Provided further that the Weymouth Rehabilitation and Ad- visory Committee of 20 members be continued in cooperation with the Admin- istrator and that the committee be maintained at full membership with appointments by the Moderator to fill all vacancies.

By adding the following words: "Provided that in each case involving real estate a majority of the Planning Board and a majority of the Park Commissioners vote to concur in the opinion that the property will not be needed for park, playground or other public use."

That the Board of Selectmen be authorized to accept conveyances or mortgages of any real or personal property belong to persons receiving relief from the Town and to dispose of said property under the provisions of Article 6 of this warrant in such manner as they may judge for the best interest of the Town and where said property is subject to any en- cumbrances if they consider it for the best interest of the Town to discharge said encumbrances, they are hereby authorized to do so.

ARTICLE 8. That Section 3 of the proposed Legislative Act for the establishment of incorporators for the proposed Laban Pratt Hospital as voted under Article 38 of the Annual Town Meeting March 2. 1942, be amended so as to read as follows:
Section 3. The Chairman of the Board of Selectmen, the Town Account- ant and the Town Treasurer, severally for the time being, and their successors. shall be Trustees. ex-officio during the terms of their respective officers. and together with the corporators named above shall constitute the Board of Trustees, of whom the Chairman of the Board of Selectmen shall be ex- officio Chairman, and whose terms of office, except as above provided, shall be as follows: The Trustees shall in the year next following the enactment of this act, elect three of their members whose terms of office are not fixed as above, who shall hold for the term of one year from the first day of the following February; three of their number who shall hold for the term of two years from said first day of the following February: three of their number who shall hold for the term of three years from said first day of the following February; three of their number who shall hold for the term of four years from said first day of the following February, and the remaining three shall be elected to hold for the term of five years from the said first day of the fol- lowing February, and who shall severally hold for the terms for which they are

elected and until their successors are chosen, and thereafter, as the terms of office expire the Annual Moderator shall annually appoint before February three Trustees for the term of five years each. Six members of the Board shall constitute a quorum. Whenever a vacancy shall occur in the Board of Trustees by reason of death, resignation or otherwise, of the members so elected or appointed, the Annual Moderator shall fill the vacancy for the unexpired term. If the Board of Trustees shall fail for three months to elect its members in accordance with the provisions of this act, the Board of Selectmen of the Town of Weymouth shall forthwith proceed to an election by concurrent vote. No member of the Board as such shall receive compensation vote. No member of the Board as such shall receive compensation for his services. And the Town of Weymouth is hereby authorized and empowered to place in trust in the hands of the trustees of said corporation all funds, gifts and bequests, which are or may be held by it for the purpose of establishing and maintainting said hospital, especially all sums it has or may from time to time receive from the Trustees appointed under the will of the said Laban Pratt, deceased. And said corporation shall, upon the acceptance of this act by the Town of Weymouth as hereinafter provided, receive and hold all past and future bequests and gifts that may be made for the maintenance of said hospital, and the same shall be appropriated, held and used by said corpora- tion for the sole use and purpose aforesaid as a trust in behalf of and for the inhabitants of said Town, and to such other persons as may be permitted to enjoy the benefits of said hospital in pursuance of the provisions of said will. And said Trustees shall render to the Board of Selectmen annually as of the first of January a report of their proceedings, with a statement of the condi- tion of the hospital, the property and funds pertaining to the same, with an accurate account of all receipts and expenditures, together with such other in- formation or suggestions they may deem desirable, which report shall be pub- lished by the Board of Selectmen in the annual Town Report. And said Trustees shall in behalf of the said Town carefully and consideratly carry into execution the generous plan of the testator as contemplated by said will and codicil.
And it is further moved that our State Senator and Representatives in the House of Representatives be instructed to ask to amend the proposed legisla- tion now before the Legislature in accordance with the terms of this vote and support such legislation to a successful end.

ARTICLE 9. That the sum of $750.00 be raised and appropriated for the working of Twilight Path.
That the Town accept the report of the Selectmen laying out the following ways, to wit :--
Welland Road Clematis Ave.
And that the Board of Selectmen be authorized to acquire by gift or purchase or take by right of eminent domain in fee or otherwise for all purposes of a public street or highway in and over said street or streets as so laid out and accepted and that the sum of $3,150.00 be raised and appropriated for ma- terials and the acquisition of the foregoing taking, gift, or purchase including all damages; provided further that they may build bridges, drains or conduits; and secure any easement which may be necessary and the Board of Selectmen are hereby authorized to accept any deeds of any reservation strips existing in connection with any of said streets; and provided further that no work shall be done on any of these streets until at least 90% of the abutters, or 100%, if in the opinion of the Town Counsel that becomes necessary, have signed, executed and delivered to the Town Counsel proper releases. Provided further that the final naming of those streets when accepted must meet with the approval of the Planning Board, and the work on these streets shall be performed under the direction of the Superintendent of Streets.
