Report of Annual Town Meeting
MARCH 13, 1954
In accordance with the warrant as posted, the voters of the Town assembled in the Wilbraham Memorial School Auditorium, Wilbraham.
The polls were declared open at 8.30 a.m. by Moderator Frank Auchter and Warden Wesley Holdridge, who had been sworn in by Town Clerk Walter F. Berry. Ballot Clerks and Tellers sworn in by the Town Clerk were: Theresa Boden, Helen Laurino, Sophie Przybycien, Evelyn Cebula, Alice Hodgdon, Wanda Gurski, Beulah Wahlberg, June Rice, Mae Irwin, Filomena Gilbert, William Dempsey, Alexina Holdridge, Helen Panek, Helen Workum. Con- stables : Jerry Donahue, Giacomo Alberici.
The meeting was called to order by Moderator Frank Auchter at 10.15 a.m. with a quorum of registered voters present.
ARTICLE 1. Minor town officers elected by unanimous vote were :

ARTICLE 2. Voted unanimously that the Town accept the reports of the Selectmen, Board of Public Welfare, Treasurer, School Committee and other officers as pre- sented in the 1953 Town Report.
ARTICLE 3. Voted unanimously that the compensation for elected Town Officers for the ensuing year be fixed as follows: Town Clerk, $2,500.00 and that all fees revert to Town Treasury ; Moderator, $50.00 for Annual Town Meet- ings, $15.00 for Special Town Meetings; Town Collector, $1,900.00; Town Treasurer, $1,200.00; Tree Warden, $1.50 per hour (includes use of car when needed) ; Selectmen, two members each $500.00 per year, Chairman $550.00; Assessors, $1.50 per hour (includes use of car when needed) ; Constables, $1.50 per hour when called on duty

by Selectmen, plus fees; Auditor, $200.00; School Com- mittee, no salary; Cemetery Commissioners, $1.35 per hour for time spent at work; Water Commissioners, $150.00 per year; Library Trustees, no salary; Planning Board Mem- bers, no salary. Poundkeeper, Field Drivers, Weighers of Grain, Surveyors of Lumber, Measurers of Wood and Char- coal (all Town Officers elected otherwise than by official ballot) fees only as fixed by General Laws, and that any changes in compensation for officials or employees whose compensation is not fixed herein shall be submitted to and approved in advance of such change by the Financial Committee.
At this time J. Loring Brooks, Jr. paid tribute to Mr. Walter F. Berry for his long and faithful service to the Town as Treasurer.
ARTICLE 4. Voted unanimously that the Town authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1954 and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, of the General Laws.
Mr. Brooks requested that in anticipation of a larger attendance to withhold action on Article 5 and to proceed with Article 6.
ARTICLE 5. ARTICLE 6. Voted unanimously to raise and appropriate the sum of $7,500.00 for the maintenance of Chapter 81 roads, provided the State contribute toward the same, in accordance with the provisions of Chapter 81 of the General Laws.
ARTICLE 7. Voted unanimously to appropriate and transfer from unappropriated available funds in the treas- ury the sum of $7,500.00 for the maintenance of Chapter 81 Roads (an amount equal and in addition to the amount appropriated under Article 6) to meet the State's share of the cost of the work, the reimbursement from the State to be restored upon receipt to unappropriated available funds in the treasury.
ARTICLE 8. Voted unanimously to raise and appropriate the sum of $1,000.00 for the maintenance of Chapter 90 Roads, provided the State and County contribute toward the same, in accordance with the provisions of Chapter 90 of the General Laws.
ARTICLE 9. Voted unanimously to appropriate and transfer from unappropriated available funds in the treas- ury the sum of $2,000.00 for the maintenance of Chapter 90 Roads (in an amount which will be double and in addition to the amount appropriated under Article 8) to meet the State and County shares of the cost of the work, the reimbursement from the State and County to be restored upon receipt to unappropriated available funds in the treasury.
ARTICLE 10. Voted unanimously to raise and appropriate the sum of $3,500.00 for the improvement or rebuilding of Chapter 90 Roads, provided the State and County con- tribute toward the same, in accordance with the provisions of Chapter 90 of the General Laws.
ARTICLE 11. Voted unanimously to appropriate and transfer from unappropriated available funds in the treas- ury the sum of $10,500.00 for the improvement or rebuild- ing of Chapter 90 Roads (in an amount which will be triple and in addition to the amount appropriated under Article 10) to meet the State and County shares of the cost of work, the reimbursement from the State and County to be

