Section 4. A member or servant of a family in which a child is born, having knowledge of the facts required * * * shall furnish the same upon request of the clerk of the town * * * or of any person authorized by him. (Penalty for refusing, not more than ten dollars.)

Section 6. Parents, within forty days after the birth of a child, and every householder within forty days after a birth in his house shall cause notice thereof to be given to the clerk of the town where such child is born.

Section 36. If a marriage is solemnized in another state between parties living in this Commonwealth, who return to dwell here, they shall within seven days after their return, file with the clerk or reg- istrar of the town where either of them lived at the time of their marriage, a certificate or declaration of their marriage including the facts required in a notice of intention of marriage.


Section 55. Whoever violates Section 36 shall forfeit ten dollars.

The attention of owners and keepers of dogs is called to the fol- lowing extracts from Chapter 140 of the General Laws as amended:


Definition: "License period," the time between April first and the following March thirty-first, both dates inclusive.


Section. 137. A person who at the commencement of a license period is, or who during any license period becomes, the owner or keeper of a dog when it becomes three months old during a license period, shall cause it to be registered, numbered, described and licensed until the end of such license period, and the owner or keeper of a dog so registered, numbered, described and licensed during any license period, in order to own or keep such dog after the beginning of the succeeding license period, shall, before the beginning thereof, cause it to be registered, numbered, described and licensed for such period .- The registering, numbering, describing and licensing of a dog-shall be-if kept in any-town in the office of the clerk thereof.


The license shall be in a form prescribed by the director, upon a blank to be furnished,-by the county in which the town is lo- cated, and shall be subject to the condition expressed therein that the dog which is the subject of the license shall be controlled and re- strained from killing, chasing or harassing live stock or fowls. The owner or keeper of a licensed dog shall cause it to wear around its neck or body a collar or harness of leather or other suitable material, to which shall be securely attached a tag in a form prescribed by the director, and upon which shall appear the license number, the name of the town issuing such license and the year of issue. Such tags shall

be furnished in the same manner as the license blanks, and if any such tag shall be lost the owner or keeper of such dog shall forthwith secure a substitute tag from the town clerk -- at a cost of ten cents which, if received by a town clerk, shall be retained by him unless otherwise provided by law.


Section 139. Fees for licenses. The fee for every license shall, except as otherwise provided, be two dollars for a male dog and five dollars for a female dog, unless a certificate of a registered veterin- arian who performed the operation that said female dog has been spayed and has thereby been deprived of the power of propagation has been filed with the town clerk, in which case the fee shall be two dol- lars. A certified copy of such certificate on file in the office of any town clerk within the commonwealth may be accepted as evidence that the said operation has been performed .-

ANNUAL TOWN MEETING-FEBRUARY 18, 1946


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at the Town House, Monday, February 18, 1946, at one o'clock P. M., the following business was transacted:


Ben W. Drew, Town Moderator, was sworn in by Charles L. Hildreth, Town Clerk, and called the meeting to order.


Rev. Garrett J. Condon, Pastor of St. Catherine's Church, offered prayer.


Voted to dispense with the reading of the Warrant.


The Canvass of the Votes cast at the Town Election, February 11th, made by the Board of Registrars was read by the Town Clerk.


On Motion of Ben W. Drew a rousing vote of thanks was given to Arthur M. Whitley, retiring member of the Board of Selectmen, who had just completed fifteen years of faithful service.


The Moderator read a letter dated September 27, 1945 from the Massachusetts Salvage Committee to the Board of Selectmen, prais- ing the work of the local Salvage Committee and their Chairman. A Certificate of appreciation was presented to Morris A. Hall, Chair- man of the Committees.


William R. Taylor, Chairman of the Committee on By-Laws, gave a verbal report.


Article 1. Voted that the Report of the Committee on By-Laws be accepted as a report of progress and that the time for making the Committee's final Report be extended until the next Annual Town Meeting; and further, that said Committee be instructed to file with the Selectmen, on or before January 10, 1947, Articles to be inserted in the Warrant for the next Annual Town Meeting calling for the adoption of such By-Laws as tlie Committee may propose for adoption by the Town.


