Art. 58. To see if the Town will vote to amend the Zoning Map and Zoning By-Law so that the prop- erty shown as lot A-58, on Asses- sors' Plan 1011, will be zoned for business, or to see what action the Town will take in the matter, agreeable to the petition of Ro- land C. Patterson and others.


Art. 59. To see if the Town will vote to change the Zoning Laws and Zoning Map so that area in the fol- lowing parcel of land may hence- forth be used for business pur- poses:


Starting at a point on the north- erly side of Lot A-7, as shown on Plan 1048 on file in the Assessors' Office, thence running in a south- erly direction 600 feet along the di- viding line between Lots A-6 and A-7, as shown on said Plan 1048; thence turning and running in a southeasterly direction for a dis- tance of 300 feet; thence turning and running in a northerly direc- tion for a distance of 600 feet; thence turning and running in a northwesterly direction for a dis- tance of 300 feet to a point of be- ginning, same being the westerly portion of Lot A-7, as shown on Plan 1048 on file in the Assessors' Office.

Art. 60. To see if the Town will vote to amend the Zoning Map and Zoning By-Law, so that that por- tion of Lot A-28 of Assessors Plan 1036, bounded by the Lynn Fells Parkway, Thomas Street, Forest Street, and Broadway, and which was rezoned for business purposes in 1937, shall hereafter be zoned for residential purposes. Art. 61. To see if the Town will vote to amend the Zoning By-Law by inserting in Section Twelve (12) the following new paragraph:


FRONT YARDS FOR BUSINESS ESTABLISH- MENTS


On all land used for business purposes on all state highways there shall be a setback, or open space, of at least forty (40) feet between the inside sidewalk or street line and the front of the building and its accessories. Plan- ning Board.


Art. 62. To see if the Town will vote to amend the Zoning By-Law and Zoning Map so that the south- erly side of Lot 54, Section A, lo- cated on Lynn Fells Parkway, now zoned for business purposes, shall hereafter be zoned for residential purposes. Planning Board.


Art. 63. To see if the Town will vote to change the Zoning By-Law and the Zoning Map of the Town of Saugus so that land shown on As- sessors' Plan 1047 as Lots A-45, A-35, A-46, shall be rezoned for business purposes for a depth of 200 feet along Broadway, or to see what action the Town will take in the matter, agreeable to the peti- tion of Lillian F. Newhall and others.


Art. 64. To see if the Town will vote to change the Zoning By-Law and Zoning Map of the Town of Saugus, so that the hereinafter-de- scribed land shall be re-zoned for business purposes:


Bounded westerly by Broadway ninety (90) feet; northerly by Hawkes Street (so-called) five hun- dred two and fifty-three one hun- dredths (502.53) feet; easterly by land now or formerly of Austin, Trustee, ninety-six and seventy-five one hundredths (96.75) feet; south- erly by other land now or late of Austin four hundred ninety-four and ninety-five one hundredths (494.95) feet.

Art. 65. Art. 66. To see if the Town will vote to change the Zoning Laws and Zoning Map so that area in the fol- lowing parcel of land may hence- forth be used for business pur- poses:


Starting at a point on Broadway at the intersection of Lot A-3 and Lot A-2 as shown on Plan 1029 on file in the Assessors' Office; thence running in a northerly direction for a distance of 506.15 feet; thence turning and running in a westerly direction for a distance of 250 feet; thence turning and run- ning in a southerly direction for a distance of 506.15 feet; thence turn- ing and running in an easterly di- rection for a distance of 250 feet to a point of beginning, same being shown as portion of Lot A-2 as shown on Plan 1029 on file in the Assessors' Office, or to see what action the Town will take in the matter, agreeable to the petition of Delmont E. Goding and others.


Art. 67. To see if the Town will vote to change the Zoning By-Law and Zoning Map of the Town of Saugus so that land shown on As- sessors' Plan 3015 as Lots A-199 and A-200 containing 5000 square feet, shall be rezoned for business purposes, or to see what action the Town will take in the matter, agreeable to the petition of Charles C. DeFronzo and others.


Art. 68. To see if the Town will appropriate the sum of $2000 (two thousand dollars) for the purposes of installing swings and slides in the school yards of the Oakland- vale, North Saugus, Lynnhurst, Sweetser, Cliftondale, Armitage,


Roby, Emerson, Ballard, and the Mansfield Schools, or to see what action the Town will take in the matter agreeable to the petition of the Board of Playground Commis- sioners.


Art. 69. To see if the Town will vote to appropriate the sum of two thousand dollars ($2000) to cover costs of material and labor for the installation of surface drainage on Johnson Road a distance approxi- mately seven hundred (700) feet, or to see what action the Town will take in the matter, agreeable to the petition of Richard B. Baldwin and others.


