SPECIAL TOWN MEETING April 29, 1925


On a Warrant duly issued by the Selectmen and dated April 16, 1925, and signed by Thomas B. Mulvehill, H. Eugene Rice, Eugene Endicott and Harold W. Baker, Selectmen of Norwood, the proper service of which, Warrant was duly attested by Thomas C. Lydon, Constable of Norwood.


All of the requirements of the Statutes and By-Laws relating to Town Meetings having been complied with, the meeting was called to order by the Moderator, James A. Halloran, the articles contained in this Warrant and the action taken thereunder being as follows:


Article 1. To see if the Town will vote to authorize the Selectmen to purchase or take by eminent domain a certain parcel of land for school purposes containing not more than 25,374 square feet, which is part of a tract owned now or formerly by Alfred L. Atwood and which adjoins a parcel of land taken for school purposes by right of eminent domain from Fred L. Fisher by action under the authority of Article 2 of the Warrant

of the Special Town Meeting held December 16, 1924, and to raise or borrow and appropriate money for such purpose, or take any further action in the matter.


Voted: To so authorize the Selectmen to take in fee by right of eminent domain parcel of land as described and shown on a plan entitled, "Town of Norwood, Mass., Plan of Land taken from Alfred L. Atwood for School Purposes, Geo. A. Smith, Town Engineer, April 16, 1925," and that the sum of $1,500.00 be raised by taxation and appropriated therefor.


Rising vote: Yes, 107; No, nonc.


Article 2. To hear and act upon a report of the Planning Board with reference to a Zoning By-law so-called and to see if the Town will make a new By-law providing for the limitation of particular classes bf Build- ings to specific districts or zones, and providing for the division of the Town into districts or zones and for the regulation of the construction and use of buildings in each district or zone, or to act in any other manner in relation thereto.


On motion offered by William G. Upham, Chairman of the Planning Board, to adopt as a By-law of the Town certain proposed By-laws (printed copies of which were distributed at the meeting), and following a free dis- cussion of the merits of the proposed By-law, on rising vote it was voted not to adopt.


Rising vote: Yes, 156; No, 221.


Article 3. To see if the Town will vote to amend Section 26 of the so- called Building By-Laws relating to the prevention of fires and the preser- vation of life as accepted by the Town March 14, 1910, and approved by the Attorney-General, or take any other action in the matter.


Voted: To amend Section 26 of the By-laws by enlarging the Board of Appeal by adding as members the Chariman of the Finance Commission and the Chairman of the Town Planning Board so that as amended said Section of said By-law shall read as follows:


Section 26. If no objection is filed with the Inspector before the ex- piration of five days after the last publication of notice, he shall, if the arrangement, location, and construction of the proposed apparatus is 4 proper, issue a permit for the same; but if such objection is filed, the application shall be referred to the Board of Appeal, consisting of the Chairman of the Board of Selectmen, Chairman of the Finance Com- mission, Chairman of the Town Planning Board, Chairman of the Board of Health, and the Chief of the Fire Department, and their decision shall be final.


Voted: That this meeting be now dissolved.

SPECIAL TOWN MEETING


December 28, 1925


On a Warrant duly issued by the Selectmen and dated December 15, 1925, and signed by Thomas B. Mulvehill, Eugene Endicott, Edmund G. Dalton, H. Eugene Rice and Harold W. Baker, Selectmen of Norwood, the proper service of which Warrant was duly attested by J. Irving Reid, Constable of Norwood.


All of the requirements of the Statutes and By-laws relating to Town Meetings having been complied with, the meeting was called to order by the Moderator, James A. Halloran, the Articles contained in this Warrant and the action taken thereunder being as follows:


Article 1. To hear and act on the reports of committees. The fol- lowing report of the Committee of Five, appointed under Article 15 of the Annual Town Meeting of March 24, 1925, was offered and read by Chair- man Thomas B. Mulvehill:

Appointed under Article 15 of Annual Town Meeting, March 21, 1925


(Proposed legislation sought by the Town of Walpole relative to es- tablishing a system of sewerage disposal and the location of disposal works in the Town of Norwood, Mass.)


The Committee appointed by the Moderator under Article 15 of the Warrant of the Annual Town Meeting of January 19, 1925, to which Com- mittee was referred the subject matter of said Article; namely, proposed legislation sought by the Town of Walpole to establish a Sewerage System and in which legislation it was proposed to locate disposal works in the Town of Norwood, submit as a report of progress the following:


Several conferences have been held with the Officials of the Town of Walpole.


