Innes, as shown on Decree Plan Number 1070 filed in the office of the Selectmen and the Town Clerk.

To see if the Town will vote to accept the provisions of Sec- tion 97A of Chapter 41 of the General Laws (Ter. Ed.) as inserted by Chapter 595 of the Acts of 1948, which provides generally for the establishment of a Police Department to be under the super- vision of a chief of police who shall be in immediate control of property used by said department and of the police officers whom he shall assign to their respective duties and who shall obey his orders, or act on anything relating thereto.


VOTED: To accept the provisions of Section 97A of Chapter 41 of the General Laws (Ter. Ed.) as inserted by Chapter 595 of the Acts of 1948.

ARTICLE 53


Will the Town vote to amend its Zoning By-Law by adding to Section 3 the following or act thereon:


(a) Area Regulation:


No building shall be erected in a residential district on a lot containing less than 10,000 square feet or less than 100 feet wide. The lot width shall be measured at the way line or the set back line. Only one building for residential purpose shall be built on any one lot of less than 20,000 sq. ft. This section with all its specifications shall not apply to any single lot which was planned, plotted and recorded as such before April 20, 1946, the date that the Town of Scituate first adopted its Building Code.


(b) Set Back:


Set back shall be 30' from the street line where no building line is already established. When present buildings on adjoining lots are less than thirty feet from the way line, new buildings may be placed as near the way line as the average of the buildings on adjoin- ing lots. A vacant lot shall be treated as though occupied by a building set back 30 feet. No building, residential or non-residen- tial, shall be erected nearer than 8' to the side or rear of lot lines, except by permission of the Board of Appeals after adjoining prop- erty owners and other interested parties have been notified.


Will the Town further amend its Zoning By-Laws by deleting Paragraph 10 which reads as follows:


(10) A private garage with space for not more than three automobiles, to be used in connection with and as an incident of one of the foregoing purposes, provided, as to each such garage that after a public hearing by the Board of Selectmen fourteen days notice of which shall be published in the local newspaper and mailed to the last known address of each owner of property within five hundred feet of the proposed location, the Selectmen shall rule that such garage will not be detrimental or injurious to the neigh- borhood.


And adopting the following: (10) A private garage with space for not more than three automobiles to be used in connection with and as an incident of one of the foregoing purposes.

ARTICLE 54


Will the Town vote to amend its Building By-Law by the dele- tion of Article 5 which reads as follows or act thereon:

shall be 10,000 feet in area with a minimum of 100 feet frontage, except those lots that were planned, plotted and recorded before April 20, 1946, the date that the Town of Scituate first adopted its Building Code. ARTICLE 55


Will the Town further amend its Building By-Law by inserting the following paragraph to be designated as Section 7 Article 7 and entitled "Gas Fitting."


Article 7, Section 7.


GAS FITTING


(a) No person, or persons, shall construct, extend, or alter any system of pipes for the conveyance, distribution, or use of gas, or install any gas appliance, unless he is lawfully registered with the Building Commissioner.


(b) All concealed, painted, or coated gas piping and fittings shall be tested at the request of and in the presence of the Com- missioner, or his agent, in a manner satisfactory to the inspector.


(c) Defective, or second hand pipe, or fittings, shall not be used unless such materials meet the requirements of new pipe and fittings. No sweated joints shall be used on pipe conveying gas inside of buildings. All materials shall be subject to the Commis- sioner's approval.


(d) All gas appliances are subject to the approval of the Commissioner.


(e) Every gas appliance, where required, shall be connected to an effective flue, or outlet pipe to the outer air. In cases where the flue pipe does not enter a chimney, the flue pipe shall enter a vertical stack terminating with a suitable device installed to prevent a down draft. The flue, or pipe, where extending through from floor to floor to roof, located inside partitions, or walls, or extending through wall or partitions, shall have at least 11/2" clearance from all combustible materials, or otherwise as the Commissioner may re- quire. A pitch or rise of at least 11/4" to the foot shall be maintained.

No vent pipe shall enter the chimney or flue at a lower level than the outlet of the appliance.


(f) The cross sectional areas of flues, or vents, for gas burning appliances shall not be less than one square inch per 7,500 hourly B.T.U. input and in no case, shall this section be less than 3 inches in diameter.

ARTICLE 56


Will the Town vote to amend its Zoning By-Laws by adding the following section, or take any action thereon:


Section 12. No loam, top soil, sand, gravel or so-called fill shall be removed from any area in Scituate for commercial pur- poses, unless a variance is granted by the Zoning Board of Appeals after a public hearing.

ARTICLE 57


Will the Town vote to instruct the Moderator to appoint a committee of seven (7) persons, including at least 2 members of the Advisory Committee and at least 2 members of The Planning Board, to further consider the advisability of adoption by the Town of Scituate of a selectmen-manager form of Town government, and to report its recommendations to the Town on or before the next annual Town Meeting, and appropriate the sum of $100.00 for in- vestigative expenses of said committee, or take any other action in relation thereto.

SPECIAL TOWN MEETING October 15, 1951


At a legal meeting of the inhabitants of the Town of Scituate qualified to vote in Elections and Town Affairs held at the High School Auditorium in said Scituate on Monday, the 15th day of October, 1951, at 8 o'clock P.M .; the meeting was called to order by Moderator Philip S. Bailey.


The check list was used, checkers being Ruth M. Meyers and Barbara Tobin.


The warrant was read by Town Clerk William M. Wade.


Tellers appointed by the Moderator and sworn by the Town Clerk were John E. Bamber, Kilby P. Smith, Jr., Joseph V. Feeley, Nels H. Sandberg, and Fred S. Gilley.


ARTICLE 1


To see if the Town will raise and appropriate, or transfer from available funds, the sum of $9,000.00 to purchase from the North Scituate Investment Corporation a certain parcel of land adjacent to the North Scituate Railroad Station, containing 23,518 square feet, for parking and highway purposes. Said parcel is shown on a plan on file in the office of the Town Engineer at the Town Hall.


VOTED: That the Town transfer from the Excess and Defi- ciency Fund the sum of $9,000.00 to purchase from the North Scituate Investment Corporation a certain parcel of land adjacent to the North Scituate Railroad Station, containing 23,518 square feet, for parking and highway purposes; said parcel being shown on a plan on file in the office of the Town Engineer at the Town Hall. ARTICLE 3


To see if the Town will vote to accept the provisions of Chap- ter 820 of the Acts of 1950 which provides for an increase of $100.00 in the annual amounts of certain pensions for employees separated from the service by retirement prior to November 1, 1949, and at the time of such separation from service had at least fifteen years of creditable service.


VOTED: That the Town accept the provisions of Chapter 820 of the Acts of 1950. Voice vote.


ARTICLE 4


Will the Town appropriate from available funds in the Treas- ury, the sum of $15,000.00 to install a water main 10 inches in diameter, along Kent Street, from Gilson Road to Edward Foster Road, for the purpose of reinforcing the water system, to and in Scituate Harbor, in accordance with an approved five-year plan, thereby increasing the supply line capacity from the pumping sta- tions to Scituate Harbor, or take any action thereon?
