SEC. 3. Whenever the Fire Marshal shall deem it necessary to protect the city from fire, that a scuttle be made in any dwelling house or other building, he shall give an order in the manner speci- fied in the second section of this By-Law, directing that a scuttle, with proper steps or stairs leading to the same, be constructed, and every neglect or refusal to comply with the requirements of said order, shall be punished by a fine of five dollars for every such neglect or refusal, and by the further sum of four dollars for each and every month thereafter that said order shall not be complied with.


SEC. 4. Whenever said city shall be exposed to danger from fire, in consequence of shavings, straw or other combustible materials, being suffered to remain in or near any buildings in said city, then it shall be the duty of the Fire Marshal to give a written order in the manner prescribed in the second section of this By-Law, to re- move the same within the time specified in said order, and any neglect or refusal to comply with said order, shall be punished in the manner prescribed in the third section of this By-Law.


SEO. 5. It shall be the duty of the Fire Marshal, whenever called upon, to inspect any petroleum or kerosene (so-called) exposed for sale within the limits of said city, and ascertain if it complies with the standard of 110 degrees Fahrenheit.


SEC. 6. It shall be the duty of the Fire Marshal to attend at every fire occurring in said city, and when he shall have any reason


to believe that any fire may have been incendiary in its origin, it shall be his duty to inquire into the cause of said fire, and to pro- ceed in said inquiry in the manner specified in the Public Act of this State, relating to the appointment of Fire Marshal.


SEC. 7. If any person shall hinder or obstruct the said Fire Mar shal in the discharge of any of the duties imposed upon him by virtue of this By-Law, the person so offending shall forfeit and pay the sum of twenty-five dollars.


SEC. 8. It shall be the duty of the Fire Marshal to keep a record- book, where he shall write down the substance of all orders by him made, and all written complaints made to him, and all examinations made by him, pursuant to the provisions of this By-Law, and to make an annual report to the Court of Common Council of the ser- vices performed by him during the year as said Fire Marshal ; and it shall also be his duty to enter complaint to the prosecuting attorney for any violation of the provisions of this By-Law.


SEC. 9. The pay of said Fire Marshal shall be at the rate of Three Dollars per day, or pro rata for parts of days for time actually employed in carrying out the provisions of this By-Law.


SEC. 10. The Fire Marshal shall have authority to appoint a deputy to aid and assist him in the discharge of the duties herein assigned to him. Provided, nevertheless, that no period during the acting of a deputy shall the Fire Marshall be entitled to pay, but the same shall be due to the Deputy.

Board of Health.


The following City Ordinances were passed unanimously by the Board of Health on the 3d of June, 1868 :


QUARANTINE REGULATIONS.


ORDERED-That the northern quarantine limits for the harbor of New Haven and contiguous waters, be a line drawn from the north - east corner of Hotchkiss' Rope Walk, in the Oyster Point quarter in New Haven, to Fort Wooster, on Beacon Hill, in East Haven ; and that the southern limit be a line drawn due west from the south - west angle of the new fort (Fort Haven) in East Haven to the beach in New Haven harbor, and the portion of the harbor and contiguous. waters between said lines, shall be the place where vessels arriving, if need require, shall perform Quarantine.


ORDERED-That the fees of the Health Officer for visiting and giving bills of health to vessels subject to Quarantine Regulations for the year ensuing, shall be five dollars, and no more, excepting vessels laden with the produce of and coming from the British North American Province, and vessels coming out of Chesapeake Bay, or from any port or place upon said Bay, or any river emptying into said Bay, for which no fees shall be paid.


Provided, however, that no vessels coming from places except those mentioned, on board of which vessels there shall be any infectious or malignant diseases, shall, on entering the harbor, show a signal

for a Health Officer, whose duty it shall be to board the vessel, for which he shall receive the fee of five dollars.


CARTING OF WHITE FISH, &c.