Article 2. A Motion was made that the compensation of Town Officers be as follows: Selectmen, Chairman and other Members $300. each; Board of Public Welfare, Chairman $20.00, other two Members $10.00 each; Town Treasurer $1,500.00; Town Clerk $400.00; Collector of Taxes $1,400.00; Tree Warden $0.53 per hour; Assessors $5.00 per day of eight hours; Registrars and Assistant Registrars of Voters $5.00 per day of eight hours for Listing as required by law. Voted to take up the compensation of said Town Officers separately. Voted that the compensation of the Chairman of the Selectmen be $225.00, the other two Members $200.00 each; Board of Public Welfare, Chair-

man $20.00, other two Members $10.00 each; Town Treasurer $1,500; Town Clerk $400.00; Collector of Taxes $1,400.00; Tree Warden $0.53 per hour; Assessors $5.00 per day of eight hours; Registrars and Assistant Registrars of Voters $5.00 per day of eight hours for List- ing as required by law.


Article 3.


1. Voted that the sum of $10,200.00 be raised and appropriated for General Government, divided as follows: Selectmen $925.00; License Expenses $75.00; Town Treasurer $1,850.00; Town Accountant 1,175.00; Assessors $1,200.00; Tax Col- lector $1,750.00; Town Counsel $300.00; Tax Title Expense $700.00; Town Clerk $750.00; Election and Registration $1,475.00.


· 2. Voted that the sum of $3,400.00 be raised and appropriated for the General Expenses of the Town Hall.


3. Voted that the sum of $6,775.00 be raised and appropriated for the purpose of defraying the Expenses of the Police Department.


4. Voted that the sum of $6,375.00 be raised and appropriated for the purpose of defraying the Expenses of the Fire De- partment, divided as follows: General Expenses $5,500.00; Permanent Man $500.00; Foam Equipment $375.00. Voted that the sum of $225.00 be raised and appropriated for three Fog Nozzles to fit small hose lines.


5. Voted that the sum of $3,350.00 be raised and appropriated for Fire Hydrants.


6. Voted that the sum of $125.00 be raised and appropriated for the Sealer of Weights and Measures.


7. Voted that the sum of $75.00 be raised and appropriated for the Salary and Expenses of the Fish and Game Warden.


8. Voted that the sum of $1,000.00 be raised and appropriated to defray the Expenses of Fighting Forest Fires.


9. Voted that the sum of $100.00 be raised and appropriated to defray the Expenses of the Town Forest.


10. Voted that the sum of $500.00 be raised and appropriated to defray the Expenses of the Tree Warden.


11. Voted that the sum of $900.00 be raised and appropriated to defray the Expenses of the Moth Department.

12. Voted that the sum of $3,500.00 be raised and appropriated to defray the Expenses of the Health Department.


13. Voted that the sum of $150.00 be raised and appropriated to defray the Expenses of the Cattle Inspector.


14. a. Voted that the sum of $7,500.00 be raised and appropria- ted for Snow and Ice Removal. b. Voted that the sum of $1,500.00 be raised and appropria- ted for Town Roads.


15. Voted that the sum of $32,350.00 be raised and appropriated to defray the Expenses of the Welfare Department, divided as follows: Temporary Aid and Infirmary $13,250.00; Aid to Dependent Children $3,700.00; Old Age Assistance $15,400.00.


16. Voted that the sum of $3,000.00 be raised and appropriated for Soldiers' Benefits.


17. Voted to lay Item 17 on the Table and take up Article 32.


Article 32.


Voted that the School Committee be instructed to re-open, for School purposes, the Nabnasset School.


Article 3.


17 Voted that the sum of $91,500.00 be raised and appropriated to defray the Expenses of the School Department.


18. Voted that the sum of $1,000.00 be raised and appropriated for Vocational School Tuition.


19. Voted that the sum of $3,000.00 be raised and appropriated, together with the Receipts from Dog Licenses in 1945, to defray the Expenses of the Public Library.


20. Voted that the sum of $300.00 be raised and appropriated for the Care of the Common.


21. Voted that the sum of $300.00 be raised and appropriated to defray the Expenses of Commemorating Memorial Day.


22. Voted that the sum of $630.00 be raised and appropriated to defray the Expenses of Publishing and Distributing the Town Reports.


23. Voted to dismiss Item 23 relative to Compensation Insurance. 24. Voted that the sum of $1,700.00 be raised and appropriated for Fire Insurance.

25. Voted that the sum of $25.00 be raised and appropriated for Interest on Revenue Loans.


26. Voted that the sum of $2,500.00 be raised and appropriated for the Care of Cemeteries.


27. Voted to lay Item 27 on the Table and take up Article 12.


Article 12.


