That Leftn James Person & Mr Ebenezer Burrill are Chosen and fully Impowered as agents or attorneys They or Either of them to prosecut to Effect Every such person or persons Justly suspected to be gilty of forging or causing to be Made or assent to be forged or Made any such falce Deed Conveyanc or Writing Refering to Land Contrary to the Laws of this his Majesties Province of ye Massetucas bay in New Ingland Whereby the Town is or May be in Danger of being Damnyfied and to prosecute ffrom Court to Court as the Matter May Require In the Towns behalf and to Constetute one or moar attorneys under them and to act & Do In all things relating there to as may be thought best

Pursewant to sd Voat we have Considered the Matter in all Respects and find that the Land Contained in sd highway was the Towns Conditinoly the Town Being abliged to Make & Maintain two gates on sd way therefore upon the Consideration that ye afore sd Daniell Mans- feild Junr Doth fence out sd highway two Pols Wide so that it shall Lye an open highway for the Towns use at all times after ye first Day of august next Ensewing the Date here of We have Laid out to sd Mansfeild one acer and one hundred and twelve pols of Land Lying in the Common swomp so called nigh ye Eastward corner of Robard Potters fence running Eastwardly three Pools then turning Northwardly three pools & a half then turning Northwesterly Upon a straeight Line to the afore sd Daniell Mansfeild Junrs Barn Lately Thomas ffullers Being two pools wide at that End as it is now staked out as allso a small strip of Common Land Lying within sd Mansfeilds feild Con- taining about fifteen pools: Dated Lyn March the 23d 1723/4

The Loe Land or Meddow called Rootens to be part of the Land so Exchanged with such other Lands as May be thought best as by the Town vote bareing Date March ye = 2d = 1723/4 Will moare fully shew forth


Pursewant to the above sd wee the afforenamed Did one the Towns behalfe one the 4th Day of March: 1723/4 set out to the above named Joseph Collins Junr & Jacob Collins by way of Exchange that peace of Low swampie meddow of of the Towns called Rootens March Lying betwixt the two sluce ponds Bounded Eastwardly with the Broock yt runns out of the old sluce pond into the new = and westwardly on the Lott Laid out to John Mowers sucsessors Running southerly Even with the Range Line that goes betwixt sd Mowers Lott & Daniel Mans- feild Junrs Land and to Extend Northerly so far as the Town hath ony Right = allso the sd Collins to have all that Right the Town hath in that peice of Low swampy Meddow Land Lying Eastward of the afforenamed brook buting southerly Even with the affore sd Line and to Extend notherly & Eastwardly so far as the Town hath any Right sd Land being now much covered with water could not be measured The first of sd peices of Land soposed to be about two or three acres the other Less


We Have allso set out to sd Collinses a small peace moare of the Towns Land Lying at the End of the Wood end plain one the Northwesterly part and on the front of sd Collinses Dweling place Betwixt the two highways leaveing Each way in the streightest place ffour poles in breadth sd Land Measuering about Ten poles and an half in Length and about Eight poles in breadth at the southerly End and about: 10: poles at the notherly end so as to make about ninty five poles the whole all which affore sd Lands as they are Discribed to be to the sd Collins and in Consideration there of the Town to have of the sd Collinses Land by way of Exchang as followeth = viz = all that part of the affore menshoned Lott Laid out to John Mowers succesers now belonging to the sd Collinses Lying to the Westward of the Contrey Road Joyning to the affore named Burrills pasture Containing near three accers


It is allso agreed by the affore named Impowered persons and the

affore named Theofilous Burrill to Exchange Lands as followeth that is to say the sd Burrill to have the westerly part of the sd Mowers Lott Joyning to sd Burrills pasture measuering Two poles and half at the southerly end neare the brdg and six poles in the middle as allso six poles at the notherly end neare bachelder's hous which measuer Includs: 57: poles of Land Which was before belonging to sd Burrill the whole with sd 57 pols containing Two hundred and five poles and all the remaining Lands yt belonged to sd Mowers Lott to be The Towns for the Making the contrey Roade and Highwayes there brouder & Moare Conveniant ---


And have also set out to the sd Burrill a small Goar of Land Joyning to the southerly side of the fresh march betwixt Browns & Ramsdils Running the Length of the Burrills Land Measuring Two Poles and Two feet at the Eastwardly End and Running to To nothing at the westarly end next Browns hous so as to make fforty five poles together with sum allowance Included in they affore sd Lands for sd Burrills removeing about 14: poles of stone wale one sd sluce plaine & to Inclose sum part of the Lands now granted to him there