This committee has recently extended for the consideration of the Officials of the Town of Walpole certain suggestions relative to the pro- posed legislation.


Inasmuch as no action on the part of the Officials of the Town of Wal- pole with respect to the suggestions made has come to the notice of your committee


We therefore recommend that the action of the Town under Article 15, as voted in Town Meeting of March 21, 1925, in instructing this Committee to oppose such legislation, be reaffirmed and stand until such time as this Committee after further conference with the Officials of the Town of Wal- pole, which the Committee request it be authorized by this meeting so to do, may report to a Town Meeting of the Voters of the Town of Nor-

wood, to the end that consideration may be given and action taken by such Town Meeting with respect to such recommendations as this com- mittee may see fit to make in its report.

Voted: To accept the report as a report of progress and further voted that the recommendations set forth therein be adopted.


The Committee on Municipal Memorial Building, through its Chairman Francis J. Foley, submitted a report of progress advising the voters of the work done by the Committee as preliminary to the preparation of actual plans and further informing the voters by stereopticon views which were shown at this meeting of the tentative plans arrived at by the Committee. Views were exhibited showing a ground plan of a proposed building on the lot bounded by Washington Street, Nahatan Street, Market Street and land of Singleton and Coyne; a drawing of the proposed building showing general view from Nahatan Street and Washington Street, also elevation view from Market Street, from rear of building, from Washington Street and from Nahatan Street. Chairman Foley stated that it was the hope of the Committee to receive suggestions and that the Committee desired under a further article to be given an additional appropriation of $5,000.00 in order that definite plans might be submitted, that actual estimates of the cost and an appropriation sought at a Town Meeting in March, 1926, which would enable the Committee to proceed with the construction of the building.


Voted: To accept the report of the Committee as offered by Chairman Foley as a report of progress, and on motion of Martin F. Lydon it was voted that the meeting assembled take the following action; namely,


"That we thank Chairman Foley and the Committee for the work which they are doing for the Town."


Article 2. To see if the Town will vote to appropriate a sum of money for the use of the Municipal Memorial Building Committee, the same to be in addition to sums heretofore appropriated for said purpose, or take any other action in the matter.


Voted: By transfer, the sum of $5,000.00.


Article 3. To see if the Town will vote to authorize the Selectmen to appoint an Inspector of Wires, as provided by Law.


Voted: To so authorize the Selectmen.


Article 4. To see if the Town will vote to amend the Building By-laws by adding thereto and adopting the following section; namely,


Section 31. No work subject to the supervision of the Inspector of Wires shall be approved by him unless said work conforms to the re-

quirements of the 1925 National Electrical Code so-called, being the "Regulations of the National Board of Fire Underwriters for Electric wiring and apparatus as recommended by the National Fire Protection Association American Standard, approved July 3, 1925, by American En- gineering Standards Committee."


Voted: To adopt as a By-law.


Article 5. To see if the Town will vote to purchase for State Armory purposes land suitable therefor and to appropriate a sum of money for such purpose, or take any other action in the matter.


Voted: That Article 5 and Article 6 be considered together.


Article 6. To see if the Town will vote to authorize the Selectmen to petition the General Court for appropriate legislation to permit the Town to sell and convey land owned and land to be acquired by it to the Common- wealth of Massachusetts for a sum not less than ten thousand ($10,000) dollars in order to provide a site for the erection by said Commonwealth of a State Armory, or take any other action in the matter.


Printed pamphlets of "Report and Recommendations on the Armory Proposition" were distributed to the voters at the meeting. The state- ments of History, Estimated Cost, Valuation of Property in 1925, De- sirability of Armory and Report of the Selectmen were read and offered as a report by Chairman of the Selectmen Thomas B. Mulvehill. Chair- man Charles J. Prescott of the Finance Commission offered the report of the Finance Commission as contained in the printed pamphlet and Chairman William G. Upham of the Planning Board offered the report of the Planning Board.


Voted: To accept the various reports as offered.


Voted: Motion under Article 5.


That the Selectmen be and hereby are authorized and directed to pur- chase by suitable deeds for the purpose of a site for a State Armory the following described parcels of land from the owners thereof; viz .:


Parcel (A) A certain tract owned by Attilio Balboni fronting on Lyman Place and bounded by said Lyman Place and lands of Rachel Holman, Town of Norwood, Norwood Housing Association, Inc., and by a private way extending from said Lyman Place to Nahatan Street, being the premises purchased by said Balboni from said Norwood Housing Association, Inc., exclusive however, of buildings numbered 11 and 15 on said Lyman Place.