WHEREAS, It appearing to, and being found by this Board, that the putting of any putrid animal substance or any fish upon any land near the public highway or dwelling house, for manure or for any other purpose, and the carting of White fish through any of the thickly settled streets of this town, are injurious to the health of the inhabitants thereof. Therefore,


ORDERED-That no person shall put any putrid animal substance or any fish upon any land, for manure or for any other purpose, within the distance of half a mile of the dwelling house of any per- son, or within one hundred rods of any public highway, without written permission from the Health Committee.


ORDERED -- That the carting of White fish through any of the streets of the city of New Haven be, and is hereby prohibited.


VOTED-That the Board of Health of the Town of New Haven do hereby delegate to the Health Committee appointed by this Board all the powers conferred on this Board for the prevention and abate- ment of Nuisances in conformity with the acts of the Legislature, passed May Session, A. D. 1866 ; Chapter V., approved May 23d, 1866.


VOTED-That the above and foregoing orders be published by the Clerk in the daily papers of this city three weeks successively, once each week. WILLIAM DOWNES, Clerk.


Expressmen, Carmen, &c.


SEC. 1. That no owner or driver of any Baggage Wagon or Ex- press Wagon, for the carriage of baggage or goods of any kind within the city limits, shall charge, demand, take, or in any way receive more than the following rates or prices, namely :


For the carriage of any trunk, chest, or other article of baggage, or any box, bundle, or package of goods of any kind not exceeding SIXTY POUNDS in weight, FROM any point or place within the city limits, TWENTY-FIVE CENTS.


For each additional trunk, chest, box, bundle, package, or other article, TEN CENTS.


For the use of an Express Wagon or Baggage Wagon, for one entire day, FOUR DOLLARS, and at that rate for half a day. .


For the use of the same by the hour for any period of time less than half a day, FIFTY CENTS per hour, and at that rate for fractions of an hour.


And for moving a chest of tools FROM any point or place within said city limits, To any point or place within said limits, FIFTY CENTS.


And it shall be and is hereby made the duty of each and every person soliciting as a Drayman, Carman, Expressman or Baggage- man, to place the NUMBER of his said license in large figures, in some conspicuous place, on his Wagon, Cart, or Dray. And each Ex- pressman or Baggageman to have said number, when soliciting or engaged in work, in some conspicuous place upon his person.


SEC. 3 .- That every person who shall violate any of the provisions

of this By-Law, or of the By-Law to which this is in addition, shall for each and every such violation, forfeit and pay a fine of FIVE DOLLARS.


SEC. 4. If the driver of any Express Wagon, Baggage Wagon or other vehicle for the carriage of baggage or goods of any kind, within the limits of the city of New Haven, shall REFUSE to carry any baggage or goods at such rates of fare as are provided in this By-Law, his license shall thereupon become void, and he shall for- feit and pay a penalty of FIVE DOLLARS.

Public Hacks, &c.


SECTION Ist-That no owner or driver of any "Hackney Coach" shall charge, demand, take, or in any way receive for the carriage of passengers within the city limits, more than the following prices or rates, namely :-


For the carriage of single passenger, with one trunk and a carpet bag, hat-box, or other similar article, from any Railroad Depot, Steamboat Landing, or other point or place within said limits, to any Railroad Depot, Steamboat Landing, or other point or place, within said limits, FIFTY CENTS.


For the carriage of two or more passengers, with the amount of baggage stated above for each, from the same Railroad Depot, Steam- boat Landing, or other point or place to the same point, place or desti- nation, within said city limits, and at the same time, THIRTY-FIVE CENTS EACH.


For carrying a child over four and under ten years of age, one-half the above rates.


For a carriage to and from a party or a wedding within the city lim- its, THREE DOLLAR .


For a carriage to and from a funeral, TWO DOLLARS, and if to and from a church, THREE DOLLARS; and for the use of a Hack- ney Coach and two horses, ONE DOLLAR AND FIFTY CENTS per hour, and at that rate for fractions of an hour


N. B .- Two cards must be placed and kept in each Hack, one at each end, under a penalty of $10; and each and every violation of these regulations, subjects the offender to a like penalty of $10.
