Of the total expenditures $128,590.86 was for Welfare functions which includes Welfare, Hospitals, Mothers' Aid and Old Age Assistance. Some refunds on Mothers' Aid and Old Age Assistance will be made by the State.


There was expended for Soldiers Benefits $22,392.27, of this there is an estimated return by the state of $2500.00 making total expenditures for relief of $150,983.13.


To meet these expenditures it has been necessary to issue in the past year bonds to the amount of $31,000.


The amount expended for the same purposes in the year 1933 was Welfare $157,932.90 and Soldiers Benefits $36,634.83.


During the financial year 1933 $80,000 was hired to meet these payments.


The continuance of hiring money to meet reoccurring charges is poor business, and it is quite evident that some adjustment must be made in the tax limit if the City is to be kept anywhere near a pay as you go policy.

City Solicitor's Report


January 17, 1935


Gentlemen of the City Council :


I present herewith my report at City Solicitor of the City of Newburyport for the year 1934.


As was the case it the two preceding years, the city's business has required much of my time in 1934. The unusual conditions which have prevailed in the community have given rise to many new and perplexing problems in the administration of the af- fairs of the various municipal departments, and a large number of these problems have been referred to the Law Department for solution. Consequently I have been called upon to render many opinions, both verbally and in writing, to His Honor the Mayor and to the various department heads.


On a number of occasions it has been necessary for me, in the performance of my duties as counsel for the city, to attend conferences and hearings at the State House and elsewhere when the city's interests have been involved. I have appeared before the Civil Service Commission, the Department of Public Utilities, the Department of Pub- lic Works, the Industrial Accident Board, and the Board of Tax Appeals. Recently - appeared before the Supreme Judicial Court in connection with the appointment of a commission to apportion the cost of th eoperation, of the Shell Fish Purification Plant.


During the year four actions at law were brought against the city. Three of these were based upon claims for injuries alleged to have been received as a result of de- fective conditions in the sidewalks. These three cases were entered in the Superior Court of Essex County, and although all of them appeared on the trial list for the November sitting of the court in this city, none were reached for trial. The plaintiffs in these tort actions are :

The other case which was brought against the city in 1934 was that of George B. Merrill in which the plaintiff seeks to recover on an account annexed for merchandise sold and labor furnished at the Water Works during the recent filter bed construction. This case was brought in the local District Court. Negotiations for its settlement are now in progress.


Upon my recommendation, and after vote of the City Council, the claims of Al- berta Nicholls, Mabel Girard and Fred Wilruth were adjusted without litigation.