Art. 70. To see if the Town will vote to amend the Zoning By-Law and Zoning Map of the Town of Saugus, so that land shown on As- sessors' Plan 2053 as Lot A-49 and having a frontage of approximately 294 feet on the Newburyport Turn- pike shall be rezoned for business purposes, or to see what action the Town will take in the matter, agreeable to the petition of Mildred A. Davis and others.


Art. 71. To see if the Town will vote to raise by borrowing, or otherwise, and appropriate the sum of four thousand dollars ($4000) for the purpose of widening Central Street from the junction of Elm Street, northerly a distance of about 1000 feet, or to see what ac- tion the Town will take in the mat- ter, agreeable to he petition of Chester P. Gibson and others.


Art. 72. To see if the Town will vote to appoint a committee to in- vestigate the advisability of bor- rowing money under the P. W. A. grants for the purpose of building a power plant, same to be used to supply the inhabitants of the Town of Saugus with electric power, or to see what action the Town will take in the matter agreeable to the pe- tition of William C. Banks and others.

Description: Commencing at a point on the northerly line of How- ard Street, said point being a stone bound situated in the driveway to the house of one Manfredonia and marking the beginning of a piece of tangent, thence the line runs south 69° 21' west along said north line of Howard Street, a distance of approximately one hundred thir- ty-seven and forty-four one hun- dredths (137.44) feet to intersec- tion with westerly line of said Man- fredonia property, thence north 2° 56' east a distance of two hundred forty-three and fifty-eight one hun- dredths (243.58) feet along west- erly line of above property to a post, thence north 88° 38' east a distance of one hundred ninety-one and twenty-four one hundredths (191.24) feet, thence south 1° 22' east a distance of one hundred seventy-three and fifty-eight one hundredths (173.58) feet to the northerly line of said Howard Street, thence turning and running westerly along north line of How- ard Street by a curve with radius of eight hundred sixty feet a dis- tance of approximately eighty- three (83) feet more or less to a point of beginning (SB) and con- taining 40,726 square feet more or less;

Art. 74. To see if the Town will vote to amend the Zoning By-Law by inserting after Section 17-A the following: No permit for the exca- vation or removal of material shall be granted by the Selectmen for a period of more than seven days from date of issue. A permit issued by the Selectmen shall only be is- sued to an owner of record and shall not be transferable, or to see what action the Town will take in the matter, agreeable to the peti- tion of he Illegal Excavations In- vestigating Committee.


Art. 75. To see if the Town will appoint a committee to study and advise the citizens of the Town of


Saugus on the advisability in a change of the present form of Town Government for the Town of Saugus.


This committee to report to the next Annual Town Meeting or Special Town Meeting that may be called.


Said committee shall consist of three duly elected Town Meeting members from each of the eight precincts and the Town Counsel. Said committee shall be selected by the duly elected Town Meeting members in their respective pre- cincts, or to see what action the Town will take in the matter, agreeable "to the petition of George B. Dixon and others.


Art. 76. To see if the Town will vote to instruct the Board of Se- lectmen to petition the General Court for legislation to place the position of Director of State Aid and Soldiers' Relief under Civil Service protection. Board of Se- lectmen.


Art. 77. To see if the Town will vote to amend the By-Laws of the Town of Saugus by adding to Art. XII the following section to be designated as Section 5:


Section 5. Any person, partner- ship or corporation inserting or causing to be inserting into the Warrant of any Annual or Special Town Meeting any article propos- ing the amendment, addition or re- peal to the Zoning By-Laws of the Town shall, prior to the public hearing required to be held by the Planning Board under Section 27 of Chapter 269 of the Acts of 1933, deposit with the Secretary of the Planning Board such sum of money as shall be determined by the said Planning Board to be necessary to defray the expense of postage, stenographic service and advertise- ment.

Art. 79. To see if the Town will adopt the following By-Law or some modification thereof for the purpose of regulating billboards or other outdoor advertising devices.


Regulation of Advertising Signs and Billboards


Section 1. Statutory Authority. In pursuance of the authority granted to the Town in Section 29 of Chapter 93 of the General Laws, and pursuant to all other provisions of law, and without relaxing any restrictions now imposed on out- door advertising devices by Sec- tions 29 to 33 inclusive of said chapter or by any lawful state regulations thereunder, such de- vices are hereby further restricted in the Town of Saugus as provided in the following sections.


Section 2. Exemptions. This by- law shall not apply to signs or other devices in or over public ways, described in Sections 1, 2 or 8, of Chapter 85, General Laws, or to signs or other devices on or in the rolling stock, stations, subways or structures of or used by common carriers, except advertising devices on bridges or viaducts or abut- ments thereof. It also shall not apply to any advertising device legally permitted and maintained on the date of the taking effect of this by-law, until one year after the first day of July next following said date.


Section 3. Definitions:


"Advertising devices" shall mean billboards, painted bulletins, poster panels, signs, placards and other outdoor units designed to call public attention to the matter dis- played thereon.


