UNANIMOUSLY VOTED: That the sum of $96,000.00 be ap- propriated to the Board of Public Works from available funds (Excess and Deficiency) to reconstruct, resurface, widen, straighten, re- locate and work Commercial Street and/or any other street,.or any portion of conduits of said ways and for the building of any bridges, drains or securing any easements which may be necessary and that the Board of Selectmen is authorized to accept any deed of any reser- vation strips in connection with said streets; and provided further, that all damages resulting or occasioned by the construction shall be a charge against the sums appropriated; the Board of Selectmen are hereby authorized to acquire by gift or purchase, or take by Right of Eminent Domain, in fee or otherwise, for all purposes of public streets or highways in and over said street; that the above sum named shall be made available only if the State or County, or both, under General Laws (Ter. ARTICLE 9. (At Request of Board of Public Works). To see if the Town will vote to raise and appropriate, by taxation, transfer and/or borrowing, the sum of $250,000.00 for the continuation of the Major Highway Program for construction and/or reconstruction of main streets and roads including Broad and Commercial Streets, pro- vided that Chapter 90 funds, if any, may be used for this purpose, or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the sum of $250,000.00 be raised and appropriattd to the Board of Public Works for the reconstruction or widening of Broad Street and Commercial Street, and other streets or portions of streets, including sidewalks and curbing, land damages and the cost of pavement laid at the time of said construction or widen- ing, and the construction of permanent pavement in connection with such reconstruction or widening under specifications approved by the Department of Public Works, all subject to the limitations of Clause 5, Sec. 7 of Chap. 44; and that the Board of Selectmen be authorized to accept any deeds or any reservation strips in connection with said streets and to acquire by gift, or purchase, or take by Right of Eminent Domain for all purposes of public streets or highways such as may be necessary; and to meet said appropriation $50,000:00 shall be appropriated from the Excess and Deficiency Account; and the Treasurer with the approval of the Board of Selectmen, is hereby authorized to borrow the sum of $200,000.00 and to issue bonds or notes under clause (5) of Section 7 of Chapter 44 of the General Laws as amended, payable in accordance with said Chapter 44 in not more than 10 years from their respective dates; provided, that any and all construction may be done under the provisions of Chapter 90 of the General Laws and that all construction shall be done by private contract under the direction of the Board of Public Works and/or the State Department of Public Works and that the streets to be con- structed other than those specifically designated above, are to be selected by the Board of Public Works. 50,000.00 200,000.00

ARTICLE 11. (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate a sum of money for the construction of particular sewers and determine whether the money shall be provided for by taxation, by appropriation from available funds including sewer assessment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.

ARTICLE 16. (By Request of Board of Public Works). To see what sum of money the Town will vote to raise and appro- priate, by taxation, transfer and/or borrowing, for drainage pur- poses (for stream improvement) from Weymouth Back River to Whitman's Pond, consisting of floodflow conduit and channel and works at dams, as recommended by Metcalf and Eddy, Engineers, in report to Weymouth Drainage Committee dated March 11, 1957.


That the sum of money named shall be made available only if the State, under General Laws, Chapter 91, will pay a sum of money proportionate to the cost of construction under the provisions of said chapter. Provided further, that such work shall be done by private contract under the direction of the Board of Public Works and/or the State Department of Public Works.


Also, to see if the Town will assume liability in the manner pro- vided by Section 29 of Chapter 91, of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts, for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tide- waters, foreshores, and shores along a public beach outside of Boston Harbor, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Board of Public Works to execute and deliver a bond of indemnity therefor to the Commonwealth; or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the. Town raise and appropriate the sum of $110,000.00 for drainage purposes and for stream improve- ments, from Weymouth Back River to Whitman's Pond; consisting of flood-flow conduit and channel and works at dams, bridges, and walls, as recommended by Metcalf and Eddy, Engineers, in a report to the Weymouth Drainage Committee, dated March 11, 1957. Of the sum appropriated, $110,000.00 shall be appropriated from the Excess and Deficiency Account. 110,000.00


Provided further, that the sum of money named shall be made available only if the State, under General Laws, Chapted 91, will pay a sum of money proportionate to the cost of construction under the provisions of said chapter.

ARTICLE 17. (By Request of Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for drainage improvements of Phillips Creek (completion of 1960 work from vicinity of Pearl St to Green St.) and extension of 1960 work on Mill River from vicinity of West St. to Columbian St. or take any other action in relation thereto.


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the Town raise and appropriate the sum of $90,000.00 for drainage purposes and for stream improvements of Phillips Creek (completion of 1960 work from vicinity of Pearl St. to Green St.) and extension of 1960 work on Mill River from vicinity of West St. to Columbian St., as recommended by Metcalf and Eddy, in a report to the Weymouth Drainage Committee, dated March 11, 1957. Provided further, that such work will be done by private contract under the direction of the Board of Public Works and/or the State Department of Public Works. To see what sum of money the Town will vote to raise and appropriate by taxation, transfer and/or borrowing for purpose of a flood control project in the Smelt Brook Watershed to be used in conjunction with matching funds by the Town of Braintree, said sum to be expended under the direction of Board of Public Works, which shall be author- ized to negotiate for and purchase necessary easements therefor, or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the sum of $15,000.00 be raised and appropriated from tax levy for the purpose of a flood control project in the Smelt Brook Watershed to be used in conjunction with matching funds by the Town of Braintree; said funds to be under the direction of the Board of Public Works which shall be authorized to negotiate for and purchase necessary easements therefor. 15,000.00;


ARTICLE 19. (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate by taxation or other- wise the sum of $10,000.00 for the continuation of the 1960 Shore Protection Project, from vicinity of Regatta Road toward River Street, or take any other action in relation thereto (Chapter 91).


