The suit filed against Frederick Millett, as the operator of a fire truck on Salem Road, was heard and decided in the Woburn District Court and resulted in a judgment against the operator in the sum of $930.00. These opinions are not only on file with the School Department, but a copy of each opinion is on file with the Board of Selectmen and is available for consideration by any interested parties.
At the present time the following matters are pending:
1. Claims for land damages for new high school property.
2. Claims for land damages at reservoir on Ames Hill.
3. Suit has been instituted against Beulah M. Lowthers in- volving the property damage as the result of an accident on November 24, 1957, to the International Fire Truck Number 6.

4. Claims against Joseph Killeen as the result of a collision involving a Police Department vehicle.
5. A claim against the Department of Public Works for damage to a Police Department vehicle.
6. Suits in Superior involving enforcement of Zoning By-Law relative to Trailers and Mobile Homes.
I have attempted to be available for conferences with your Board and the several town boards and committees upon request.
Total amount paid to your town counsel for court appearances, opinions and conferences, $3,009.50. This does not include court fees or other disbursements for service of writs or summonsing of witnesses.

This year your Finance Committee has worked many long hours in the interest of keeping the Tax Rate to a minimum. The Town's available cash has dwindled to a new low of less than $99,000. With this fact in mind, we have recommended a minimum of transfers and postponed many Articles, which, although of merit, must be delayed until the tax payer can afford this additional burden. Our tax picture at present is not a happy one, and we need your cooperation to maintain financial stability.

WARRANT FOR ANNUAL TOWN MEETING
Middlesex, ss.
To any of the Constables of the Town of Tewksbury, in said County:
Greeting:
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in town affairs, to meet and assemble at Town Hall in said Tewksbury on Saturday, March 7, 1959 at 10:00 o'clock A.M. to act on the following articles, except Article 1, and you are also hereby further required and directed to notify and warn the said inhabitants of the Town of Tewksbury, who are qualified to vote on elections and town affairs therein, to assemble subsequently and meet in town meeting at the polling places in said Town of Tewksbury, on Wednesday, March 11, 1959 at 10:00 A.M. then and there to act on the following Article 1.
The polls for the election of Town Officers to be opened at 10:00 o'clock A.M. and to be closed at 8:00 P.M.
ART. 1-To choose all necessary Town Officers, to choose by ballot two Selectmen for three years, one Member for Board of Health for three years, two members for Board of Public Welfare for three years, one Assessor for three years, two members for the School Committee for three years, one Water Commissioner for three years, two Trustees for the Public Library for three years, one Road Commissioner for three years, one Park Commissioner for three years, one Trust Fund Commissioner for three years, one Moderator for one year and one member of the Planning Board for five years, and to vote yes or no on the following question: "Shall an act passed by the General Court in the year nineteen hundred and forty-nine entitled 'An Act Relative to the Granting of Vacations for Members of the Regular or Permanent Police and Fire Forces in Certain Cities and Towns' be accepted?" All on the same ballot.
ART. 2-To hear and act upon the reports of the various town officers.
ART. 3-To fix the salary of the Building Inspector and the several elective officers of the Town and determine whether such salaries shall be retroactive to January 1st. (Refer to Salary Schedule).
Recommend adoption as scheduled.
ART. 4-To see what sums of money the Town will vote to raise and appropriate, from available funds or otherwise, for its necessary and expedient purposes hereinafter designated, and determine that

ART. 5-To determine what sum the Town will authorize and direct the Assessors to take from available funds to reduce the tax levy for the current year, or take any other action relative thereto.
Recommend no money be taken from available funds for this purpose.
ART. 6-To see what sum of money the Town will vote to raise and appropriate and/or transfer from Overlay Reserve for a reserve fund, pursuant to the provisions of Chapter 40, Sec. 6.
Recommend $8,000.00 from Overlay Reserve and $12,000.00 be taken from available cash for this purpose. 1 Dissent
ART. 7-To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year be- ginning January 1, 1959, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, of the General Laws.
Recommend adoption.
ART. 8-To see if the Town will authorize the Selectmen to institute suits on behalf of the Town or defend any suits that are, or may be brought against the Town, and to sign any contracts or agree- ments in behalf of the Town.