Parcel (B) A certain tract owned by Norwood Housing Association, Inc., fronting on Nahatan Street and bounded by said street and boundcd by lands of the Town of Norwood, Attilio Balboni and by a private way extending from Nahatan street to Lyman Place, exclusive, how- ever, of the building thereon numbered 161 Nahatan Street.


And from available receipts in the Treasury the sum of $11,000.00 is hereby appropriated for the purchase of Parcel A and the sum of

$10,000.00 is hereby appropriated for the purchase of Parcel B; said structures so exeluded to be removed from said parcels at such time or times as the Seleetmen may agree with said owners.


Voted: Motion under Article 6.


That the Selectmen be and hereby are authorized and directed to peti- tion the General Court for appropriate legislation to permit the Town to sell and eonvey to the Commonwealth of Massachusetts for a sum not less than ten thousand dollars, in order to provide a site for the erection by said Commonwealth of a State Armory, the following described lands owned and to be acquired by it; viz:


A portion of a certain pareel owned by the Town of Norwood adjoining the parcels hereinafter described, and a certain parcel fronting on Nahatan Street now owned by the Norwood Housing Association, Inc., and a certain parcel fronting on Lyman Place now owned by Attilio Balboni, exclusive of buildings on said Norwood Housing Association, Inc. and Balboni parcels.


Article 7. To see if the Town will vote to accept and allow as a public park a parcel of land adjoining the Balch School Lot, now held by the Town by gift from Hon. Charles S. Bird, as taken and located as a public park and reported by the Selectmen, and to call the same "Charles W. Eliot Park," or take any other action in the matter.


Voted: To accept and allow.


Article 8. To see if the Town will vote to reconsider the action taken under Article 2 of the Warrant for the Special Town Meeting held Decem- ber 29, 1924, authorizing the purchase by the Selectmen of certain land near Pleasant Street from Emily C. Fisher et al, and to authorize the Selectmen to purchase a parcel of greater area in the same locality from Emily C. Fisher et al, and to appropriate a sum of money for said purpose, or take any other action in the matter.


Voted: That the action taken under Article 2 of the Warrant for the Special Town Meeting held December 29, 1924, authorizing the purchase by the Selectmen of certain land near Pleasant Street from Emily C. Fisher et al be and hereby is reconsidered and rescinded, and be it further voted that the Selectmen be and hereby are authorized and directed to purchase by suitable deed from Emily C. Fisher of Norwood, Nettie F. Day of Somerville and Albert M. Shattuck of Worcester, or their succes- sors in title for school, playground and Town way purposes, certain parcels of land substantially as described as follows, viz .:


(1) A tract containing about 1 acre, 34,648 square feet, and located northeasterly of other land of said Town of Norwood, and being Parcel A shown on a plan entitled, "Plan of land of Emily C. Fisher et al, showing parcels ineluded in option given to the Town of Norwood, Geo. A. Smith, Town Engineer," dated "August 21, 1925."


(2) A traet containing about 23,424 square feet also adjoining said other land of said Town of Norwood, being Parcel B shown on said plan.

(3) A traet containing about 1 aere, 16,920 square feet and also ad- joining said other land of said Town of Norwood and Fred L. Fisher and fronting on Pleasant Street, being Pareel C shown on said plan.


and further voted that the following sums be appropriated to meet the estimated expense of said purchase; namely, the sum of $1,000.00 from the surplus returned to the Town by the State Treasurer in the year 1924 for Soldiers' Bonus, so-called, and the further sum of $2,360.00 from the available receipts in the Treasury.


Article 9. To see if the Town will authorize the Selectmen to petition the next General Court for legislation in the form of a resolve or otherwise to permit an investigation and report to be made to a further legislation as to necessity and desirability of the extension of the Metropolitan Sewer- age System in the Neponset River Valley, and the cost thereof and recom- mendations with respect thereto, or take any other action in the matter.


Voted: That the Selectmen be and hereby are authorized and direetcd to petition the General Court for appropriate legislation in the form of a resolve or otherwise to permit an investigation and report to be made to a future legislature as to the necessity or desirability of the extension of the Metropolitan Sewcrage System in the Neponset River Valley, and the cost thereof, and with recommendations with respeet thereto.


Article 10. To see what sums of money, if any, the Town will vote to appropriate from surplus revenues of the Municipal Electric Light De- partment.

Article 11. To see what sums of money the Town will vote to appro- priate from available funds for the following purposes, or any of them, the same to be in addition to sums heretofore appropriated for said purposes for the current fiscal year:
