ARLINGTON TOWN REPORT


ADJOURNED TOWN MEETING


March 16, 1945


Pursuant to the vote of Adjournment of March 14, 1945, the Town Meeting Members met in the Robbins Memorial Town Hall on Friday evening, March 16, 1945, notices having been sent to the Town Meeting Members.


Lists of the duly qualified Town Meeting Members were used at the entrances of the meeting place and were in charge of Philip T. Robinson and James E. Sweeney.


The check lists filed with the Town Clerk at the close of the meeting showed that two hundred and four attended the meeting.


The Moderator called the meeting to order at 8:10 P. M.


At the suggestion of the Moderator, the Assembly stood and sang one verse of the National Anthem.


Town Meeting Members not previously sworn were sworn by the Moderator.


On motion of Chairman Elliott, duly seconded, it was unanimously


Voted: That if all the business of the meeting as set forth in the Warrant is not disposed of at this session, when the meeting adjourns it adjourn to Monday evening, March 19, 1945 at eight o'clock.


Article 6 taken up. (Special Compensation for Town Officers and Employees)


The Finance Committee recommended the following:


That effective January 1, 1945 there be paid to the employees of the Town a sum equal to nine and one tenth (9.1%) percent of their basic wages or salary, excluding extras or overtime, subject to the following conditions: payments shall be based upon the basic wage or salary in effect on January 1, 1945; payments shall be made in

accordance with the various payroll periods now in effect; the total payments to any individual shall not exceed one hundred sixty ($160.00) dollars for the calendar year 1945; all elected officials are hereby specifically excluded from re- ceiving any payment hereunder except the Town Clerk; this action shall not be construed as permanently increas- ing salary or wages, nor shall payments hereunder be deem- ed to be part of the regular compensation of any town em- ployee.


That the sum of ninety thousand ($90,000.00) dollars be and hereby is appropriated for the purpose of this article, said sum to be raised by general tax and expended under the direction of the various boards and heads of de- partments of the town and charged to the appropriation made under this article.


Mr. Murphy offered the following substitute motion, duly seconded


That effective January 1, 1945 there be paid to each employee of the town the sum of two hundred sixty ($260.00) dollars as special compensation for the year 1945, to be paid in installments in accordance with the various payroll periods now in effect; all elected officials are hereby specifically excluded from receiving any payments hereunder except the Town Clerk; this action shall not be construed as permanent increasing salaries or wages, nor shall pay- ments hereunder be deemed to be a part of the regular compensation of any town employee.


That the sum of one hundred sixty-three thousand, eight hundred ($163,800.00) dollars be and hereby is appropriated for the purpose of this article, eighty-one thousand nine hundred ($81,900.00) dollars to be raised by general tax and eighty-one thousand nine hundred ($81,900.00) dollars to be taken from available funds now in the treasury and ex- pended under the direction of the various boards and heads of departments of the town and charged to the appropri- ation made under this article.

Following extended discussion the Previous Question was moved and seconded, and, on being put to a vote, the Moderator declared it carried.


Thereupon, it was


Voted: to substitute Mr. Murphy's motion for that of the Finance Committee.


Mr. Hayes moved that Article 6 be laid on the table; and, on being put to a vote, the Moderator declared the motion lost.


On motion, duly made and seconded, it was


Voted: to amend Mr. Murphy's motion by inserting between the words "paid" and "in," the words "pro rata of amount earned."


Mr. Mansfield offered the following substitute motion:


That effective January 1, 1945, there be paid to the employees of the town a sum equal to two hundred and eight dollars ($208.00) as a bonus, in addition to their basic wages or salary, subject to the following conditions: pay- ments shall be based upon the basic wage or salary in effect on January 1, 1945; payments shall be made in accordance with the various payroll periods now in effect; the total payments to any individual shall not exceed two hundred and eight dollars ($208.00) for the calendar year 1945; all elected officials are hereby specifically excluded from re- ceiving any payments hereunder except the Town Clerk. Part time employees to be paid on a pro rata basis for time employed only. This action shall not be construed as permanently increasing salary or wages, nor shall pay- ments hereunder be deemed to be part of the regular com- pensation of any town employee.


That the sum of one hundred thirty-five thousand two hundred dollars ($135,200.00) be and hereby is appropriated for the purpose of this article, said sum to be raised by gen- eral tax and expended under the direction of the various

boards and heads of departments of the town and charged to the appropriation made under this article.


A vote thereon was taken and the announced result was doubted, and a rising vote was called for which re- sulted in 70 voting YES and 119 voting NO; and the Mod- erator declared the motion lost.


Mr. Hayes offered an amendment to Mr. Murphy's motion "that the entire sum be raised by general tax." On being put to a vote the announced result was doubted, and the Moderator called for a rising vote which resulted in 40 voting YES and 138 voting NO; and the Moderator declared the motion lost.


Mr. McManus moved the Previous Question, and on being put to a vote the Moderator declared the motion lost.