Upon motion duly made by the Appropriation Committee, it was


UNANIMOUSLY VOTED: That the Town raise and appropriate from tax levy the sum of $10,000.00 for the continuation of the shore protection from the vicinity of Regatta Road toward River Street; provided that the sum of money named shall be made available only if the State under General Laws, Chapter 91, will pay a sum of money. proportionate to the cost of construction under the provisions of said Chapter. ARTICLE 20. (By Request of Board of Public Works). ; To, see what sum of money the Town will vote to raise and appropriate, by taxation, transfer and/or borrowing for the purpose of acquiring by gift, purchase or eminent domain in fee seven parcels of land, with the buildings thereon, situated on River Street, (North) Weymouth, shown as parcels "A" through "G" on a plan entitled "Wessagusset Beach Area, Weymouth - Norfolk County, January 6, 1961, Frank S. La- grotteria, Town Engineer, Plan No. 999B," for protection against highway and shore erosion, or take any other action in relation thereto.

That the Town vote to authorize the Board of Selectmen to acquire by gift, purchase, or take by Right of Eminent Domain in fee, together with all rights therein, the seven (7) parcels of land, with the buildings thereon, situated on River Street, (North) Weymouth, shown as Parcels 'A" through "G", on the Plan entitled, "Wessagusset Beach Area, Weymouth, Norfolk County, dated January 6, 1961, Frank S. ARTICLE 22. (At Request of Board of Public Works). To see what sum of money the Town will raise and appropriate, by taxation, transfer and/or borrowing, for the development and construction of additional well fields, including wells, pumping station, pipes and original pumping station equipment for the purpose of an emergency water supply; and further, that said sum shall include installation of a pipe line from the well to Winter Street, all to be located on lands and roadways acquired under Article 10 of the Special Town Meeting of June 15, 1959, as located on plan by Town Engineer en- titled "Plan of Land for Well Location for Water Supply, Plan No. 771B.", said plan duly recorded in the Norfolk County Registry of Deeds, or take any other action in relation thereto.

UNANIMOUSLY VOTED: That the sum of $40,000.00 be raised and appropriated for the development and construction of additional well fields, including wells, pumping station, pipes, and original pump- ing station equipment for the purpose of an emergency water supply, all subject to the limitations of Clause (5), Section 8,, of Chapter 44; of the General Laws as amended; and further, that said sum shall include the installation of a pipe line, not less than 6" in diameter, from the well to Winter Street, all to be located on lands and roadways acquired under Article 10 of the Special Town Meeting of June 15, 1959, as located on Plan by Town Engineer, entitled, "Plan of Land for Well Location for Water Supply, Plan No. 771B", said Plan being duly recorded in Norfolk County Registry of Deeds; and to meet said appropriation, the Treasurer, with the approval of the Board of Select- men, be and hereby is authorized to borrow $40,000.00 and issue bonds or notes of the Town therefrom, payable in not more than 15 years from their respective dates, in accordance with Clause (5), Section 8 of Chapter 44, of the General Laws, as amended; said sum to be expended under the direction of the Department of Public Works.

UNANIMOUSLY VOTED: That the sum of $100,000.00 be raised and appropriated for the installation of by laying or relaying of water mains of not less than six inches in diameter and all necessary appur- tenances relating thereto, in the streets of the Town; and to meet said appropriation, the Treasurer, with the approval of the Board of Selectmen, be and hereby is authorized to borrow $100,000.00 and issue bonds or notes of the Town therefrom, payable in not more than 15 years from their respective dates, in accordance with Clause (5), Sec- tion 8 of Chapter 44, of the General Laws, as amended; said sum to be expended under the direction of the Board of Public Works.

ARTICLE 25. (At Request of Board of Public Works). "That in accordance with Chapter 94 of the Acts of 1945, and the provisions of the General Laws, the estimated cost of the town system of sewer- age disposal shall be provided as follows:


Assessments shall be made upon owners of the land'accord- ing to the frontage of such land on any way in which a sewer is constructed at a rate of one dollar and fifty cents ($1.50) per linear foot of such frontage and according to the area of such land within a fixed depth of one hundred (100) feet from such way at the rate of one and one-half cents ($0.015) per square foot of such area.


On corner lots on such ways one side of lot shall be exempt from assessment on a frontage of one hundred (100) feet, but no town owned land shall be assessed and the town shall pay the balance of the cost of construction. The action of the town under Article 1 of the Annual Town Meeting, March 6, 1950, is hereby rescinded."

A certain parcel of land shown as Parcel B, containing 4,555 square feet of land, on a certain plan filed in the Town Clerk's office, entitled "Subdivision Plan of land in Weymouth, Nor- folk County, Mass., shown on Land Court Plan No. 8456-A" dated January 6, 1961, Frank S. Lagrotteria, Town Engineer, drawn by Neil J. Murphy, C. E., or take any other action in relation thereto.
