To see if the Town will vote to authorize the Board of Selectmen to petition the Massachusetts General Court for authority to transfer from the Park Department to the Selectmen the care, custody, control and management of the road known as Parkland Drive and to change the use of the land from Park purposes to general Municipal purposes, or take any action relative thereto.


Upon motion of Mr. Jameson, duly seconded, it was


Voted unanimously: That the Selectmen be authorized to petition the Massachusetts General Court for authority to transfer from the Park Department to the Selectmen the care, custody and control and management of the following described parcel of land known as "Park- land Drive" and as shown as "New Town Way" on "Plan of Memorial Park in Wayland, Mass., owned by Cornelius J. Maguire," dated March, 1951, Irving Rosenblatt, Engineer, Framingham, Mass. and to change the use of the land from park purposes to general municipal purposes.


Article 43. To see if the Town will vote to authorize the Board of Selectmen to petition the Massachusetts General Court for authority to transfer from the Park Department to the Selectmen the care, custody, control and management of land described in deed from John B. Wight to Inhabitants of the Town of Wayland, recorded with Middlesex South District Deeds in Book 4425, Page 309 and to change the use of the land from Park purposes to general Municipal purposes, or take any action relative thereto.


Upon motion of Mr. Jameson, duly seconded, it was Voted: That the article be passed over.


Article 44. To see if the Town will vote to authorize the abandon- ment of its rights and easements in, through and over the way formerly known as County Road; or take any action relative thereto.


Upon motion of Mr. Bertelsen, duly seconded, it was Voted unanimously: That the article be passed over.


Article 45. To see if the Town will vote to authorize the abandon- ment of its right and easements in, through and over the way formerly known as Castle Hill Road; or take any action relative thereto.


Upon motion of Mr. Robert H. Charnock, duly seconded, it was


Voted unanimously: That the Town authorize the Selectmen, with the approval of the Town Counsel, to take such steps as may be necessary to abandon the Town's rights and easements in, through and

over the way formerly known as Castle Hill Road from Moore Road to the land acquired by the Town under Article 3 at the Special Town Meeting of 2/15/56 for a new school site and located just south of Sherman Bridge Road.


At this point the meeting returned to Article 22, which had been tabled by a previous vote, to be taken up after Article 45.


The Moderator briefly explained the status of the action, in view of the two Motions of Amendment before the floor at the time of tabling.


Mr. Mendler and Mr. McEnroy each requested permission to with- draw their respective amendments; and there being no objection voiced, the Moderator declared unanimous consent of the Meeting to withdrawal of both Motions.


Mr. Kilburn then requested permission to withdraw his original motion, in order to clear the floor for a new, amended motion on the same subject. This permission was granted by unanimous consent of the meeting.


Upon motion of Mr. Kilburn, duly seconded, it was


Voted unanimously: That the Board of Selectmen, with the approval of the Town Counsel, be authorized to sell as a single parcel of land at public auction, or private sale, only to an abutter, to be incorporated into the abutter's lot, to be held as a single parcel, for not less than $900.00, the land shown on Plate 42D of the Town Atlas as Lot 59 and parts of Lots 28 and 29 Hawthorne Road, containing 13,288 sq. ft.


Article 46. To see if the Town will vote to amend Chapter V of the Building Code, as amended, by adding at the end thereof the follow- ing new section:


"Section 16. Fire Protection


"(a) No building shall be used in whole or in part as a hospital, nursing home, rest home, convalescent home, or home for the aged unless such building is protected throughout by a standard automatic sprinkler system designed to give audible alarm on the premises and also automatically to transmit a fire alarm signal to Fire Department headquarters; Provided, that nothing contained in this sub-section (a) shall apply to a building used for such purposes on March 1, 1960 which complies with the requirements of sub-section (b).


"(b) No building used on March 1, 1960 as a hospital, nursing home, rest home, convalescent home, or home for the aged shall be used for any such purpose after March 1, 1961 unless such building is pro- tected throughout either by a standard automatic sprinkler system designed to give audible alarm on the premises and also automatically to transmit a fire alarm signal to Fire Department headquarters or by a complete automatic fire alarm detection system with an approved design of wiring and equipped with thermostats designed to give audible alarm on the premises and also automatically to transmit a fire alarm signal to Fire Department headquarters.


" (c) No sprinkler or fire detection system shall be deemed to meet the requirements of this section unless it is in accordance with the standards of the National Board of Fire Underwriters and approved

by the Chief of the Fire Department," or take any action relative thereto.


