VOTES ENACTED AT THE SPECIAL TOWN MEETING Held: Wednesday, June 15, 1960
Town Clerk's Office Wayland, Massachusetts
Roger P. Stokey, Moderator :-
Pursuant to the Warrant dated May 23, 1960, signed by Thomas F. Linnehan, Archibald Cox and Frank S. Tarr, Selectmen; served and return of service given by Ernest H. Damon, Constable of the Town of Wayland, the inhabitants of said Town qualified to vote in Town Meeting assembled this day; and at 7:45 P. M. the Moderator called the meeting to order, declared a quorum to be present and the meeting proceeded to transact the following business:
Article 1. To see if the Town will vote to amend the Zoning By-Laws and the Zoning Map by making the following changes in Dis- trict boundaries, or take any action relative thereto:
Change from Business District A to Residence District Forty Thousand (40,000) square feet with One Hundred Eighty (180) feet front on land bounded and described as follows:
NORTHERLY by State Road West
WESTERLY by Pelham Island Road and by land of the Town of Wayland; and
SOUTHERLY by land of the Town of Wayland; and
EASTERLY by land of the Town of Wayland;
Before any motion was heard, the Moderator explained the parlia- mentary situation of this meeting: He outlined the statutory require- ment whereby the Planning Board would have to hold a public hearing upon the subject matter of this Article before any positive action could legally be taken in relation to it; that such a hearing had not yet been held, and therefore, only two courses of action would be in order at this meeting: 1.) To adiourn the meeting until after such hearing would have been held, and at such time as the Planning Board could present a Report based upon its findings from such hearing; or 2.) Pass over the Article, and vote final adjournment of the Meeting.
Upon motion of Mr. Eugene C. Roberts, duly seconded:
"That the meeting be adjourned to Wednesday, June 29, 1960 at 7:45 P. M., the place to be the High School Gymnasium, it was
Voted: 1st Vote was declared in doubt by the Moderator.
Counted Vote: "Yes" 69, "No" 88.
This vote was declared in the Negative.
Upon motion of Mr. Robert M. Morgan, duly seconded "To pass over the Article," it was
Voted: 1st Vote was declared in doubt by the Moderator.
Counted Vote: "Yes" 90, "No" 77.
Upon motion, duly seconded, it was
