War With France, 1798-1801.
The War with France was conducted entirely by the naval and marine forces of the United States.
The Revolution was on in Franer, and the maritime powers of Europe, with England in the lead, were striving to crush the new republic. In retribution, the French ernisers captured and condemned many American merchantmen laden with American products not contraband of war, simply because those ships were en route to ports of nations at war with France. Retaliation. therefore, became absolutely necessary, disagreeable as it might be to engage a former ally, after all diplomatie efforts failed to preserve a permanent peace with the discordant elements that, in those days of the French Revolution, ruled at Paris.
While the United States government did not actually declare war against France, Congress substantially did so when it passed the following, and the subsequent, Act:
AN Act more effectually to protect the Commerce and Coasts of the United States.
WHEREAS armed vessels sailing under authority or pretence of authority from the Republic of France, have committed depreda- tions on the commerce of the United States, and have recently captured the vessels and property of citizens thereof, on and near the coasts, in violation of the law of nations, and treaties between the Caited States and the French nation. Therefore
BE IT ENACTED by the Senate and House of Representatives of the United States of America in Congress assembled, That it shall be lawful for the President of the United States, and he is hereby authorized to in-truet and direct the commanders of the armed vessels belonging to the United States to seize, take and bring into any port of the United States, to be proceeded against according to the laws of nations, any such afmed vessel which shall have committed or which shall be found hovering on the coasts of the United States, for the purpose of committing depredations on the vessels belonging to citizens thereof: and also to retake any ship or vessel, or any citizen or citizens of the United States which may have been captured by any such armed vessel .- Approved, May 28. 1798.
On June 13, 1798, the commercial intercourse existing between the United States and France, and the dependencies thereof, was suspended by an act of Congress. The Congress passed the following et, which was approved July 7, 1795:
Ax Acr to declare the treaties heretofore concluded with France, no longer obligatory on the United States. WHEREAS the treaties concluded between the United States and France have been repeatedly violated on the part of the French government; and the just claims of the United States for reparation of the injuries so committed have been refused, and their attempts to negotiate an amicable adjustment of all complaint- between the two nations, have been repelled with indignity: and, WHEREAS, under authority of the French government, there is yet pursued against the United States, a system of predatory violents, infracting the said treaties, and hostile to the rights of a free and independent nation :
BE IT ENACTED by the Senate and House of Representatives of the United States of America in Congress assembled. That the I'mited States are of right freed and exonerated from the stipulations of the treaties, and of the consular convention. heretofore ooheluded between the United States and France; and that the same shall not henceforth be regarded as legally obligatory on the Lovernment or citizens of the United States.
This naval war between France and the United States, which began May 28, 1799, was virtually closed on February 3, 1501. The convention of peace, commerce and navigation, was concluded by the l'inipotentiaries of the governments of the United States and France, September 30, 1500. The Senate of the United States by a resolution passed February 8, 1501, advised the ratifica- tion of the treaty made by the convention, subject to a material alteration suggested in one of the articles. This was agreed to, all the ratification was exchanged at Paris, France, July 31, 1501; approved by the United States Senate, December 19, 1901: and promulgated by a Proclamation of the President of the United States, Thomas Jefferson, December 20, 1501.
By the provision of this treaty all government vessels of war captured on either side were to be restored, and the prizes to ho " tamed by their respective captors.
