PROCEEDINGS OF SPECIAL TOWN MEETING


NOVEMBER 14, 1960


The meeting was called to order by the Moderator, Romeo Assetta, at 8:00 P.M. in Dean College Gymnasium.


The Moderator then appointed the following Tellers and they were sworn by him to the faithful performance of their duties: Richard Costello, William B. Goodwin, Donald Patton, Daniel Carty, Joseph Turco, Domenic Depoto, Nicholas Socci and Maurice Simon.


The Warrant and Return of the Warrant was read by the Town Clerk.


Article 1. To see if the Town will vote to acquire by purchase, or by taking by right of eminent domain, pursuant to the provisions of General Laws, Chapter 40, Section 14 and/or the provisions of General Laws, Chapter 79, both as most recently amended, or in any other legal manner, all or any of the several parcels of land situated on or off the northeasterly side of Maple Street, in Franklin, all of said parcels, when taken together, as shown on plan entitled "Proposed High School- Maple Street Site-Franklin, Mass.", made by J. Williams Beal Sons, Granger and Dyer, Architects, dated 7 January, 1960-revised 9 February, 1960, comprising approximately thirty-one (31) acres, for the purpose of constructing thereon a new Senior High School, to- gether with equipment and furnishings therefor, and athletic fields and/or other facilities for use in connection therewith, and raise and appropriate, or transfer from available funds, and/or raise by bond issue pursuant to the provisions of General Laws, Chapter 44, a sum of money sufficient to pay the cost, or estimated cost, of so acquiring such land, such sum of money to be expended under the direction of the School Building Committee, or do or act anything relating thereto.


VOTED by secret ballot, yes 665, no 368, blanks 2, that this Article be indefinitely postponed.


Article 2. To see if the Town will vote to construct, equip, and furnish a new Senior High School, together with athletic fields and/or other facilities for use in connection therewith, on land acquired by the Town for such purpose, situated on the northeasterly side of Maple Street, in Franklin, such construction, equipment and furnishing to be done under the direction and control of the school Building Com- mittee, which shall have full authority to enter into all agreements or contracts necessary or incidental to the performance of the work involved, and raise and appropriate, or transfer from available funds,

and/or raise by bond issue, subject to the approval of the Emergency Finance Board, pursuant to the provisions of General Laws, Chapter 44, a sum of money sufficient to pay the cost, or estimated cost, of such construction, equipment and furnishing, the same to be expended under the direction of the said School Building Committee, or do or act anything relating thereto.


VOTED that this article be indefinitely postponed.


Article 3. To see if the Town will vote to acquire from Jessie A. Munroe of Franklin by purchase, or by taking by right of eminent domain, pursuant to the provisions of General Laws, Chapter 40, Section 14 and/or the provisions of General Laws, Chapter 79, both as most recently amended, a strip of land not less than forty (40) feet in width throughout its entire length, extending in a general westerly direction from the westerly side of Lincoln Street to the easterly line of land on the northeasterly side of Maple Street recently acquired, or to be acquired, by the Town for School purposes, such strip of land to be used by the Town as a public way, and raise and appropriate, or transfer from available funds, a sum of money sufficient to pay the cost, or estimated cost, of acquiring such strip of land, or do or act anything relating thereto.


VOTED that this article be indefinitely postponed.


Article 4. To see if the Town will vote to acquire by purchase, or by taking by right of eminent domain, pursuant to the provisions of General Laws, Chapter 40, Section 14 and/or the provisions of General Laws, Chapter 79, both as most recently amended, or in any other legal manner, all or any of the several parcels of land situated on and off the southwesterly side of Oak Street, in part, and in part on and off the northwesterly side of Beaver Street, all in Franklin, all of said parcels, when taken together, as shown on plan entitled "Proposed Beaver and Oak Street Site for Franklin Senior High School, Franklin, Mass.", made by J. Williams Beal Sons, Granger and Dyer, Architects, dated October 5, 1960, comprising approximately thirty-eight (38) acres, for the purpose of constructing thereon a new Senior High School together with equipment and furnishings therefor, and athletic fields and/or other facilities for use in connection therewith, and raise and appropriate, or transfer from available funds, and/or raise by bond issue pursuant to the provisions of General Laws, Chapter 44, a sum of money sufficient to pay the cost, or estimated cost, of so acquiring such land, said sum of money to be expended under the direction of the School Building Committee, or do or act anything relating thereto.


Mr. Lewis J. Cataldo, Chairman of the School Building Commit- tee, reported that he had consulted with all the owners of the proposed

Beaver and Oak Street site and had obtained a total figure of ($29,000) Twenty Nine Thousand Dollars for the purchase of said site.


