BY-LAWS


(Revised 1928; approved by Attorney General February 14, 1929; there- after amended)


ARTICLE 1 General Provisions


SECTION 1. The by-laws contained in this chapter and in the chapters fol- lowing shall be known as the "Revised By-Laws of 1928." All by-laws here- tofore adopted by the Town are hereby repealed.


A. Words importing the singular shall include the plural; words import- ing the plural shall include the singular; and words importing the masculine shall include the feminine.


B. The word street shall include all public ways, town ways, squares, lanes, sidewalks and parks, or other open and public places contiguous to public and town ways.


C. The word person shall include corporations.


D. The word owner, used in reference to real estate, shall include all per- sons, whatever their estate therein, who have a rightful estate in posses- sion in and to such real estate.


E. Words prohibiting anything being done except in accordance with a license or permit or authority from a board or officer of the Town shall be construed as giving such board or officers power to license, permit or authorize such an act.


F. Words prohibiting any act shall not be construed as prohibiting any board or officer of the town from doing such things as he or they may rightfully do in the execution of their or his powers of office.


G. The word sidewalk shall be construed as meaning any sidewalk, foot path, bicycle path or other path commonly and generally used by pedestrians situated outside that portion of a street commonly used by horses and vehi- cles for travel whether or not the same has been wrought and constructed by or under the authority of the Town.


ARTICLE 2 Concerning Town Meetings and Elections


SECTION 1. The warrants for all town meetings and elections shall be di- rected to a constable or some police officer of the town, and every town meet- ing and election shall be notified by posting attested copies of the warrant calling the same in not less than three public places in the town, seven days at least before the time of said meeting and election. One copy of said war- rant shall be posted at the post office at North Wilbraham, one copy at the post office at Wilbraham, one copy at Glendale, so-called.


SECTION 2. The Annual Town Meeting shall be held on any Saturday in the month of March, to be determined by the Board of Selectmen and specified in the warrant prepared by them. The polls for the election of officers shall open at 8:30 o'clock A. M. and close at an hour to be determined by the Selectmen and specified in the warrant, but the polls shall be kept open at least ten hours. The meeting for the consideration of the articles of the warrant other than the election of officers shall commence at 10:00 o'clock A. M., and the warrant shall so specify. (Amended February 27, 1948.)


SECTION 3. At any town meeting for the transaction of business other than the election of town officers, twenty registered voters of the town shall con- stitute a quorum for the transaction of business.


S-CTION 4. Articles in the warrant shall be acted upon in the order in which they stand, except that the Moderator may, upon request and for rea- sons stated, entertain the motion to take up an article out of its regular order.


SECTION 5. No motion the effect of which would be to dissolve a Town Meeting shall be in order until every article in the warrant has been duly considered and acted upon, but this shall not prevent the postponement of action on, or the consideration of, any article to an adjournment of the meet- ing to a stated time.


SECTION 6. At the Annual Town Meeting in every year, when the term of office of any incumbent expires, and except when other provision is made by law, there shall be chosen by ballot from the inhabitants of the town the following officers for the following terms of office :

A. Amended February 27, 1948: Voted unanimously to elect at each an- nual election hereafter a Moderator to serve for the term of one year, or until his successor is qualified, in accordance with the provision of the General Laws, Chapter 39, Section 14, and to amend the Town By-Laws accordingly.


B. A town clerk for one year.


C. A town treasurer for one year.


D. One selectman who shall be a member of the Board of Public Welfare, for three years.


E. One assessor for three years.


F. Five constables for one year.


G. One auditor for one year.


H. One School Committee for three years.


I. One collector of taxes for one year.


J. One library trustee for three years.


K. One tree warden for one year.


L. One cemetery commissioner for three years.


M. One water commissioner for three years.


SECTION 7. (Repealed February 27, 1948.)


ARTICLE 3 Financial Committee


SECTION 1. There shall be a financial committee for the town consisting of nine members, and no person holding an elective town office shall be eligible to serve on said committee. (Amended July 27, 1953.)