Still more discussion followed for and against. Mr. Harris moved the Previous Question, and being put to a vote the Moderator declared it carried;


Thereupon, the Moderator called for a vote on Mr. Murphy's substitute motion as amended, and declared it carried as follows :

There being no further business under Article 6, the Moderator declared it disposed of.


At this point the Moderator declared a recess of five minutes.


At 10:15 the Meeting resumed.


Article 7 taken up (Treasurer: Power to Borrow)


On motion, duly made and seconded, it was unanimously


Voted: That the Town Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow money on and after January 1, 1946 in anticipation of the revenue of the financial year beginning January 1, 1946, and to issue a note or notes therefor, payable within one year, and to renew such note or notes as may be given for a period of less than one year in accordance with Section 17 of Chapter 44 of the General Laws and any amendments thereof; any debt or debts incurred under this vote to be paid from the revenue of the financial year beginning Jan- uary 1, 1946.


There being no further business under Article 7, the Moderator declared it disposed of.


Article 8 taken up. (Extension of Sewerage System)


On motion, duly made and seconded, it was unanimously


Voted : That the sum of ten thousand ($10,000.00) dollars be and hereby is appropriated for the extension of the Sewerage System; said sum to be raised by general tax and expended under the direction of the Board of Public Works substantially as follows,

Article 9 taken up. (Extension of Water Mains)


On motion, duly made and seconded, it was unanimously


Voted: That the sum of fifteen thousand ($15,000.00) dollars be and hereby appropriated for the extension of water mains, said appropriation to be raised by general tax and expended under the direction of the Board of Public Works substantially as follows:


Laying and relaying water mains of not less than six inches in diameter (including Tools and Equipment) $15,- 000.00.


There being no further business under Article 9, the Moderator declared it disposed of.


Article 10 taken up. (Extension of Storm Drains)


On motion, duly made and seconded, it was unanimously


Voted: That the sum of eight thousand ($8,000.00) dollars be and hereby is appropriated for the extension of storm drains in the year 1945; said appropriation to be raised by general tax and expended under the direction of the Board of Public Works.

Voted: That the Chairman of the Finance Committee be and hereby is authorized to move at the annual Town Meeting that the amount of the snow and ice removal ap- propriation be made in a sum covering the amount expended from January 1, 1945 to the date upon which the motion is made plus any outstanding liabilities for such removal estimated by the Public Works Department but at the time unpaid and by adding thereto the sum of eight thousand ($8,000.00) dollars to cover the cost of removal of snow and ice for the months of October, November and December, 1945.


Mr. Hayes offered to amend as follows:


That Article 11 be amended by striking out the words and figures of $8,000.00 and substituting therefor the sum of fifty-five thousand eight hundred and eighty-four dollars and 31/100.


And on being put to a vote the Moderator declared the motion carried.


And, on motion duly made and seconded it was


Voted: That the sum of fifty-five thousand eight hun- dred and eighty-four dollars and 31/100 ($55,884.31) be and hereby is appropriated for the removal of snow and ice; said sum to be raised by general tax and expended under the direction of the Board of Public Works.

Article 13 taken up. (Relocation, Alteration, Widening, Construction of Town Ways)


On motion, duly made and seconded, it was unanimously


Voted: That the sum of nine hundred ($900.00) dollars be and hereby is appropriated for maintaining, repairing and Improving ways within the town, said appropriation to be used with any sum or sums which may be allotted by the Commonwealth or the County of Middlesex, or both, for such purpose or purposes; and that said sum be raised by general tax and expended under the direction of the Board of Public Works.


There being no further business under Article 13, the Moderator declared it disposed of.


To make sure a quorum was present the Moderator had a count made of those present, and found that there were 160 members present.


Article 14 taken up. (Abandonment of Town Way- George Street)


On motion, duly made and seconded, it was unanimously


Voted: That the town does hereby abandon and relin- quish whatever title or interest, if any, it may have or seem to have by virtue of an attempted laying out and ac- cepting a town way from the Concord Turnpike to Oakland Avenue, substantially in the location of the private way known as George Street, as made and filed in the office of the Town Clerk by the Joint Board of Selectmen and Board of Public Works, the establishment of which was accepted by the town by unanimous (more than two-thirds) vote under Article 17 of the adjourned Town Meeting held March

There being no further business under Article 15, the Moderator declared it disposed of.

Voted: That the town does hereby abandon and relin- quish whatever title or interest, if any, it may have or seem to have by virtue of an attempted laying out and accepting a town way from Margaret Street to Burch Street, sub- stantially in the location of the private way known as Os- borne Road, as made and filed in the office of the Town Clerk by the Joint Board of Selectmen and Board of Public Works, the establishment of which was accepted by the town by unanimous (more than two-thirds) vote under Ar- ticle 20 of the adjourned Town Meeting held March 13, 1942; and as more particularly referred to in Article 17 of the Warrant.