restored upon receipt to unappropriated available funds in the treasury.
ARTICLE 12. Voted unanimously to raise and appropriate the sum of $6,250.00 for the improvement or rebuilding of Chapter 90 Roads and Bridges, provided the State and County contribute toward the same, in accordance with the provisions of Chapter 90 of the General Laws.
ARTICLE 13. Voted unanimously to appropriate and transfer from unappropriated available funds in the treas- ury the sum of $43,750.00 for the improvement or rebuild- ing of Chapter 90 Roads and Bridges, to meet the State and County shares of the cost of work, the reimbursement from the State and County to be restored upon receipt, to unappropriated available funds in the treasury.
ARTICLE 14. Voted unanimously to appropriate and transfer from unappropriated available funds in the treas- ury the sum of $8,500.00 to be spent by the Water Depart- ment for additional household and business installations for water service, the cost of which is collected by the Town from the individuals or concerns requesting the installa- tions, and which is returned to surplus funds.
ARTICLE 15. Voted unanimously to authorize the Select- men to sell at public auction, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town 14 days at least before the sale, property taken by the Town under tax title procedure, provided that the Selectmen, or whom- soever they authorize to hold such public auction, may reject any bid which they deem inadequate.
ARTICLE 16. Voted unanimously to authorize the Select- men to institute or defend suits and employ counsel for the purpose of protecting the interests of the Town.
ARTICLE 17. Voted unanimously that the Town's share of the 1953 Dog Tax (estimated at $876.82) be added to the Library appropriation made under Article 5.
ARTICLE 18. Voted by a majority to raise and appropriate the sum of $7,500.00 for a Reserve Fund.
ARTICLE 19. Voted unanimously to appropriate and transfer from unappropriated available funds in the treas- ury the sum of $3,500.00 to pay the garbage collector, with receipts from garbage collection subscribers to be restored as received by the Town Collector to unappropriated avail- able funds in the treasury.
ARTICLE 20. Voted by a majority to raise and appropriate the sum of $1,000.00 for the purpose of purchasing a garbage cooking unit.

ARTICLE 21. Voted unanimously to appropriate the sum of $22,515.00 to pay interest and amortization of the Wilbraham Memorial School Building Loan, and to trans- fer from unappropriated available funds in the treasury the sum of $9,426.25 toward such appropriation, being the amount to be received toward such bond amortization from the State, with such payment from the State to be restored upon receipt to unappropriated available funds in the treas- ury, and to raise $13,088.75 or the balance of such appropriation.
ARTICLE 22. Voted unanimously to appropriate the sum of $26,555.00 to pay the second year's interest and amorti- zation of the Wilbraham Memorial and Pines School Build- ing Loan, and to transfer from unappropriated available funds in the treasury the sum of $8,000.00 toward such appropriation, being the amount to be received toward such bond amortization from the State, with such payment from the State to be restored upon receipt to unappropriated available funds in the treasury, and to raise $18,555.00 for the balance of such appropriation.
ARTICLE 23. Voted unanimously to raise and appropriate the sum of $12,137.50 to pay the first year's interest and amortization of the Water Mains Loan.
At this time Mr. Brooks requested permission from the moderator to proceed under Article 47.

ARTICLE 31. Voted by a majority to postpone action on this article until the next Annual Town Meeting.

ARTICLE 32. Voted not to adopt the following by-law; No person shall fire or discharge any firearms or explosives of any kind within the limits of any highway, park, or other public property, or on any private property except with the consent of the owner or tenant thereof or the agent of either; provided, however, that this by-law shall

not apply to the lawful defense of life or property, or to any discharge of firearms in accordance with law enforcement.

ARTICLE 33. Voted unanimously to appropriate from the Road Machinery Fund the sum of $3,300.00 to purchase a two ton dump truck for the use of the Highway Department.
ARTICLE 34. Voted unanimously to appropriate from the Road Machinery Fund the sum of $2,500.00 to purchase a two ton chassis and cab for the use of the Highway Department.
ARTICLE 35. Voted not to repeal that part of Article 2, Section 6, of the Town by-laws which requires the election of five constables for one year; and, instead of electing constables, to authorize the appointment of constables by the Selectmen in accordance with the provisions of the General Laws, Chapter 41, Sections 91A and 91B.
ARTICLE 36. Voted unanimously to amend the zoning by-laws and change Resident "A2" district to "Business" district the hereinafter described parcel of land lying south- erly of Boston Road and easterly of Stony Hill Road, beginning at a point in the easterly line of land formerly of Francis J. Powers, et al, and now supposed to belong to the Holly Realty Corp., said point being distant southerly one hundred and 69/100 (100.69) feet from the southerly line of Boston Road, thence running easterly along lines parallel to and one hundred (100) feet distance southerly from said southerly line of Boston Road about 1830 feet to a point in the westerly line of land now or formerly of Albert Bonavita, said point being distant southerly 100.37 feet from said southerly line of Boston Road; thence running southerly along said westerly line of land of said Bonavita 850 feet to a point; thence running westerly crossing land of the petitioners, about 1837 feet to a point in said easterly line of land of said Realty Corporation ; thence running northerly along said Realty Corporation's easterly line 850 feet to the point of beginning.