SECTION 2. The Selectmen shall after each annual Town Meeting appoint from the citizens of the town said committee to serve until next annual Town Meeting, at which time the Board of Selectmen shall appoint or reappoint another Financial Committee. Said committee shall choose its own chairman and secretary. Vacancies on said committee may be filled at any time by the Board of Selectmen. To this committee shall be referred all articles in the Town Warrant calling for appropriations. The committee shall consider all matters proposed to be acted upon at Town Meetings, but it shall not report on such matters as may have been referred to other committees by vote of the town.


SECTION 3. No vote shall be passed at any town meeting involving the appropriation or expenditure of more than $100.00 the subject matter of which has not first been considered and reported on by said committee.


SECTION 4. It shall be the duty of this committee to investigate the needs of the town, particularly the financial requirements of the several departments, and to ascertain and recommend the amount required to carry out the work . of the town for the ensuing year.


SECTION 5. Five members of the committee shall constitute a quorum for the transaction of business.


ARTICLE 4 Concerning the General Welfare


SECTION 1. No person other than those officers or boards having authority to repair or construct highways, or a person acting under the authority of any of them, shall dig up, open or excavate any street without first obtaining permission in writing so to do from the Selectmen, and if the Selectmen so require, executing and delivering to the town an agreement under seal to indemnify the town and save it harmless from all loss, cost or damage caused to it thereby and to replace the material and substances so dug up or removed to the satisfaction of the Selectmen. Such permission shall state the place where, and the manner in which, such opening or excavation may be made. Whoever does so open, dig up or excavate in any street shall properly guard such opening or excavation, and the substance or material removed there- from, and shall keep the same properly lighted one hour after sunset until sunrise.


SECTION 2. No person shall dig up, plow up, cut up or despoil any portion of any street, except that any owner whose land abuts upon any street may grade or otherwise beautify the said street immediately in front of his own

parcel in such a manner as will not interfere with public travel in the spaces in said street reserved or generally used for such travel.


SECTION 3. No person shall throw or place or cause to be thrown or placed in any street or upon any sidewalk, any glass, broken crockery, scrap iron, nails, whole or broken bottles or any other article that would be liable to injure the feet of horses or pedestrians or injure or damage the tires of bicycles or any other vehicle which has wheels with tires composed in whole or part of rubber.


SECTION 4. No person shall allow a horse or vehicle under his control to be driven or parked on any sidewalk or cinder path in such a manner as to obstruct travel in the same.


SECTION 5. No person shall hitch or tie or allow his horse or other animal to be hitched or tied to any tree in any street.


SECTION 6. No person shall throw stones, snow balls, sticks or any other missiles, or kick football or play at any game in which a ball is used, or fly kites or balloons, or shoot with or use an air gun, bow and arrow, sling shot or other similar device in or across any public ways of the town.


SECTION 7. No person shall write, paint, print or otherwise inscribe any notice, advertisement, word, figure or pictures on any of the public sidewalks or bridge abutments of the town.


SECTION 8. Persons shall not assemble or stand upon any sidewalk or street so as to obstruct the free passage thereof.


SECTION 9. No person shall destroy, remove, injure, tear down or deface any guide board, sign or other public notice erected by the Selectmen or other public town officer.


SECTION 10. No person shall revel, quarrel, behave in a boisterous, indecent or disorderly manner or use any indecent or profane, insulting or abusive language, or sing any lewd, profane or indecent song in any street or public place.


SECTION 11. No person shall cut down, remove, mutilate or otherwise in- jure any fruit, shade, or ornamental tree now growing or which may here- after be growing in any park, including Collins Memorial Park at North Wil- braham, or street, common ground or cemetery in this town.


SECTION 12. No person shall light or extinguish by stone-throwing, any Town light in any street, square or public place in the Town.


SECTION 13. No fireworks or fire crackers shall be sold at retail within the limits of the Town of Wilbraham except on the two week days prior to Inde- pendence Day and on Independence Day between the hours of 4:00 A. M. and 10:00 P. M. The selling of fireworks on Sunday is strictly forbidden. (This section is modified by the General Laws (Ter. Ed.) Chapter 148, Section 39, Section 39A, Section 40, Section 42 and Section 47.)


