REPORT OF THE COMMITTEE APPOINTED UNDER ARTICLE NO. 34 1961 ANNUAL TOWN MEETING RELATIVE TO APARTMENT BUILDINGS


The committee appointed under this article and vote organized and its members have made a detailed study of the subject, its members have consulted other municipality officials, and have obtained their experiences and suggestions relative to Apartment Buildings.


By previous acceptance and enactment, Apartment Buildings may be constructed in Weymouth only in business, limited business, and industrial areas, and not in residential districts, nor in Limited In- dustrial Districts "A" or Limited Industrial Districts "B", where building is expressly confined to industry or its relative pursuits and where residential construction is expressly prohibited.


We feel that such buildings should be confined to family dwelling and not part business or industrial, since many tragedies have occurred in Apartment Buildings where the lower floors are used for commercial purposes hazardous to dwelling space above.


Exhaustive discussions brought a unanimous decision that the changes presented in the accompanying article should be favorably considered and enacted by the Town Meeting and made a part of the Weymouth Zoning Ordinance.


1. Strike out the clause in Section III paragraph 2 which states "Apartment Houses of first and second class construction."


2. Insert in Section III after paragraph 2, the following new para- graph :


2A Apartment Buildings. Apartment Building shall mean any structure hereinafter constructed or altered so that it contains family units for four or more families, the building to contain nothing other than family units.


No Apartment Building shall be permitted which exceeds two and one half stories or thirty-five (35) feet in height, nor with the front of said building less than thirty (30) feet from the street line, and the sides and rear of said building less than fifteen (15) feet from the adjoining property line. Signs shall be permitted only when attached to or flush with the front of the building, not above the first floor, and shall in no case be of neon or electric activating type. The Board of Appeal shall approve the design and appearance of the building and shall determine that it is in harmony with and not detrimental to the surrounding area.


3. Amend Section VIA by inserting at the end of the first sen- tence and made a part of said sentence the following: "Except in the case of multi-family or apartment buildings there shall be space for two motor vehicles per family unit."


4. Amend Section VII by adding the following sentence: "If said application is for any variance in lot size, the applicant shall file a plan, drawn to scale, and in a form approved by the Board of Appeal, which plan shall remain in the custody of the Board of Appeal."

The type and design of Apartment Buildings seem to change more rapidly than many other types of construction. This seems also to be true of the need for and desirability of such con- struction. For this reason it appears to be necessary to so define Apartment Buildings, limit their height, and somewhat their position on a given lot, and to provide ample parking facilities for the vehicles of the occupants and their guests. Further pro- vision must prevent offensive signs.


Since the type of building, its position on a given lot and its appearance may be so varied and difficult to define, the view of the Committee is that, under the guiding provisions con- tained in the proposed changes, a rather wide discretion must be left with the Board of Appeals in each particular case, and for this reason we have provided that the Board of Appeals shall approve the design and appearance of any proposed build- ing and shall determine that it is in harmony with and not detrimental to the surrounding area.

To: The Citizens of Weymouth, Mass.


The Board of Public Works is pleased to submit its Fourth Annual Report and Budget for the ensuing year in the amount of $2,545,105.40. This represents a decrease of $15,325.47 under the appropriation for 1961.


On June 18, 1961, the new Public Works Building was dedicated and the use of this new facility has enabled us to further consolidate Public Works personnel. The engineers of the Sewer Division were transferred to the Town Engineer's Division; this merger will enhance the efficient planning and execution of Public Works projects. Cen- tralization of all the facets of Public Works is proving to be of sound economical benefit to the Town of Weymouth.


A revised schedule of water rates for all users was effected on July 1, 1961. This was the first change in the rate schedule in thirteen years and we believe it to be equitable to all concerned. Since the in- ception of Public Works and a period of years prior thereto, the Water Division has been operating with a yearly deficit approximating $100,- 000.00. The reserve fund of the Division which was used to finance this deficit is now exhausted. It is anticipated that the new schedule of rates will furnish approximately the required $100,000.00 per year. This additional revenue will enable the Water Division to remain a self-sustaining operation; allow for the improvement of existing fa- cilities; expand the supply of potable water, and at the same time, enable the financing of improvements to the distribution system on a sound financial basis.


After a comprehensive study and with the recommendation of our onsultant engineers, we will institute, effective April 1, 1962, a sewer ervice charge of twelve dollars per year for the homeowner who has ise of the sewer system. A schedule of rates affecting all other prop- erties has been promulgated and will become effective on the same date.


Weymouth Public Works' One Million Dollar Capital Outlay Pro- gram is being continued with very little change. As the following pages are analyzed, it will be noted that the request for Drainage and Sewer Construction appropriation has been adjusted. This change will enable us to hold the line on expenditures and not adversely affect our overall planned programs.


Due to unforseen circumstances, the State Department of Public Works has been unable to proceed on schedule with the Back River Flood Control Project and this has necessitated a delay in the proposed Mill River Extension and the Swamp River drainage projects. Phase II of the Phillip's Creek drainage project was completed in 1961; the third and final stage of this undertaking is presently under contract

The $2,500,000.00 Master Highway Program was continued with a portion of Broad Street reconstructed under the supervision of the Department of Public Works. Commercial Street, between the rail- road crossings, in the Weymouth Landing area was reconstructed under the provisions of Chapter 90.


The federal-aided sewer program in North Weymouth being con- structed under the provisions of the Water Pollution Control Act (P.L. No. 660) commenced in 1961 and is scheduled for completion during the summer of 1962.


At this time we wish to extend to the Public Works Building Com- mittee and their architect our congratulations for a job well done. After twelve long years of planning, this building-of functional design and well suited to the needs of an expanding and progressive town-has become a reality. The savings that will be derived by the use of this new facility will justify the Committee's untiring efforts on behalf of their fellow citizens.