ARTICLE 38. Voted by a majority to accept as a public way the street now known as West Colonial Road as shown on plan of land in Wilbraham entitled "Colonial Acres" as surveyed by Merrill and Sears, Civil Engineers dated February 7, 1952, beginning at the southerly side of Lot No. 44 known as the Pugsley lot on Colonial Road, and running southerly for a distance of approximately 749 feet more or less to the southerly side of Lot No. 90 known as the Reese Lot, and that the sum of $825.00 be raised and

appropriated for original construction of West Colonial Road, and that betterment assessments be levied in accord- ance with the provision of Chapter 80 of the General Laws.
ARTICLE 39. Voted by a majority to accept as a public way the street now known as South Colonial Road as shown on plan of land in Wilbraham entitled "Colonial Acres" as surveyed by Merrill and Sears, Civil Engineers, dated February 7, 1952, beginning at the south westerly corner of Lot No. 88 now owned by Charles J. Ouimet, Jr. and Marie T. Ouimet, and running approximately 560 feet more or less to the easterly sides of Lot No. 76 known as the Jensen Lot on South Colonial Road, and that the sum of $740.00 be raised and appropriated for original construc- tion of South Colonial Road, and that betterment assess- ments be levied in accordance with the provision of Chapter 80 of the General Laws.
ARTICLE 40. Voted by a majority to accept as a public way the street now known as East Colonial Road as shown on plan of land in Wilbraham entitled "Colonial Acres" as surveyed by Merrill & Sears, Civil Engineers, dated February 7, 1952, beginning at the south easterly corner of Lot No. 80 now owned by Philip M. and Sally D. Barnhart, and running northerly for a distance of approximately 689 feet more or less and that the sum of $760.00 be raised and appropriated for original construction of East Colonial Road, and that betterment assessments be levied in accord- ance with the provision of Chapter 80 of the General Laws.

Voted by a majority to accept as a public way the street now known as Brookside Road, (formerly known as Brookside Ext.) as shown on a subdivision plan of "Colonial Acres" as surveyed by Merrill & Sears, Civil Engineers, dated November 19, 1951, beginning at the intersection on the southerly side of Springfield Road at a point on the northwesterly corner Lot No. 103 owned by Whyte and Wadsworth and running southerly 525 feet more or less to Brookside Drive at a point at the south- westerly corner of Lot No. 101 known as the J. B. Emerson Lot, and that the sum of $580.00 be raised and appropriated for original construction of Brookside Road, and that betterment assessments be levied in accordance with the provisions of Chapter 80 of the General Laws.

Voted unanimously to raise and appropriate the sum of $250.00 to be expended by the Highway Depart- ment for the purchase of weed or brush killer, and give it to such citizens of the Town as will effectively use it for the control of poison ivy along the highways and on private properties under the supervision of any local civic organ- ization which will volunteer to administer the program subject to the approval of the Selectmen.
The original motion on this article was seconded and amended and the following vote taken.
ARTICLE 46. Voted by a majority to create a special unpaid committee to be known as a Regional School District Planning Committee of Wilbraham, to consist of three (3) members, including at all times one member of the Wilbra- ham School Committee then in office, said Committee as well as its successors, if any, to be appointed by the Town Moderator in accordance with the provisions of General Laws, Chapter 71, Section 14; and to instruct said Com- mittee to report at the next Annual Town Meeting the results of its consideration, study and deliberations of the matters referred to in said Chapter 71, Section 14A of the General Laws.
ARTICLE 47. Voted unanimously that all appropriations made at this meeting, unless otherwise provided for, be raised by assessment against the polls, personal properties and real estate of the Town.
Voted unanimously to instruct the Planning Board and the Board of Selectmen to do everything possible to bring before a special Town Meeting at an early date action to restrict all undeveloped land in the Town, in residence A1 only, to a two hundred foot frontage (200) and to make any other changes, including the possibility of a Building Code.
Voted unanimously that the polls may be closed at 5.30 p.m.
