CITY SOLICITOR
City Solicitor's Report
February 4, 1933.
City Council, City of Newburyport.
Gentlemen:
The ordinance setting forth the duties of the City Solicitor provides that he shall annually make a report to the City Council of all cases in court involving the interests of the city which are in his care. I submit my report for the year 1932 in compliance therewith.
Four cases were pending in the courts when I assumed office in January, 1932. These actions were:
Hazel Sass vs City of Newburyport
(A claim for personal injuries received in 1930 as a result of a sidewalk de- fect.)
Simon Sandler, Assignee vs City of Newburyport
(An action of contract brought April 12, 1930 to recover for material and supplies alleged to have been furnished to the city by the Edward Perkins Lumber Company.)
Morse and Dickenson vs City of Newburyport
(Au action of contract to recover certain fees for expert testimony given in the case of Evans vs City of Newburyport, the writ being dated May 6, 1931.)
Simon Goldberg vs City of Newburyport
(An action of tort for injuries alleged to have been received when a car in which the plaintiff was riding was in collision with a city truck.) This ac- tion was started August 19, 1930.
In 1932 the following plaintiffs brought actions against the city for injuries alleged to have been received as a result of defects in sidewalks:
Margaret O'Laughlin, Charles Donahue, Elsie M. Dow, Sabina Casey, Vir- ginia Garand, Caroline Francois and Dora Woodman.
Other actions which were brought in 1932 were:
Edward H. Porter vs City of Newburyport
(An action of contract to recover a sum of money due the plaintiff as salary as supervisor of attendance.)
Jeremiah F. Lynch vs City of Newburyport
(An action of contract of substantially the same nature as the preceding case.)

Isaac U. Wood vs City of Newburyport
(An action of tort for damage to an automobile as a result of alleged negli- gence of a driver of a city truck.)
Albert Tobin vs City of Newburyport
(A proceeding under the Workmen's Compensation Law for payment for in- juries received while in the course of claimant's employment in the high- way department in 1931.)
T. Francis Kelleher vs City of Newburyport
(An action of contract for services alleged to have been performed in con- nection with the revision of city ordinances.)
During the year the following cases were disposed of either by trial or by settlement approved by the Mayor and Committee on General Government:
Hazel Sass, Morse and Dickenson, Simon Goldberg, Edward H. Porter, Jere- miah F. Lynch, Margaret O'Laughlin, Sabina Casey, Albert Tobin, Dora Wood- man and Elsie M. Dow.