"Advertising sign" or "sign" shall mean any outdoor advertising device.


"Sign-board" shall mean any structure designed for displaying an outdoor advertisement.


"Highway" or "street" shall mean any public way twenty feet or more in width.


"Public park" shall mean a piece of public land of at least five thou-


sand square feet set apart for beauty and public enjoyment.


"Public reservation" shall mean a piece of public land set apart for recreational use, as a state or municipal forest, as a protection to a public water supply, as a memori- al, or cemetery, or as place of un- usual scenic or historical interest.


"Permitted" shall mean author- ized by an official permit.


"Display" shall mean to make or maintain visible from any highway, public park or reservation.


"Area" of a sign or sign-board, shall mean the area of the face view of the entire device, including all attachments except supports and lattice at the base thereof.


"Residential district" shall mean any area zoned as residential.


"Non-conforming business" shall mean a business located in a resi- dential or rural district other than such rural business as farming or the raising and sale on the same premises of farm, garden or orch- ard products,


"Lawful sign" shall mean any outdoor advertising device not pro- hibited by any provision of law or by any lawful state regulation.


"Accessory sign" shall mean any outdoor advertising device which carries only advertisements strict- ly incidental and subordinate to a principal use of the premises on which it is located, including signs indicating business transacted or goods sold or produced on the premises or an occupant thereof, but not including any sign which is rented or controlled by any party except the owner or occupant of the premises.


"Sign on a wall" shall mean a sign closely attached throughout to and facing with that wall, or on a window or door therein.


"Lot" shall mean a plot of ground containing and devoted to the purposes of a building, or laid out to contain a building, with all required open spaces; or a tract of unbuilt, undivided land under one ownership.


Section 4. Prohibition. No per- son, firm, association, or corpora- tion, except the owner or a tenant occupant of the premises, shall be permitted or allowed to erect, dis-

play or maintain any billboard or other outdoor advertising device thereon except in pursuance of written authority from such owner or tenant and unless either the name and address of the party hold- ing such authority or a lawful per- mit number from the state licens- ing authority be displayed on such device.


No billboard or other outdoor advertising device shall be erected, displayed, or maintained:


(a) Upon any road, tree, fence, or pole or on a pole owned or con- trolled by a public service corpora- tion.


(b) If it contains any obscene, indecent or immoral matter;


(c) Unless all parts and attach- ments and the ground about the base thereof are kept in neat and safe condition.


Section 5. General Restrictions. No advertising sign or signboard shall be permitted or allowed to be so located as to obstruct a view be- tween any points on connecting streets within fifty feet of a corner of the rights of way; or to extend more than twenty feet above the surface on which it stands or to ob- struct any door, window or fire es- cape on a building; or, if on a roof or wall of a building to extend above the legal limit of height for such a building or wall, or, in a residential district, to extend more than six inches nearer to any boundary of the lot or premises on which it is located than it would be lawful to maintain a building, except as provided in paragraph (c) of Section 6.


Section 6. Restrictions in Resi- dential District. No person, firm, association or corporation shall erect, display or maintain, or al- low to be displayed or maintained on his or its property, in a residen- tial district, any billboard or other outdoor advertising device, except devices specified in paragraphs (a) (b) (c) and (d) of this section.


(a) Any lawful accessory 'sign or signs not exceeding 15 square


feet in aggregate area on any one building or lot; or any lawful sign or signs advertising only the sale or rental of the premises, not exceed- ing 'a total area of 15 square feet; or, on the premises of any public building, public recreation ground, farm, garden, tree-nursery or for- est, any lawful accessory signs not exceeding all together fifteen square feet in area within the lim- its of said premises; or any lawful accessory signs on the front wall of any building occupied by a non- conforming business.


(b) Any lawful sign displayed by the Town, or any sign displayed by the United States, the State or the County relative to government. business.


(c) At any boundary line of the Town a lawful sign not exceeding 15 square feet in area indicating the meetings of any civic organiza- tion located therein.


(d) On property owned or prin- cipally occupied by a religious, civic- or charitable organization, associa- tion of war veterans or the like, any lawful accessory sign displayed by written permission of the Select- men, with approval of the Inspector of Buildings if any, for a limited period of not exceeding one year.


Section 7. Administration. Whenever notice of an application; to a state authority for a permit for an advertising device to be erected or displayed in the Town is received by the Town Clerk or- any other Town official, he shall immediately transmit it to the In -- spector of Buildings (or other of- ficer charged with the administra- tion of this by-law). Such officer,. or, in the lack of other responsible officer, the Town Clerk, shall there- upon make an examination of the case and, as promptly as possible,. within thirty days of the receipt of the application by the Town, shall send written notice to the state authority to whom the appli- cation is addressed, stating whether or not the proposed advertising de- vice would violate any provisions. of this by-law, and, if he finds. such violation, specifying what pro-
