Art. 48. To see if the Town will vote to accept Section 2 of Chapter 420 of the Acts of 1938 entitled "An Act providing for one day off in every six for police offi- cers of certain cities and towns," or to see what action the Town will take in the matter, agreeable to the petition of John J. Bucchiere and others.


Art. 49. To see if the Town will vote to accept from New England Home Builders, Inc., two lots of land situated in that part of Sau- gus, Massachusetts, known as Oak- landvale. Said lots being shown as Lots 59 and 60 on a plan of lands belonging to the New England Home Builders, Inc., dated Octo- ber 16, 1937, and filed with the land Court Division of the Essex Regis- try of Deeds as Plan 16764-B, and bounded and described as follows:


Southwesterly by Bennett Ave- nue, one hundred thirty-five and 76/100 (135.76) feet; westerly by lot 61 as shown on said plan, eighty-one and 69/100 (81.69) feet; northwesterly by Lots 1, 2 and 3 as shown on said plan, one hundred ninety-three and 20/100 (193.20) feet; northeasterly by land now or formerly of Kiley, one hundred ninety-three and 51/100 (193.51) feet; and southeasterly by Lot 58 as shown on said plan, one hundred eighty-seven and 52/100 (187.52) feet. Said lots together containing 40,459 square feet.


Said premises are to be used for school and playground purposes only, or, with the consent of the said grantor, may be used for any other purposes. Planning Board.


Art. 50. To see if the Town will vote to accept Birchwood Avenue, in accordance with plan and pro- file on file with the Town Clerk.


Art. 51. To see if the Town will vote to amend the Zoning By-Law and Zoning Map so that the premi- ses shown as Lots A-3, A-12, A-14 and A-15 on Assessors' Plan 1029, said premises being bounded and described as follows :-


Beginning at a point six hundred (600) feet north of the intersection of Main Street and Broadway on the westerly side of Broadway, thence westerly three hundred (300) feet; thence northerly three hundred fifty and fifty one-hun- dredths (350.50) feet ; thence easterly three hundred and seven (307) feet to Broadway; thence southerly by Broadway two hun- dred and ninety and forty one- hundredths (290.40) feet to the point of beginning.


Will be rezoned for business pur- poses; or to see what action the Town will take in the matter agree- able to the petition of Fred H. Jackman and others.


Art. 52. To see if the Town will authorize the Board of Selectmen to petition the Great and General Court to enact legislation which will £ accomplish the following changes in the Town's charter or form of government, by amending Chapter 55, of the Acts of 1928, and amendments thereto, or other- wise, as follows:


1. To reduce the number of Limited Town Meeting members;


2. To allow the recall of Select- men, or other elected officers of the Town, except Limited Town Meet- ing members, and to provide for the election of successors to any officers so recalled, by a petition signed by not less than one-quarter (25%) of the registered voters of the Town, including at least one hundred registered voters from each precinct ;


3. To provide for the appoint- ment by the Board of Selectmen of a Town Manager or Purchasing Agent, to determine his qualifica- tions, terms of office, and the method of his appointment and discharge, and to define his duties and powers;

4. To provide for any other changes, incidental or collateral to the above, or otherwise,

Art. 53. To see if the Town will vote to accept Clinton Avenue, as per plan and profile filed with the Town Clerk.


Art. 54. To see if the Town will vote to accept Johnson Street, as per plan and profile on file with the Town Clerk.


Art. 55. To see if the Town will vote to accept Crescent Avenue, as per plan and profile on file with the Town Clerk or to see what action the Town will take in the matter agreeable to the petition of A. H. Woodward and others.


Art. 56. To see if the Town will vote to accept Davis Street, as per plan and profile on file with the Town Clerk, or to see what action the Town will take in the matter agreeable to the petition of A. H. Woodward and others.


Art. 57. To see if the Town will vote to accept Tuttle Street, as per plan and profile on file with the Town Clerk, or to see what action the Town will take in the matter agreeable to the petition of A. H. Woodward and others.


Art. 58. To see if the Town will vote to amend Section 16 of the Zoning By-Law relative to the lo- cation of automobile services, or to see what action the Town will take in the matter agreeable to the petition of George T. Bicknell and others.


Art. 59. To see if the Town will vote to transfer to the School De- partment for school purposes, the land on Birch Street containing ap- proximately 22,763 square feet be- ing Lots 23, 24 and 25 now owned by the Town of Saugus, or to see what action the Town will take in the matter, agreeable to the peti- tion of the School Committee.


