Bamber, Town Engineer on file at the office of the Town Clerk, for the purpose of collecting, storing, purifying and treating water and for a pumping station, for procurement of addi- tional water supply for the Town of Scituate; said water supply to be developed as required by the Board of Water Commissioners; provided, however, that such land shall not be taken and such water

supply shall not be developed without the prior approval of the Department of Public Health as required by law; together with a right of way giving access thereto across other land of said Fitts, shown as Parcel 9 on said plan; and raise and appropriate the sum of $1,000.00 therefor, or act thereon.

ARTICLE 20


To see if the Town will raise and appropriate by taxation or otherwise a sum of $24,000.00 for the construction of a gravel-packed well, a pumping station with necessary machinery on the land acquired under Article 19 and lay a water main to and connecting with, the present water system by the Water Department, or take any action thereon.


VOTED: To raise and appropriate $24,000.00.


ARTICLE 21


To see if the Town will vote to transfer the proceeds of the Dog Fund received from the County to Libraries and that the amount be equally divided between the Peirce Memorial at North Scituate and the Allen Memorial at Scituate, or act thereon.

To see if the Town will raise and appropriate or transfer from available funds a sum of money for the procurement of plans and specifications and working drawings for secondary school housing and to receive bids to be opened and submitted for approval at the next annual or a future Town Meeting.


VOTED: That the Town raise and appropriate the sum of $51,000.00 for the procurement of plans, specifications and working drawings for the construction of a Senior High School on Town owned land at the junction of First Parish Road and Chief Justice Cushing Highway; and that the Town vote to raise and appropriate the sum of $12,000.00 for the procurement of plans, specifications and working drawings for an addition to the present High School which will ultimately become a Junior High School, and that these sums be spent under the jurisdiction of the School and Public Building Committee who are to receive and open bids and submit the same to a future Town Meeting for appropriate action.

ARTICLE 23


To see if the Town will assume liability in the manner provided by Sec. 29 of Chapter 91 of the G. L., as amended by Chapter 516 and 524, Acts of 1950, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachu- setts for the improvements, development, maintenance, and pro- tection of tidal and non-tidal, rivers and streams, harbor, tide- waters, foreshores and shores along a public beach outside of Bos- ton Harbor, including the Merrimack and Connecticut Rivers, in accordance with Sec. 11 of Chapter 91 of the G. L. and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Commonwealth.


VOTED: To assume liability as stated in article.


ARTICLE 24


To see if the Town will raise and appropriate the sum of $900.00 for the maintenance and improvement of the Town Forests, or act thereon.


VOTED: To raise and appropriate $900.00.


ARTICLE 25


To see if the Town will raise and appropriate or transfer from available funds, the sum of $25,000.00 for Foreshore Protection to be used in conjunction with any sums already appropriated by the Commonwealth of Massachusetts and the County of Plymouth, or either of them, or take any action in relation thereto.

Will the Town vote to raise and appropriate a sum of money for the completion of the original project of preventing further erosion of Fourth Cliff, Scituate, or take any action thereto.

ARTICLE 28


To see if the Town will vote to raise and appropriate, or trans- fer from available funds, in the treasury, a sum of money for Chap- ter 90 Highway Construction, or take any action in relation thereto.


VOTED: That the sum of $6,500.00 be appropriated to meet the Town's share of the cost of Chapter 90 Highway Construction, and to meet said appropriation, the sum of $6,500.00 be transferred from the proceeds received or to be received from the State under the provisions of Chapter 718 of the Acts of 1956.


ARTICLE 29


Will the Town vote to raise and appropriate a sum of money for the purpose of constructing a walking area 5 feet wide on Lang- don Lane from Country Way, easterly to the property of the Central Elementary School, or ace thereon.


VOTED: To raise and appropriate $1,200.00.


ARTICLE 30


Will the Town vote to raise and appropriate a sum of money for the purpose of constructing a walking area 5 feet wide for school children from the westerly end of Ermine Street to the property of the Wampatuck School, or act thereon.

ARTICLE 31


To see if the Town will raise and appropriate a sum of money to construct a sidewalk on Country Way from the corner of Utility Road to the intersection of First Parish Road and Country Way, or take any action thereon.


RESOLUTION: Voted that it be the sense of this meeting that the Highway Surveyor be instructed to build a sidewalk from available funds as outlined in Article 31 of the warrant.


ARTICLE 32


To see if the Town will vote to take by eminent domain a strip of land on the northerly side of First Parish Road containing 2,966 square feet and adjoining other land of the Town all as shown on a plan entitled "Plan of Land in Scituate, Mass. dated January 24, 1954" and drawn to the scale of 40 feet to an inch by John E. Bamber, Town Engineer, on file at the Town Clerk's Office, and authorize the Selectmen to use the sum of $1.00 raised and appro- priated under Article 63 of the Annual Town Meeting of 1953 for the purchase of said strip of land for this purpose.