In Consideration of the Lands set out to sd Burrill & Moveing Said Wall it is ffurther agreed that the Town shall have of sd Burrills Eighty five poles of Land Joyning to the Two pole Highway that Leads from Bachelders hous along by the side of Collinses stone Wall Running Norwestarly so farr as sd Burrills Land goes sd way thereby to be Made Three poles Wide & three foot at Bachelders hous and Three poles wanting three feet at the other End So as to make Sd way three poles Wide threwout


In Consideration of the severall exchanges of Land as they are set forth and Discribed to Each party Wee the affore named Joseph Mansfield Wm Bassett & Joseph Newhall as Impowered by sd Town and Joseph Collins Jacob Collins & Theofilous Burrill as propriators and owners have set to our hands on this ninth Day of March = Anno Domine one Thousand seven hundred & twenty four


It is agreed by the partys Conserned before Signing That the Highway at the Eastwardly end of Bachelders hous shall runn so even with as to be answerable to the afforemenshoned Three pole Waye and the Contrey Roade and all the Land Lying Eastward there of be allso for the Making the high ways there Moare Conveniant signed in presence of

persuant to an order for ye selectmen of Salem Mr Ebenzer Burrill and Mr William Bassett Junr are apointed to perambulat and Renew the bounds betwixt Salem and Lyn on ye Lower Line and to Meet at Mr Gedneys farm hous in Lyn on Monday ye 27th of this Instant at Eight of the clock in the Morning to Joyn with such as Salem has appointed for sd servs and to make Retorn of their Doings therein.

Wee ye subscribers being appointed by ye Towns of Salem & Lyn to preambulate of ye Lower Line between sd Towns have accordingly Meett this 27th Day of Aprill att Mr Gidneys ffarm Hous and per- ambulated sd Line beginning att a Heap of stons beareing southerly from sd Gidneys alias Jones to ye Head of Long pond to an old stump & heap of stons and have renewed about Twenty five bounds in or nigh to ye wall and from sd stump & heap of stons over ye Countrey Roade on Lynseys wall Wee renewed three Bounds down to a Heap of stons by a Branch of spring pond & from thence on ye other side of ye pond to a Heap of stons on a rock on ye Brink of the Hill and so to the spring & from thence as the ffence now stands to ye Contrey Road & thence over by Mr Blaneys House Leaving sd House about six feet Eastward & from thence down to ye Heap of stons to ye westward of the out Let Where wee have renewed about sixteen Bounds

fencing in the Towns Lands as allso straighening & Lessoning the Highways to the great Damage of our town: Wherefore Voted: That Captn John Bread Mr Henery Collins and Mr Joseph Mansfeild Junr aree Chosen & fully Impowered they or Either or them as agents or attorneys for and in behalf of sd Town to prosecute to Effect from time to time such person or persons by such proper ways & means as may be thought best who have or shall hereafter by way of Incroachment or otherwais Erect any building or buildings on any part of the Towns Land or that hath or hereafter shall fence in or Inclose any of sd Towns Land -


As allso to prossecut as a fore sd aney such person or persons as have or hereafter shall Erect or Caus to be Erected any Edifice boulding or fence what so Ever set up in up or or over any of the Highways streets or Lans in our Town or any part of aney of them so as to straighten the passage or Lessen the breadth of any such ways whereby the same may be Demed a Common Nucance and to prossecut as affore sd from Coart to Coart as may be thought best and to Constitute on or moar attorneys under them and to act & Doe in all things Relateing to the affore sd Consern as they May see caus they attending the Law therein: and the affore named John Bread Henery Collins and Joseph Mansfeild are allso further Impowered by and with the advise of the selectmen for the time being to agree with aney trespassing person or persons as afore sd where the trespass is not Deemed a Nusance in the Towns behalf Every such trespased so agreed with paying Down their money to the selectmen and they alowing sd agents for their charge and trouble wt may be thought Reasonable Refering to the Whole Concern they are appointed to

Whereas sundry Trespases have bin Commited by Persons Boulding on and fencing in the Towns Common Lands & high ways & Contrey Rhoads To the Great Damage of our Town


Wherefore Voted that Captn John Bread Joseph Mansfield Senr & Henery Collins are Chosen and fully Impowered they or the maior Part of them as agants or attorneys in behalf of the Town to prosecute to Effect from time to time Such person or persons that hath or shall hereafter by way of Incroachment: and the sd Commity are further Impowered with the advise of the selectmen to mack sail of any such Lands where it may be thought Conveniant or procecut any of them in a coars of Law and to Imploy an atorney or atoreys under them: or by puling up aney such fences so Erected The said Commity To Render an account to the Town of their Doings Therein: and they to be paid for their Trouble for the same

Therefore by order of ye Selectmen you are appointed & Required forthwith to warn the Sd James Goke and Elizebeth his wife & famaly to Depart out of ye Town of Lynn or they shall be Proceeded with as the Law Directs: fail not and Make Retorn of your Doings herein: Dated in Lynn Desember ye 29th 1724