Voted that the Selectmen be authorized to install two Street Lights on Abbot Street in Forge Village.


Article 3.


27. Voted to take Item 27 from the Table. Voted that the sum of $7,085.00 be raised and appropriated for Street Lights.


28. Voted that the sum of $3,000.00 be raised and appropriated to be used as a Reserve Fund, at the discretion of the Finance Committee, as provided in General Laws, Chapter 40, Section 6, and that the further sum of $10.00 be raised and appropriated to be used by the Finance Committee for payment of Membership in the Association of Town Finance Committees.


29. Voted that the sum of $1,465.64 be raised and appropriated for the purpose of paying Unpaid Bills of 1945, divided as follows: FIRE DEPARTMENT: C. G. Sargent's Sons Corp. $9.74; Jim Knowlton $3.43; Whitney's Repair Shop $73.94. (The Vote on these three bills was unanimous) Total $87.11; HIGHWAY DEPARTMENT-Machinery Account: Whitney's Repair Shop $15.20; J. A. Healy & Sons $17.60; Edwin H. Article 1. Voted to again take up Article 1. The Report of the Committee appointed under Article 27 of the Annual Town Meeting held February 19, 1945, was given verbally by Thomas McGrath, Chairman. Voted to accept the verbal Report given under Article 1

and the Reports of the Finance Committee, other Committees, Boards and Officers, as printed in the Town Report.


Article 4. Voted unanimously that the Town Treasurer be au- thorized, with the approval of the Selectmen, to borrow money from time to time in anticipation of the Revenue of the current financial year and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year, in accordance with Section 17 of Chapter 44 of the General Laws.


Article 5. Voted that the sum of $10,125.00 be raised and ap- propriated to meet the Town's share of the cost of Chapter 81 High- ways, and that, in addition, the sum of $18,225.00 be transferred from Unappropriated Available Funds in the Treasury to meet the State's share of the cost of the work, the reimbursements from the State to be restored, upon their receipt, to Unappropriated Available Funds in the Treasury.


Article 6. Voted that the sum of $1,000.00 be raised and appro- priated for Maintenance of Chapter 90 Roads, on condition that like amounts be contributed by either or both state and County respective- ly, to be used in conjunction therewith, and that, in addition, the sum of $2,000.00 be transferred from Unappropriated Available Funds in the Treasury to meet the State's and County's share of the cost of work, the reimbursements from the State and County to be restored, upon their receipt, to Unappropriated Available Funds in the Treas- ury.


Article 7. Voted that the Town authorize the Selectmen to act as its Agent in any suit or suits which may arise during the current year, with authority to settle and adjust claims or demands for or against the Town, and to employ Counsel whenever in their judgment it is advisable so to do.


Article 8. Voted that this Article, to raise and appropriate a sum of money to pay the County of Middlesex the Town's share of the Middlesex County Tuberculosis Hospital, be dismissed.


Article 9. Voted that the sum of $300.00 be raised and appropri- ated for the Care of the Whitney Playground.


Article 10. Voted that the sum of $400.00 be raised and appro- priated for Band Concerts during the current year.


Article 11. Voted that the sum of $1,250.56 be raised and appro- priated for the Machinery Fund, and that the sum of $3,088.19 be transferred from the Machinery Fund to the Highway Equipment Ac- count.

Article 13. Voted that the sum of $76.13 be raised and appro- priated for the purpose of paying into the Contributory Retirement System the Town's portion of the amount which would have been paid into said Retirement System by former Westford Teachers who are now in the Military or Naval Services, all as provided in Section 9 of Chapter 708 of the Acts of 1941, as amended by Chapter 419 of the Acts of 1943.


Article 14. Voted that the sum of $10.00 be raised and appro- priated for Demonstration Work in Agriculture and Home Economics and that a Director be elected, under the Provisions of Chapter 128, Sections 40-45 of the General Laws, as amended. Mabel M. Nixon was elected Director.


Article 15. Voted that the Town accept a gift made to it by the Isabel F. Hyams' Fund, Inc., formerly known as the Solomon Hyams' Fund, Inc., and that the Town Clerk be authorized and directed to extend to said Corporation, the appreciation of the Town for this gift.


Article 16. Voted that the sum of $2,000.00 be raised and appro- priated for the reconstruction of Groton Road, on condition that like amounts be contributed by either or both the State and County to be used in conjunction therewith and that, in addition, the sum of $6,- 000.00 be transferred from Unappropriated Available Funds in the Treasury to meet the State's and County's shares of the cost of the work, the reimbursements from the State and County to be restored, upon their receipt, to Unappropriated Available Funds in the Treas- ury.


Article 17. Voted that the sum of $680.50 be raised and appro- priated for the purpose of purchasing a Stone Spreader for the High- way Department, the same to be purchased under the supervision of Board of Selectmen.


Article 18. Voted that the sum of $2,000.00 be raised and appro- priated for the purpose of purchasing a new Truck for the Highway Department, said purchase to be made under the supervision of the Board of Selectmen.


Article 18A. Voted that the Selectmen be and hereby are author- ized to transfer, by a good and sufficient Bill of Sale, Title to the 1937 Ford Truck now used by the Highway Department, and apply the sum received therefrom against the purchase price of the new Truck.


Article 19. Voted that the sum of $575.00 be raised and appro- priated for the purpose of purchasing a new Automobile for the Po- lice Department, said purchase to be made under the supervision of Board of Selectmen.

Article 20. Voted that the Selectmen be and hereby are author- ized to transfer, by a good and sufficient Bill of Sale Title to the au- tomobile now used by the Police Department, and apply the sum re- ceived therefrom against the purchase price of the new Automobile.


Article 21. Voted that the sum of $144.00 be raised and appro- priated for the purpose of purchasing a new Typewriter for use in the Office of the Board of Selectmen, said purchase to be made un- der the supervision of the Board of Selectmen.


Article 22. Voted that the Selectmen be and hereby are author- ized to transfer, by a good and sufficient Bill of Sale. Title to the typewriter now used in the Office of the Board of Selectmen, and ap- ply the sum received therefrom against the purchase price of the new Typewriter.


Article 23. Voted that a Committee of seven persons be ap- pointed by the Moderator for the purpose of investigating the advis- ability of constructing a permanent Bandstand on the Common in Westford Center.


Article 24. Voted not to raise and appropriate the sum of $375 .- 00 for the purpose of purchasing and installing in the Fire House in Westford Center, an Oil Burner.


Article 25. Voted that the Town purchase a parcel of land sit- uated on the Southwesterly side of Broadway and the Northwesterly side of Cross Street in that part of Westford known as Graniteville and supposed to contain 8,639 square feet, said premises being more particularly described in a Deed from the Abbot Worsted Company to Fred S. Healy dated October 21, 1938 and recorded with Middlesex North District Registry of Deeds, Book 920, Page 522, said purchase to be made under the supervision of the Board of Selectmen.


Article 26. Voted that the sum of $750.00 be raised and appro- priated for the purpose of purchasing the parcel of land voted to be purchased under Article 25, and that the further sum of $50.00 be raised and appropriated for the purpose of defraying the expenses of examination of Title and Recording Fee of the Deed to the Town. William R. Taylor and John S. Creig, appointed Tellers by the Mod- erator and sworn in by the Town Clerk, counted the Vote which was Yes 90, No 17.


Article 27. A Motion to lay Article 27 on the Table and take up Article 39 was defeated 60 to 52.


Voted that the sum of $15,000.00 be transferred from the Account entitled Excess and Deficiency for the purpose of erecting, on the land purchased under Article 25, a new Fire House, said new Fire

House to be erected under the supervision of a Committee consisting of the Board of Selectmen, the Fire Engineers and one Member of the Finance Committee, to be designated by the Moderator, said Com- mittee to have full power and authority to obtain such plans and specifications as the Committee deems advisable and to pay for the same out of this Appropriation.


A Motion was made to reconsider Article 27.


A Motion for a recess was defeated.


Voted not to reconsider Article 27.


Article 28. Voted that the Board of Selectmen be and hereby are authorized, in the name and behalf of the Town, to convey, by a good and sufficient Deed, at public auction or private sale, Title to the land situated in Graniteville, with the Building thereon, said Building now being used as a Fire House, for such sum as to the Board of Selectmen may seem advisable.


Article 29. No action was taken under Article 29 as the Vote under Article 28 was in the affirmative.


Article 30. Voted that the Town purchase, for the purpose of enlarging the present Town Dump, a parcel of Land adjoining the present Town Dump containing about seventeen (17) acres, said premises being more particularly described in a Deed from Minot A. Bean to Fred S. Healy dated January 3, 1929 and recorded with Mid- dlesex North District Registry of Deeds, Book 773, Page 459.