VOTED by secret ballot yes 873, no 151, that the Town acquire by purchase, or by taking by right of eminent domain, pursuant to the provisions of General Laws, Chapter 40, Section 14 and/or the pro- visions of General Laws, Chapter 79, both as most recently amended, or in any other legal manner, the several parcels of land situated on and off the southwesterly side of Oak Street, in part, and in part on and off the northwesterly side of Beaver Street, all in Franklin, all of said parcels, when taken together, as shown on plan entitled "Pro- posed Beaver and Oak Street Site for Franklin Senior High School, Franklin, Mass.", made by J. Mr. Lewis J. Cataldo, Chairman of the School Building Committee, stated that a brochure containing the proposed new High School had recently been delivered to every house in Franklin. He then presented the following estimates which were contained in said brochure.

VOTED by secret ballot yes 817, no 122, that the Town construct, equip and furnish a new Senior High School, together with athletic fields and/or other facilities for use in connection therewith, on land acquired by the Town for such purpose, situated on the southwesterly side of Oak Street, and on the northwesterly side of Beaver Street, in Franklin, such construction, equipment and furnishing to be done under the direction and control of the School Building Committee, which shall have full authority to enter into all agreements or contracts necessary or incidental to the performance of the work involved; that the sum of $1,695,000 is appropriated therefor, the same to be expended under the direction of said School Building Committee; and that to meet the foregoing appropriation $5,000 is transferred from the surplus revenue account, $10,000 is to be raised from 1961 tax levy, and the treasurer, with the approval of the selectmen, is authorized to issue $180,000 bonds or notes of the Town under Chapter 44 of the General Laws as amended and $1,500,000 bonds or notes of the Town under Chapter 645 of the Acts of 1948 as amended, all of such bonds or notes to be payable within 20 years from their respective dates.


Article 6. To see if the Town will vote to acquire by purchase, for present or future use as the site of a public school, approximately fifteen (15) acres of land in Franklin, situated on the easterly side of Pond Street and having a frontage of approximately two hundred seventy-five (275) feet thereon, and raise and appropriate, or transfer from available funds, a sum of money sufficient to pay the cost thereof, or do or act anything relating thereto.


UNANIMOUSLY VOTED that the Town acquire by purchase for a school site a certain piece or parcel of land, situated on the easterly side of Pond Street, in Franklin, and bounded and described as follows: Beginning on the easterly side of said Pond Street, at a point distant one hundred seventy-five (175) feet southwesterly along said Street from a stone wall at land now or late of one Berndt; and thence run- ning South 851/2° East, three hundred ten (310) feet, more or less; thence turning and running South 761/2° East, three hundred five (305) feet, more or less; thence turning and running South 41/2° West, twelve

Article 7. To see if the Town will vote to appropriate the sum of One Hundred Seventy-five Thousand Dollars ($175,000) or any other sum for the purpose of constructing eight (8) additional class- rooms and related facilities to the existing Gerald Murdock Parmenter School and for originally equipping and furnishing said addition, above sum to include the cost of architect's fees and plans, and deter- mine whether the money shall be provided by taxation, by appropria- tion from available funds in the treasury, or if there are no funds available for appropriation, then the sum appropriated will be included in the tax levy for the next following year, and by borrowing under authority of Chapter 44 of the General Laws and Chapter 645 of the Acts of 1948, as amended, to be expended under the direction of the School Building Committee, or take any action relative thereto.


VOTED that this article be indefinitely postponed.


Article 8. To see if the Town will vote to acquire, for improve- ment of Spruce Pond Brook, as a part of the Spruce Pond Drainage Project, so-called, by purchase, or by taking by right of eminent do- main, pursuant to the provisions of General Laws, Chapter 40, Section 14, and/or the provisions of General Laws, Chapter 79, both as most recently amended, or in any other lawful manner, either outright, in fee, or a right of way in, through, over and across, that certain piece, parcel or lot of land in Franklin, that is now owned or supposed to be owned by Franklin Salvage Company of Franklin, that lies northerly from the location or right of way of New York, New Haven & Hartford Railroad, and between Fisher Street Extension, on the west, and land of Franklin Woolen Mills, on the east, containing one and five-tenths (1.5) acres, more or less, according to plan thereof made by Green Engineering Affiliates, Inc., dated September 1960, entitled “PLAN OF LAND IN FRANKLIN, MASS. TO BE TAKEN FOR IMPROVE- MENT OF SPRUCE POND BROOK BY TOWN OF FRANKLIN", and bounded according to said plan as follows: Beginning at a point in the easterly line of land of Franklin Salvage Company that is distant North 32° 05' 13" West along said line 55.37 feet from a point in the northwesterly line of the location or right of way of New York, New Haven & Hartford Railroad that is distant South 48° 32' 47" West along