SECTION 14. No firework, fire cracker or pistol shall be discharged, set off or used within the limits of the Town of Wilbraham except upon Independence Day between the hours of 4:00 and 11:00 P. M .; provided that no explosives of any character shall be used or discharged within 500 feet radius of any concert, exhibition or exercises being conducted at the time under the auspices of the Town or organization; provided further that this by-law shall not apply to illuminating fireworks set off between the hours of 7:00 P. M. and midnight on Independence Day or to the use of explosives authorized by the law. (This section is also modified by the General Laws (Ter. Ed.) Chapter 148, Section 39, Section 39A, Section 40, Section 42, and Section 47.)


SECTION 15. No person except a fireman in legitimate discharge of his du- ties as a fireman of the Town of Wilbraham, shall open any hydrant without consent of the Water Commissioners, and no person shall place any building material or other article or rubbish of any kind so as to hinder the free access to the use of any hydrant.


SECTION 16. Any person violating any of the provisions of the preceding by-laws shall be punished by a fine not exceeding $20.00 for each offense.


ARTICLE 5


Breeding License


SECTION 1. No person shall keep dogs for breeding purposes within the Town of Wilbraham without first obtaining a special license therefor from the Town Clerk.

ARTICLE 6 Sanitation


SECTION 1. No person shall allow any sink water or other impure water to run from any house, barn or lot occupied by him or under his control into any street or highway of this town.


SECTION 2. No cesspool shall be permitted in the cellar or court of any tenement house nor within 15 feet of any wall of said tenement house, or boundary line.


SECTION 3. No person or persons shall at any time whatsoever carry into or through any public street of the Town any part of the contents of the privy vaults or cesspools in any cart, wagon or any other vehicle or utensil which shall not be closely covered, water tight and kept clean upon the outer surface.


ARTICLE 7 Collecting Junk


SECTION 1. No person shall go about from place to place in the Town of Wilbraham collecting by purchase or otherwise junk, old metals or second handed articles without being licensed so to do by the Selectmen.


PLANNING BOARD Adopted February 2, 1931


SECTION 1. Amended April 9, 1945: Voted that the Town will adopt a by- law establishing a Planning Board under the provisions of General Laws (Ter. Ed.) Chapter 41, Section 81A, with all the powers and duties therein and in any existing by-laws of the Town, to consist of five members to be elected by ballot at the Annual Town Meeting in February, 1946, one for a term of one year, one for a term of two years, one for a term of three years, one for a term of four years and one for a term of five years and thereafter in accordance with the provisions of the statute.


SECTION 2. Vacancies otherwise occurring in the Board shall be filled as provided in General Laws, Chapter 41, Section 11. (No change under Section 81A.)


SECTION 3. The duties of such Board shall be such as are stated in Chapter 41, Section 70 to 72 of the General Laws, and further to consider and advise upon municipal improvements either at the request of other officials of the town or upon its own initiation. It shall consider and develop a town plan with special attention to main ways, land development zoning, playgrounds and parks and sites for permanent school plants. The Board shall meet at regular intervals. It may hold public meetings. It shall at all times have access to public documents or information in the possession of any town official or department. It shall examine the plans for the exterior of any public building, monument or similar feature and for the development and treat- ment of the grounds about the same before the adoption thereof and may make such recommendations thereon as it may deem needful. It may provide for public lectures and other educational work in connection with its recom- mendation. It may incur expenses necessary to the carrying out of its work within the amount of its annual or special appropriations. (See Sections 81B, 81C and 81D of Chapter 41, General Laws for further provisions and requirements.)

SECTION 4. All plans for laying out, extending, discontinuing or chang- ing the limits of any way, street, playground, public park or square, and every purchase of land for the site of any public buildings and all plans for the location, erection or alteration of public buildings shall be submitted to said Board for its opinion at least two weeks in advance of action by the Board of Selectmen of the town. (See Section 811 of Chapter 41, General Laws.)


SECTION 5. The Board shall make a report to the town annually giving information regarding the condition of the town and plans or proposals for the development of the town and estimates of the cost therefor. Such reports shall be sent to the Selectmen not later than such time in January in each year as the Selectmen may prescribe or as may be prescribed by laws in force relative to reports, and a copy thereof shall be filed with the Massachu- setts Department of Commerce, Division of Planning. (Section 81C of Chap-

ter 41, General Laws, requires the Board to report at the annual town meeting. )

Chapter 41, Section 81B, General Laws (Ter. Ed.) delegates all the powers and duties of the Board of Survey to the Planning Board.


