ARTICLE 55


Will the Town amend the Zoning By-Laws as follows:


A. By deleting the second, third and fourth paragraphs of Section 11.


B. By substituting for said second, third and fourth para- graphs the following :


"Any person feeling himself aggrieved by a violation of these Zoning By-Laws with respect to any property with- in one quarter of a mile of property owned by him may complain to the Building Inspector in writing, setting forth in detail the facts which he alleges constitute the violation and the section of the By-Laws allegedly violated. If the Building Inspector fails to cause the violation to be abated, or to commence legal action to enforce the By-Laws within thirty days after receipts of said complaint, such failure shall be deemed an order or decision of the Building In- spector and the complainant shall have a right of appeal to the Zoning Board of Appeals. Said appeal must be taken in writing within fifteen days of the expiration of said thirty days, and notice and opportunity for a hearing shall be given in the same manner as on a petition for a variance."


"If after notice and hearing as aforesaid, the Zoning Board of Appeals determines that there exists a violation as alleged by the Complainant, it shall order the Building Inspector to forthwith cause the violation to be abated or institute legal proceedings to enforce the By-Laws. Any person aggrieved by a decision of the Zoning Board of

Appeals may take an appeal to the Superior Court in ac- cordance with Chapter 40A of the General Laws. If he fails to do so, he shall himself also be deemed in violation of these

ARTICLE 56

ARTICLE 57


Will the Town amend Section 6-3 of the Zoning By- Laws as authorized by Section 5A of Chapter 40A of the General Laws, by adding thereto the following proviso:


"provided, however, that at the time of building, such lot has an area of not less than 5,000 square feet, a front- age and "Required Lot Width" of not less than fifty feet, and at the time of adoption of this proviso was held in ownership separate from that of adjoining land."

ARTICLE 58


Will the Town adopt the following sections to be in- corporated in the Town By-Laws, or act thereon :

SECTION 1. The Town Pier will be limited to one day tie-up for vessels with permission given by the Harbor Master. No fee to be charged for this service except for a commercial venture, when the Board of Selectmen shall levy a fee which shall accrue to the Town.


North float at Town pier shall be kept free for taking on and discharging of passengers and freight and no per- son shall tie vessels, boats or tenders to this float longer than reasonably necessary to accomplish such loading and discharging. Each face of other floats shall be kept free for taking on and discharging passengers and freight.


No tender with an overall length greater than 12 feet to be tied to any town float for the season.


SECTION 2. No person shall place or continue to maintain a mooring in Scituate Harbor after the effective date hereof, until he has first filed an application therefor in a form approved by the Harbor Master. No person shall continue to maintain a mooring in Scituate Harbor thereafter unless he shall make such application on or before July 15, 1960. Such application shall set forth the name and address of the owner; the size and type of the boat to be moored, the size and type of the mooring and if the mooring is already in the water, the location thereof with sufficient details to enable the Harbor Master to lo- cate it. No boat shall be regularly moored on a mooring except those described on the application therefor, except with the prior approval of the Harbor Master.


If the Harbor Master is satisfied that such mooring will conform to the requirements of this by-law he shall assign such mooring to a location.


SECTION 3. The Harbor Master shall keep accurate records and books, and shall issue receipts in duplicate, the original of which shall be given to the payor and the duplicate to the Town Accountant.


VOTED: That the Town adopt and incorporate into its by-laws Section 1 and Section 3 as printed under Article 58 in the Warrant and also so adopt and incorporate the following section :

has first filed an application therefor in a form approved by the Harbor Master. No person shall continue to main- tain a mooring in Scituate Harbor thereafter unless he shall make such application on or before July 15, 1960. The Harbor Master shall forthwith prepare regula- tions governing the size and specifications of moorings, their hardware and pennants, shall submit the same to the Selectmen for their approval, and shall cause the same to be published in a newspaper published in the town in each of two successive weeks, the second publication to be not later than May 5, 1960. The Harbor Master may amend said regulations from time to time, which amendments shall become effective only after approval by the Select- men and publication in each of two successive weeks as aforesaid.


If the Harbor Master is satisfied that such mooring will conform to the requirements of said regulations, he shall assign such mooring to a location. Yes 207, No. 33.

ARTICLE 59


Will the Town vote to amend its By-Laws by adding thereto the following :


DISCHARGING FIREARMS


No person shall, except in the performance of some legal duty, discharge any firearm upon any public grounds within the Town, nor upon any private property without the written consent of the owner or tenant thereof.

Any person violating any of the provisions of this By- Law shall be punished by a fine of not more than twenty dollars for each offense.


VOTED : That a Committee of seven be appointed by the Moderator to include three member of the Scituate Rod and Gun Club and Francis W. Navin; the Committee to study the need for the proposed by-law and any other related matters and report its recommendations to the Selectmen not later than January 1, 1961.


ARTICLE 60


Will the Town vote to amend Section 2 of its By-Laws by adding the words "The annual election of officers shall be conducted on the Saturday immediately following the first Monday in March," so that the said Section 2 shall read as follows; Section 2. The Annual meeting shall be held at the first Monday in March. The annual election of officers shall be conducted on the Saturday immediately following the first Monday in March.

To see if the Town will authorize the Park Commis- sioners to appoint themselves to positions on the labor force of the Park Department for the year 1960, to be compensated at the rate established under W-4, Schedule 2 of the Classification and Salary Plan of the Town.

Will the Town vote to raise and appropriate a sum of money for additional premiums to raise the hospital bene- fits from $14.00 to $20.00 a day under the Town's Con- tributory Group Insurance Plan.

RESOLUTION: Be it hereby resolved that the Mod- erator appoint a committee of nine members to report to the next Annual Town Meeting concerning the library needs of the Town; said committee is to be composed of three members representing the Allen Memorial Library, three members representing the Pierce Memorial Library, and three members representing the Scituate Public Schools.


RESOLUTION: Resolved that the citizens of Scituate assembled in Annual Town Meeting include in the records of this meeting an expression of its appreciation to Mr. Fred T. Waterman for his nineteen years of devoted serv- ice to the Scituate Public Schools as a member of the Scituate School Committee.


Voted to accept. Unanimous.


RESOLUTION: Resolved that the Selectmen be, and they hereby are, authorized and instructed to negotiate an arrangement whereby North Scituate Beach would be sufficiently opened to public use so that it would qualify for reclamation under the beach erosion program of the United States Army Engineers, and in the event that it is impossible to accomplish this purpose through negotiation with the owners of said Beach before the end of the cur- rent year, to take preliminary steps toward the taking by eminent domain of a sufficient interest in said Beach to qualify it as aforesaid, including inserting an appropriate article in the Warrant for the Annual Town Meeting of 1961, preparing a detailed estimate of costs and securing from the United States Army Engineers their proposals with reference to said Beach, to the extent that the United States Army Engineers will release the same prior to action by the Town.

A legal meeting of the inhabitants of the Town of Scituate qualified to vote in Elections and Town Affairs was held at the High School Gymnasium in said Scituate on Monday, the sixteenth day of May, 1960, at 8:00 o'clock P.M. The meeting was called to order by Mod- erator John Barnard, Jr.
