 64, or do anything relating thereto. (By Board of Health)


Article 25. To see if the Town will vote to accept the provisions of Sec. 8-C of Chapter 40 of the General Laws providing for the estab- lishment of a Conservation Commission, or do anything relating thereto. (By Selectmen)


Article 26. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Seven Thousand One Hundred and Twenty-five Dollars ($7,125.00) to extend, construct and improve the Town drainage system, said sum to be expended under the direction of the Board of Public Works, or take any action relative thereto. (By B.P.W.)


Article 27. To see if the Town will vote to raise and appropriate the sum of Ninety-five Hundred Dollars ($9,500.00) to install an 8-inch water main on James Street from Arlington Street to a point opposite the house of Francis Taddeo, a distance of approximately 1350 feet to be expended under the direction of the Board of Public Works, or do anything relating thereto. Article 28. To see if the Town will vote to transfer from the Parking Meter Account the sum of One Thousand One Hundred Seventy-five Dollars ($1,175.00) for the control, maintenance, and supervision of the parking meters and the enforcement of the parking meter regulations, to be expended under the direction of the Board of Selectmen, or do anything relating thereto. Article 29. To see if the Town will vote to transfer from the Parking Meter Account the sum of One Thousand Dollars ($1,000.00) for snow removal in the Parking Meter Area, said sum to be expended under the direction of the Board of Public Works, or take any action relative thereto. (By B.P.W.)

To see if the Town will vote to transfer from the Parking Meter Account the sum of Five Hundred Dollars ($500.00) for painting street lines in the Parking Meter area, said sum to be expended under the direction of the Board of Public Works, or take any action relative thereto. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Sixty-five Hundred Dollars ($6,500.00) to purchase and equip a sidewalk Snow Plow, said sum to be expended under the direction of the Board of Public Works or take any action relative thereto. Article 32. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Six Hundred and Eighty- four Dollars and Twenty Cents ($684.20) to purchase a two-way radio for an addition to the communications system of the Department of Public Works, said sum to be expended under the direction of the Board of Public Works or take any action relative thereto. Article 33. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Three Thousand Nine Hundred and Fifty Dollars ($3,950.00) for the purchase of a Pipe Cleaning Machine, said sum to be expended under the direction of the Board of Public Works or take any action relative thereto. Article 34. To see if the Town will vote to raise and appropriate the sum of Eight Thousand Two Hundred Seventy-one Dollars and One Cent ($8,271.01) to pay for unpaid bills contracted in 1960 by the School Department in accordance with the provisions of General Laws, Chapter 44, Section 64, or do anything relating thereto. (By School Committee)


Article 35. To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Three Thousand Dollars ($3,000.00) to install a Mosquito Control Program in the Town, said money to be expended under the direction of the Board of Public Works or take any action relative thereto. Article 36. To see if the Town of Franklin will vote to modify the "Zoning Map of the Town of Franklin, Massachusetts," by changing from SINGLE FAMILY RESIDENTIAL IV to COMMERCIAL I the

land belonging to Arthur R. Stobbart, lot of land situated on the Southerly side of Cross Street and bounded and described as follows: Beginning at the Northeasterly corner of the granted premises, on the Southerly line of said Cross Street, at land of the Town of Franklin; thence running Southerly on said land of Town of Franklin one hun- dred eighty-five (185) feet to a leading way as shown on plan herein- after mentioned; thence Westerly on said leading way one hundred ten (110) feet to land formerly of A. M. Waite; thence Northerly on said land formerly of A. M. Waite eighty-eight (88) feet to a stake and stones; thence Easterly on said land formerly of Waite thirteen (13) feet to a stake and stones; thence Northerly on said land formerly of Waite ninety (90) feet to said Cross Street; thence Easterly on said Cross Street one hundred thirty (130) feet to the first mentioned bound and place of beginning, all of the aforesaid distances being more or less. Being the lots numbered thirteen (13), fourteen (14), fifteen (15) and sixteen (16) on plan of land of Enoch Waite recorded with Norfolk Deeds, Book 637, Page 555. Or do anything related thereto. Article 37. To see if the Town will vote to authorize the Board of Public Works to apply for, and accept, Federal funds as provided under Public Law 560 and to expend the same for surveys, plans, specifications and reports with estimates of cost, in relation to revisions and extensions of the town sewerage system in all its various phases, with the understanding that the Town will reimburse the Federal Government for that part of the cost of the surveys allocated to a par- ticular sewer project if and when that particular sewer project is subsequently voted by the Town, or to take any other action thereon. Article 38. To see if the Town will vote to elect at the annual Town Meeting for the calendar year 1962, a Board of Public Welfare consisting of three members, of whom one shall be elected for one year, one shall be elected for two years, and one shall be elected for three years, and thereafter, one member shall be elected annually for three years, or do anything relating thereto.
