SELECTMEN'S REPORT


REPORT OF THE BOARD OF SELECTMEN


To the Citizens of Scituate:


The rapid growth of our Town and its consequent demand for greater services is of paramount interest to all of us. With this thought uppermost in our minds, your Selectmen called a meeting of all Department Heads to discuss future projects involving money expenditures beyond the ordinary, such as, harbor dredging, addi- tion to High School, water extensions, etc. We are of the opinion that the resultant meetings were of great benefit to the Town, as a whole, in planning the immediate future. We hope to continue these project meetings in the year 1950 and bring to the attention of the taxpayer the crucial years that lie ahead for him and for the Town.


The year 1949 brought about the retirement of Chief Stewart and the appointment of Chief Kane as the Head of our Police Department. We also received the resignation of Chief Cole and appointed Chief Curran to take his place as Chief of our Fire Department. The decision of your Selectmen was unanimous in both instances.


At this writing the contracts have been let on three different shore protection projects in conjunction with the State and County at Minot and at First and Second Cliffs. The project at Second Cliff is unique as it is the first time that a soil erosion project in con- junction with State and County funds has ever been undertaken in our Town or in the Commonwealth. These necessary shore pro- tection undertakings have exhausted our money available for that use and we have prepared an article for the 1950 Town Meeting to replenish the same.


The Greenhead Fly project carried on in the Town during the summer of 1949 proved highly successful from reports available.


The financial condition of your Town remains strong but the years ahead promise to be more burdensome if your Town con- tinues to grow as rapidly as it has in the post-war years. All of us should carefully scrutinize requests for expenditures of money to determine their absolute necessity to the Town in the light of foregoing statement.

REPORT OF THE TOWN CLERK


ANNUAL TOWN MEETING March 7, 1949


At a legal meeting of the inhabitants of the Town of Scituate, qualified to vote in Elections and Town Affairs, held at the High School Auditorium in said Scituate on Monday, the seventh day of March, 1949, at 7 o'clock P.M .; order was called by Moderator Nathaniel Tilden.


The warrant was read by Town Clerk William M. Wade.


Tellers appointed by the Moderator and sworn by the Town Clerk were: J. George Vollmer, Kilby P. Smith, Andrews Wyman, John E. Bamber, Thomas W. Macy, and Elmer Kettell.


The check list was used. The ballot clerks appointed and sworn were: Charlotte L. Chessia, Barbara Tobin, John J. Loner- gan and Ruth M. Meyers.


ARTICLE 1


To choose all the necessary Town Officers other than those elected by ballot, viz: Surveyor of Lumber, Measurer of Wood and Bark, two or more Field Drivers, one Pound Keeper.


VOTED: Surveyor of Lumber and Measurer of Wood and Bark: Russell L. Fish.


Field Drivers: Ernest M. Damon, Lawson C. Vickery.

ARTICLE 2


To hear the report of the Selectmen or other Town Officers and Standing Committees, and act thereon.


VOTED: To accept reports of Town Officers and Standing Committees as printed in the Town Report.


ARTICLE 3


Will the Town vote to establish salaries and compensation of all elected Town Officers, or act thereon.


VOTED: That the Town establish the salaries and compen- sation of all elected Town Officers as follows:


Voted that all salaries and compensation of all elected Town Officers voted under Article 3 be less any retirement allowance or pension received by such officers.

Selectmen: Chairman, $3,000.00 and legitimate expenses. Other members $700.00 each and legitimate expenses.


Board of Public Welfare: Chairman, $600.00 and legitimate expenses. Other members $200.00 each and legitimate expenses. This sum shall include their charges for all services performed by them or either of them.


Assessors : Chairman, $2,500.00 and legitimate expenses. Other members $750.00 each and legitimate expenses.


Highway Surveyor: $3,600.00.


Town Collector: $2,940.00 and legitimate expenses. All de- mand fees to accrue to the Town.


Town Treasurer: $2,520.00 and legitimate expenses.


Tree Warden: $400.00.