Will the Town vote to raise and appropriate the sum of $1,- 500.00 to be spent in conjunction with any State funds which may be made available for the purpose of stream clearance in Bound Brook between Country Way and Hunter's Pond.

ARTICLE 37


To see if the Town will raise and appropriate the sum of $6,000.00 for the purchase of a new 31/2 ton dump truck for the use of the Highway Department and authorize the Highway Surveyor, in co-operation with the Selectmen, to sell the present 1952 21/2 ton Dodge dump truck or use same for trade-in value on the purchase of the new truck.

ARTICLE 38


Will the Town authorize the Selectmen to purchase or take by eminent domain for the purpose of establishing a public park- ing area certain land the title to which stands in the name of Clara C. Biasey, sometimes known as Claire C. Fairhurst, lying on the

southerly side of Gannett Road and easterly of the North Scituate shopping center, bounded and described as follows: Northerly by Gannett Road, 98 feet; Easterly by land now or formerly of Cush- ing, 265 feet; Southerly by land of Anderson, Inc., 149 feet; and Westerly by land of the North Scituate Investment Corporation, 123 feet; said parcel containing 32,670 square feet more or less and formerly being known as the Old Mill; and to raise and appropriate the sum of $10,000.00 therefor.


VOTED: To indefinitely postpone.


ARTICLE 39


Will the Town vote to authorize the Selectmen to purchase or take by eminent domain that parcel of land lying easterly of the Town Pier and locally known as Stagehouse Beach, as shown on a plan entitled "Compiled Plan of Stagehouse Beach" dated Janu- ary 28, 1958 and drawn to a scale of 60 feet to an inch by John E. Bamber, Town Engineer, for dredging and harbor development purposes; and to raise and appropriate a sum of money therefor.


VOTED: That the Town authorize the Selectmen to purchase or take by eminent domain that parcel of land lying easterly of the Town Pier and locally known as Stagehouse Beach as shown on a plan entitled "Compiled Plan of Stagehouse Beach" dated January 28, 1958 and drawn to a scale of 60 feet to an inch by John E. Bamber, Town Engineer, for dredging and harbor protection pur- poses, and raise and appropriate the sum of $2.00 therefor.


ARTICLE 40


Will the Town vote to amend Section 1-2 of the Zoning By- Laws by designating as a "B" Zone an area in Greenbush bounded as follows: Beginning at a point marking the Southerly bound of Judge Cushing Road on Chief Justice Cushing Highway, thence running in a Southerly direction approximately 1,900 feet by Chief Justice Cushing Highway to a tributory brook shown on a map prepared by the Scituate Planning Board, dated May 18, 1953, on file in the office of the Town Clerk; Thence turning and running in a generally Westerly direction by said brook to a point which is 1,200 feet distant from Chief Justice Cushing Highway; thence turning and running in a Northerly direction by a line parallel to and 1,200 feet distant at right angles from Chief Justice Cushing Highway to a point on Cornet Stetson Road; Thence turning and running in a generally Easterly direction by Cornet Stetson Road and the Boundary lines of the Land owned by Helen J. Dunn to a

point on the Southerly side of Judge Cushing Road; Thence turn- ing and running in a northeasterly direction by the Southerly line of Judge Cushing Road to the point of beginning.

ARTICLE 41


To see if the Town will vote to appropriate a sum of money for the purpose of constructing on land owned by the Town a municipal building to serve as a town office building, a police sta- tion, and a fire station, and for originally equipping and furnish- ing said buildings, and determine whether the money shall be pro- vided for by taxation, by appropriation from available funds in the treasury, and by borrowing under authority of Chapter 44, of the General Laws, or take any action in relation thereto.


VOTED: That the sum of $555,000.00 be appropriated for the purpose of constructing on land owned by the Town a municipal building to serve as a town office building, a police station and a fire station, and for originally equipping and furnishing said build- ing, and that to meet said appropriation the sum of $10,000.00 be raised in the tax levy of the current year, and that the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $545,000.00 under authority of Chapter 44 of the General Laws, and to issue bonds or notes of the Town therefor, payable in accordance with the provisions of said Chapter 44 so that the whole loan shall be paid in not more than twenty years from the date of issue of the first bond or note.

ARTICLE 42


To see if the Town will vote to appropriate a sum of money for the purpose of construction on land owned by the town a muni- cipal building, to serve as a town office building, and a police station, and for originally equipping and furnishing said buildings, and determine whether the money shall be provided for by taxation, by appropriation from available funds in the treasury, and by borrowing under authority of Chapter 44 of the General Laws, or take any action in relation thereto.

ARTICLE 43


To see if the Town will vote to appropriate a sum of money for the purpose of constructing on land owned by the Town a

municipal building to serve as a Town office building, and for originally equipping and furnishing said building, and determine whether the money shall be provided for by taxation, by appropria- tion from available funds in the treasury, and by borrowing under authority of Chapter 44 of the General Laws, or take any action in relation thereto.

