RESOLUTIONS ON THE DEATH OF JOHN F. REARDON ADOPTED BY THE BOARD OF REGISTRARS OF THE TOWN OF WEYMOUTH JANUARY 26, 1948
WHEREAS, John F. Reardon passed away on January 11, 1948, it is hereby RESOLVED :
That we deeply regret the loss of our worthy friend and colleague who faithfully served the Town of Weymouth for thirty-two years in the following capacities: As a member of the School Committee, the Appropriation Committee, and twenty-one years as a member of the Board of Registrars, of which he was Chair- man for the past, nine years.
That John F. Reardon, by his faithfulness to public duty, has been an inspiration to all of the citizens of the Town of Wey- mouth; that he has been an inspiration to the Board of Regis- trars, and that the memory of his loyal and faithful service will always be with us; that we extend our sincere sympathy to the members of his family, and request that these resolution be in- corporated in the records of the Town of Weymouth.

REPORT OF THE TOWN COUNSEL
To the Honorable Board of Selectmen
January 1, 1949
Gentlemen :
I hereby submit my annual report for the fiscal year 1948.
The Town By-Laws, by Section 404 and 404A, provide that the Town Counsel "shall draw or supervise the drawing of or approve all contracts, deeds, bonds and other legal instruments relating to the town; shall prose- cute and defend all suits to which the town is a party; shall under the direction of the Selectmen represent the town before any committee of the Legislature, Administrative Board, or other public official in any matter wherein the town has an interest; shall furnish legal advice to town offi- cers, boards and committees pertaining to the discharge of their official duties. The Selectmen may instruct him to prosecute any cases of viola- tion of town by-laws or to defend any proceeding brought against any officer or employee of the town for acts done in the discharge of his official duties. In the discharge of his legal duties, he may employ assistants, but except as otherwise expressly authorized by the Board of Selectmen or vote of the town, he shall be responsible for the acts of any assistants employed by him and such assistants shall be paid by him."
"The salary of the Town Counsel shall cover all work performed by him except examination of titles to real estate or actual appearances in court in the conduct of litigation or before administrative boards or other tribunals and except legal work done in connection with the laying out and establishing construction and maintenance of a sewerage system."
Acting in accordance with the directive language quoted above, several of the contracts authorizing the construction of our sewerage system have been examined and approved, contracts dealing with proposed addi- tions to two of our school houses have been submitted and are in the process of being approved.
Many deeds and releases, numbering possibly fifty, have been pre- pared and in the case of sales of land by the Selectmen such releases have been recorded at Dedham in order that the property may be restored to the assessable list. All bonds of such officers who require them have been approved.
The Town Counsel has attended the meetings of your Board with unfailing regularity and during these evenings have had many consulta- tions with various Town Department heads and employees concerning their official duties. In many instances written opinions have been re- quested and provided.
During the year a petition of certiorari was filed against the action of your Board in granting a license from May 1st through October to carry on automobile night racing, one night a week, at the Weymouth Fair Grounds. An injunction was issued by the Court preventing the licensees from operating until after the issues raised were determined. The question at issue being briefly whether the premises, though lying within the limits of a zoned residential district was protected by the statute that permits the continuance of an existing use of the premises and whether the proposed use was one of the existing ones contemplated. The pleadings were lengthy and then various motions were filed challenging material contained in the Respondents' Answer. It appeared that no hearings on the merits of the case could have been heard before July and in the meantime it became apparent that the licensees were either un- able or unwilling to put the grounds in such a condition as to satisfy the

department of public safety. This was a necessary step in preparing for the use of the grounds. It therefor became evident they would not be able to operate under the limited term of the license. The case appeared to be moot and the matter remains on the list but would not be heard by the Court further, in my opinion.
No other cases of major importance in which the Town was a party in interest have been tried during the year. There were the usual number of small claims growing out of alleged injuries on the highways of the Town, but fortunately only one major case has developed, and that is now pending in the Superior Court.

The General Relief budget for the year 1949 would indicate a slight increase over 1948. This, of course, is contingent on business.
The high cost of living is a vital factor, not only upon the cost per case, but also the number of cases.
The major number of cases on relief are due to old age, physical unfit- ness, and broken homes.