Town Clerk: $1,560.00 and legitimate expenses.


Board of Health: Divided as follows: Secretary $700.00 and legitimate expenses. Other two members $400.00 each and legiti- mate expenses. This sum shall include their charges for all services performed by them or either of them, other than the inspection of meat, plumbing or cattle.


Park Commissioners: Each member shall be paid the amount per hour for work actually performed as is paid laborers in the Highway Department.


Water Commissioners: Chairman $350.00 and legitimate ex- penses. Other members $300.00 each and legitimate expenses.


Moderator: Per annum $110.00.

To see if the Town will vote to raise and appropriate, or transfer from available funds in the Treasury, such sums of money as may be necessary to defray expenses estimated for the year 1949 and make appropriations for the following Departments:

TOWN CLERK'S REPORT


ARTICLE 6


To see if the Town will authorize the Board of Public Welfare to contract at their discretion for support of the Town's poor, or act thereon.


VOTED: To so authorize.


ARTICLE 7


To see if the Town will authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year, beginning January 1, 1950 and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Sec. 17, Chapter 44, G.L.


VOTED: To authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipa- tion of the revenue of the financial year, beginning January 1, 1950, and to issue a note or notes therefo:, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws. Unanimous vote.


ARTICLE 8


Will the Town vote to have all the income from the Water Department paid to the Town Treasurer, and estimated receipts used by the Assessors in fixing the tax rate for the current year?


VOTED: Yes.


ARTICLE 9


To see if the Town will vote to rescind the vote passed under Article 2 of the Warrant for the Annual Town Meeting held in 1941, and vote that water revenue shall be expended for water purposes, and no other purposes, and that any excess of revenue over payments for water purposes, in any year, be set up on the books of the Town as available Water Revenue.


VOTED: That this article be referred to a committee of three, comprising one Selectman, one Water Commissioner, and one member of the Advisory Board. This committee to report their findings to the next town meeting.


ARTICLE 10


Will the Town vote to raise a sum of money, now estimated at $14,000.00, to be expended for the installation of water mains, of not less than six inches diameter, the total appropriation for the Water Department, however, shall not exceed the income for the current year, or take action relative thereto.


VOTED: To raise and appropriate $5,000.00.

Will the Town vote to raise and appropriate the sum of $10,000.00 to the Reserve Fund or transfer the whole or any part thereof from any available funds, or act thereon?

Will the Town vote to raise and appropriate the sum of $500.00 to meet foreclosure costs on tax titles, or act thereon?

Will the Town raise and appropriate the sum of $150.00 for channel markings and regulations of the usage of the North River from Humarock Beach to the Sea, same to be in conjunction with like control by the Town of Marshfield, or act thereon?

ARTICLE 14


Will the Town raise and appropriate the sum of $70.00 for payment of dues for a yearly membership in the Maritime Division of the Boston Chamber of Commerce, or act thereon?

To see if the Town will raise and appropriate $2,500.00 to cover cost of supervision and control of the Clam flats within the Town of Scituate, or act thereon.


VOTED: To raise and appropriate $2,500.00.


ARTICLE 16


To see if the Town will authorize the Selectmen to control, regulate or prohibit the taking of eels and any or all kinds of shell- fish and sea worms within the borders of the Town of Scituate and such other authority as is provided in Sec. 52 of Chapter 130 of the General Laws as inserted therein by Chapter 598 of the Acts of 1941, or take action in relation thereto.


VOTED: To so authorize.


ARTICLE 17


To see if the Town will vote to raise and appropriate, or transfer from unappropriated available funds in the treasury, a sum of money for Chapter 90 Highway Maintenance, or take any action in relation thereto.


VOTED: To pass over.

ARTICLE 18


Will the Town vote to authorize the Town Treasurer with the approval of the Selectmen to transfer from unappropriated avail- able funds in the treasury any money necessary to meet the State and County's share of the cost of any Chapter 90 Maintenance or Construction work, the reimbursement from the State and County to be restored, upon their receipt, to unappropriated available funds in the Treasury?