Art. 60. To see if the Town will vote to indemnify Joseph A. Lam- bert, Jr., for damages incurred by him in the defense of settlement of claims of Joseph M. Stapleton and Winifred Stapleton against him for bodily injuries arising out of the operation of a motor vehicle owned by the Town while acting within the scope of his duties as a police officer, and appropriate a sum of money for said purpose; or to see what action the Town will take in the matter, agreeable to the petition of Edward Gibbs, Jr., and others.


Art. 61. To see if the Town will appropriate $900.00 from available surplus Cemetery funds with which to purchase a 11/2 ton truck chasis for use in the Cemetery in accordance with petition of Ceme- tery Commissioners.


Art. 62. To see if the Town will vote to change the Zoning By-Law and Zoning Map of the Town of Saugus so that land shown on Lots A-5 and A-6 Assessors plan 2055 shall be rezoned for business purposes or to see what action the Town will take in the matter, agreeable to petition of Charles F. Gage and others.


Art. 63. To see if the Town will vote to change the Zoning By-Law so that the following described premises may henceforth be used for business purposes :


A parcel of land located c on Broadway containing 2.20 acres bounded and described as follows:


Starting at an iron stake 3 ft southerly from a pole numbered 33-112 and continuing in a south- erly direction along Broadway a distance of 270 feet + to a stone wall, thence in a northeasterly di- rection a distance of 411 feet + to a fence thence in a northerly direc- tion to a brook a distance of 250 + thence along brook in a westerly direction to a stake, thence in a southerly direction a distance of 5 feet to a stake thence in a west- erly direction a distance of 130 feet to point of beginning; agree- able to petition of Charles W. Donovan and others.

Art. 64. To see if the Town will authorize the appointment of a committee of three or more citi- zens to study the sources of water supply and the needs and condition of the water distribution system, or to see what action the Town will take in the matter agreeable to the petition of Edward Gibbs, Jr., and others.


Art. 65. To see if the Town will vote to amend the Zoning Map and Zoning By-Laws by rezoning for business purposes the property owned by Charles W. Donovan lo- cated on Broadway and described as follows: starting at a stone bound, sta. 172. plus 57.36 on the easterly side of Broadway, 1936 State layout, thence northerly along said Broadway a distance of 213.10 ft., thence by a curve of 154.34 ft., with a radius of 170 ft., thence by a straight line a distance of 202.12 ft., thence by a curve a distance of 181.49 ft., with a radius of 170 ft., thence along Walnut Street a distance of 198.59 ft., to center of right of way, thence along said right of way a distance of 292.50 ft., thence by said right of way a distance of 529.50 ft., to Broadway, thence along Broadway a distance of 29.0 ft., to point of beginning, and being lot A-12 as shown on Assessors' Plan 1046, or to see what action the Town will take in the matter agreeable to the petition of Charles W. Donovan and others.


Art. 66. To see if the Town will vote to amend the Zoning Map and Zoning By-Laws by rezoning for business purposes the property owned by Charles W. Donovan lo- cated on Broadway and described as follows: starting at a stone bound at Station 172 plus 57.36 on the westerly side of Broadway, 1936 State layout, thence northerly 213 ft. plus to a stone wall, thence westerly along stone wall a dis- tance of 260 ft. plus, thence southerly a distance of 525.0 ft. plus, being parallel to and 200 ft.

Art. 67. To see if the Town will vote to change the Zoning By- Law and Zoning Map so that the parcel of land on Bryer Street and Bennett Highway shown as Lots A-260 and A-261 on plan on file in the Assessors' Office shall be zoned for business purposes, or to see what action the Town will take in the matter, agreeable to the petition of Lionel M. Reid and others.


Art. 68. To see if the Town will vote to change the Zoning Laws and Zoning Map so that area in the following parcel of land may henceforth be used for business purposes.


Description: Commencing at a point on the Northerly line of Howard Street, said point being a stone bound situated in the drive- way to the house of one Manfred- onia and marking the beginning of a piece of tangent, thence the line runs South 69° 21' West along said north line of Howard Street, a dis- tance of approximately one hun- dred, thirty-seven and forty-four one hundredths (137.44) feet to intersection with Westerly line of said Manfredonia property, thence North 2º 56' East a distance of two hundred forty-three and fifty- eight one hundredths (243.58) feet along Westerly line of above prop- erty to a post, thence North 88° 38' East a distance of one hundred ninety-one and twenty-four one hundredths (191.24) feet, thence South 1º 22' East a distance of one hundred and seventy-three and fifty-eight one-hundredths (173.58) feet to the Northerly line of said Howard Street, thence turning and running Westerly along North line of Howard Street by a curve with radius of eight hundred sixty feet, a distance of approximately eighty- three (83) feet, more or less, to point of beginning (SB) and con- taining 40,726 square feet, more or less, or to see what action the Town will take agreeable to the petition of Delmont E. Goding and others.

