IN COMMISSION AND ENLISTMENT DURING THE
War With Tripoli, Africa, 1801-1805.
This war. conducted entirely by the naval and marine forces of the United States, was occasioned by the refusal of the United States to deliver tribute levied and demanded by the Bashaw of Tripoli. Jusuf Caramanly, as the price for his specifie performance of the treaty of amity concluded with this regency ou November 4, 1706.
The leading naval powers of Enrope had long been accustomed to the payment of annual tribute to the piratical States of Barbary for the safety of their commerce upon the high seas, while the merchantmen of the weaker maritime natioos were constantly harassAl. and their seamen carried off to a horrible servitude to await ransom. By reason of these existing conditions, the government of the I'nited States reluctantly entered into relations with these barbarous powers similar to those of the most favored nations.
When the Bashaw learned of the concessions made by our government to the Dey of Algiers he manifested a disposition to war. l'pon receiving no satisfactions from the representations made to the American consul at Tripoli, and the letter addressed to President John Adams on the 5th of March, 1890. he gave our consul, James Leander Catheart, his passports; cut down the flag-staff of the American consulate, May 14. 1801; and. on the 10th of the following month, formalis declared war against the United States.
Before news of the declaration of war by the Bashaw of Tripoli reached the United States, the government had intimations of the probability of such a measure being taken: and on the 20th of May, 1801, the Secretary of the Navy ordered a squadron of observation to the Mediterranean, under the command of Captain Richard Dale, with ample instructions to meet any emergency.
On February 6, 1802. Congress enacted laws which obviated all the constitutional scruples of President Thomas Jefferson, con- tained in his message of December S, 1801, which authorized the capture and condemnation of any Tripolitian vessels that might be found. This act did not contain a formal declaration of war, but provided for all the contingencies of such, even to empowering the President to issue commissions and letters of marque to privateers. Provision was made for a more vigorous prosecution of the war ly an Act of Congress entitled "An et further to protect the commerce and seamen of the United States against the Barbary powers," approved March 26. 1804.
The war was terminated June 4, 1805, by a treaty of peace, amity and commerce, concluded on board the United States Frigate "Constitution," flagship of Captain John Rodgers, commanding the Mediterranean Squadron. in the barbor of Tripoli; and its ratification was advised by a Resolution of the United States Senate on April 12, 1806. Under the provision of this treaty the Bashaw relinquished all claim to future tribute; Tripolitian and United States prisoners were exchanged, man for man; and the remaining American captives were liberated by the payment of a ransom of sixty thousand dollars.
The significant features of such conflicts as took place during this war were found in the intrepidity of the officers and enlisted men of the American ships, and the development of an esprit de corps unknown to the navies of the world, whose gallantry, bravery and success was specially recognized by the several resolutions of Congress during this war period.