VOTED: To pass over.


ARTICLE 19


To see if the Town will vote to transfer the proceeds of the Dog Fund received from the County to Libraries and that the amount be equally divided between the Pierce Memorial at North Scituate and the Allen Memorial at Scituate, or act thereon.


VOTED: To transfer equally to Allen Memorial and Pierce Memorial Libraries.


ARTICLE 20


To see if the Town will raise and appropriate the sum of $700.00 for the care of Soldiers' neglected graves in accordance with the provisions of the General Laws, Chapter 115 (Ter.Ed.), or act thereon.


VOTED: To raise and appropriate $700.00. Unanimous vote.


ARTICLE 21


To see if the Town will raise and appropriate the sum of $350.00 for the purpose of providing quarters for the Satuit Post 3169, Veterans of Foreign Wars, in accordance with the provisions of General Laws, Chapter 40 (Ter.Ed.) Section 6, or act thereon.


VOTED: To raise and appropriate $350.00. Unanimous vote.

To see if the Town will raise and appropriate $100.00 for County Aid to Agriculture, and choose a Town Director as provided in Sections 41 and 45 of Revised Chapter 128 of the General Laws, or act thereon.

ARTICLE 23


To see if the Town will raise and appropriate the sum of $10,000.00 to be used in conjunction with such sums of money as may be allotted by the Department of Public Works of the Com- monwealth of Massachusetts and County of Plymouth, or either one of them, for the continuation of new construction on Gannett Road and First Parish Road under Chapter 90, or act thereon.

TOWN CLERK'S REPORT


VOTED: That the Town continue with the widening and straightening of First Parish Road, and that we use $2,600.00 of the available balance for the Town's part of costs. This sum to be used in conjunction with such sums as may be allotted by the Department of Public Works, Commonwealth of Massachusetts and the County of Plymouth, or either one of them, as per Article 37, Annual Town Meeting, 1941. Unanimous vote.


ARTICLE 24


To see if the Town will raise and appropriate the sum of $500.00 for the maintenance and improvement of the Town Forests, or act thereon.


VOTED: To raise and appropriate $500.00. Unanimous vote. ARTICLE 25


To see if the Town will raise and appropriate the sum of $500.00 to provide a Life Guard for Sand Hills Beach, or act thereon.


VOTED: To raise and appropriate $500.00; the life guard selected to be a Scituate man. Yes 279, No 173.


ARTICLE 26


To see if the Town will assume liability in the manner pro- vided by Sec. 29 of Chapter 91 of the General Laws for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, develop- ment, maintenance and protection of rivers, harbors, tidewater and foreshores, in accordance with Sec. 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.


VOTED: To adopt and assume liability. Unanimous vote.


ARTICLE 27


Will the Town raise and appropriate the sum of Two Thou- sand Dollars ($2000.00) for the purchase of gas masks as required under General Laws, Chapter 48, Section 51A, or act thereon.


VOTED: To raise and appropriate $2,000.00 Unanimous vote.


ARTICLE 28


To see if the Town will raise and appropriate the sum of $500.00 for a series of band concerts to be given during the summer season, or act thereon.

ARTICLE 30


Will the Town appropriate a sum of money up to $200.00 for the purpose of stocking ponds and other inland water located within the Town limits with fish and of liberating game, as defined in Sec. 1, Ch. 129A, within said limits and to meet the necessary expense incidental thereto, including the feeding of game so liberated, as provided in Ch. 142 of the Acts of 1938, or act on anything relating thereto.


VOTED: To raise and appropriate $200.00.


ARTICLE 31


Will the Town vote to authorize and instruct the Selectmen to acquire, for Park purposes, by purchase from the First Parish Church, of Scituate, for the sum of One Dollar all the right, title and interest of the said Church in and to that parcel of land situ- ated on Meeting House Lane commonly known as the MEN OF KENT CEMETERY, or take any action relative thereto.


VOTED: To raise and appropriate $1.00 and to so instruct the Selectmen.