Art. 69. To see if the Town will vote to raise and appropriate a sum of Fifty-five ($55.00) for land damages incurred in the construc- tion of Hesper Street, or to see what other action the Town will take in the matter. Board of Sel- ectmen.


Art. 70. To see if the Town will vote to appropriate the sum of $5183.55 to pay for water pipe, labor for laying, and materials in- cidental to the installation of same pipe, from Bufford Street along Essex Street to Wilbur Avenue, thence along Wilbur Avenue to Fiske Avenue, and thence along Fiske Avenue to Essex Street, work to be done by a W. P. A. pro- ject, or to see what action the Town will take in the matter, agreeable to the petition of Albert Richardson and others.


Art. 71. To see if the Town will appropriate the sum of $100.00 to indemnify Norman Hull for in- juries received in the explosion at the Town Garage in 1935. Board of Selectmen.


Art. 72. To see if the Town will vote to accept Bridge Street in ac- cordance with plan and profile on file with the Town Clerk, agreeable to the petition of Wilhelm Walz and others.


Art. 73. To see if the Town will vote to accept Holland Street in ac- cordance with plan and profile on file with the Town Clerk, agreeable to the petition of Wilhelm Walz and others.


Art. 74. To see if the Town will vote to install two lights, one on Holland Street about 250 feet from Elm Street, and another on the corner of Bridge Street and Hol- land Street, or to see what action the Town will take in the matter, agreeable to the petition of Wil- helm Walz and others.


Art. 75. To see if the Town will vote to accept Summit Avenue in accordance with plan and profile on file with the Town Clerk.


Art. 76. To see if the Town will vote to accept Sweetwater Street in


accordance with plan and profile on file with the Town Clerk.


Art. 77. To see if the Town will vote to have the Town Accountant, with the assistance of the Board of Assessors insert in the next Annual Town Report a list of all taxable property with the valua- tions thereof, as of September 1, 1940 and each year thereafter, or to see what action the Town will take in the matter, agreeable to the petition of the Saugus Taxpayers' Association, Harold W. Humphrey and others.


Art. 78. To see if the Town will vote to request through the Board of Selectmen that the Public Works Department make a study of each proposed street acceptance inclu- ded in this Warrant with a view to determining the cost of putting such streets in an acceptable condi- tion and report thereon to this meeting, or to see what action the Town will take in the matter agree- able to the petition of the Saugus Taxpayers' Association, Harold W. Humphrey and others.


Art. 79. To see if the Town will vote to petition the Legislature to reduce the number of


Limited Town Meeting members, or to see what action the Town will take in the matter agreeable to the peti- tion of Laurence F. Davis and others.


Art. 80. To see if the Town will vote to elect its Tree Warden for three years beginning in 1941, or to see what action the Town will take in the matter, agreeable to the petition of D. M. Cronin and others.


Art. 81. To see if the Town will vote to have the Town Accountant with the assistance of the Board of Assessors, insert in the next An- nual Town Report, a list of all tax abatements as of December 31, 1940, and each year thereafter, or to see what action the Town will take in the matter agreeable to the petition of the Saugus Taxpayers' Association, Harold W. Humphrey and others.

Zoning By-Law so that the proper- ty shown as Lot A-57 on Assessors' Plan 2011, will be zoned for gene- ral residence purposes, or to see what action the Town will take in the matter, agreeable to the peti- tion of Earl L. Gaylor and others.


Art. 83. To see if the Town will vote to amend the Zoning Map and Zoning By-Law so that the proper- ties on the Westerly and Easterly sides of Jackson Street from Es- sex Street to Central Street for a depth of one hundred feet from the property line on the inside line of the sidewalks, shall be zoned for general residence purposes, pro- vided, however that any properties already zoned for busines purposes and included in the area above de- scribed shall not be affected by any action under this article, or to see what action the Town will take in the matter agreeable to the peti- tion of Edward Gibbs, Jr., and others.


The polls will open at 12 o'clock, noon, and will close at 8 o'clock, P. M., and you are hereby directed to serve this Warrant by posting attested copies thereof at the usual places seven days, at least, before the time of holding said meeting, and to distribute copies as provided by the By-Laws at least four days before.


Hereof, fail not, and make due return of this Warrant, with your doings thereon, to the Town Clerk, at the time and place of said meet- ing.