ART. 9-To see if the Town will vote to authorize the Board of Select- men and the Treasurer to foreclose, either through the land court or by affidavit of the Commissioner of Corporations and Taxation, any tax title held by the Town for more than two years, and see what sum of money the Town will vote to raise and appropriate therefor.
Recommend $1,100.00 to be raised and appropriated for this Article.

ART. 17-To see if the Town will vote to enact a by-law under the provisions of Chapter 41, Section 108A and 108C, and establish a personnel board to be appointed by the Board of Selectmen to study the problem of compensation of all Town employees except those filled by popular election and professional positions under the direction and control of the School Committee and to prepare a wage and classification plan and personnel policy plan, classifying all such employees into groups and classes doing substantially similar work or having substantially equal responsibilities. Such a plan to provide minimum and maximum salaries to be paid to such employees in positions so classified and for the attainment of such maximum salaries by periodical step rate increases, such salaries to be appropriately related, if possible, to salaries paid commercial and business establishments and by comparable municipalities as well as a reliable cost-of-living index. The personnel board to be authorized to employ professional consultants in connection with the foregoing if deemed desirable and to report its findings for a complete wage and classification plan and personnel policy plan to the next special or annual Town Meeting. The personnel board to consist of five members, two to be appointed for three years, two to be appointed for two years, and one for one year, and thereafter each member to be appointed for a three-year term. No member of the personnel board to receive compensation. Vacancies to be appointed by the Selectmen. At all times one of the five members shall be one who has been selected from a list of not less than three suggested members submitted by the full-time employees of the Town, excluding the professional employees of the School Depart- ment; or take any other action relative thereto.

ART. 23-To see if the Town will vote to raise and appropriate the sum of $1,800.00 for the maintenance of Chapter 90 Highways, said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose or take any other action relative thereto, and will further vote to transfer the sum of $3,600.00 from the E. and D. Account in anticipation of re-imbursement from the State and County for the work or take any other action relative thereto.

ART. 24-To see if the Town will vote to transfer the sum of $23,650.00 from the E. and D. Account in anticipation of the re- imbursement from the State for Highway maintenance under Chapter 81 or take any other action relative thereto.

ART. 25-To see if the Town will vote to raise and appropriate the sum of $6,250.00 or any other sum for the improvement of Shaw- sheen Street, said money to be used in conjunction with any money

which may be allotted by the State or County, or both, for the pur- pose, or take any other action relative thereto and will further vote to transfer the sum of $18,750.00 from the E. and D. Account in anticipation of re-imbursement from the State and County for the work, or take any other action relative thereto.

ART. 26-To see if the Town will vote to continue the Highway Machinery Fund as established at the last Annual Town Meeting, and to appropriate an additional sum including the unexpended balance of the 1958 Highway Machinery Account to be added to the amount already accredited to this fund for Highway Ma- chinery purposes, or take any other action relative thereto. Recommend the adoption of this Article and the sum of $18,400.33 be raised and appropriated for the Machinery Fund, $15,500.00 of this to be used for new equipment. 1 Dissent
ART. 27-To see what sum of money the Town will vote to transfer from the Highway Machinery Fund for the purpose, repair and maintenance of Road Machinery equipment for 1959 or take any action relative thereto. Road Commissioners
Recommend adoption and that $26,500.00 be transferred from the Highway Machinery Fund to the Highway Account, $15,500.00 of this to be used for capital outlay.
ART. 28-To see if the Town will vote to raise and appropriate the sum of $50,000.00 for the purpose of new installations of water ser- vices to dwellings or other buildings, and provided that the cost of said installations has been first deposited with the Town Treasurer and applied to estimated receipts and to authorize the Water Department to do such work and expend such money and in the event said entire sum is not required for said installations, the unexpended balance shall likewise be credited to estimated receipts, or take any action in relation thereto.