BUILDING LINES Adopted February 2, 1931


Voted to accept Section 37 of Chapter 82, General Laws:


SECTION 37. Building Lines. - If a city by its city council or a town accepts this section or has accepted corresponding provisions of earlier laws, a build- ing line not more than forty feet distant from the exterior line of a highway or town way may be established in the manner provided for laying out ways, and thereafter no structures shall be erected or maintained between such building line and such way, except steps, windows, porticos, other usual pro- jections appurtenant to the front wall of a building, embankments, walls, fences and gates, to the extent prescribed in the vote establishing such build- ing line, and except that any structure existing at the time of the establish- ment of the building line may be permitted to remain and to be maintained to such extent and under such conditions as may be prescribed in the vote establishing such building line. Whoever sustains damage thereby may recover the same under chapter seventy-nine. A building line established under this section may be discontinued in the manner provided for the discontinuance of a highway or town way. Whoever sustains damages by the discontinuance of a building line may recover the same under chapter seventy-nine. (As amended.)

TOWN COLLECTOR Adopted February 6, 1939


Voted to adopt the following by-law under Section 38A of Chapter 41, General Laws:


The Collector of Taxes shall collect under the title of Town Collector all accounts due the Town.


ANNUAL AUDIT Adopted February 5, 1945


There shall be an annual audit of the town's accounts under the supervision of the Director of Accounts of the Department of Corporations and Taxation in accordance with the provisions of Section 35, Chapter 44, General Laws.


TRAFFIC AND SAFETY Adopted July 7, 1932, at a Special Town Meeting


Resolved that the town hereby accept Sections 3, 4 and 9 of Chapter 357, Acts of 1928, with amendments thereto, and that such laws be included in the by-laws of the town:


SECTION 3. Said chapter eighty-five is hereby further amended by striking out section two and inserting in place thereof the following: - The depart- ment of public works, in this chapter called the department, shall erect and maintain on state highways and on ways leading thereto, and on all main highways between cities and towns, such direction signs, warning signs or lights, curb, street or other traffic markings, mechanical traffic signal systems and similar devices as it may deem necessary for promoting the public safety and convenience. No such signs, lights, markings, signal systems or devices shall be erected or maintained on any state highway by any authority other than said department except with its written approval as to location, shape, size and color thereof and except during such time as said approval is in effect. No rule, regulation, order, ordinance or by-law of a city or town here- after made or promulgated relative to or in connection with such signs, lights, markings, signal systems or devices on any way within its control shall take effect until approved in writing by said department or be effective after said approval is revoked. Said department, after a public hearing and with the approval of the governor and council, may from time to time make, alter, rescind or add to rules and regulations to direct, govern and restrict the movement of vehicles on all state highways and to carry out the purposes of section nine of chapter eighty-nine on highways, including state highways, which are designated thereunder by said department as through ways, with penalties for the violation thereof not exceeding twenty dollars for each offense; provided, that nothing in this section shall be construed to give said department the power to regulate the speed at which motor vehicles may be operated on such public ways. The superior court shall have juris- diction in equity to enforce the provisions of this and the preceding section and any rule or regulation made thereunder or to enjoin the violation thereof. Said department may, after notice, revoke any approval granted under this section. (1906, 234; 1928, 357, section 3.)


SECTION 4. Chapter eighty-nine of the General Laws is hereby amended by striking out section eight, as amended by section one of chapter three hundred and thirty of the acts of nineteen hundred and twenty-six and in- serting in place thereof the following: - Every driver of a motor or other vehicle approaching an intersection of any ways, which for the purposes hereof shall mean the area embraced within the extensions of the lateral curb lines, or, if none, then the lateral boundary lines, of intersecting ways as defined in section one of chapter ninety, shall grant the right of way to a vehicle which has already entered such intersection, and every driver of a vehicle entering such an intersection shall grant the right of way to a vehicle so entering from his right at approximately the same instant; but the foregoing provisions of this section shall not apply at any intersection of ways when a driver is otherwise directed by a police officer, or by a lawful traffic regulating sign, device or signal maintained by or with the written approval of the department of public works and while said approval is in