Upon motion of Mr. Morgan, duly seconded, it was


Voted unanimously: That the Town amend Chapter V of the Build- ing Code, as amended, by adding the following new section:


"Section 16. Fire Protection (And the rest of the wording is verbatim as given in the Warrant under Article 46.)

Article 47. To see if the Town will vote to amend the Zoning By-Laws by deleting Section V, Sub-Section (g) and inserting in place thereof the following:


"Sanitariums or Hospitals, not for the insane or feebleminded, or Nursing Homes for the care of the sick or aged, provided a special permit is granted by the Board of Appeals in accordance with the procedure provided in Sub-Section (r) and only under such condi- tions as the Board of Appeals may impose, and provided that no building be within thirty (30) feet of any lot line" or take any action relative thereto.


Duly seconded, Mr. Gordon E. Gott offered the following


Motion : That the Town amend the Zoning By-Law by deleting Section V, Sub-Section (g) and inserting in place thereof the following: "(g) Sanitariums or Hospitals, not for the insane or feeble- minded, or Nursing Homes for the care of the sick or aged, pro- vided a special permit is granted by the Board of Appeals in accordance with the procedure provided in Sub-Section (r) and only under such conditions as the Board of Appeals may impose, and provided that no building be within thirty (30) feet of any lot line." Mr. Gott then presented the Report of the Planning Board relating to this Article, and placed the Report on file with the Town Clerk.

Article 48. To see if the Town will vote to amend the Zoning By-Laws to provide for a change in set-back provisions, by amending Section IX, Sub-Section (a), (b) and/or (c) ; or take any action relative thereto.


Duly seconded, Mr. Edward F. Thorburn offered the following


MOTION: That the Town amend the Zoning By-Law by deleting Section IX, Sub-Sections (a) and (b) and inserting in place thereof :


"(a) No building or structure in any residence district shall extend within 55 feet of the center line or within 30 feet of the street line of any street whether accepted or not, whichever dis- tance is greater, except as providede in paragraphs (b) and (c). "(b) A building in existence on March 1, 1960, may extend within 50 feet of any center line of the street; a porch attached thereon may extend within 20 feet of any street line; and a two-story porch

which is unenclosed at least half of the year, may project six feet into the front yard."


Mr. Thorburn read the Report of the Planning Board relating to Article 48, and placed the Report on file with the Town Clerk.


Upon Mr. Thorburn's motion it was


Voted unanimously: In favor.


In response to an inquiry whether this meeting might instruct the Finance Committee, and make a suggestion regarding the preparation of next year's budget, the Moderator said that, strictly speaking, this should only be done by returning to Article 4. However, in view of the early hour, and the expressed willingness on the part of the Chairman of the Finance Committee to hear helpful suggestion, the Moderator permitted about five minutes of discussion in this vein. (It was about 10:15 P. M. at this point).


A suggestion was stated. That the Wayland Town Finance Com- mittee be instructed to present next year's budget to be within the income of the Town so that there will be no increase in the Tax Rate.


This was NOT taken as a vote, but merely stood as a suggestion.


The Moderator thanked the students operating the microphones, the police, the tellers, high school officials who had cooperated with setting up the hall, etc., for the smooth running of the several sessions of this meeting; and he gave special mention to John T. Howard, Jr., who had been present, working on microphones until the bitter end, each week, perhaps at times being the last person out of the building - an outstanding civic contribution on the part of one of our students.


He also thanked F. Douglas Dyer, who had repaired the gavel, as a matter of civic contribution, when it had been broken during one of the meetings.


He also announced his appointments to the Memorial Day Commit- tee. Mr. Ronald H. Wood, who had served several years as chairman, having expressed inability to serve, as a matter of health, the following persons were named:


Chairman John W. Leavitt, and as representative of the American Legion, Joseph L. Strafus, as representative of the Veterans of Foreign Wars, Richard Loynde.


He also announced his appointments to the Mosquito Control Study Committee :


Allan Morgan, to represent a Conservation Organization; Dr. John Gordon Freymann, to represent the Board of Health; Mr. Dewit Mitchell as an individual whose business is raising livestock; and two members-at-large: Mr. John Pratt and Mrs. Herbert Lipton.


Article 49. To see what sum, if any, the Town will vote to transfer from available funds to meet any of the appropriations made under the foregoing articles.