ARTICLE 44


To see if the Town will instruct the Selectmen to take the fol- lowing action in relation to Contributory Group General or Blanket Insurance for Persons in the Service of the Town and their Dependents, as provided in accordance with Chapter 32B of the General Laws of Massachusetts.


1. To establish that on and after the date of approval of this Article by the Attorney General, no person, whether em- ployed, appointed or elected by popular vote, shall be con- sidered an employee within the meaning of said Chapter 32B unless the duties of such person require that a substan- tial part of his total time be devoted to the service of the Town during the regular work week of permanent em- ployees; and to further provide that no person shall be deemed to devote a substantial part of his total time to the service of the Town if any of the following conditions exist:


(a) such persons regularly devotes less than 20 hours per week to the service of the Town as an employee or as an appointed or elected official;


(b) such person receives compensation from the Town in the form of salary or wages at the rate of less than $2,000. per year, or its weekly equivalent;


(c) such person devotes less than half his total working time to the service of the Town;


(d) such person is employed or appointed as an employee and has completed less than three months of continuous active service from his latest date of employment as a permanent employee, and no period of service shall be considered continuous if such person shall not be in the service of the Town as a permanent employee or an appointed or elected official for a period of ninety days or more.

2. To establish that the insurance or other benefits to be pro- vided for in accordance with said Chapter 32B shall be limited to Group Life Insurance, Group Accidental Death and Dismemberment Insurance, and Hospital and Surgical Benefits, but not including Medical benefits (sometimes called Prolonged Illness Certificate or P.I.C.).


3. To terminate the eligibility for and to terminate the insur- ance of any person and his dependents who does not qualify as an employee because of the conditions set forth in para- graphs 1 (a), 1 (b), or 1 (c) of this Article, and to terminate the Medical benefits (P.I.C.) of all persons; such termina- tion of insurance to take place on the last day of the month in which the Attorney General approves this Article.


4. To establish that the parts of this Article are separable, and if any portion shall be declared to be invalid the re- mainder of this Article without such invalid portion shall be effective, or take any other action thereon.


VOTED: To instruct Selectmen as stated in warrant, changing clause (b) to read as follows: "such person as an employee other than a school department employee, and receives compensation from the Town in the form of salary or wages at the rate of less than $2,000.00 per year, or its weekly equivalent.


ARTICLE 45


To see if the Town will vote to instruct the Selectmen to re- strict eligibility for inclusion in the Town's Group Insurance Plan only to those employees working, and receiving pay for, a minimum of 28 hours a week, and for 36 weeks a year.


VOTED: To indefinitely postpone.


ARTICLE 46


To see if the Town will vote to instruct the Selectmen to place the Prolonged Illness Coverage provision on an employee-pay-all basis, as of the next renewal date of the Town's Group Insurance contract.


VOTED: To indefinitely postpone.


ARTICLE 47


To see if the Town will vote to request the Selectmen to sub- mit to the voters at an annual Town Meeting any plan for increas- ing the town's Group Insurance coverage which would require any increase in premium.

Will the Town vote to accept House Bill 398 of the General Court of the Commonwealth authorizing the payment by the Town of Scituate of an Annual Pension of $1,300.00 to Roy C. Merritt.


VOTED: That the Town accept Chapter 558 of the Acts of 1957 of the General Court of the Commonwealth authorizing the payment by the Town of Scituate of an annual pension of $1,300.00 for Roy C. Merritt.


ARTICLE 49


Will the Town authorize the Selectmen to purchase or take in fee by eminent domain property of the North Scituate Beach Association and others, being a portion of the North Scituate Beach as shown on a plan on file in the office of the Town Clerk, for the purpose of establishing a public bathing place, and to raise and appropriate a sum of money for this purpose.

ARTICLE 50


To see if the Town will vote to authorize the Selectmen to lease all or any portion or portions of a strip of land 25 feet wide along the easterly edge of the Cole Parkway parking lot in Scituate Harbor, between the face of the existing curbing and a line com- mencing at a point 100 feet from the northeasterly corner of said parking lot and 25 feet from the face of the curbing and running southerly and southwesterly following the course of said curbing and 25 feet distant therefrom to a point 75 feet distant from the southwesterly terminus of said curbing (all as shown on a plan entitled "Plan of Part of Cole Parkway" dated January 31, 1958 and drawn to a scale of 40 feet to an inch by John E. Bamber, Town Engineer, on file at the office of the Town Clerk) to any person, firm or corporation for the purpose of operating a boat marina, for terms not to exceed twenty years, and on such other terms and conditions as the Selectmen shall in their discretion impose, or act thereon.


VOTED: That Article 50 be referred to a committee com- posed of the Selectmen and the Planning Board. Said committee is instructed to study this matter and report to the next Annual Town Meeting.
